Declaration by the Presidency on behalf of the European Unionon the upcoming electoral process in Nicaragua

Brussels, 8 May 2001

The European Union follows with great interest the preparations of the upcoming general electionsto be held in Nicaragua in November 2001.

The Union considers that a representative, inclusive and transparent electoral process would greatlycontribute to the strengthening of democracy in the country.

In this respect, the Union supports a process which will enable all parties and candidates that fulfilthe legal requirements to fully participate in the elections.

With a view to contribute to the satisfactory development of the elections, the Union is currentlyexploring the possibilities of offering its assistance and support, in accordance with the Nicaraguanauthorities, by means of, inter alia, an election observation mission.

The Central and Eastern European countries associated with the European Union, the associatedcountries Cyprus, Malta and Turkey, and the EFTA countries, members of the European EconomicArea align themselves with this declaration.

The EU supports the efforts of President Gloria Macapagal Arroyo and the Government of thePhilippines to reach a sustainable, negotiated settlement to longstanding internal disputes in thecountry.

The EU welcomes the decision by the Philippine Governement and the National Democratic Frontto resume peace negotiations. A durable agreement will serve as an important contribution to allendeavours to carry out the reforms necessary for social and economic development in thePhilippines.

Declaration by the Presidency on behalf of the European Union on PhilippinesBrussels, 4 May 2001

The European Union regrets the violence and loss of life that have occurred during recent events inManila. The European Union calls for the Constitution of the Philippines, human rights and therule of law to be upheld by all political forces in the country. With a view to the forthcomingelections on 14 May, the Union urges all concerned to exercise restraint and to co-operate in orderto secure a peaceful and fair electoral process. The European Union also reaffirms its readiness toco-operate with the new administration in addressing the priorities it has set for the development ofthe Philippines.

Declaration by the European Unionon the situation in the Former Yugoslav Republic of Macedonia

Brussels, 3 May 2001

The European Union strongly condemns the renewed acts of violence by ethnic Albanian extremistsin the northern region of the Former Yugoslav Republic of Macedonia, including the killing of twosoldiers, the occupation of several villages and the taking of hostages. The European Union callsupon the extremists to stop the violence, to release the hostages and withdraw immediately.

The European Union emphasises its continuing strong support for the process of inter-ethnicdialogue that was recently launched by the Former Yugoslav Republic of Macedonia authorities.The latest provocations underline the need for the Former Yugoslav Republic of Macedoniagovernment to continue to show restraint and for leaders of all political parties to support theprocess of peaceful dialogue, to isolate extremists, to condemn the violence and to urge theirsupporters to remain calm. The European Union condemns the vicious circle of violence andcounter-violence from whatever quarter.

The Union also urges ethnic Albanian leaders in Kosovo and political leaders in Albania tocondemn unambiguously these acts of terrorism and to use their influence to prevent the violence,which threatens the stability of the whole region.

Declaration of the European Union on the Ratification by Andorra of the Rome Statute of theInternational Criminal Court

Brussels, 10 May 2001The European Union welcomes the ratification by Andorra of the Rome Statute of the InternationalCriminal Court, which is the thirtieth ratification or accession, thus reaching exactly half thenumber required for the entry into force of the Statute.

The Rome Statute of the International Criminal Court is possibly the most significant achievementof international law since the founding of the UN. By ending impunity for those who havecommitted or instigated atrocities, and through effective and impartial administration of justice, theCourt will strengthen the primacy of law and contribute to global peace and security. The Statutehas received a high degree of support from a large number of states from all regions of the world,including 139 signatures.

The European Union is a strong supporter of the Court. Eight of its fifteen Member States havealready ratified the Rome Statute, while the others are in the process of doing so. All Member Statesare working on the implementation of the Statute to ensure full co-operation with the future Court.The European Union assists countries to ratify or accede to the Statute, and the Union is alsodetermined to contribute to the effective, early establishment of the Court.

Declaration by the Presidency on behalf of the European Union on IndonesiaBrussels, 10 May 2001

The European Union is deeply disappointed with the recent judgements against the six personsinvolved in the killings of three international staff members of the United Nations HighCommissioner for Refugees (UNHCR) in Atambua, East Nusa Tenggara in September last year.

The Union fully supports the United Nations Secretary General's views as expressed in hisstatement on 4 May. The brutality of the murders does not seem to be commensurately reflected inthe judgements. The judgements weaken both domestic and international efforts to ensure the safetyand security of all humanitarian personnel.

The Union welcomes statements by the Indonesian Attorney General that the prosecutor intends toappeal the judgements. It recalls the commitment of Indonesia in the United Nations Commissionon Human Rights (UNCHR) that the trials of the suspects be conducted in conformity withinternational standards of justice and fairness.

on the establishment of a broad coalition Governmentin the Former Yugoslav Republic of Macedonia

Brussels, 11 May 2001

The European Union warmly welcomes the agreement on a broad coalition government in theformer Yugoslav Republic of Macedonia.

This is a strong message of unity from democratic leaders in the Former Yugoslav Republic ofMacedonia against the cowardly acts of violence by the extremists. It is also a brave step by thepolitical leaders to assume their responsibilities for the country in a difficult situation. The EU callsfor an end to the violence, and expresses the hope that the new coalition government will achieveconcrete and substantial results on the main issues in the ongoing dialogue by the end of month.

The new government of national unity will serve as a solid platform in handling the hard politicaldecisions that lie ahead. Only through political means can this crisis be resolved and a viablesolution be found. The EU will support the new Government in its difficult task.

Declaration by the European Unionconcerning recent developments in Mexico

Brussels, 14 May 2001

The EU has been following the process in Chiapas closely and will continue to do so, in particularregarding the recent developments in Mexico concerning the passing of the constitutionalamendment bill on indigenous rights. The EU regrets the EZLN's (Ejército Zapatista de LiberaciónNacional) decision to suspend its contacts with the Mexican Government and urges it to respond to

the constructive offer by President Fox to find political ways to make progress on those elementswhich have not been included in the new law.

The EU is convinced that a dialogue between the Mexican Government and the EZLN is of vitalimportance in order to reach a final settlement of the situation in Chiapas.

Declaration by the Presidency on behalf of the European Unionon the promulgation of a Constitutional Framework

for Provisional Self Government in Kosovoand the announcement of Kosovo-wide elections

Brussels, 16 May 2001

The European Union warmly welcomes the promulgation of a Constitutional Framework forProvisional Self-Government in Kosovo by the Special Representative of the UN Secretary-GeneralMr. Hans Haekkerup in Pristina yesterday. The EU commends the work accomplished by theUNSRSG. This document represent a landmark step in the implementation of UN Security CouncilResolution 1244, which foresees the establishment of provisional institutions of self government.

This is a decisive move towards the establishment of meaningful and democratic self-government inKosovo. The Constitutional Framework provides the common institutional groundwork for the wayahead, pending a final political settlement.

The challenge of building functioning institutions safeguarding fundamental human rights andcapable of supporting a multi-ethnic society based on democratic principles and tolerance is a majorone. The success of this endeavour ultimately rests with the people of Kosovo themselves and theirrepresentatives. The EU is prepared to continue to assist in the effort to build a democratic andprosperous society where violence is shunned and genuine reconciliation can be achieved.

The EU also welcomes the announcement by SRSG Haekkerup of Kosovo-wide elections on17 November 2001. It urges all individuals and communities to participate actively andconstructively and to refrain from all acts of violence in the process leading to this most importantelection for Kosovo.

Declaration by the Presidency on behalf of the European Unionon the demobilisation of ethnic Albanian armed groups

in the Presevo Valley areaBrussels, 22 May 2001

The European Union welcomes the commitment by representatives of ethnic Albanian armedgroups to full demobilisation in Southern Serbia (Presevo Valley area), signed yesterday byUCPMB Commander Shefket Musliu. This move is an encouraging step towards a non-violentsettlement of the situation in the Presevo Valley. The EU urges all individuals concerned to fullyrespect this commitment and to hand over their weapons to KFOR and return to civilian life.

The EU encourages FRY/Serbian authorities and ethnic Albanian representatives to continue theirconstructive talks held in recent days in order to consolidate the implementation of confidencebuilding measures, including the early establishment of a multi-ethnic police force. The EU expectsthat outstanding issues concerning ethnic minorities in the Presevo Valley area, including the returnof displaced persons and the integration of ethnic Albanians in political economic and social

structures, will continue to be addressed in a serious manner after the return of Yugoslav forces toSector B.

Declaration by the Presidency on behalf of the European Unionon the nation wide local elections in Croatia 20 May

Brussels, 22 May 2001

The European Union welcomes the overall well conducted nation wide local elections held inCroatia 20 May and takes note of the ODIHR conclusions that the elections were held generally inaccordance with international standards. This is a concrete sign that the Republic of Croatia is astable democracy on the path to integration into European structures.

At the same time, the EU notes the concerns expressed by ODIHR, in particular with regard tominority participation and representation, and encourages the relevant Croatian authorities toaddress these questions.

The EU calls upon Croatia to continue the reform process at all levels in society. The EU standsready to assist Croatia on her way to full implementation of the newly initialled Stabilisation andAssociation Agreement.

The European Union welcomes the publication of the Report of the Sharm el Sheikh Fact FindingCommittee (the Mitchell Report), and fully endorses its recommendations. Like the Jordanian-Egyptian initiative, the Mitchell Report is a realistic and balanced proposal to work from, in order torestore calm in the Middle East and relaunch the Peace Process.

The Union urges the parties to faithfully adhere to the recommendations contained in the Report. Inparticular, the Union expects the parties to take immediate and unconditional steps to cease allviolence, to resume security co-operation and to exchange confidence building measures, includinga halt to settlement activities. These are all important elements for a resumption of negotiations,which should then follow. Negotiations should be based on international law, in particular UNresolutions 242 and 338, and the principle of land for peace.

Given its remit under the Treaties and in the light both of its make-up and of the expertise ofits members, the Economic and Social Committee is - within the overall EU institutionalframework - the ideal forum for civil society organisations to defend their interests, obtain

The aims of the ESC's considerations and proposals are based on two approaches:

• establishing new synergies between the bodies and institutions of the European Union withthe aim of enhancing governance, and in particular developing the Committee's role by settingup new types of partnership with the institutions, especially the European Commission;

• preparing the Committee to face the challenge of the new governance concept so that it canrealise fully its role as an essential "bridge" between Europe and its citizens and contributeeven more effectively in the future to developing and reinforcing the participatory model ofcivil society in formulating and implementing Community policies.

2. ENLARGEMENT

• The employment and social situation in the CEECRapporteur: Ms Belabed (Workers - A)

Key points:

The purpose of this own-initiative opinion is to point out that, over and above theCopenhagen criteria, the social consequences of EU enlargement must also be taken intoconsideration so that all concerned can be sure that enlargement will be socially-compatible.

An earlier information report taking stock of the employment and the social situation in theapplicant states (REX/015) made it clear that despite the progress made in the CEEC,considerable problems still exist on the labour market and in the field of social development.These may even worsen in some sectors (e.g. steel, agriculture etc.) as a result of structuralchange, since the pressure on labour markets will increase. In conclusion, the own-initiative opinion recommends several measures, including thefollowing:

• the urgent need to formulate appropriate, socially- and environmentally-sustainable,development strategies for key problem areas (e.g. heavy industry, agriculture) building on anoverall approach;

• the need for training measures at every level, but especially for economically disadvantagedregions;

• promoting social dialogue at the various levels and raising awareness among the socialpartners and civil society organisations, so that they organise themselves more effectively ontheir own;

• establishing social service systems that help to strengthen social cohesion and alleviate theplight of the socially most disadvantaged;

• the need to step up dialogue with civil society about preparing for EU accession and theconsequences of accession;

• fostering equal opportunities for all, especially between men and women and in relation tominorities;

• greater transparency in the application and use of EU programmes and other possible forms ofsupport.

• EU enlargement: the challenge faced by candidate countries of fulfilling the economic criteriafor accessionRapporteur: Mr Vever (Employers - F)

Key points:

The new enlargements essentially depend on the "road maps" for each of the applicantcountries, i.e. their progress in adopting the Community acquis, considered to be going well forthe great majority of the applicants, and in concluding the accession negotiations, considered tobe possible as of 2002 for the applicant countries which are in the best position. Whilesubscribing to the main points of this assessment, the Committee would also stress thatresponsibilities will necessarily still have to be shared between the 15 EU Member States and theapplicant countries for taking up the economic challenge of enlargement. This is a moving targetand the stakes are threefold: effective adoption of the acquis, more effective support methodsand preparation for new cohesion in an enlarged Union.

Taking on board the Community acquis effectively is very exacting because of the highlevel of integration which the Union has already achieved and will continue to work on. Theissue is inevitably complicated by the high number of applicant countries, the gaps between themin terms of development and the diverse nature of their adjustment needs. This progress opens up

the prospect of accession for a large majority of these applicant countries in the near future. Theremaining priorities vary from one country to another and must therefore be targeted.

Success in the integration process requires more effective support methods. Community aidprogrammed in Agenda 2000 in Berlin will not in itself be enough to finance measures to ensurethat the applicant countries catch up on the rest of the EU. The Committee would underline thatCommunity aid programmed in Agenda 2000 must above all help to create a favourable climatefor attracting private investment which alone is able to pull in all the resources needed.

The ESC therefore believes that it is important to start now on laying the foundations fornew economic and social cohesion in an enlarged Europe; this is a complex issue which entailsjoint innovative action. The Committee would stress the need to undertake organisationalreforms in the legislative, administrative, economic and social spheres.

To achieve these objectives the Committee is launching an appeal for a global multi-annualprogramme to be undertaken as from 2001 in preparation for enlargement, aimed at boosting theeffectiveness of support methods for applicant countries while creating the right conditionsamongst the 15 for preserving cohesion in an enlarged Europe.

3. SINGLE MARKET

The Committee also congratulates the Commission on the work accomplished in opening upthe procurement markets in water, energy and transport markets and basically welcomes theproposed amendments. It regrets, however, that European law is modified too often as this has adamaging effect on knowledge and comprehension of that law. It calls upon the Commission toconsider establishing more flexible and more stable general frameworks to avoid impairing thenecessary development of knowledge of European law.

The Committee approves the clarification provided by this new draft directive, set out underfour headings which cover definitions, rules applicable to contracts, specific rules applicable todesign contests, and statistical rules and final provisions. However, the text remains laborious toread through an excess of details on certain points and a clear lack of precision on other points.

Key points:

It is now a recognised fact that the extent of the BSE crisis is due to delays in the adoptionand implementation of provisions, as well as patchy compliance.

The ESC feels that, as a matter of principle, the use of healthy parts of healthy animalsapproved for human consumption may be considered completely safe provided that the relevantprovisions are complied with, as well as ensuring the recovery of resources. However, for thepurposes of risk management, the current ban on the use of meat-and-bone meal forruminants should remain in place and ruminant material should be removed from the feedchain so that only the use of materials derived from, or intended for, single-stomach animals ispermitted. In addition, a ban on intra-species recycling ("cannibalism") could be introduced.However, the temporary ban should definitely remain in place until adequate safetystandards are achieved in the production and use of meat-and-bone meal.

It is clearly necessary to eliminate the risk of the rules being circumvented. This can beachieved by means of HACCP programmes, certification or accreditation of individualenterprises (slaughterhouses, meat-feed factories, feedingstuff companies etc.), as well asmandatory separate production chains, in order to ensure completely safe production of meat-and-bone meal. Here total traceability in all production chains and clear indication offeedingstuffs containing meat-and-bone meal are a necessary consequence.

As regards the concrete assessment of the present proposal, the ESC is in no doubt, bothfrom the ethical point of view and considering the scientifically documented evidenceconcerning diseases, that fallen animals and condemned material from animal by-productsshould no longer be used for the production of feedingstuffs and that the current lack ofclarity in provisions on waste should be rectified.

Key points:

The ESC agrees with the Commission on the urgent need for emergency measures to tacklethe upheavals on the beef and veal market brought about by the BSE crisis. The ESC supportsappropriate measures designed to bring an end to market disruptions in the short term and torestore the markets to balance in the medium term. National aid schemes must not trigger newdistortions in competition or even trends towards a "renationalisation" of the CommonAgricultural Policy.

In the ESC's view the BSE crisis poses a threat to the existence of both small and largeenterprises irrespective of the farming method employed. Steps should therefore be taken toensure that the proposals do not result in further loss of income for particular farms and regions

and that the Community's efforts are not undermined by increased exports which may be subjectto lower health standards and checks.

In the current market crisis, producers and processors alone cannot be burdened with theconsiderable additional costs of comprehensive BSE safeguards. It is also essential to avoid newdistortions in competition. In view of the seriousness of the crisis, the ESC expects that the EUwill also have to make available special funding to relieve or remove hardship.

The ESC requests the Commission to back up the supply-side measures by additional andmore pro-active demand-side measures. The wide-ranging consumer protection measures shouldgo hand in hand with the substantial stepping-up of an information and communicationcampaign.

The Committee would warn against any return to permanent intervention. However, in thelight of the current extreme market disruptions, the ESC considers that the proposal that theintervention ceiling of 350,000 t set out in Agenda 2000 be temporarily repealed is the rightcourse of action. The provisions governing intervention, particularly those in respect of carcassweights, should also be reconsidered.

Key points:

The ESC considers that this proposal is grossly inadequate and deals only partially with theproblem.

The ESC asks that the amendment of the regulation should not be reserved for organicproduction alone, so that all farmers can develop environmentally friendly practices, andsuggests that the proposal be extended to seed legumes and protein crops not covered by theBlair House agreements.

Finally the ESC points out that the temporary ban on the use of meat meal in all animal feedheightens the need to analyse in depth the EU's situation of dependence in the field of vegetableproteins and seek sustainable and suitable solutions. To this end, the ESC does explore somepaths for reflection which should lead to an opinion dealing more specifically with the issue ofthe EU's supply of plant proteins.

6. ECONOMIC AND MONETARY UNION

Key points:

The Committee supports the retention of Objective 1 territorial assistance and that asubstantial part of EU cohesion efforts should be targeted towards these regions. The principle ofconcentration of effort should not be compromised.

The Committee's position is that the revisions to Objective 1 eligibility criteria should notresult in the exclusion of those regions currently in receipt of funds and whose economicdevelopment will continue to depend on cohesion assistance. This may be best achieved byraising the current threshold beyond the 75% level.

The Committee recognises the force of Commission arguments in favour of a regime ofindirect zoning to deliver assistance outside of Objective 1 regions.

The Committee recommends that the Commission seek ways in which the activities of theEuropean Investment Bank in conjunction with private sector capital might be harnessed with aview to increasing the part they play in the EU cohesion actions.

Key points:

The weaknesses of the present transitional system can only be finally removed by theintroduction of a new definitive system based on the principle of taxation in the country oforigin. The total lack of progress which has been made towards achieving this goal is deeplyregrettable.

A system which would make a reality of the Single Market - rather than undermining it -would do much to stem the current tide of VAT fraud.

In the absence of the political consensus that would bring this about, the need is accepted forfurther amendments to the transitional system to mitigate some of its worst defects.

The agenda set out in the Commission's New Strategy for 2000 and in its Action Programme2000/2001 is broadly approved.

The reverse charge mechanism should be extended or made the general principle fortaxation of services. Removing the system of fractionated payments would do much to reducecompliance costs for business without providing any greater scope for fraud.

The Committee believes that this is a necessary initial step towards achieving a commonpolicy on asylum and establishing an area of freedom, security and justice as recommended atTampere. It is also a humanistic and humanitarian instrument which is an integral element ofhuman rights protection, since it is based on safeguarding the dignity and fundamental rights ofall human beings and cannot, therefore, be subject to conditions.

The ESC, as an advisory body representing organised civil society, feels that it must serveas a catalyst for greater civil society involvement in this issue

The Committee asks for the following rights to be guaranteed to asylum-seekers:− access to competent, qualified and impartial interpreters at every stage of the procedure;− free legal assistance at every stage of the procedure;− a personal interview carried out in a climate of trust and respect for the asylum-seeker;− the benefit of the doubt should be given to the asylum-seeker, when his/her application is

examined.

The ESC suggests taking into consideration the specific vulnerability of unaccompaniedminors and other vulnerable categories so that they can be given special help.

The ESC also deems it important to enshrine the following principles in the draft directive: -principle of "non-refoulement", whereby no refugee may be expelled or sent back to a countrywhere his life or freedom would be threatened; - principle of confidentiality of informationregarding all applications for asylum; the guarantee that asylum applicants shall not bedetained for the sole reason that they are seeking asylum.

The ESC calls on the Council and European Parliament to adopt the measures proposedas soon as possible and to incorporate ESC's suggestions.

The proposal presents adjustments to theCommission proposals adopted on 6September 2000 on the financial andresearch activities to be carried out afterexpiry of the ECSC Treaty. The changes areneeded to take account of the new legalbasis – the Protocol annexed to the Treatyof Nice, on the financial consequences ofthe expiry of the ECSC Treaty and on theResearch Fund for Coal and Steel.The act refers to the Charter ofFundamental Rights of the European Union.

Commitments and payments: Commitment appropriations amount to some€100.3 billion (+3.4% from 2001) leaving a margin of more than €500million below the ceiling set in the Financial Perspective 2000-2006. Therise in payment appropriations has been kept at 4.8% (or some €97.7billion). In relative terms they remain at the same level as in 2001,i.e.1.06% of EU GNP.AGRI: Agricultural expenditure represents the biggest share (46%) of theproposed budget and shows the highest increase (+5.0% in relation to2001 spending).

STRUCT measures: Thanks to the decision to re-use in 2002 €870 millionof funds left over from 2000, the increase amounts to 2.8%. Without this re-budgeting the increase of only 1.5% reflects the stabilisation of aidintensities and the gradual phasing-out of non-eligible regions as foreseenin the Financial Perspective.

INT policies: The increase of commitments is above the average for thewhole budget (+4%). The main points are: R&DT with more than €4 billion;A total amount of €111.7 million (+ 7.1% compared to 2001) is proposedfor €7.5 million is assigned to the start-up of the European food Agency;Appropriations assigned to the environmental programme LIFE III amountto €140.6 million. That is an increase of €.2 million on 2001;Justice andhome affairs: the amount of approximately €81 million planned for 2002 willallow activities to continue at the same level as in 2001, including theDAPHNE programme (€million to combat violence against children), theEuropean Refugee Fund (€million) and the campaign againstdiscrimination (€million)

AID to non-EU countries: Commitment appropriations are down by 2.4%.

Pre-accession: For SAPARD, ISPA and the PHARE programme the totalamount of €.328 billion will be budgeted.

ACCES: The budget for payment appropriations is €4.4billion smaller thantheoretically planned with the enlargement.

ADMN expenditure: 5.1% of total budget, including the cost of pensions.
