If your business, website, app or other entity:
Is located in California or reaches any residents of the state
and
If you collect and use personal information from customers or users
...you’ll need a Do Not Track (DNT) disclosure in your Privacy Policy (1)
This requirement has been part of the CalOPPA law (2) since January 1st, 2014.

What is Do Not Track
DNT is a browser setting (3) that lets users send a “Do Not Track” request and attempt to opt out of online behavioral
tracking like that seen in Google AdWords or AdRoll.

However, not all browsers support this setting and not all companies follow these requests.
This means it’s not an absolute way for users to stop online behavioral tracking.
The DNT Disclosure
This disclosure will go in your Privacy Policy and will let users know how you respond to DNT settings.
You will either:
Respond to the DNT settings and no tracking will occur, orYou won’t follow the DNT settings and tracking will occur
Note that the DNT requirement doesn’t require that you follow DNT settings - just that you let users know whether
you follow them or not.
If you do follow DNT settings but work with third parties who don’t or may not, let users know this in your disclosure.
If your business is located in California or reaches any residents of the state, you need to include a DNT disclosure in your Privacy Policy.
Let users know whether you follow DNT settings or not.
This keeps you compliant with the DNT disclosure requirement of CalOPPA.
