Any criminal investigation where the remaining leads to be completed are best conducted by another criminal investigative 'unit, office or organization will have 2nd Status Reports completed refening the investigation to HQUSACIDC. After the 2nd Status Report is dispatched the investigation will be written Final Referred, reviewed by the Team Chief, Special Agent in Charge and Detachment Commander, before, being closed and sent the HQUSACIDC. Once received by HQUSACIDC it will be detennined which investigative agency is best suited for completing the investigation (Le., NCIS, SOTF, FlU...) and the investigation will be forwarded to them.

This' generic Agent's Activity Summary entry will be placed in each file that will be referred to HQUSACIDC.

All investigative activity in non-referral DATF investigations -will be held'in abeyance unless it is determined it is absolutely necessary the activity be conducted in an expedient manner. Review of File: Abuse occurred between ,12 May 04 thru 7 Jun 04. At Mosul, IZ. Reports abuse by: Translator: Slapped him causing,a wound inside his-mouth.

Unknown: Grabbed by hood and head beaten on a-steel plate until unconscious, ice poured into suit, water poured on him~ stones were thrown at him, sandbags placed on his head and shoulders.

Capturing unit was 2/3 INF, still here in country but was not the abuser. All abuse occurred in Mosul as per victim. <Request Final C of this> \\

Will send a Shotgun RFA to Mosul and see if they can canvass personnel to see if this abuse had been dorie and to obtain interrogation reports there. Locate and fully identify and conduct subject interviews of the interpreter/translator, guards, and interrogatoi.

NClS is developing or has already a task force to look into criminal offenses committed by SEAL Team 7. I have taken and provided a listing of all the detainee cases we are working which might have a tie in to SEAL Team 7 to the DATF.

They will coordinate with NClS over' the next couple of da~s and hopefully, they will assume on some of these cases. If this is the case, we will have this RFA cancelled and then hava~raq close and refer these cases to NCIS.

So, for now, the RFA is still on hold until we get word back from NCIS if they are interested or not.

If you can get the Navy (NClS or SEALS) to verify that they owned the "disco", and they did. all the guarding and interrogating at the "disco" (that is, no Army Sold~ers, no Army SF, no Army civ employees or contractors involvement), and get that done like over the phone ASAP, then I'd' say refer the whole thing to them, and notify Iraq CIO to do a Final Referred ROI to NelS (assuming NCIS has been notified that the referral is cbming).

If there is a chance that some type of Army personnel were involved in either guarding or interrogating the detainee', but the Navy still admits that it was their faci,lity, then I think a joint investigation with NelS is called for until we can rule out an;·y Army personnel involvement, then a Final Referred ROI could be done and NCIS can 'proceed on alone.' .

If yc;>u can't get answers over the phone, or if the Navy denies it, then make some coordination with NClS and take a road trip to San Diego to find out/verifythe details. If it is a denial, you should also immediately alert Iraq CIO so that they can do some more digging on their end.

4. On 4 Sep 04, this office received information that the "Disco" had beenia detention and interrogation connex, in the Mosul area, operated by SEAL Team 7 who has since redeployed to San Diego, CA. The "Disco" was reported to have bright lights and played loud music used to disorient the detainees prior to interrogation.

Request your office coordinate with Naval Special Warfare Group SEAL Team 7 based out' of San Diego, CA and determine the location of the "Disco" and conduct a c1rime scene examination of the "Disco". Further request your office locate, fully identify, and conduct subject interview(s) of the members of. S~J\.:L. I feel the NSWTGAPIZ operated the "disco" and they are attempting to deny knowledge and shifting the blame on the Army to avoid the scrutiny of their questionable 'practices toward detainees interrogated at the "disco", I feel that the "disco" con~x may still exist and or is in route to the US with the other "gear" used by the SEAL ~eam operating in that area. I feel that this is a time ,sensitive m~tter and the longer the delay the more of a chance the "disco" will "disappear" again.

If you can get the Navy (NelS or SEALS) to verify that they owned the "disco'~, and they did all the guarding and interrogating at tne "disco" (that is, no Army Soldiers, no Army· SF, no Army civ employees or contractors involvement}, and get that done lik~ over the phone ASAP, then I'd say refer the whole thing to them, and notify Iraq Cln ~o doaFinal Referred ~or to NClS (assuming NClS has been notified that the referral is c~ming).

If' there is a chance that some type of Army personnel were involved in either guarding or interrogating the detainee, but the Navy'still .admits that it was their faci~ity, then I think a joint investigation with NCIS is called for until we can rule out any Army personnel involvement, then a Final Referred ROI could be done and NelS can proceed on alone.

If you can't get answers over. the phone, or if the Navy denies it, then make! some coord~nation with NCIS and take a road trip to San Diego to find out/verify the details. If it is a denial, you should also immediately alert Iraq CIO so that they can do some more digging' on their end.
