In exercise of powers conferred under Rule 29 (3) read with Rule 3 of Haryana School Education Rules-2003 Education Department, Haryana hereby permit to add new proposed classes for higher stage. However, it is made clear that such permission will not enable such school to get recognition automatically for which the applicant shall have to fulfill the required conditions.

This letter of permission is based on the undertaking given by the applicant as per details given overleaf. Any violation of the undertaking automatically nullifies the permission. This permission is further subject to 'No Objection' from the 'Competent Authority' regulating the land use of the proposed site.

The permission to add new proposed classes for higher stage is only 'In-principle' approval of the Education Department to allow applicant to initiate steps and provide infrastructure to the new proposed classes of higher stage.

ORDER

No. 6/112-2015 PS (2) Dated, Panchkula, the

This order of mine shall dispose of a complaint dated 29.07.2015 against

Dayal Singh Public School, Sector-7 Karnal which was filed by parents

association, Karnal. In the complaint, various allegations were levelled by the

association against the school e.g. that the Principal of the school has struck off

the names of their wards and the school has increased the fee and funds without

justifying the same to the Department whereas the school management had

surplus funds. The District Education Officer, Karnal vide their order dated

15.04.2014 had specifically directed the school not to increase fee without getting

no objection certificate from their office and directed the school management to

charge only fee in accordance with the fee structure of 2013-14. Despite the

directions of the D.E.O, Karnal, the school expelled the students on the ground

that they are not paying fee on 2014-15/2015-16 pattern. The school did not put

up justification for increasing the fee and funds. Consequently D.E.O, Karnal

directed vide order dated 28.07.2015 to re-admit the expelled students but the

school management did not obey the orders of D.E. 0, Karnal.

The action of the school management as explained above was viewed

seriously and a show cause notice under Rule 43(1) of the Haryana School

Education Rules, 2003, amended in 2007 was issued on 31.03.2015 to the school

management as to why the recognition/NOC granted to their school may not be

withdrawn from the next academic session 2016-17. Rule 43 of the rules is

reproduced as under:-

"43(1) The appropriate authority may withdraw/suspend the recognition/NOC of a school after giving reasonable opportunity against the proposed action to be taken against the school in the following circumstances:-

(a) xxxxxxxxxx (b) xxxxxxxxxx (c) If the managing committee of the school obtains recognition/NOC by fraud, mis-representing or suppressing any particulars or after obtaining recognition/NOC fails to continue to comply with any of the conditions specified in these rules the appropriate authority after giving a reasonable opportunity and one month notice to show cause against proposed action can withdraw recognition/NOC."

The school management submitted its reply to the show cause notice on

Q2.09.2015. In the reply, the society submitted that M/s Dayal Singh College

Trust Society is a registered Educational Trust and it was originally registered

with the Registrar of Joint Stock Companies Punjab vide Registration No. 39

dated 19.10.1951 and now the society is registered under the Haryana

Registration and Regulation of Societies Act, 2012 vide Registration No. 01414

dated 12.03.2015. It has also been submitted that apart from the educational

activities, no other activity is carried out by the Trust and no donation or

capitation fee directly or indirectly is collected or charged from the students. The

staff of the school is being paid salaries as per the recommendations of.6th Pay

Commission and DA and HRA is being paid at par with the Haryana Govt.

Employees alongwith other retiral benefits like Gratuity, EPF and Leave

Encashment etc.

In response to the allegations regarding the strucking of the names of

the children, the school management has submitted that it was not done

arbitrarily but only after showing a lot of restraints and fulfilment of conditions

under Rule 24 of the Haryana School Education Rules, 2003. There are 70 un-

aided private schools in the district whereas the Abhibhvak Ekta Sangh has only

targeted our school despite our nominal fee structure rather less than some other

schools in the region. The fee structure of the school was duly intimated in the

notified Form-VI to the concerned DEO.

Thereafter the matter was referred to the Fee and Funds Regulatory

Committee (in short FFRC) headed by. Divisional Commissioner, Rohtak under

Rule 158-A of the Haryana School Education Rules (amended) 2014. During the

proceedings before the Divisional Commissioner, Rohtak, detailed submissions

and explanations were made with respect to the various queries raised by the

Chairman FFRC and after hearing the Abhibhavak Ekta Sangh, the FFRC found

the fee and funds being charged by the school to be justified. Any party aggrieved

by the order of FFRC could file appeal before the Administrative Secretary within

a period of 30 days from the date of passing of order under Rule 158, which

having been lapsed. Thus the order dated 12.06.2015 has attained finality.

The Society further submitted that Rule 24 (1) (a) of the Haryana School

Education Rules stipulates that the name of the students shall be struck off if he

or she does not deposit the fee for 10 days after the last day of payment. In spite

of that, the school did not struck off the names of the students throughout the

year. Parents were requested time and again through SMS, telephonic calls,

written notices to deposit the outstanding fee. At the time of Annual

Examination, the parents who had not paid the full fee were finally requested to

deposit the pending fee before appearing in the exams. The DEO, Karnal during

visit to the school on 12.02.2014 as well as in a meeting held at S. D Sr. Sec.

School, Karnal with representatives of all private schools in the district on

16.02.2015 instructed to withhold their results in case they did not pay the fee

till that time. They complied with her directions and allowed the students to sit

in the exams.

At the time of declaration of the results, the parents were again requested

to pay the outstanding fees and get their results. Again the District

Administration intervened and instructed us to give them their results with the

condition that the parents will deposit the cheques for outstanding fee with the

DEO office and these will be handed over to the school in case the decision of Fee

and Fund Regulatory Committee, chaired by the Commissioner, Rohtak comes in

favour of school and vice versa. Accordingly, 39 parents of 54 students deposited

the cheques for outstanding fee with the DEO, Karnal. The directions were

complied with in letter and spirit. Results were handed over to the students as

per the directions. The. school even allowed the students to continue their studies

in the next session i.e. 2015-16 in spite 'of non-payment of the outstanding fee.

Since the parents did not deposit the fees despite several reminders, names of 11

students of 7 parents were struck off as per rule with effect from 17.07.2015 and

they were duly informed through SMS.

It has also been submitted by the society that the notice containing

allegation referring to generation of surplus and diversion of funds though does

not come within the purview of section '158-A of the Haryana School Education

(Amendment) Rules, 2014, yet in good conscious we would like to apprise your

good office that the Hon'ble Supreme Court in the Review petition (C) No. 1368

(2004) of the Action Committee, unaided Pvt. Schools & Ors, has confirmed that

so long as there is transfer of funds from one institution to the_other under the

same management, there , cannot be any objection from the Department of

Education. It has been further submitted that it is wise to maintain a

development fund for future plans, for expansion and for betterment of

institution and to keep the institution financially sound. Further, surplus fund is

essential to meet the contingent requirement and to meet unforeseen liabilities,

like Government of India's notification dated 31.12.2009 implementing Gratuity

for private schools teachers with retrospective effect from 03.04.1997 which

created a huge liability (in crores) on the school, it was mentioned that to meet

such unforeseen liability, if fee is increased in one year only, it would create huge

hardship to the parents and similarly educational institutions in Haryana were

previously exempted from payment of property tax. He submitted that now,

however, the school has received a demand notice of Rs. 49,35,398/- from the

local authorities which liability we cannot escape and naturally, it would not be

possible to meet such unforeseen expenses by increasing huge fee in one year

only in the absence of surplus or accumulated funds. It is further stated that the

school was in the process of constructing additional class rooms and activity

rooms etc. which was necessitated to provide additional activities for the students

and due to the disturbance created by the Abhibhavak Ekta Sangh, they had to

postpone the same he argued that the Trust Society is only custodian of all the

assets and controls and supervises construction and other development activities

related to education only in all of our schools and the land was allotted to the

Trust/ Society only for the schools and educational institutions. He submitted

that the funds transferred by the school are only used for the betterment and

expansion of the education which is the only objective of the Trust society and

the same is also allowed by the CBSE Bye laws.

During the course of hearing, the complainant Abhibhavak Ekta

Sangh has also submitted that the numerous complaints are pending against

Dayal Singh Public School, Karnal with the State Educational Authorities on

account of violation of rules, regulations and instructions of the Department. In

support of their complaints, the Sangh has pointed out some letters of the

Education Department/DEO as under:-

i. Letter no. PS/13/1645-49 dated 28.03.2013 issued by DEO Karnal

to above mentioned school regarding refund of illegally hiked fee. In

the letter DEO Karnal clearly mentioned that in case of defiance NOC

of school will be withdrawn.

ii. District Education Officer, Karnal vide order No. 134-A/14/94 dated

15.04.2014 issued orders that the school cannot hike their school fee

without obtaining NOC. Annual/Admission charges can be taken

only in 1st, 6th, 9th and 11th class. Smart class and computer fee

cannot be taken. Fees of 2013-14 will be taken by the school in the

session 2014-15.

iii. A meeting was held with the representatives of Private Schools. The

copy of proceedings of meeting with private schools (08.02.2014) and

Abhibhavak Ekta Sangh in which DEO was conveyed to the school

Principals not to ctiarge annual fee, smart class fee, etc. Admission

fee can only be taken in 1st, 6th, 9th and 11th.

iv. Copy of proceeding of meeting with the private schools (09.05.2014)

in which schools were conveyed the rules and regulations by DEO,

Karnal. In this meeting, special emphasis was put on the harassment

of children by Dayal Singh Public School, Sector-7, Karnal.

Education Department has conveyed its displeasure over this issue.

In this meeting, the matter came up regarding the surplus funds of

year and 1.90 crores in previous year. Abhibhavak Ekta Sangh has

also asked the school to submit its balance sheet for the last 10

years. Mr. N. K Bhandari representing the school did not reply to this

question. This was conveyed to school that the school can be run on

no profit no loss basis and utilization of existing reserve funds is

essential before any fee hike. Schools Association's President took

time up to 21.05.2014 to resolve this issue.

v. DEO, Karnal issued show cause notice vide no. PS/14/1376-80

dated 14.05.2014. Reply of Dayal Singh Public School, Sector-7,

Karnal that they will not torture the children and will not force to

deposit the illegitimate increased fees.

vi. Letter of DEO No PS/14/1396-1401 dated 27.05.2014 written to

Commissioner, Rohtak Division recommending for taking disciplinary

action against Dayal Singh Public School, Sector-7, Karnal.

vii. Letter of DEO No. PS/14/1344-45 dated 20.06.2014 written to Dayal

Singh Public School, Sector-7, Karnal asking the school to submit

record.

viii. Reply of Dayal Singh Public School, Sector-7, Karnal DSCT/ 17/1761

dated 24.06.2014 conveying their inability to provide the record.

ix. Reply of Dayal Singh Public School, Sector-7, Karnal no. DSCT

x. Letter of DEO, Karnal no. PS/14/1372-74 dated 10.07.2014 to

Commissioner, Rohtak Division, Rohtak to take disciplinary action

against Dayal Singh Public School, Sector-7, Karnal.

xi. Proceeding of meeting of DEO, Karnal and private schools on

16.02.2015 in which schools have been asked why they have not

attached the Audited Revenue Account and Balance sheet, along with

NOC of concerned Board, excess of surplus funds utilisation and

justification of fee hike by school. Also in this meeting, schools have

been told clearly and categorically that they cannot charge Annual

Charge, Activity, :Smart Class Fee as this is a refined form of

Capitation fee, which is not approved by DEO/Deptt. of school

Education, Haryana and as such is not allowed. As per Haryana Govt

School Education Act, Admission fee can only be charged in 1st, 6th,

9th and 11th class. Schools have been advised to submit their revised

Form-VI along with necessary documents. Also, schools have been

categorically told to make NCERT books as sole text books. They

have been ordered to go for fee hike only after consumption of

surplus funds.

xii. Letter of DEO No. PS/15/2017-21 dated 03.03.2015 to

Commissioner, Rohtak Division to take disciplinary action against

Dayal Singh Public School, Sector-7, Karnal.

xiii. Private schools that are the violators of rules have been viewed by

Deputy Commissioner, Karnal very seriously and emphasized that

rules to be followed in true spirit which includes non-charging of

smart class fee, computer fee, activity fee or any other fee under

unapproved heads. Also only NCERT books will be endorsed as sole

text books. Also, upper limit of students in a class is 40 students.

Also, advised the schools to give direction to their bankers for

accepting the fees as per rules.

xiv. Inquiry report of BEO, Karnal in which the Inquiry Officer has found

that the school is charging fee under unapproved heads, under the

pretext of smart class, computer class, activity fee, etc. the Inquiry

Officer found several complaints regarding torture of students by

Dayal Singh Public School, Sector-7, Karnal. Inquiry Officer has

recommended strict action against the school.

xv. As per Haryana Government, School Education Department order

No. 8/27-2013 PS (2) dated 04.03.2014 it was clearly mentioned that

schools cannot indulge in profiteering. Also, there was clear

direction that the funds cannot be diverted elsewhere. In this order

it was also emphasized that no charges such as capitation fee can be

taken from children. Admission fee can only be taken in class 1st,

6th, 9th, and 11th or fresh entry in the school. Also, it was clearly

mentioned in the order that Govt. can direct the concerned

institution to refund the capitation fee or excess fee. Govt. can also

recommend withdrawal of recognition/ affiliation and the Director

shall pass the orders accordingly. In the case of Dayal Singh Public

School, Sector-7, Karnal, the BEO has pointed out that the school

management has increased the fee without utilizing the huge reserve

funds and without taking the NOC. It was also observed that the

school transferred the reserve funds whereas the school have to run

on no profit no loss basis and moreover, the clear direction of

Commissioner Education Department of Haryana vide No. 7/4-2009

PS (2) that school fee can be increased in case of deficit only.

Whereas in the present situation, the school has increased the fee in

an unjustified manner to grab the money from the pockets of the

parents instead of utilizing the reserve funds which is the legal way

to meet with their demands. But in the present case, this huge

amount was transferred to the trust account for utilizing the money

by trustees at their own will and pleasure. These evil designs of the

school management clearly depicts that they have no intention to

comply with the instruction or to work for the welfare of the students.

xvi The school management is charging excess fee and capitation fee

forcibly in the shape of various kinds of funds/charges like Smart

Class Fee, Computer Charges, Development and Activity Fee,

Physical Education Fee, Maintenance Fund etc. which is against the

rules. The above facts have proved in a crystal clear manner that

increasing the school fee is absolutely violation of rules.

Besides the above, a show cause notice was issued by District Education

Officer, Karnal also on 15.05.2015 which was challenged by the School

Management by way of filing CWP. No. 12016 of 2015. This writ petition

was dismissed by the Hon'ble High Court vide its order dated 29.05.2015

with the following orders:-

"This petition has been filed against the show cause notice attached as Annexure P-44 dated 15.05.2015 asking the petitioner to file its reply within

15 days.

Instead of filing reply to the show cause notice, the present writ petition has been filed which is apparently premature and, thus, no interference is called for at this stage. However, the petitioner may, if so advised, file reply to the show cause notice and in case any adverse order is

passed, they are free to approach this Court again.

Dismissed."

The aforesaid order of the Hon'ble High Court would show that the

school management has made endeavour not to take care of the show cause

notice. The school management instead of making compliance of the provision of

rules, directions and instructions of the Department, challenged the same in the

Hon'ble High Court. As contended by the school management that their fee

structure has been approved by the FFRC, it is stated in this context that while

disposing of the complaint against the school regarding charging of excess fee

and funds from the students, the FFRC has directed as under:-

"As far as the allegation regarding transfer/ diversion of funds by the

school to the Trust is concerned, though, this issue does not come in the

purview of this Committee but, however, this issue also needs to be considered and disposed of by the Education Department in the light of

the following observation given by Hon'ble High Court while deciding CWP

No. 20545 of 2009 vide order dated 09.04.2013 titled as 'Anti Corruption & Crime Investigation Cell Vs State of Punjab and Others' in para 44(v)-

It was also held that the Govt. can ensure that there is no transfer of amounts from the schools to the society in view of the provisions of rules

and if any new school to be opened by the society or educational institute

exploited the collection of money had to be in the nature of voluntary

donation and for the expansion of education for future generation, unreasonable demand cannot made from the present students and their

parents." The balance sheets of the school submitted by the Abhibhavak Ekta

Sangh were perused. After perusal of the same, it has been observed

that as per balance sheet for the year 2012, the school has transferred

an amount of Rs. 81,11,210/- (Rs. Eighty One Lakh Eleven Thousand

Two Hundred Ten only) in the account of Trust and as per balance sheet

for the year 2013, the school was having an amount of Rs.

2,30,86,196/- (Rs. Two Crores Thirty Lakh Eighty Six Thousand One

Hundred Ninety Six only) as surplus fund.

After hearing the rival contention of the parties and perusal of

the relevant record, I have come to the conclusion that although there is

no such recommendation of withdrawal of recognition/NOC of the

school by the FFRC, the school management has violated the directions

of District Education Officer, Karnal and also violated the Departmental

instructions and rules, whereas in the present situation, the school has

increased the fee in an unjustified manner to grab the money from the

pockets of the parents instead of utilizing the reserve funds which is the

legal way to meet with their demands in the present case, this huge

amount was transferred to the trust account for utilizing the money by

trustees at their own will and pleasure. These evil designs of the school

management clearly depicts that they have no intention to comply with

the instruction or to work for the welfare of the students. In addition to

the above, 24 complaints of the students/parents against the school

have also been received in the Department regarding the charging of

excess fee and funds from the students. Thus, by doing so the

management has made itself liable for penal action in accordance with

the relevant rules. That reply submitted by the management is not

satisfactory and in this way I am not inclined to take any lenient view

against the school management.

In view of the above, I am of the considered view that the

recognition/NOC granted to the school upto 12th level i.e. Dayal Singh

Public School, Sector-7, Karnal vide No. 23/202-2001 S-1 (3) dated

29.06.2001 deserves to be withdrawn w.e.f 01.04.2016. The school

management is directed not to make any admission for the next

academic session.
