    1. SCHEMEI. The scheme is called DDA Housing Scheme, 2010,

    of the Delhi Development Authority.II. The scheme shall remain open from 25-11-2010 to 24-

    12-2010.III. Detail of flats under this scheme is given in annexure A.

    Flats are given on As is where is Basis. All the flats arealready constructed and are ready for occupation.

    2. ELIGIBILITY

    I. The applicant must be a citizen of India.II. He/ She should have attained the age of majority. For

    this an applicant should have completed 18 years of ageas on the date of filling of the application for a flat.

    III. The applicant must not own any residential flat or plotin full or in part on lease hold or free hold basis in Delhi

    / New Delhi/ Delhi Cantonment either in his/ her ownname or in the name of his/her wife / husband or in thename of his / her minor or dependent children.

    IV. Family means spouse (if any), dependent/minorchildren, if any.

    V. Both husband and wife can apply for flats subject tofulfillment of eligibility condition with a stipulation that ifboth are found to be successful only one shall be allottedflat.

    VI. One person can submit one application only.VII. A person who has already been allotted a plot or house/

    flat constructed by the DDA or any other land owning

    department shall not be eligible to apply for another flatunder this scheme.

    VIII. There is no income criterion. The applicant can applyaccording to his/her requirement and affordability.

    IX. The applicant must have an account in any bank andthe particulars must be filled in the application form. Itis assumed that the bank has followed KYC norms ofReserve Bank of India in respect of such Accounts.

    X. Applicant must have Permanent Account Numberallotted under the provisions of Income Tax Act andthe same must be quoted on the application form.

    3. RESERVATIONSThe details of reservations under this scheme are as givenbelow:-

    I. 17.5 % of the flats for persons belonging to ScheduledCastes.

    II. 7.5% for applicants belonging to Scheduled Tribes.If adequate number of applications are not receivedfrom applicants belonging to ST category, remainingflats shall be disposed of in favour of applicantsbelonging to SC category and vice-versa.

    III. 1% for war widows.IV. 1% for physically handicapped persons; andV. 1% for ex-serviceman.

    Notes:a. In case No(s) of flats in respect of reserved category

    comes to fraction i.e. less than 0.5 it would berounded off to zero and if it is 0.5 or more it would berounded off to one.

    b. In case of application preferred in joint name underSC or ST reserved category, the joint applicantshould also belong to the same category or shouldbe in the blood relation or should be within the family

    as defined in Para 2.IV.c. In case of application preferred in joint namesunder War Widows, Physically Handicapped, Ex-serviceman reserved category, the joint applicantsshould be from within the family as defined in Para2.IV or should be in the blood relation.

    d. If requisite number of applications are not receivedfrom the above mentioned five categories, allremaining flats shall be offered to the persons of non-reserved categories.

    4. HOW TO APPLYI. The applicant applying for a flat under this scheme shall

    have to deposit the registration money of `1,50,000/-or`50,000/- (Janta/ORT only) as the case may be bya Single Bankers Cheque/ Demand Draft of any bankdrawn in favour of DDA Housing payable at Delhi/New

    Delhi. Applicants using downloaded form need to depositseparate draft/ banker cheque of`105/- (`100/- cost ofform +`5/- D-Vat) in addition to`1,50,000/- or`50,000/-(Janta/ORT only) as the case may be. This BankersCheque/Demand Draft has to be presented along withthe application form completed in all respects on theprescribed form at one of the prescribed bank branchesas mentioned in annexure B, on working days during thecurrency of the scheme. Duly filled up application canalso be sent by registered post addressed to the Branch

    Managers of nodal bank branches as mentioned inannexure B to reach not later than 15 days before thelast date of closure of the scheme. The envelope shouldbe clearly marked Application under DDA HousingScheme 2010. Payment by cheque, Multiple BankersCheque/ Demand Draft will not be accepted with theapplication form.

    II. Application forms will not be accepted after date ofclosure, in case it is found at any stage that the issuedate of payment instrument is after the closure of thehousing scheme, such applications would be summarilyrejected and the applicant would be solely responsiblefor this, DDA would not entertain any such application indraw of lots.

    III. The applicant may give one or more preferences of his/her choice by writing locality codes, given in AnnexureA, in appropriate box and put a cross (x) against thepreferences not exercised. It is presumed that applicanthas seen the locality before giving preference. If anybox is left blank or preferences are not given inprescribed locality codes, form would be consideredincomplete and would be rejected. No preference forsector/ pocket/ floor can be exercised by the applicantand no request for change of sector, pocket or floor shallbe entertained by the DDA.

    IV. The application form should be signed only by theapplicant himself, who wants to get a flat under thisScheme. No applicant should make any cutting, erasingor overwriting in the application. In case a person desiresto make changes, it is advised to obtain and fill up a freshapplication.

    V. No conditional application form will be considered.Incomplete application forms shall be rejected summarilywithout conveying any reason to the applicant.

    VI. Persons holding a registration with DDA under any of its

    other schemes can also apply under this scheme. They,however, have to make payment of Registration Amountof the scheme in full. They should separately make awritten request for withdrawal of Registration Depositof the earlier scheme once they are successful in thisscheme.

    5. DOCUMENTS TO BE SUBMITTEDI ALONG WITH APPLICATION FORM(A) FOR ALL CATEGORIES(i) Self attested Copy of PAN (Permanent Account Number),

    allotted by Income Tax Department.(ii) Proof of residence e.g. self attested copy of passport

    or identity card or election card or ration card or drivinglicense or telephone bill or electricity bill or water billor house tax receipt or bank pass book (page carryingname and address) or CGHS card.

    (iii) Self attested copy of bank Pass Book/ Statement ofaccount mentioned in the application form.

    (B) FOR RESERVED CATEGORYIn addition to (A) above, persons applying under any of thereserved categories have to submit:-(i) An attested copy of the original certificate from the

    District Magistrate/Sub Divisional Magistrate of the areaconcerned in case the applicant belongs to the ReservedCategory of SC/ST.

    (ii) An attested copy of the original certificate issued by theMedical Board of a Govt. Hospital in case the applicantis applying under the reserved category of physicallyhandicapped persons.

    (iii) An attested copy of Discharge Certificate from thecompetent authority of Ministry of Defence / Dept. ofDefence in case of Ex-serviceman.

    II. FOR POSSESSION OF FLAT

    Applicant to submit:a. Copy of Bank account Pass Book/Bank Statement duly

    attested by the Bank Manager from which the Allotmentmoney has been deposited alongwith Payment proof.b. Conveyance deeds duly stamped from the office of

    collector of stamps. Blank Conveyance deeds would besent to allottees alongwith the demand letter.

    c. Affidavit as per proforma given in Annexure-C, D & E.d. Undertakings as per proforma given in Annexure-F & G.e. Duly filled possession letter in quadruplicate given in

    Annexure-H.f. Photograph and three signatures of self and wife, if any,

    duly attested as per proforma given in Annexure- I.g. Identity proof and address proof.h. Self Attested Copy of PAN Card as mentioned in the

    application.

    MODE OF ALLOTMENT

    All the eligible applicants shall be considered for allotment

    through a computerized draw based on random numbertechnique. The draw shall be held in the presence of panel ofobservers.

    RESULT OF ALLOTMENT

    I. The results of the draw shall be displayed on the NoticeBoard of DDA at Vikas Sadan, D-Block, INA, NewDelhi-23. In addition the result shall be displayed on thewebsite of DDA with the address http://www.dda.org.in.The result will also be published in the leading NationalNewspapers.

    II. The allotment-cum-demand letters will be dispatchedthrough Speed Post/Courier/Registered Post but it shallbe the sole responsibility of the applicant to check theresult of the draw if he/she does not get informationdespite the afore mentioned means. In case applicanthas given address of a place/office, where entry (of

    courier) is restricted, all communication includingdispatch of refund cheque/ demand letter on failure ofcourier would be through available mode. Applicant isadvised to contact nodal officer of the bank as given inAnnexure B in such cases. DDA/Banks in such caseswould not be responsible for delay/ non receipt ofcommunication by applicant/allottee.

    III. A separate waiting list of 600 applicants will also bedeclared in order of priority. The waiting list will be validonly for 9 months from the date of issue of demandletters to successful applicants. The registration moneyof the wait listed registrants shall be refunded alongwith unsuccessful registrants. However, before goingfor the draw in case the same takes place for filling upthe vacancies, all such eligible waitlisted shall be askedto deposit the registration money. 15 days time shallbe given to them to do so and only those names shall

    be included who would be depositing their registrationmoney prior to the draw. A draw will be held only onceafter six months, from date of issue of demand letters,for allotment of the surrendered flats to the wait listedregistrants as per the priority decided initially. Only thoseflats which are surrendered within six months from dateof issue of demand letters would be included for allotmentto waitlisted registrants. The waiting list is created just toensure that the surrendered flats (if any) are allotted tosame registrants rather than keeping them vacant andthe list will be valid only for 9 months, hence it doesntcreate any right of the wait listed registrants if they fail toget a flat from the surrendered ones. If successful, thecost would be the cost of the flat on the date the demandcum-allotment letter is issued.

    8 STATUS OF ALLOTTEEAll allotments shall be made on free hold basis. However,the title shall be transferred only when conveyance deed isexecuted in favour of the allottee and is registered in the officeof Sub-Registrar.

    9. INTEREST ON REGISTRATION MONEYI. No interest will be paid if the draw is held within four

    months from the last date of closure of the scheme incase of successful applicants.

    II. In case of unsuccessful applicants, no interest will bepaid, if the amount is refunded within four months fromthe last date of the closure of the scheme.

    III. In case registration money is not refunded within fourmonths from the closure of the scheme, in case ofunsuccessful applicants, simple interest @ 5% p.a. willbe paid on the registration money for the period beyondfour months after the closure of the scheme up to the lastdate of the preceding month in which refund has beenmade.Illustration: In case four months period expires on24th April, interest as per this clause would be duefrom 1st May i.e. after the last date of the month inwhich refund has been made.

    IV. Applicants not getting refund within one month fromholding the draw are advised to contact the nodal branchof the bank in which application was deposited. DDA willnot pay any interest in case of postal delay or applicant

    not available at given address or in case of incompleteaddress.

    10. REFUND TO UNSUCCESSFUL APPLICANTSI. DDA will refund the registration money through the nodal

    branch, as indicated in Annexure B, of the Bank whereinthe allottee had deposited the application form. Theconcerned Bank shall be responsible for the dispatch ofrefund cheques to the unsuccessful applicants. The bankshall bear the responsibility for any loss on this account.DDA or the bank will not entertain any application forrefund, loss/mutilation, and non-encashment of refundcheque one year after the closure of the scheme.

    II. For getting refund, the applicant has to clearly mentionhis/her bank account number. In case the application isin joint name, refund will be made in the name of the firstapplicant only and, therefore, only his/her bank accountnumber should be given. This account number and bankparticulars will be printed on cheque, hence applicantshould carefully fill these particulars in the Form.Note: In case the application money has beenpaid from the account of the firm/company etc. ofthe applicant, still for the purpose of refund, theapplicants banking details have to be provided asthe same would be printed on refund cheque and incase of mismatch of account number and payeesname, the bank would not clear the instrument. Inorder to avoid situation, it would be appropriateto recheck this column before submitting theapplication.

    III. Applicant is advised to enclose one cancelled chequeof the account in which he wants refund money to becredited, in case refund is given through ECS, at theoption of the bank, for faster refund.

    IV. In case applicant has given address of a place/office,

    II. Following documents are to be submitted for refund incase of Surrender/Cancellation:a. Original allotment-cum-demand letter issued by

    DDA in respect of allotted flat.b. Proof of residence in case there is change of

    address as given in the application form.

    c. Photocopy of passbook or bank managers/ incharge certificate in case there is change in bankparticulars from as given in the application form.

    Note: In case flat is cancelled automatically as statedabove, Refund will be made after deduction ofcancellation charges as stated above and nointerest would be paid on amount deposited.

    12. DISPOSAL COST OF THE FLATSa) The tentative disposal cost of the flats is given at

    annexure A. The above cost includes land premium,cost of construction and 20% surcharge on landpremium and cost of construction in case of flats situatedin South Delhi/ Motia Khan. Cost of furnishings andfittings in case of flats at Vasant Kunj and one timemaintenance charges in case of newly constructedflats. Cost of construction includes departmentalcharges and interest during construction period. The

    land premium is normally revised every year on first Aprilwhile cost of construction is revised twice during the yearon every 1st October and 1st April. The variation in costwithin category is due to variation in plinth area of theflats. There may be some more flats added or deleted (atthe discretion of DDA). If the area changes, the cost ofnewly added flats will change accordingly.For furnished apartments situated at Vasant Kunj,the cost includes cost of furnishing, fittings, electricalinstallations and other items provided with the apartment.The final cost may increase/ decrease due to final billingof these items; therefore, the disposal cost may changeon such account.For the new housing pockets, DDA would providemaintenance of common areas for 30 years as perschedule tabulated below:

    21. MIS-REPRESENTATION OR SUPPRESSION OF FACTSIf it is found that the applicant has applied although he was not

    eligible as per conditions laid down in para 2 of this brochureor has claimed benefit of reservation on the basis of wrongdocuments or has submitted more than one application as givenin para 2(IV, V & VI) or has given false affidavit/ informationincluding quoting wrong PAN number or suppressed anymaterial fact whether at the time of application or at the time oftaking over possession or at the time of execution of conveyancedeed, the application(s)/allotment(s) will be rejected/cancelledsummarily without issuing any show cause notice for the same.In case of such cancellation/rejection, amount of registration/earnest money deposited against application(s) shall beforfeited.

    22. PREFERENTIAL ALLOTMENT(i) 1% reservation in allotment of flats will be provided to

    the persons with disability as defined in Section 2 of thePersons with Disabilities (Equal Opportunities, Protectionof Rights and Full Participation) Act, 1995.

    (ii) Allotment of flats to persons with disability will be madeat Ground Floor.

    (iii) The allotment of DDA flats to persons with disability wouldbe on hire purchase basis. The initial payment in case ofhire purchase allotment would be 25% instead of 50% ofthe total cost applicable for general category. Rest of theamount would be taken in monthly installments over aperiod upto 15 years.

    (iv) 5% rebate in the cost subject to a maximum of `1.00lakh will be given to the persons with disability, whoare allotted flats under the above quota. The remainingconditions of allotment will remain the same. Theconveyance deed papers will be executed in the nameof original allottees only.

    (v) In order to ensure that the concessional provisionsmeant for the persons with disability do not lead tomisuse or speculation, it has also been decided that theletter of allotment of such flats would specifically statethat alienation of possession of the flat prior to 15 yearsfrom the delivery of possession to the allottee wouldresult in automatic cancellation of the flat and under nocircumstances such cancellation would be withdrawn.In addition, the conveyance deed for all such caseswould also include the following specific clause whichwould be included in the letter of allotment itself and theallottee should by way of affidavit specifically agree tothe same being a part of the conveyance deed before thepossession of the flat is delivered to the allottee.THE PROPOSED CLAUSE WOULD BE AS FOLLOWSThat the allottee/vendee specifically agrees that heshall not part with possession of the whole or any partof the flat at any time prior to the expiry of 15 years fromthe date of actual delivery of possession thereof by theVendor to the allottee/vendee and to that limited extent,the title in the property shall be deemed to continue to

    vest in the vendor. It is further specifically agreed that incase the allottee/ vendee violates terms of the presentconveyance deed, the entire conveyance deed shall bedeemed to be void and in that eventuality, the vendorshall be entitled to take back possession of the demisedproperty from the allottee/ vendee.In case the allottee/vendee dies prior to the expiry of thestated period of 15 years, his/her legal representativesand heirs shall be bound to honour the stated condition,but shall be entitled to occupy the said flat.

    (vi) The concession shall be applicable to persons who comewithin the meaning of disability as defined in the Personswith Disabilities (Equal Opportunities, Protection ofRights and Full Participation) Act, 1995 and duly certifiedby a Medical Board.

    (vii) The permissible benefit under this clause will begiven only to those applicants who have been
