I knew it was only a matter of time before our aging air

conditioning units called it quits. With rather large dogs, I

also knew a hotel was not an option if our units died in the

middle of the peak season. My wife and I decided to look

into replacement before the inevitable occurred. We had five

quotes from both local and larger valley contractors. Travis

Dear Doreen, I made an offer on an “as-is” house. It’s a real

mess but a good deal. My agent told me I could cancel if the sellers won’t fix things, like an A/C unit, for instance. Well, guess what? One of the A/C units didn’t work when we did our inspection. I asked the seller to repair or replace the unit. They refused citing the “as is” clause. My agent is encouraging me to move forward because it’s a good deal. But, a contract is binding! Don’t the sellers have to fix it? Can I cancel and get my earnest deposit back? You always know. Thanks! (P.S. Love your column!)

Thank you for the kind words! Because the sellers included the “as is” addendum, they are not obliged to repair the A/C. But, that addendum does not alter the inspection rights in the original contract. So, you can cancel the contract during the inspection period if a warranted item, such as an A/C unit, is not working. In defence of your agent, though, you might move forward with the sale if it is a really good deal. Consider the cost of a new unit vs. the next best deal. In my opinion, this is a simple math problem. Let me know what you decide.

Frances Perkins knew the water was rushing toward her New River home west of I-17.

“I was releasing horses out of their corrals. When it hit, we were in the arena. We were standing there and saw it come over the bank,” she said. She scrambled to safety with her friend and two of her dogs. “After that we just had to sit and watch.” Perkins helplessly witnessed as New River flooded her property.

Now the waters have receded and some New River residents face the daunting task of cleanup. For Perkins, that means salvaging what she can from her now-condemned home.

Residents near Coyote Pass off New River Road surveyed extensive damage to their homes and counted several animals and vehicles among the loss. On the west side of the I-17, at least one home on Hallie

Curtis’ property was damaged by debris floating downriver.

And Marcia Fuller (Curtis’ mother), whose helicopter rescue from her home was broadcast nationwide, shared frustration with In&Out as she wondered where government officials were to help.

Ground crews were assessing the damage as of Aug. 23, according to Maricopa County Department of Emergency Management Director Pete Weaver. As of this writing, three homes and two mobile homes have been declared destroyed while another 13 sustained major damage. Nineteen others were reported to have minor damage. Weaver said U.S. Small Business Administration, which helps homeowners recover from disaster, is assessing the area to determine if it will qualify for an emergency low-interest loan program.

The situation has been ongoing since 2009, according to Roger

Oyler of the Wild Horse and Burro Program at the Bureau of Land Management. HOAs request the burros be

relocated, but community residents sometimes feel otherwise. He said residents call and say “ ‘The HOA said come get them, but we don’t want you to, because they [the HOA] don’t speak for us.’ ”

And so it is with Anthem. When Parkside HOA nudged residents to contact the BLM about burros in the neighborhood, all of the 80 responses on Parkside’s Facebook page opposed the proposal [See Page 17].

“We have actually gotten a lot of calls asking that we leave them there,” said Rem Hawes, the Hassayampa field manager for BLM who oversees the area.

Regardless, residents haven’t got much say in whether the animals stay or go. “We pay attention to

every call we get, but the primary factors we consider in a situation are whether they’re a hazard on the roadway and if they are in danger,” Hawes said.

Wild horses and burros are protected on public land (managed by the BLM or the Forest Service). But the burros in the North Valley area have been sighted largely on state or private land where the BLM does not have jurisdiction to manage the animals. These have likely strayed from the herd management area west of Lake Pleasant, Hawes said. They tend to follow the water, so when it rains, they often wander.

couple weeks ago. “That raises our level of interest,” Oyler said.

But don’t look for a full evacuation of the Anthem-area burros any time soon. The BLM doesn’t have the funds to do a full collection, nor the space to accommodate the burros at the moment, Oyler said. “What we would likely do in the in the next six months or so is to go in and capture whatever burros that are getting access to I-17.”

The BLM is currently in the process of a “gather” in the Loop-303 area south of SR-74 where it hopes to collect some 40 “nuisance” burros. This gather comes after 27 vehicle collisions with burros have been reported so far this year. No humans were seriously injured, Hawes said, but all 27 burros died.

Gathering the burros is difficult, he said, partly because people sabotage the BLM’s efforts by chasing burros away from the traps.

But when the time comes—and Oyler said it’s not “if,” but “when” for the Anthem-area burros—the process involves baiting traps with feed for the animals then moving them to a holding facility. There, they become accustomed to a diet of alfalfa hay. Later, they move to the adoption facility where they get tested for disease and vaccinated. The burros are then “freeze-marked” on the side of the neck for identification purposes and put up for adoption for $125 each. Relocating the animals back to the management area is also a possibility, Hawes said.

According to the Wild Free-Roaming Horse and Burro Act of 1971, if the number of animals in the adoption program exceeds the demand, the animals could be destroyed. But Hawes said that just doesn’t happen, as burros are extremely popular. “People think they’re cute. They’re much easier to train and handle than the horses,” he said. And, people don’t fuss about the breed like they do with horses. io

Snowbird Watching (They’ll be here soon. Younger and better looking than ever.)

I hit the “double nickels” lottery this week. I now qualify for discount movie tickets, the “Senior Scrambled Eggs”

breakfast at Denny’s (not sure if that means they use the old eggs, or what) and a whole host of other perks for accomplishing nothing more than staying on the right side of the dirt since 1959. Hooray, me!

All of a sudden the term “snowbird” takes on a whole new meaning. First of all, they are no longer “those old people,” they are now peers. I never realized just how darn good looking snowbirds are until recently.

Actually, snowbirds are trending a lot younger these days.

With all the improvements in technology during the past decade or two, people who couldn’t break away from their primary hometown for extended periods, now can. If the kids are out of the nest, folks in their 40s and 50s are taking advantage of the opportunity to escape from whatever seasonal crappy weather they once had to tolerate.

Here’s another new trend: People are finding a new place to roost and staying put. Instead of keeping that home back in Ham Lake, Minn. (mmmm… ham!), some are opting for one home in, say, Fireside at Norterra, and ares taking a few long vacations throughout the year to escape the heat (or snow/rain/volcano season depending on the location of the roost).

RVs are back! The recreational vehicle industry was pummeled during the dark days of 2008–2010, but sales have been rising since then, according to the Recreational Vehicle Industry Association.

The upside is a different destination every year (or month or week) as opposed to dealing with the costs, upkeep and, well, lack of mobility of a second home. I kind of like that idea.

Those snowbirds will be migrating our way starting October and will be in full plumage by Christmas. Please make them feel welcome. They bring much-needed revenue and cultural diversity.

And, some of them are just darn good looking! io
