On June 8, 2005, Scott Blaising, counsel for the California Municipal Utilities Association (CMUA), met with Amy Yip-Kikugawa, advisor to Cmmr. Bohn, Julie Fitch, advisor to Cmmr. Peevey, and David Gamson, advisor to Cmmr. Brown, in three separate meetings in San Francisco. For the part of the meeting with David Gamson, also present were Eric Eisenman and Dennis Keane of Pacific Gas and Electric Company. Written material (attached to the notice) was used. Blaising commented that the ALJ `s draft decision (DD) incorrectly addresses the issue of "stand-alone" municipal departing load (MDL) ("load that does not otherwise require the use of transmission or distribution facilities owned by the investor-owned utility"). Blaising indicated that the DD claims that there are policy justifications for treating MDL differently than CGDL in stand-alone situations, however, there are no policy issues implicated by the stand-alone issue. Rather, Blaising observed, Public Utilities Code Section 369 provides a strict, definitional basis for determining stand-alone situations. Blaising also noted that the Commission must treat MDL and CGDL similarly.
