Chief Mechanical engineer is satisfied that surplus capacity exists in the production Unit after meeting the Railways' requirement and the Production Units. Railway Workshops can undertake the work without detriment to their own or Railways work subject to:-i) This power may not delegated by the Chief

Mechanical Engineer of Production Unit/ Coordinating HOD i.e. CWE/CWM of railway workshop to any authority subordinate to him but must be exercised by him personally.

ii) The quotations as per 10.01 (b) should be given only to genuine buyers and those inquiries which are only for collecting market intelligence, should be avoided.

iii) All efforts must be made to secure best possible and most optimum price for Indian Railways.

iv) While quoting the delivery schedule, Production units/Railway Workshops will ensure that first the entire requirement of the Indian Railways is met and only the balance spare capacity is utilized for non-railway orders. Only such items should be undertaken which are normally used in Railway working.

v) The work should not be undertaken unit after 10% of the estimated cost of the job, viz. labour, stores, on cost (including profoma on cost) and all other charges leviable under the rules (paragraph 1426) and all other leviables have been deposited in advance by the party ordering the work, in case of manufacture of vehicles of Rolling Stock. In all other cases, 25% of the estimated cost of the job, as per the conditions indicated above, would be deposited by the party ordering the work. The balance payments regarding the work is to be deposited with the Railways as per the contract terms approved by the competent authority.

ii) Payment of Excise Duty on account of Sale of complete Loco/DG. Sets etc. to PSUs or other Govt. bodies.

To write off outstanding payment of locomotives & spares when it is not practicable to recover the amount.

Purchase of tender/bid documents for submission of tender for sale of locos/spares.

Subject to finance vetting for rates & terms & condition and CME's approval for rate and other terms & conditions if only full charges are taken as proposed above. If any of other charges like proforma profit, warranty & over head are reduced, then GM's approval will be required.

i) Power under item 4.01 delegated to other HODs for entertaining on special occasion will, however, not be exercised by CMgM.

ii) For expenditure beyond ` 2000/- finance concurrence is necessary.

Marketing

Following special delegations have been made by Railway Board to GM's of PUs for Marketing:-1. Pricing of New Rolling Stock and spares for sale

a) Reduction in profit margin upto 3%.b) Reduction in proforma charges upto 2% for export and upto 4% for NRCs.c) Variable overheads should be charged fully.d) Reduction in fixed over heads upto 5%.e) Warranty charges should be levied @ 2% of manufacturing cost. The warranty of purchase items will be born by suppliers as per IRS conditions.f) Contingencies and unforeseen circumstances should be charged at the rate of 1%.

Note:- i. FA & CAO's concurrence and GM's approval will be required.ii. As per Railway Board's letter No. 94/Dev.Cell/ ERSI/7 Pt.-III dated 19.10.2005 these instructions are applicable for rate in international market (export)

to make DLW's product competitive irrespective of capacity being surplus. The same may be adopted for NRCs also with exception that proforma

charges may be reduced upto 4% as per Rly. Board's letter no. 2001/Dev. Cell/ERSI/Diesel Spares/dt. 13.03.200liii. Only fixed components of overheads may be reduced, as variable overheads have to be realised.

Marketing

Following special delegations have been made by Railway Board to GM's of PUs for Marketing:-3. Development of new items, product diversification marketing efforts and engagement of consultant for sale to NRCs and for Export.

Note :1- Upto Rs. 5 crore per annum (Rs. 1 crore in each case out of the profit accruing from sales to NRCs and export during the course of year subject

to the following conditions : a) Keeping the provision of para 1349 of Mechanical Code in view, the profit accruing from sales to NRCs and exports during the course of

current year should be worked out taking into account all inclusive cost including all over heads and the accumulated balance profit from

earlier years should not be utilized for this purpose. The accumulated profit of earlier year should be utilized only for reducing the transfer

price of the rolling stock for the Railway.b) The Powers are to be exercised by GM's with personal concurrence of FA & CAO and can not be delegated further. c) The expenditure on any particular item under GM's power may be restricted according to the specific delegation available or prior higher

sanction obtained if it is beyond the specific delegation available for the particular item concern. (Authority: Rly. Bd's letter No. 2004/F(S) -

4. Purchase of components for supplies against confirmed orders of NRCs and Exports:-

Note:- I. Rs. 22 crore per case for export only subject to laid down procedure being followed. (Authority: Rly. Bd's letter No. 2004/F(S)-I / PW7 /1

dt. 31.03.2004).

5. To incur expenditure towards hospitality to non-Railway customers upto a ceiling of Rs. 250/- per head per occasion:Note:I) An annual ceiling limit of Rs. 10000/- has to be kept.ii) These powers have to be personally exercised by GM in consultation with FA&CAO and not to be delegated to lower levels.iii) The expenditure shall be met from the Market Development Fund.
