The department is funded through fees and assessments from the industries and professionals regulated by the department rather than state general revenue. The department has seven divisions: Resource Administration Division, Consumer Affairs Divi- sion, Insurance Solvency and Company Regula- tion Division, Insurance Market Regulation Division, Division of Finance, Division of Credit Unions and Division of Professional Registration. in Missouri. In 2006, the division responded tomore than 3,603 complaints and opened 726 in-vestigations, recovering more than $12 millionfor consumers. The division operates the Con-sumer Insurance Hotline at (800) 726-7390. Con-sumers can file a complaint or inquiryelectronically through the department’s website,which has a broad array of consumer and indus-try information available.

The Investigations Section records complaintsfiled on behalf of consumers against insuranceproducers, bail bond agents and public adjusters.The staff also investigates unlicensed insuranceactivities and reviews license applications that arereferred from the Insurance Licensing Section.Department investigations may result in licensedenials, revocations or suspensions, cease anddesist orders, injunctions and referrals for crimi-nal prosecution.

The department receives a federal grant fromthe Centers for Medicare and Medicaid Services,which funds the CLAIM program in Missouri. TheCLAIM (Community Leaders Assisting the Insuredof Missouri) program provides counseling and ed-ucational activities to seniors on health insurancecoverage and Medicare benefits. The departmentcontracts with a not-for-profit organization to ad-

minister the CLAIM program. The program re-cruits sponsors and volunteers, develops and con-ducts volunteer training, publicizes the programand maintains a toll-free number (800-390-3330)for consumers to call. Volunteers are recruited lo-cally and community organizations such as hos-pitals, community centers, extension offices orsenior centers serve as co-sponsors and providespace, supplies and local publicity for the pro-gram.

Insurance Solvency and Company Regulation Division

The Insurance Solvency and Company Regu-lation Division monitors the financial conditionof all domestic (Missouri based) and foreign (non-Missouri based) insurance companies operatingin Missouri. The division includes the FinancialAnalysis, Financial Examination, Premium Taxand Surplus Lines sections.

The Financial Analysis Section reviews finan-cial statements received from insurance compa-nies on quarterly and annual bases. Bymonitoring insurance companies, this section isable to identify financially troubled companies sothat further action may be taken to prevent insol-vencies. The analysts recommend action on pro-

posed business transactions by Missouri-domi-ciled companies and evaluate mergers and acqui-sitions, payments of dividends and otherproposed transactions for financial and opera-tional impact. The division conducts financial ex-aminations of 232 domestic insurance companiesat least every four years and analyzes the finan-cial condition of all foreign companies licensedto sell insurance in Missouri. The department di-rector can call for an examination of a licensedinsurer at any time.

The Premium Tax Section audits and deter-mines premium taxes, which insurance compa-nies pay in lieu of income taxes. The departmentcertifies to the Department of Revenue the tax duefrom each company. In 2006, the Premium TaxSection certified for collection over $197 millionin tax, which is deposited into general revenueand the state school fund. The Surplus Lines Sec-tion regulates the placement of policies and col-lection of premium taxes on business written inthe non-admitted market known as surplus lines.The section oversaw the activities of 899 surpluslines brokers in 2006, and collected $23.8 millionin taxes on surplus lines premiums, which is de-posited into general revenue.

Insurance Market Regulation DivisionThe Insurance Market Regulation Division

protects the interests of Missouri’s insurance buy-ing consumers by ensuring companies are con-ducting business in compliance with applicablestate statutes and regulations. The division re-views insurance contracts, endorsements andother insurance documents by reviewing and an-alyzing a number of rate structures and under-writing practices and by analyzing and examiningcompanies’ marketing and claims handlingprocesses. This division works with insurancecompany compliance offices to strengthen inter-nal compliance systems. The division includesfour sections: the Market Conduct Examination,Statistics, Life and Health, Property and Casualty,and Managed Care sections.

The Life and Health and Property and Casu-alty Sections approve policy forms, endorse-ments, illustrations and some rate filings. TheManaged Care Section oversees activities of Mis-souri HMOs and reviews company applicationsfor new certificates of authority or service areachanges and analyzes trends in HMO activities.The Statistics Section analyzes and publishes in-dustry and market data as well as trends in theoverall industry.

The Market Conduct Examination Section per-forms exams of insurance companies operating inthe state to ensure equitable treatment of policy-holders. The department director can call for a mar-ket conduct examination at any time. Market

conduct examiners review insurers’ operations, in-cluding marketing, claims handling, policies andrates. If violations of the laws are detected, the di-rector may issue an order requiring future compli-ance. For some violations, the director may alsorequire the insurance companies to pay restitutionto Missouri citizens, either through re-adjudicationof claims or re-evaluation of the premium chargedfor the policy and/or a fine or penalty. In 2006, con-sumer recoveries totaled over $9.6 million.

The original statute governing credit unionswas passed by the state legislature in 1927. Thisenactment gave the secretary of state charteringauthority and required that all amendments to thebylaws be approved by that office. Effective Au-gust 13, 1972, these powers were transferred tothe commissioner of finance.

The Omnibus State Reorganization Act of1974 removed credit unions from the jurisdictionof the Division of Finance. On July 1, 1974, theDivision of Credit Unions was created and allpowers, duties and functions were transferredfrom the commissioner of finance to the directorof the Division of Credit Unions. This agency isunder the Department of Insurance, Financial In-stitutions and Professional Registration and has adirector who is nominated by the department di-rector and appointed by the governor with the ad-vice and consent of the Senate.

The Credit Union Commission was created in1998. The commission determines appeals fromcertain decisions of the director of the Division ofCredit Unions, approves or disapproves regula-tions proposed by the director, and consults withand advises the director on matters pertaining tothe organization, operation and supervision ofcredit unions. The bipartisan commission is com-prised of seven members; four must have certaincredit union experience, two must be individualsnot involved in the administration of a financialinstitution and one must be an attorney.

The Division of Credit Unions is the regula-tory agency responsible for the examination, su-pervision, chartering, merger and liquidation ofall state-chartered credit unions. The division alsoresponds to consumer requests or complaints inregard to credit union services or operations.

A director, deputy director, chief examiner, 10examiners and three administrative personnelstaff the division. Examiners are located in KansasCity, St. Louis and Jefferson City. The entire cost of

the agency is reimbursed to the state through feesand assessments paid by the credit unions.

The division is an accredited agency throughthe National Association of State Credit UnionSupervisors.

The National Credit Union Administration, anagency of the federal government, insures allmember deposits.

As of December 31, 2006, Missouri rankedeighth in the nation in the number of state-char-tered credit unions. The Division of Credit Unionscurrently regulates 143 credit unions with assetsexceeding $8.5 billion. There are approximately1.2 million members of Missouri credit unions.

Missouri state-chartered banks, trust companies,savings banks and savings and loan associationsbe examined for safety and soundness at leastonce every 18 months. The division also licensesand examines consumer credit companies, creditservices organizations and money order compa-nies.

State-chartered banks were under the jurisdic-tion of the secretary of state from 1895 until1907, when the General Assembly created theState Banking Department. Over the years, theagency was renamed the Division of Finance andis now an agency within the Department of In-surance, Financial Institutions and ProfessionalRegistration.

The State Banking Board, a quasi-judicialbody, was created in 1955 to handle appeals fromcertain decisions and orders of the commissionerof finance. The bipartisan board is comprised offive members: two must be non-bankers, onemust be a lawyer and two must be experiencedbankers. The Savings and Loan Commission, cre-ated in 1957, serves a similar function for state-chartered thrift associations. This bipartisancommission is also comprised of five members,one of whom must be a lawyer.

The Division of Finance has 25 administrativeand clerical employees in the Jefferson City officeand a total of 68 field examiners – 54 bank exam-iners, 10 consumer credit examiners and fourtrust examiners. Field offices are maintained inKansas City, St. Louis, Columbia, Springfield andSikeston.

The entire cost of the division’s operations isfunded through assessments paid by state-char-tered banks, trust companies, savings banks, andsavings and loan associations and fees paid by li-censees.

Banking in MissouriMissouri ranks fifth in the nation in the number

of state-chartered commercial banks. As of De-cember 31, 2006, the Division of Finance (pur-suant to Chapters 361 and 362, RSMo) supervised304 state-chartered banks and trust companieswith combined total assets of $65.2 billion. Dur-ing the 2005—2006 biennium, the division ap-proved charters for 10 new banks. The number ofstate-chartered banks decreased by 15 during theperiod as a result of six mergers into other statebanks, seven mergers into out-of-state banks, onenon-deposit trust company merger into an out-of-state bank and the dissolution of one non-deposit

trust company. The deposits in all Missouri state-chartered banks and trust companies are insuredby the Federal Deposit Insurance Corporation;savings banks and savings and loan associationsare also federally insured.

Branching and Interstate BankingFor most of the 20th century, Missouri was a

unitary banking state and branching developedgradually as laws were changed over the last 45years. Interstate barriers have also fallen and,since June 1, 1997, banks in Missouri have beenable to merge with banks in other states. The Di-vision of Finance has entered into arrangementswith other regulators to examine banks with inter-state branches.

Savings and Loan SupervisionThe Division of Savings and Loan Supervision,

created in 1895, was merged into the Division ofFinance effective July 6, 1994, in accordancewith the provisions of House Bill 1165. This billtransferred the supervision of state chartered sav-ings and loan associations as well as the licensingof mortgage brokers to the Division of Finance.

As of December 31, 2006, there were six sav-ings and loan associations with total assets of$413 million.

Mortgage BrokersThe mortgage broker law, Section 443.800 et

seq., RSMo, was substantially amended in 1995;and currently there are 626 active licensees. Bro-kers are subject to surety bond and net worth re-quirements. A five-member Residential MortgageBoard approves regulations and hears appealsfrom the commissioner’s decisions.

Consumer CreditThe consumer credit section supervises institu-

tions licensed pursuant to state law (Chapters 364,365, 367 and 408, RSMo) to engage in consumerlending, payday lending (making unsecured loansof $500 or less), automobile title lending, retailcredit financing of motor vehicles and other goodsand the financing of insurance premiums. Thestatutes give the commissioner authority to issuenecessary regulations and examine for compliancewith consumer protection laws. This unit also en-forces the Sale of Checks Law (Sections 361.700 etseq., RSMo), which provides for the licensing ofcompanies which issue money orders or electron-

Mission:

It is the mission of the Division of ProfessionalRegistration to serve and protect the public byproviding an accessible, responsible and ac-countable regulatory system that:

• Protects the public from incompetency, mis-conduct, gross negligence, fraud misrepresen-tation or dishonesty;

• Licenses only qualified professionals by ex-amination and evaluation of minimum com-petency;

• Enforces standards by implementing legisla-tion and administrative rules.

The Division of Professional Registration wascreated by the Omnibus Reorganization Act of1974. The division, within the Department of In-surance, Financial Institutions and ProfessionalRegistration, is charged with protecting the publicby licensing qualified professionals, appropriatelyenforcing standards and maintaining an opencommunication network with the over 400,000 li-censees in order to encourage the development ofprofessional services throughout the state. The li-censing entities within the division provide theconsumer an accessible, responsible and account-able regulatory system. The division has a directorwho is appointed by the Governor with adviceand consent of the Senate.

The staff of the division provides services toeach of the agencies with respect to the collectionof fees, purchasing and disbursement, buildingand equipment management, budget and legisla-tion preparation and accounting for all license re-newal activities. The 38 regulatory agencies withinthe division are charged with the responsibility tosafeguard the public interest.

The Missouri State Board of Accountancy wascreated in 1909 and consists of six certified pub-lic accountants and one public member who arenominated by the director of the Division of Pro-fessional Registration and appointed by the gov-ernor with the advice and consent of the senatefor terms of five years. The board meets at leastsix times each year. Officers are elected in June ofeach year.

The Missouri accountancy law protects the in-terests of the citizens of Missouri through the ex-amination, licensure and regulation ofindividuals, limited liability companies, partner-ships and professional corporations engaged inthe practice of public accounting; assures theusers of financial and economic data of an inde-pendent, objective and uniform product basedupon generally accepted accounting principlesand auditing standards; and ensures that the serv-ices are provided by competent and ethical prac-titioners. The Missouri Board for Architects, Profes-sional Engineers, Professional Land Surveyors andLandscape Architects was established in 1941 toprotect the health, safety and welfare of the citi-zens of Missouri against the danger of collapse ofstructures erected for public use. The Office of Athlete Agents was organized asan office under the Division of Professional Reg-istration by the Missouri Legislature in 2004 to li-cense and regulate athlete agents who enter intoan agency contract with a student athlete or di-rectly or indirectly recruits or solicits a studentathlete to enter into an agency contract.

The Office of Athletics was established in1983 and has general control and supervision ofall professional boxing, wrestling, kickboxing andfull contact karate contests held in the state andis empowered to make and publish rules and reg-ulations governing the conduct of these sports.

The office investigates and processes all ap-plications for licenses.

Upon satisfactory proof that applicants arequalified, the office grants licenses to promoters,contestants, matchmakers, managers, referees,judges, timekeepers, announcers, seconds andphysicians.

A permit is granted for each event allowingthe contest to be held under the supervision ofthe Office of Athletics rules and regulations. Theoffice collects the permit fees and license fees aswell as assesses a tax of five percent of the grossreceipts on all contests.

The State Board of Chiropractic Examiners,created in 1927, consists of six members submit-ted by the director of the Division of ProfessionalRegistration and appointed by the governor withthe advice and consent of the senate. The mem-bers, five licensed chiropractic physicians and onepublic member, serve terms of four years.

It is the duty of the board to administer andenforce the chiropractic practice act and issue li-censes to persons entitled to practice chiroprac-tic under the provisions of the law. Boardmeetings are usually held four times annually.

The board is funded by fees derived from newand renewed licenses. There are over 1,800 chi-ropractic physicians currently licensed by theboard.

To qualify for license renewal, chiropracticphysicians must earn 24 hours of board-approvedcontinuing education, four hours of which mustbe in x-ray, four hours in differential or physicaldiagnosis and four hours in risk management. Theboard certifies qualified chiropractic physiciansto perform meridian therapy, acupuncture or acu-pressure (MTAA). To retain the certification, thechiropractic physician must earn 12 hours of an-nual continuing education in MTAA approved bythe board.

The board also certifies qualified chiropracticphysicians as insurance consultants. To retain thecertification, the chiropractic physician must earn12 hours of annual continuing education in in-surance claims review.

The State Board of Barber Examiners was cre-ated by an act of the Legislature approved May 5,1899, titled, “An act to establish a board of ex-aminers for barbers to regulate the occupation ofa barber in Missouri to prevent the spreading ofcontagious diseases.” The board functioned as thelicensing and regulatory agency for all persons in-volved in the practice of barbering in this stateand derived its authority from Chapter 328,RSMo.

The licensing of cosmetologists began in 1929as a result of HB 650, which required the regula-tion of the occupation of hairdressers, cosmetol-ogists and cosmeticians. The State Board ofCosmetology was established by law in 1956through SB 430 for the purpose of regulating thepractice of cosmetology and, effective August1995, esthetics. The board functioned as the li-censing and regulatory agency for all persons in-volved in the practice of cosmetology in this stateand derived its authority from Chapter 329,RSMo.

On August 23, 2005, Senate Bill 280 waspassed by the 93rd General Assembly that abol-ished the cosmetology and barber boards‘ respec-tive duties and responsibilities by merging theboards and creating and establishing the Boardof Cosmetology and Barber Examiners” for the

purpose of licensing all persons engaged in thepractice of cosmetology, manicuring, esthetics,and barbering; and to fulfill all other duties andresponsibilities delegated by Chapters 328 and329, RSMo, as it pertains to barbers and cosme-tologists. The duties and responsibilities of theboard of cosmetology and barber examiners didnot take full force and effect until the governorappointed the members of the board and the ap-pointments were confirmed by the senate onApril 19, 2006. The first combined meeting washeld in May of 2006.

The combined board is comprised of 11members, who are United States citizens andwho have been residents of this state for at leastone year immediately preceding their appoint-ment. Of these, three shall be licensed cosmetol-ogists holding a “Class-CA” license classification,one shall be an accredited cosmetology schoolowner as defined in section 329.010 RSMo, oneshall be the owner of a school licensed undersubsection 1 of section 329.040 RSMo, one shallbe a cosmetologist with a license of any type ofcosmetology classification, three shall be licensedbarbers and two shall be voting public members.All members, except the public members and theaccredited cosmetology school owner member,shall be cosmetologists and barbers duly regis-tered as such and licensed under the laws of thisstate and shall have been actively engaged in thelawful practice of their profession for a period ofat least five years immediately preceding their ap-pointment.

Annually, the board elects one of its membersas president, one vice president, and one secre-tary with the limitation that no single professioncan hold the positions of president and vice pres-ident at the same time. The board meets regularlysix times each year as well as holds any specialmeetings that are deemed necessary.

Section 329.025, RSMo sets forth the board’sauthority to promulgate rules necessary to carryout the duties and responsibilities designated byChapters 328 and 329, RSMo. These rules in-clude, but are not limited to, the inspection ofbarber and cosmetology establishments and set-ting the fee amounts at a level sufficient to pro-duce revenue that does not substantially exceedthe cost and expense of administering Chapters328 and 329, RSMo. The board is self-sustaining.It generates the necessary funds through the col-lection of fees for the issuance of new licenses,renewal of licenses and other fees paid by the77,419 barber and cosmetology licensees.

The board’s mission is to protect the public’shealth, safety and welfare by ensuring that onlyqualified persons are examined and licensed topractice barbering and cosmetology, as well as tostrive to reduce the number of instances of in-competent, negligent, fraudulent or dishonest

services provided by licensees regulated by Chap-ters 328 and 329 RSMo.

The Missouri Dental Board was created by theGeneral Assembly in 1897. It consists of five den-tists, one public member and one dental hygienemember appointed for five-year terms. Membersare nominated by the director of the Division ofProfessional Registration and appointed by thegovernor with the advice and consent of the sen-ate. The board is self-sustaining through originallicense, renewal and other fees paid by dentists,specialists and dental hy gien ists.

One of the primary functions of the board isexamination for competency of candidates whowish to become licensed as dentists, dental spe-cialists or dental hygienists. The Missouri DentalBoard is a participating member of the CentralRegion Dental Testing Service (CRTDS) and theWestern Regional Examining Board (WREB).CRDTS and WREB give a clinical examination,which is accepted by each member state. Appli-cants for original licensure who wish to practicein Missouri must pass the CRDTS or WREB re-gional examination or a state or regional entry-level competency examination approved by theboard as well as apply to the Missouri DentalBoard. The board also issues licenses by creden-tial verification to qualified applicants who havebeen licensed in another jurisdiction.

The board is responsible for the enforcementof Chapter 332, RSMo. The board responds toconsumer complaints, and investigates and bringsformal complaints against licensees who violatethe dental law or rules and regulations of theboard. The board also brings actions against per-sons practicing dentistry or dental hygiene with-out a license and may promulgate rules andregulations necessary to enforce Chapter 332,RSMo.

The State Committee of Dietitians was estab-lished in 1998 by an act of the General Assemblyto license individuals who wish to use the title“Licensed Dietitian” or “L.D.” In 2004, the Gen-eral Assembly established mandatory licensurefor anyone practicing as a dietitian. The commit-tee is composed of five dietitians and one publicmember. Committee members are nominated bythe director of the Division of Professional Regis-tration and appointed by the governor with theadvice and consent of the senate.

The committee is responsible for reviewingapplications for licensure, determining accept-able education and experience, reviewing com-plaints and imposing discipline if cause exists.

The committee participates in the Clearing-house on Licensure, Enforcement and Regulation(CLEAR).

The board was created in 1895 by an act ofthe General Assembly. In 1965, the legislaturepassed a bill licensing funeral directors as well asembalmers and changed the name of the board tothe State Board of Embalmers and Funeral Direc-tors. The board also has statutory oversight of pre-need providers and sellers with regard to anycontract or other arrangements whichrequires pre-payment of money or property inconsideration for the final disposition of a deadhuman body. The board licenses funeral directors,embalmers, and funeral establishments. Theboard also registers preneed providers and sell-ers. The board consists of six members, includingone voting public member. Members of the

board are nominated by the director of the Divi-sion of Professional Registration and appointedby the governor for a five-year term, with the ad-vice and consent of the senate. No more thanthree members of the board may belong to thesame political party. Annually, the board holds anelection for chair, vice chair and secretary, eachof whom serves for one year.

The board is governed by Chapters 333 and436, RSMo. The board’s regulations can be foundin 20 CSR 2120.

Meetings are held at least three times per year.Examinations are given throughout the year ondates designated by the board.

The board is entirely self-sustaining by meansof fees, derived from new licenses issued andthrough renewal of licenses of embalmers, fu-neral directors and funeral establishments.

The board is a member of the InternationalConference of Funeral Service Examining Boards(Conference) and the Federations of Associationsof Regulatory Boards (FARB). The board partici-pates in the National Funeral Directors Associa-tion (NFDA), Missouri Funeral Directors andEmbalmers Association (MFDEA) and the Clear-inghouse on Licensure, Enforcement and Regula-tion (CLEAR).

The Office of Endowed Care Cemeteries wascreated in 1990 by an act of the 85th General As-sembly and is funded from fees associated with li-censure and fees derived from the issuance ofvital records.

The office establishes the rules for the qualifi-cations and expectations of endowed care ceme-teries; develops and enforces standards forendowed care cemeteries; establishes fees tocover the cost of administering the Endowed CareCemetery Act; audits cemetery trust funds; inves-tigates complaints; and recommends prosecutionfor cemeteries found in violation of the standards,rules or the Endowed Care Cemetery Act.

An endowed care cemetery is defined as acemetery or section of a cemetery, which repre-sents itself as offering endowed care and whichcomplies with the provisions of sections214.270—214.410, RSMo.

The office is a member of North AmericanCemetery Regulators Association (NCRA) andparticipates in the Clearinghouse on Licensure,Enforcement and Regulation (CLEAR).

The Missouri Board of Geologist Registrationwas established with the passage of Senate Bill649 during the 1994 legislative session. The Ge-ologist Registration Act requires licensure for in-dividuals engaged in the practice of geologyhaving an impact upon public health, safety andwelfare as defined by law.

The board is composed of five practitioners,with four members representing different geologicspecialties and the fifth practitioner employed bythe state, a city or county. The board includes twopublic members as well as the state geologist whoserves as an ex officio member. The State Board of Registration for the HealingArts was created in 1939 by the General Assem-bly in an act codified as Chapter 334, RSMo. Thisact established a bipartisan board of nine mem-bers, five of whom shall be doctors of medicine,two of whom shall be doctors of osteopathy anda public member. The members are nominated bythe director of the Division of Professional Regis-tration and appointed by the governor with theadvice and consent of the senate. Each memberis appointed for a term of four years.

Among its duties, the board is responsible forthe examination and licensure of individuals to

practice as physicians and surgeons and to annuallyregister each person who is licensed. Professional physical therapists, physical ther-apist assistants, speech-language pathologists, au-diologists, speech-language pathology aides,speech-language pathology assistants, audiologyaides, physician assistants, athletic trainers, clin-ical perfusionists and anesthesiologist assistantsare health professionals who are also licensedand regulated by the board.

The General Assembly created the AdvisoryCommission for Anesthesiologist Assistants in2003. Members of this commission, appointed bythe governor with the advice and consent of thesenate, are responsible for advising the board onthe licensure and regulation of anesthesiologistassistants.

The board is composed of eight members: fivehearing instrument specialists, one otolaryngologist,one voting public member and one audiologist hold-ing a certificate of clinical competence and licensedpursuant to Chapter 345, RSMo. The State Board of Optometry was created in1921 by an act of the 51st General Assembly. Theboard consists of five doctors of optometry andone public member. The State Board of Pharmacy was establishedby the General Assembly in 1909. The board con-sists of seven members, six of whom must be li-censed pharmacists in good standing and actively

The pharmacy law has been amended at var-ious times to meet the needs and requirements ofthe profession. During the 66th General Assem-bly, a drug store or pharmacy law was enactedgranting the board power to license all drugstores, pharmacies, apothecary shops andchemist shops in the state. Eight inspectors assistin enforcing the law with their salaries and travelexpenses set by the board.

Organization of the board is held annuallywith the election of a president and vice presi-dent, both of whom must be board members.

The board annually issues 7,700 renewals toregistered pharmacists and permits to some 1,800pharmacies in the state. In addition, the board an-nually issues 400 renewals to non-resident phar-macies as well as 1,200 renewals to drugdistributors.

The board also licenses intern pharmacistsand renews approximately 1,200 intern pharma-cist licenses annually. The board issues temporarylicenses to pharmacists who are licensed in an-

As of January 1, 2005, all podiatrists who de-sire to perform ankle surgery are required to meetadditional residency and continuing medical ed-ucation requirements.

The board is funded entirely through fees de-rived from new and renewed licenses. To qualifyfor renewal, licensees must have fulfilled the re-quirements of at least twenty-four hours of ap-proved continuing medical education creditduring the two-year period preceding renewal.Podiatric physicians with ankle surgery certifica-tion must complete fifty hours of approved con-tinuing medical education preceding renewal.

The Missouri Real Estate Commission was cre-ated by an act of the 61st General Assembly andapproved by the governor on July 31, 1941.

Board members are nominated by the directorof the Division of Professional Registration andappointed by the governor with the advice andconsent of the senate. The commission consistsof seven voting members. Six of those membersmust have at least 10 years experience as real es-tate brokers. A public member serves as the sev-enth member. Each commissioner is appointedfor a five-year term.

Under the provisions of the Real Estate Act, noreal estate broker or salesperson may act as suchwithout first procuring a license from the commis-sion. Other responsibilities include investigatingcomplaints generated by consumers against theacts of a real estate licensee and auditing real es-tate escrow accounts to verify proper handling ofbuyers’ earnest money. The commission also ap-proves all real estate pre-examination and contin-uing education courses. The commission meetsregularly to review complaints, investigations andaudits and to take up other matters. The MissouriReal Estate Commission may perform duties nec-essary to carry out the provisions of the real estatelicense law.

The State Committee for Social Workers wasestablished with the passage of Senate Bill 246during the 1990 legislative session. The commit-tee consists of six licensed clinical social workers,two licensed baccalaureate social workers andone public member nominated by the director ofthe Division of Professional Registration and ap-pointed by the governor with the advice and con-sent of the senate.

The committee is responsible for promulgat-ing rules, licensing applicants, responding to con-sumer complaints, and disciplining the licensesof individuals who violate the practice act. Thecommittee also determines the requirements forlicensure and establishes the ethical standards forlicensed social workers.

The committee is a member of the Associa-tion of Social Work Boards (ASWB) and partici-pates in the Clearinghouse on Licensure,Enforcement and Regulation (CLEAR).

The office/division is responsible for enforc-ing sections 324.520–324.524, RSMo. Rules andregulations have been implemented relative tothe hygienic practices of tattooing, body piercingand branding, and sanitary operations of tattoo,body piercing and branding establishments.

The office/division is further responsible forreviewing applications, conducting inspectionsof the establishments, reviewing complaints andimposing discipline if cause exists.

The Missouri Veterinary Medical Board wascreated in 1904 and consists of five licensed vet-erinarians, one of whom is the state veterinarianwho serves as an ex officio member of the board,and one public member. The board is nominatedby the director of the Division of ProfessionalRegistration and appointed by the governor withthe advice and consent of the senate for terms offour years. No more than three members of theboard may belong to the same political party.

The Missouri Veterinary Medical Practice Act,revised in 1992, protects the citizens of the statethrough the examination, licensure and regula-tion of doctors of veterinary medicine and veteri-nary technicians. It authorizes the board torespond to consumer complaints and investigateand file formal complaints against licensees whoviolate the law.

The board appoints a Veterinary TechnicianExamining Committee, consisting of two veteri-narians, two veterinary technicians and the exec-utive director, to administer the examinations forregistration for veterinary technicians.

The board is entirely self-sustaining by meansof fees derived from issuance of new licenses,registrations and facility permits and the annualrenewal of those licenses and permits.

The board is a member of the American Asso-ciation of Veterinary State Boards and the Feder-ation of Associations of Regulatory Boards(FARB). The board participates in the Clearing-house on Licensure, Enforcement and Regulation(CLEAR).
