    HOW DOES A SALES AGENT WORK WITH A PRODUCER?

    A sales agent has 3 important roles to fulfill for every film.

    Creating, together with the filmmaker a:

    sales strategy

    festival-market strategymarketing

    The Sales Strategy includes a detailed look at the countries where the film can be sold, together with the different

    rights packages that are best for the film: broadcast, theatrical, festivals, digital platforms, educational, most

    probably a mixture of all five. Depending on the Sales Strategy the sales agent will select the best festival-market

    strategy. Where a films first window is theatrical, the sales agent will try to get the film into a big A-list festival; when

    a film is more broadcast-focussed markets like Sunny Side of the Doc or MIP will have priority. Also here a mixture of

    festivals and markets to launch the film will be featured.

    After the sales and festival strategy it is good to work with the sales agent for the appropriate marketing strategy.

    That will include the best poster, trailer, synopsis and press images for your film, looking at the target audiences and

    working on creative marketing ideas to reach them. As the sales agent will try to sell the film to theatrical, digital,

    DVD distributors, broadcasters, festivals, educational partners who each focus on reaching their target audiences,

    every sales agent will prepare this with the producers. However, it is even better to draw on marketing already

    created by the producer in the development and production phase.

    A sales agent signs a distribution agreement with a producer (rights owner) in which items like exclusivity, type

    of rights, commission, distribution costs, deliverables, time schedules etc. are all laid down. As a rule, a sales agent

    prefers all rights in all media in all territories to be able to handle world sales effectively. The sales agent will agree

    with the producer on the focus of distribution: Does the film have potential for all rights deals including theatrical

    distribution? Is the film mainly attractive to TV buyers? Is there a specific focus on the festival and/or educational

    market? Usually, a sales agent will request to have an one-hour TV version of the film to work effectively on the

    market.

    Most of the sales agents handle festivals and are able to collect revenue through screening fees. For a lot of films,

    such screening fees have turned into a considerable source of income in the past years and it is the sales agentsskill to negotiate those fees and share them with the producer. It is highly recommended to contact a sales agent

    before having the world premiere of your film. Festival strategies need to be coordinated with all other distribution

    activities as early as possible.

    If a documentary has potential for the big screen outside your home country, the sales agent will contact domestic

    distributors and offer them all rights/theatrical deals. Other lucrative rights are educational, DVD, in-flight, digital

    and non-theatrical rights and of course sales to TV-broadcasters.

    A producer should contact a sales agent as early as possible to make the first contact and to get their general

    feedback concerning the market potential of the project. Sometimes sales agents can help early on in the funding

    process with providing a Letter of Interest usually and fairly requesting a first look option (right of first refusal) inreturn. For particularly strong projects, sales agents sometimes advance a minimum guarantee. In such a case, a

    legally binding contract can be signed already at rough cut stage.

    It is important to maintain good communication between producer and sales agent throughout the whole

    production process in order to ensure that the film goes in a direction with a good market potential. This can

    include decisions about the opening sequence of your film or the right structure for TV. But bear in mind, your sales

    agent is not an executive producer, unless you want him or her to take this job.

    Sometimes a sales agent can help raising production money against a share by doing pre-sales for a project. At

    the same time, remember that a film is only attractive for a sales agent if there are enough key territories left to sell

    after completion.

    In general, early contact between sales agent and producer can help avoid frustrations once the film is finished. It is

    very important that the expectations of both parties are met. The relationship between sales agent and producer is

    all about preparing your film in the best way possible for international exposure and sales.

    The sales agent needs to build a strong long-term relation with all important buyers.

    A sales agent needs to know the buyers personally and be in regular contact. That is why good sales agents have

    a sales team with specialized managers for every type of rights package. Most important are the theatrical sales,

    digital sales, broadcast sales, festival sales and educational sales. These sales managers know their buyers and

    respective markets really well and have a global rights overview. The buyers appreciate highly this knowledge of

    a sales agent and will often turn to them for advice - and vice versa. In order to build a personal relationship with

    every buyer it is necessary to travel to the markets and even visit the buyer in their office. Of course, that is not

    possible for every buyer but a good sales agents will try to fit this into their schedule.

    A good sales agent will discuss the distribution and festival strategies with the producer before signing a contract,

    they will agree on recoupable distribution costs and will make sure that the producer understands every item of

    the contract and will check the expectations on either side. The agent will also provide you with a list of technical

    deliverables (tapes, DCPs, files in different versions, artwork etc) and will discuss which ones are urgently needed

    and which ones can be delivered on demand (note that creating these materials will require investment on your

    side). The agent will usually report twice the first year and annually in subsequent years and will try to communicate

    We handle festival strategy and festival exposure for more than 80 per cent of our new titles and it proves to be

    a very attractive service for our producers. Apart from the logistics involved (submissions, tape traffic, negotiating

    screening fees, etc) we can often pave the way for our films. We cant promise the world and of course every

    festival has individual ways of decision-making, but we experience very good results for our films as we are

    constantly in touch with all major festival programmers and can discuss new films at all stages of production.

    Naturally, our position as sales agents is different to the one of a filmmaker or producer when presenting the film

    to a festival director or to the programmers. As the sales agents already do a pre-selection of the most interesting

    films in the market and as we are informed about films in production, naturally, festivals are very open to our

    suggestions. Its very likely that we can help a film to end up on the right pile and in front of the right people.

    Saying this, as a filmmaker or producer, you should never stop promoting your film and pushing it to the right

    channels.

    WHAT KIND OF RIGHTS CAN A SALES AGENT HANDLE?

    CAN A SALES AGENT BRING PRODUCTION FINANCING TO A PROJECT?

    HOW DOES A SALES AGENT ADAPT ITS DISTRIBUTION/MARKETING STRATEGY TO EACH FILM?

    A sales agent can be specialized in one package of rights like TV sales or digital sales (also called an aggregator)

    or educational sales (mostly in North America). Some sales agents take all rights and are specialized in a bigger

    territory like North America or German speaking territories so they do not work globally.

    Most sales agents deal with all rights and all territories. This sales agent needs a strong sales team as explained

    in point 4. Some sales agents will work with sub-distributors for certain territories, these are the sales agents

    working in selected territories. Make sure that the sales percentage of the sub-distributor is not added to the

    existing one.

    The last important differentiation is the genre of film. Some sales agents only sell documentaries while others only

    feature fiction or TV formats. So it is important to know what your sales agent is specialized in.

    A sales agent can work on many levels and layers. But dont mistake him or her for an executive producer or a

    fundraiser unless you explicitly want them to take this job and get a credit for it. Very often, sales agents help

    early on by providing letters of interest or commitment. A confirmation of interest from a good and experienced

    sales agent can make a difference when applying to a domestic or international fund, as it is a statement on

    the international market potential of your film project. Some sales agents offer coproduction in their country of

    residence; others are affiliated with well-established production companies on their home turf, so bring up that

    issue if you are interested in going that path.

    Pre-sales are the most popular form of bringing production funding to a project. But bear in mind that

    pre-sale opportunities are pretty rare and you wont get the full license fee before delivery of the film.

    Pre-sales usually make sense for territories where there is competition among the buyers. In rare cases, where films

    have a really big market potential for all rights deals, sales agents might offer a minimum guarantee (MG). A generalrule is: the earlier a sales agent can be involved in a project and the more territories he can sell, the more attractive

    it is for them to handle your project and the more successful they can be.

    For the distribution strategy a sales agent sticks to the market rules; a film for television will be presented at MIP

    and Sunny Side of the Doc as all TV buyers will be present and looking for new films as we

    explained in point 1 above. Slowly this is changing - emphasizing the word slowly - and every film needs a

    specific distribution strategy as the global market is changing with many new players and rights to distribute.

    For the marketing strategy a sales agent becomes more active with an individual film. Here it is important to

    differentiate 2 marketing strategies, the B2B - business-to-business strategy and the end-users strategy. The sales

    agent will create the marketing for the B2B strategy because it is part of the core business to persuade buyers to

    screen and acquire the film.

    Occasionally, sales agent invests in an end-users marketing strategy, this is left for the local distributors that buy the

    film in a territory. This is also changing rapidly as more sales agents want a global end-users marketing strategy to

    present to their buyers. One needs to be careful with a single global end-users strategy as many territories have

    different customs. Here the sales agent is crucial as they can get the feedback from local buyers on the local

    marketing customs, see point 4 when a sales agent has a strong relation with the buyer.
