    OF LITTLE THOMPSON WATER DISTRICT The Board of Directors of Little Thompson Water District (LTWD) met in regular session on Thursday, February 13, 2020 at the District office. ROLL CALL It was moved by Director McMurtrey, seconded by Director Gallivan-Crist, to excuse the absence of Director Brandenburg. Roll call was taken. All other Directors were present. AGENDA REVIEW Agenda Item 6.3 – LTWD – City of Loveland Intergovernmental Agreement was moved for discussion before Agenda Item 6.1 – Carter Lake Filter Plant. There were no other changes to the agenda. PUBLIC COMMENTS ON NON-AGENDA ITEMS President Szmyd opened the Public Comments period. There were no public comments and the Public Comments period was closed. CONSENT AGENDA It was moved by Director Bukowski, seconded by Director Brandt, to approve the Consent Agenda including:

    • Minutes of the January 9, 2020 Regular Board Meeting, • Tap List 649, • January 2020 Disbursements in the amount $1,800,669.64:

    o Operating Account: $1,352,092.10: ACH Manual Check Numbers 2355 to 2399 – $1,076,548.40, Bank Bill Paycheck Numbers 5007 to 5028 - $60,069.12, Check Numbers 9693 to 9729 – $215,474.58,

    • January 2020 Financial Report. Motion carried unanimously. DISCUSSION ITEMS LTWD – City of Loveland Intergovernmental Agreement (IGA): The proposed IGA between Loveland and LTWD provides for the following:

    • The new IGA changes the service boundary between the two entities. o Loveland desires to grow along State Highway (SH) 402 and would like to serve that corridor. o LTWD has not made substantial investment in that area and does not propose switching the

    existing customers in that area unless they develop their property. o The change results in a loss of service area for LTWD of 4.6 square miles west of I-25 and

    east of SH 287. • The two entities have services to customers that overlap service areas and sometimes have customers

    served from the other entity’s lines. • Loveland and LTWD have not suggested transferring raw water supplies for this tap exchange. • In exchange for LTWD taking over the Campion area Loveland will be providing LTWD with up to

    20 acre-feet of return flows for a portion of LTWD’s native water obligations. • The provision reduces the amount of water LTWD has to return through the river and therefore saves

    LTWD costs that would otherwise be spent on infrastructure and water rights. • To make the tap swap effective, LTWD and Loveland have agreed to split the costs for the

    infrastructure changes required. Following discussion, it was moved by Director Martens, seconded by Director Bukowski, to support the City of Loveland IGA subject to possible changes by the Loveland City Council. Motion carried unanimously.

    Carter Lake Filter Plant (CLFP): The following items were discussed:

    • In December 2019 CLFP board approved the purchase of additional membranes from Evoqua to replace membranes that had been damaged beyond repair. By Wednesday, February 5 CLFP had received approximately 540 modules.

    • CLFP Manager, Rick Whittet, believes the 540 modules will be enough to take the plant through the 2020 summer season.

    • A representative from Dupont tested the modules that were transported in a truck that was not climate controlled and determined the modules were acceptable for use.

    • Discussion followed regarding means to assure the performance of the modules in addition to the testing completed by Dupont.

    • Director Bukowski suggested forming a User’s Group for filter plants that use membranes. • The construction for the 7 million-gallon (MG) tank had begun. • The Bureau of Reclamation (BOR) granted CLFP perpetual easements. • Central Weld County Water District (CWCWD) and LTWD were planning to meet with Colorado

    Department of Transportation (CDOT) to address the removal of the 42-inch waterline for use at CLFP.

    • During Northern Colorado Water Conservancy District’s (Northern) scheduled canal shutdown CLFP used all three pumps at Dry Creek to keep up with the flows.

    • No taste and odor complaints were taken at either District during the shutdown.

  • St. Vrain Water Authority (SVWA): Both Firestone and LTWD’s interim financing agreements were approved by the Authority at the January 2020 meeting. The Authority is in the process of setting up banking for operation. Going forward the scope of the board meetings will be more directed as to the creation of the Intergovernmental Agreements (IGA). SVWA Board Member David Lindsay and LTWD District Manager, Amber Kauffman, met February 5, 2020 to discuss IGA issues. It was decided that two agreements should be written. An IGA would address the formation and management of the Authority:

    • Buyout or lease of capacity. • Opt-out of Authority. • Bonding ability of the Authority. • Rate structure: fixed costs and variable costs. • Decision making for capital expansion and allocation of costs/capacity. • Capital replacement to be made through rates. • Reserve accounts.

    An Operations Agreement would address the operation of the Authority:

    • Water accounting and water loss assignment. • Capital planning requirements. • Rate studies/structures, update requirements including triggers for updates. • How are new raw water sources approved for treatment, who pays for that approval, what happens if

    it affects the treatment train, etc. • How are raw water/treated water deliveries managed or controlled. • Allocation of space on site for pumping facilities.

    Discussion also included the following topics:

    • Construction of the plant was expected to start in May or June of 2020, with the plant to be operational by 2022.

    • A permit for a deep well injection site had been submitted.

    Action Item: Resolution 2020-7, Consumer Data Privacy Policy: The Colorado Special District Association recommends adopting a Consumer Data Privacy Policy resolution as referenced in §24-73-101 C.R.S. Governmental entity – disposal of personal identifying information – policy – definitions. Following discussion, it was moved by Director Bukowski, seconded by Director Gallivan-Crist, to approve Resolution 2020-7, Consumer Data Privacy Policy. Motion carried unanimously. Public Hearing: Action Item: Motion to Ratify Adopted Resolution 2020-1, 2019 Amended Budget: The Board of Directors approved Resolution 2020-1 at the January 9, 2020 meeting. A Public Hearing is required for budget approval. The requirement was fulfilled at the February 13, 2020 meeting. The Public Hearing was properly noticed in two newspapers of general circulation within the district, as well as all District Posting Places. President Szmyd opened the Public Hearing. There were no public comments and the Public Hearing was closed. It was moved by Director Martens, seconded by Director Brandt, to ratify the 2019 Supplemental Budget and Appropriation Resolution 2020-1. Motion carried unanimously.

  • Weld County Request for Tap Relocation: Weld County was in the process of making improvements to the intersection at Weld County Road (WCR) 54 and WCR 17. The County purchased parcel number 095729000014 (served by LTWD Residential Tap 928). The existing utilities, including District infrastructure, were to be relocated for the intersection improvements. The county would not need a water tap at this location as it was to become a portion of a new traffic circle. Weld County also purchased parcel number 120713100090 at the southwest corner of the improved intersection of WCR 34 and WCR 13. The county planned to utilize the second parcel for a heavy equipment storage facility that would include a small office and restrooms. The proposed county facility would require a domestic water tap, therefore the basis of the county’s request to relocate tap 928 from parcel 095729000014 to parcel 120713100090. Subsection 304.1 of the District’s Rules and Regulations prohibit relocation of water meters unless the parcels are adjoining and of the same ownership. The referenced parcels were owned by Weld County but separated by approximately 10 miles. A waiver to the District’s Rules and Regulations was required to accommodate Weld County’s relocation request. Following discussion, it was moved by Director Szmyd, seconded by Director McMurtrey, to grant a waiver to the District’s Rules and Regulations, Subsection 304.1, to relocate Tap 928 from Parcel Number 095729000014 to Parcel Number 120713100090. Motion carried unanimously. Action Item: Resolution 2020-9 Board Term Limits: District Manager Kauffman presented information regarding changes to Board of Director Term Limits and Director Wards within the district, as requested by the Board at previous meetings. Per the Colorado Constitution changes to or removal of board term limits would require a vote by the District. A resolution would need to be passed to add a ballot question regarding changes to term limits. Additionally, the Board was advised there were no state statutes legislating the abolishment of director wards within the district. However, legislation was being crafted regarding the number of directors on a Special District board. This legislation was expected to include wording that would address changes to director wards. Following discussion, it was moved by Director Martens, seconded by Director Brandt, to adopt Resolution 2020-9 to add a ballot question in the May 5, 2020 election asking District voters to eliminate term limits, extend term limits from two 4-year terms to four 4-year terms, or keep term limits at two 4-year terms. Motion failed. Following further discussion, it was moved by Director Szmyd, seconded by Director Martens, to adopt Resolution 2020-9 to add a ballot question in the May 5, 2020 election asking District voters to extend term limits from two 4-year terms to four 4-year terms. Motion carried unanimously. Opposition to Johnstown’s Change of Consolidated Home Supply Change Case: The Town of Johnstown applied for a change of use of Consolidated Home Supply shares it acquired after 2006 and other water within the Home Supply Ditch from agricultural to municipal use through Water Court. This application would initiate the town’s third change of use case based upon a ditch-wide analysis completed in 1997. In order to have standing in a Water Court case, the District must file a Statement of Opposition. As an objector, the District can monitor and enter into the case as needed to protect the District’s ability to change the use of its Consolidated Home Supply shares and other Big and Little Thompson water rights. Water Resources Manager, Nancy Koch, recommended the Board approve the District filing a Statement of Opposition to Johnstown’s Water Court application 20CW3011. Following discussion, it was moved by Director McMurtrey, seconded by Director Martens, to support Ms. Koch in opposing the Johnstown Consolidated Home Supply Change Case. Motion carried unanimously.

  • Public Hearing: Action Item: Motion to Approve Resolution No. 2020-8 Exclusion: It was moved by Director Brandt, seconded by Director Bukowski, to approve Resolution 2020-8, Exclusion (Hulson Properties LLC Parcel 106103435001). Motion carried unanimously.

    STAFF REPORTS

    District Manager’s Report: District Manager Kauffman reported on the following: The CLFP Managers Meeting was held January 22, 2020. Topics included the following:

    • The Northern canal shut-down brought attention to areas for improvement to ensure demands can bemet.

    • The plans for a vulnerability assessment report.• LTWD and CWCWD committed to having the Request for Proposal (RFP) for floating photovoltaic

    completed as soon as possible.• CLFP requested a grant from the state to be used to complete a PFAS sampling at the plant.• A search had begun for a parcel of land between 60 and 160 acres to be used for the East I-25 plant.

    Ms. Kauffman also noted Northern’s Spring Water User’s meeting was scheduled for April 7, 2020 and the Annual Tri-City and Districts Water Board Meeting had been scheduled for May 28, 2020 from 5:00 p.m. to 8:30 p.m.

    District Engineer’s Report: District Engineer Eaton reported on the following: • The 2020 Capital Project list had been updated.• The Taft Avenue project was underway however the district ran into rock under the Lake Ditch where

    boring had begun.• The District received bids for a water line relocation at WCR 54 and 17, and the project was awarded

    to Gopher Excavation.• The District received bids for the County Road 50 project, and the project was awarded to

    Gopher Excavation.• Development activity continued to be predominantly in the Mead area.

    President Szymd opened a discussion regarding a need for updated master planning of water consumption demand.

    • The relocated potion of the 42-inch transmission line successfully passed disinfection and pressuretesting.

    • The 25 day shutdown and tie-in was to begin on Saturday, February 8, 2020.• A total of six proposals had been received for the Design Project of a 24-inch transmission line (funded

    by Brookfield). The Farnsworth Group had been selected for the project.• The GIS project continued to progress.• The engineering department was to begin implementation of a new hydraulic water model that would

    interface directly with the GIS system.

    Water Resources Manager’s Report: District Water Resources Manager Koch reported on the following: • Accumulative water usage was as expected.• The district received its carryover water from Northern.• The ice over Dry Creek Reservoir came off and there was very little evaporation.• The snowpack in the South Platte and Colorado river basins was above average.

  • • President Szmyd requested an explanation of the District Average Yield in Quantity and Time versus Demand chart from the updated 2020 Dashboard. Ms. Koch detailed the layers represented on the chart.

    • Recent storms had added significant snowfall to the mountains.

    Operations Manager’s Report and Water Quality Update: Operations Manager Lambrecht reported on the following:

    • The locate requests and leaks had increased for the month of January. • All monthly testing samples were within acceptable parameters. • A meeting was scheduled with Beacon Meter for Tuesday, February 18, 2020 to craft a plan to move

    forward with the upgrade project. • An improved model of the Beacon Meter was expected to be released within the first quarter of 2020. • The valve exercising project was 22.5% completed. • The district Senior GIS Specialist, Joe Robinson, compiled a heat map outlining all leaks from 2019.

    This tool was to be used for planning future maintenance. • Colorado Rural Water was scheduled to come to the district for an exam preparation session with the

    operations department.

    DIRECTOR REPORTS Director Bukowski questioned if district staff had been trained on automated external defibrillator, (AED) use. He was advised the staff had been trained and the biennial first aid training was scheduled for the next three safety trainings. Director Gallivan-Crist advised she will not be in attendance at the April 9, 2020 Board Meeting. Director Brandt advised the board of information he obtained at the recent Weld County Farm Show: Northern gave a presentation on projects being completed in the area:

    • The City of Fort Collins will be raising the Halligan Dam. • Denver Water will be raising the Gross Dam. • The City of Greeley will be increasing the Milton Seaman Dam.

    Another presenter noted solar panels, used in a body of water in Walden, had sunk from the weight of recent snowfall and the panels had stopped working. When the snow melted the panels raised up out of the water and began to work again. President Szmyd advised the board that at the recent South Platte River Basin Roundtable (SPBR) he learned by the population of Colorado was expected to grow by 2.5 million by the year 2050. This growth was expected to cause a water shortfall of 500,000 acre-feet.

    President Szmyd will not be attending the May 14, 2020 Board Meeting. At the March 12, 2020 meeting the board will need to decide who will moderate the meeting in May since Vice President Bukowski will no longer be a board member. It was moved by Director Martens to adjourn the meeting at 7:47 p.m. Motion carried unanimously. Respectfully submitted,

    Discussion: No CLFP packet was available at the time of the preparation of the Board packet. The construction for the 7 MG tank and required yard piping is progressing. Stan, Rick, Josh and I met with Brad Wind and Jerry Gibbens, General Manager and Operations Manager respectively, of Northern Colorado Water Conservancy District (Northern) on March 2 to discuss operations of the raw water delivery to Carter Lake Filter Plant during annual maintenance and shut down of the Saint Vrain Supply Canal. Northern has a better understanding of our supply options and will evaluate two options for the future, replacing the “high pressure line” with a new, larger waterline and a potential new connection to the flume at the upstream end of their canal system. Both options would allow CLFP to stay in service during a canal shutdown but would require the review/approval of the Bureau of Reclamation.

    Subject: Prohibition of the Wasting of Water and Voluntary Outside Watering Schedule Staff Recommendation: Staff Recommends a motion to approve Resolution 2020-11.

    Discussion: Both topics are related to water conservation and were therefore included in one resolution. An explanation of the purpose of both topics is below. In order for Little Thompson Water District to be more successful in attaining grants and loans in the future it is important for the District to move in a path in line with the Colorado Water Plan. The Colorado Water Plan is currently being updated but one of the goals of the plan is “honoring Colorado’s water values and ensuring that our state’s most valuable resource is protected and available for generations to come.” This means ensuring beneficial use of the water Colorado has, i.e. using water on farms, in homes, and on lawns instead of sending the water down the storm sewers or watering while weather conditions result in ineffective watering. Many times flows out of Carter Lake Filter Plant peak on one day of the year. This peak causes stress on the treatment plant and the transmission facilities. If Central Weld County Water District (CWCWD) and Little Thompson Water District can alter watering days, voluntarily, there is opportunity to extend the capacity of our facilities by spreading the peak demands over two days. The following resolution is intended to show a specific decision by the Board to achieve this balancing of peak demands without requiring the customers to comply.

    PROHIBITION OF THE WASTING OF WATER AND A VOLUNTARY OUTSIDE WATERING SCHEDULE

    “RESOLVED that LITTLE THOMPSON WATER DISTRICT adopt a Policy that opposes the wasting of water and recommends a voluntary outside watering schedule that follows the following format: Waste of water prohibited. Water shall be used only for beneficial purposes and shall not be wasted by any District customer. Non-beneficial uses include, but are not restricted to:

    • Watering landscaped areas in such a manner, rate and/or quantity that it overflows and runs onto adjacent properties.

    • Applying water to impervious surfaces such as streets, parking lots, driveways, or sidewalks. • Failing to repair any irrigation system that is broken or leaking. • Watering landscaped areas during rain or high wind.

    Voluntary Outdoor Water Scheduling: Effective April 1st – October 1st

    • Water no more than three times per week. • Watering schedule:

    o Homes/business with addresses ending in even numbers may water on Monday, Wednesday and Saturday.

    o Homes/businesses with addresses ending in odd numbers may water on Tuesday, Thursday and Sunday.

    • All customers should avoid watering on Fridays.

    Managers Meeting A manager’s meeting was scheduled with Rick and Stan for March 4 but had to be cancelled due to Stan being sick. We are looking for a date to reschedule. Loveland IGA The Loveland Utility Board approved the IGA on Wednesday February 19 and sent it to the City Council with the recommendation for approval. The IGA will be on the Council Agenda in April. Loveland and LTWD will host open houses for the communities impacted by the change in billing agency. We are targeting March 26 and 31 for those open houses to be hosted in the Campion area. Utility Roundtable I was invited to participate on a utility roundtable of water providers across the state to discuss the largest challenges water providers face; whether there are any policies/laws/other gaps or hurdles we routinely have; and to discuss innovative solutions. The result was confirmation that LTWD is one of the most difficult utilities to manage for purposes of land planning, raw water inventory, and development type relationships. Consistent challenges for water providers were:

    • Water scarcity and a longer reach was required to secure additional water resources. • Water quality for treatment. • Undefined future uses for commercial or industrial zoned parcels. • Realistic population projections. • Ensuring long term maximum water use on each parcel – not increased water use for

    landscaping. Some interesting solutions others had used (some appropriate for use in LTWD and some not):

    • Surcharges for use over what was allocated (similar to our Urban tap). • Reimbursement agreements for tap fees when developments meet water conservation goals. • Having a developer’s roundtable for review of policies that affect development and landscape

    planning design such as reducing or eliminating irrigated bluegrass requirements. • Requiring qualified landscape contractors be used on irrigation installation.

    Rules and Regulations Updates Staff have been working hard on updating Section 3 of our Rules and Regulations regarding Taps and plan on having the updated Section to the Board in April for review. Annual Tri-City & Districts Water Board Meeting Mark your calendar for the Annual Try-City & Districts event hosted by the City of Fort Collins on Thursday, May 28, from 5:00 to 8:30 p.m. at the Lincoln Center (Columbine Room). May Board Meeting We need a volunteer to run the meeting as Bill will not be in attendance. Suggest either Ed or Larry due to the elections.

    Barefoot Lakes: Filing 4 and Filing 1, 3rd Replat are under construction. Filing 5 review is complete and approved for construction. Horizon Hills (269 lots): Subdivision design has changed, and revised plans are pending. Owner has purchased water. Sorrento (454 lots): Waterline infrastructure for phases 1 - 3 has recently been accepted by the District. Red Barn (457 lots): The 4th submittal of construction plans has been received and is currently in review. Highlands (225 lots): Waterline construction within filing #1 is substantially complete. Mead Place (313 lots plus multifamily): Final Plat, third submittal review is complete, revisions pending. St. Acacius: Construction documents review is complete, revisions are pending. Raterink – Mead Warehouse: Waterline plans are approved, and construction is expected to begin in late March. St. Iglesia: Waterline plans have been approved. Construction schedule is unknown at this time. Gopher Gulch RV Park (145 spaces): The 1st submittal of have been received and review in pending. Waterfront (1800 lots plus commercial): This development is working through the Mead annexation process. Hawks Ridge Subdivision (120 lots): The 2nd submittal for construction plans have been received and review is pending.

    42-Inch Transmission Line Relocation: The relocation of the 42-inch waterline at the intersection of SH 56 and I-25, along with connections to the existing 42-inch transmission line were substantially complete on Saturday February 29, 3 days ahead of the 25-day shutdown time limit. The transmission line was placed back into service on Monday March 2 and both districts are now operating normally. The relocation of the 6-inch distribution line which provides service both north and east of the SH 56 & I-25 interchange is scheduled to begin in April with an expected construction duration of 6 – 8 weeks.

    Other Project Information: The Farnsworth Group was selected for the West I-25, 24-Inch Transmission Line Design Project and is now under contract. The first meeting with the consultant, LTWD and Brookfield occurred on February 13 and the design project is underway. Easement acquisition along the transmission line corridor began in late September of 2019 and is ongoing.

    GPS Shots on Main for the month of February totaled 160, bringing the 2020 year to date total to 1261, which is 30 percent of the total Shots on Main for all of 2019. The limited data collection for the month of February is primarily attributed to weather related construction delays for new developments, along with completion of phases 1-3 of Sorrento and phase 1A of The Highlands developments in Mead.
