    COME NOW the petitioners, all citizens of the Philippines and in their sovereign capacity

    A Proposed Peoples Initiative as a Constitutional

    AMENDMENT ONE TO THE PHILIPPINE CONSTITUTION

    (Re: Election By Regional Senatorial Representation in Congress

    And Creation of Federal Regions To Function Administratively to Build Infrastructures)

    PREAMBLE

    ONE: WHEREAS, The election at large of Senators in the senate who come from a few and

    privileged segments of metropolitan society have caused a gross imbalance and underdevelopment

    or absence of economic progress in outside regions from said societies;

    TWO: WHEREAS, This senatorial imbalance in Congress has resulted in the failure of

    exploiting the rich potential opportunities of the natural resources in the outlaying regions of the

    country;

    THREE: WHEREAS, This senatorial imbalance of representation in Congress has further

    created an undue migration and concentration of the people in cities and towns arising from the

    neglect of commercial and industrial development in their rural areas of the country;

    FOUR: WHEREAS, If the senators who are born, reside and elected from the undeveloped

    cities and towns of the districts they represent, it is expected that they will have more natural and

    inherent interest to take care of their localities and shall be able to demand politically their fair share

    in the budgeting of public funds to underwrite the expenditures for their local projects and further

    create employment opportunities for the people in their districts. The further beneficial effect on this

    will be less traffic congestions of over saturated cities and towns and shall thereby enhance and fully

    activate the flow of commerce in rural areas;

    FIVE: WHEREAS, The Senatorial representation for rural localities, specially for the Muslim

    Regions, can contribute to the enhancement of unity and better friendly understanding between and

    among the different ethnic group in their local communities; and

    SIX: WHEREAS, The Senatorial Districts can likewise serve as Federal Regions to function

    administratively in building infrastructures in their respective territories,

    NOW, THEREFORE,

    THE PEOPLE OF THE PHILIPPINES hereby propose and approve this Initiative

    Amendment to Article VI, Sections 2 and 3, of the Philippine Constitution and this reform amendment

    shall be referred to as AMENDMENT ONE to the Philippine Constitution as follows:

    (1) The Senate shall be composed of thirty-four Senators who shall be elected by Regional

    Districts and each District shall be represented by two Senators;

    (2) The Philippines shall be apportioned into seventeen (17) Senatorial Districts over the

    same and current regions in accordance with ISO 3166-2:PH as published by the International

    Organization for Standardization comprising the now existing designated regions as Senatorial

    Districts of the Philippines as follows:

    (a) The National Capital Region (NCR);

    (b) The Cordillera Administrative Region (CAR);

    (c) Ilocos Region (Region1);

    (d) Cagayan Valley (Region 2);

    (e) Central Luzon (Region 3);

    (f) CALABARZON (Region 4A);

    (g) MIMAROPA (Region 4B);

    (h) Bicol Region (Region 5);

    (i) Western Visayas (Region 6);

    (j) Central Visayas (Region 7);

    (k) Eastern Visayas (Region 8);

    (l) Zamboanga Peninsula (Region 9);

    (m) Northern Mindanao (Region 10);

    (n) Davao Region (Region 11);

    (o) SOCCSKSARGEN (Region 12);

    (p) Caraga (Region 13); and

    (q) Autonomous Region in Muslim Mindanao (ARMM).

    (3) The term of office of each Senator shall be six (6) years and may be re-elected for a

    second and last term. Thereafter, he shall no longer be eligible to occupy the same position for life.

    If a person is related by consanguinity or affinity or adoption within the third degree with another

    relative who holds, or has already previously filed his certificate of candidacy or application to hold

    or run for, a political or appointive or judicial position in a national or local public position, the

    candidacy and/or election of such person in the Senate shall be void regardless of having been sworn

    in office.

    (4) If during the term of office of a senator, any of his relatives within the same degree of

    relationship referred to in the preceding paragraph shall have obtained a public or judicial position

    in the national or local government in any manner regardless of having been sworn in office, the

    election or appointment of such relative to such public office or judicial position shall be void.

    (5) No person shall be a Senator unless he is a Filipino citizen, native born, lifetime

    permanent resident, in the senatorial district he shall represent and, on the day of the election, is at

    least thirty years of age, able to read and write, a registered voter, raised, has received his education

    from the local schools or colleges and has resided in his senatorial district until the time of his

    election.

    (6) No senator elected at large, past or present, shall qualify to run for a senate seat after

    approval of this constitutional amendment.

    (7) The Senators shall commence their official duty, unless otherwise provided by law, at

    noon on the thirtieth day of June next following their election. Voluntary renunciation of the office for

    any length of time shall not be considered as an interruption in the continuity of his service for the full

    term of which he was elected.

    (8) The election of Senators shall be held in the next national or local election of public

    officials following the date of approval of this constitutional amendment. The two candidates with the

    highest votes received shall be elected and between them, the Senator-Elect with more votes shall

    serve the full six-year term in office and the Senator-Elect with the lesser vote shall serve a three-year

    term. Thereafter, election of senators shall be held for the six-year term of office to succeed Senators

    whose term have expired. The term of office of all and each incumbent Senators elected-at-large

    shall then expire upon the taking of oath of office by the newly elected Senators by district.

    (9) The designated Senatorial Districts in Section (2) of this amendment shall function

    administratively as a Federal Region of the national government and shall be governed by a Federal

    Regional Commission whose members shall be composed of the governors and mayors of the

    provinces, cities and municipalities composing the Senatorial District. Its principal office shall be

    located in the least developed municipality. Other administrative offices may be created by each

    Federal Regional Commission respectively it may deem essential for its operation.

    (10) The chief officer of a Federal Region shall be known as the Regional Commissioner.

    He shall be assisted by an Assistant Regional Commissioner who shall act as an Administrative

    Officer and they shall not be related to each other by sanguinity or affinity within the third degree of

    family relationship. In the event of the incapacity of the Regional Commissioner, the Assistant

    Regional Commissioner shall assume the office of the Regional Commissioner. Both shall be elected

    for a term of 3 years, and may be re-elected for a second and final term, by the members of the

    provincial board, city and municipal councils.

    (11) None of the senators, the provincial and vice governors, city and municipal mayors and

    vice mayors and members of the provincial board, or city or municipal council shall qualify, or shall

    be nominated, as Regional Commissioner or Assistant Regional Commissioner and neither between

    them shall be related by sanguinity or affinity within the third degree of such relationship with said

    public officials. The Regional Commissioner or Assistant Regional Commissioner shall be native born

    citizens of the Philippines, at least 35 years of age on the date of his election, and permanent

    resident since birth of, his Region and shall be a holder of any bachelors degree with a diploma from

    any college or university. The salary of the Regional Commissioner shall equal to the basic pay of the

    highest paid governor, and the salary of the Assistant Regional Commissioner shall equal to the basic

    pay of the highest paid vice-governor, of his region.

    (12) The Federal Regional Commission shall serve dual functions, namely (1) As Policy and

    Planning Body for the Region with power to recommend appropriation of funds upon request of the

    members of the Federal Regional Commission, and (2) As a Supervisory Authority in drawing plans

    to build the infrastructure of its region, including but not limited to the construction of public buildings,

    roads, bridges, recreational parks, water and power, and calamity preparedness needed for the

    operation in its regional district.

    (13) The laws or regulations enacted by the Federal Regional Commission shall be known,

    designated and written as Region (Initials or #) Act (#) example: Region NCR Act 101, or Region

    NCR Act 102, for the two laws enacted by, and in, Region NCR; or Region 1 Act 101, or Region 1 Act

    102, or Region 1 Act 103, for the three laws enacted by, and in, Region 1. The same pattern shall

    be adopted by the other Federal Regions indicating their Region acronym or number followed by the

    Act Number.

    (14) All public funding for the projects of each and all Federal Regions shall come from and

    financed by the national government through its annual appropriation, or special or supplemental

    allotment or budget as the case may.

    (15) The Regional Commissioner shall have the obligation and duty to render an annual

    status report of the activities in his region to include both finished and unfinished projects. Unfinished

    projects shall be explained with appropriate recommendation.

    (16) Date approved by the People in a public initiative held on ____________;

    (17) This Amendment shall take effect after fifteen (15) days from the date of its Registration

    in the Official Gazette or publication in a newspaper with national circulation in the entire country

    whichever comes first.

    2. The entire Philippines consists of ____ provinces and ____ cities. They are comprised

    of _____ legislative districts and said legislative districts are tabulated sequentially by provinces then

    followed also sequentially by cities in alphabetical order under which each legislative district is listed

    in this Petition. All the signatures of registered voters in said legislative districts have been gathered

    and correspondingly verified and duly certified to by the Local Election Registrars of each Provinces

    and Cities. The Certificates of Verification are herewith attached and made part of this petition. The

    signature sheets of the petitioners are being kept in the custody of the Local Election Registrars in

    support of their respective Certificates of Verification and said signature sheets are ready for

    inspection or production if so desired by this Honorable Commission in the respective Local Election

    Registrars Office around the country. Petitioners think that it would not be practical to bring in and

    attach all signature sheets to this Petition because it would entail truck loads of papers for exhibits

    in the office of this Honorable Commission. Therefore, presentation of the Certificates of Verification,

    akin to the Certificate of Canvass in counting of electoral votes, is the most practical means in

    determining the sufficiency of signatures to support this petition.

    barangay or per municipality rule does not apply here because this initiative is not
