(~: ,(jl.., -~ ' - ~ .I .,' No. :m5 - 5 ~ 16, XXJj Heads of Constitutional Bodies, Departments, Bureaus and Offices of the National Government, State Universities and Colleges (SUCs), Gi)vernment-Owned and/or - Controlled Corporations (GQCCs), Government Financial Institutions (GFIs), and AUOthers Concerned TO SUBJECT RECLASsIFICATION OF POSITIONS 1.0 Purpose After consultations were made with the Civil Service Commission (CSC), this Circular is issued to prescribe the guidelines relative to the reclassification of positions m the government. tI 2.0 Coverage, Exemptions and Prohibitions Reclassification of positions shall apply only to filled regular positions in the national government covered by or following the Position C!assification and Compensation System established under RA No. 6758. 2.1 : 2.2 In view of their tenure, casual and contractual positions shall not be reclassified.     3.1.1 Suchreclassification,however,shouldnotresultin a'distortionin thestaffingpatternnor in an unauthorizedchangein organizationalstructureor leveling,notonlywithintheunitwheresaidpositionisdeployed,but also amongequivalentor parallelstructuresin theagency..

    3.1.2 Reclassificationgenerallyinvolvesa changein thepositiontitleandmaybe accompaniedby anupwardor downwardchangein salary'grade.However,if thesalarygradeof thepositionis maintained,thestaffingmodificationandJorpositionclassificationactionisdeemedasretitling,providedthatsuchiswithinthesan1eoccupationalgroup.

    ReclassificatiQnmayalsobeappliedwhen:

    3.2.1 Therearechangesinthelevel/categoryofthegovernmententitywhichwill bearon thelevelof key positions,e.g.,PresidentandVice-Presidentpositionsin.stateuniversitiesandcolleges(SUCs) andGeneralManager,AssistantGeneralManager,andotherManagerialpositionsin LocalWaterDistricts;

    3.2.2 Therearechangesin quantitativefactorsusedin determiningtheappropriatepositionaridlevelin accordancewith existingpositionclassificationstandards,e.g.,coverageof agriculturalfacility forcertainpositionsundertheDepartmentofAgriculture;

    3.2.3 Therearechangesin thepositiontitlesandsalarygradesin theIndexof OccupationalServices,PositionTitlesandSalaryGradesapprovedbytheDBM; and

    3.2.4 The reclassificationof a positionis providedby law or Presidentialauthority.

    3.3 . Thefollowingshallnotbeusedasbasesforthereclassificationofpositions:

    Non-performanceof the regulardutiesand responsibilitiesof apositionbyreasonoftlleincumbent'sinabilityorincompetence;

    3.3.2 Newduties/assignmentswhicharetemporaryinnature;

    3.3,3 Qualificationsof theincumbentexceptthoseenumeratedin Sub-items3.4.1to3.4.3ofthisCircular.

    TheanalystsintheDBM Officeconcernedshallevaluatetherequest.Shouldtherebea needto.validate,clarifyorsupplementinfonnationgatheredfromthePDFs, theagenciesshallassisttheDBM analystin hislherconductofposition/work audit.. .. .

    An agencyshallbe inf~ed of theapprovalof the reclassificationofpositionsthrougha Noticeof Organization,'StaffingandCompensation,Action(NOSCA)orthroughaDBM letter,asthecasemaybe;otherwise,theagencyshallbeinfomiedofthedenialactionthroughaDBM letter.

    A requestfor reconsiderationmaybe.madewithinthirty(30)calend.ardaysafterreceiptoftheNOSCNDBM action..

    Agencieswhichhavebeengnmtedbudgetflexibilitiesby thePB11 mayreclassifyfilledpositionsprovid.edthattheconditionsin item3.5aresatisfied;thatsucharein accordancewiththepositionclassificationstandardsandthatsucharewithintheirbu,dgetmanagementauthorities.Any additionalfundingrequirementshallbesourcedoutof theabolitionof fimdcdvacantpositions.Uponreceiptof thebudgetaryactionsmadebytheagency,theDBM analystconcemedshallevaluatethesame.If foundin order,thecorrespondingNOSCA shallbe preparedto fonnalizethechangein theGMIS.database,subjecttoapprovalof theDBM authoritiesconcerned.TheNOSCA shall,beissuedto theagency.However,if uponreceiptof thebudgetaryactions,thereclassificationactionsmadebyagenciesarenotin order,theDBM reservestherighttomakealterationstherein. .

    4.6 In theimplementationof reclassificationaction,thefollowingsalaryrulesshallapply.

    4.6.1 An employeewhosepositionis reclassifiedwithoutchangein salarygradeshallcontinuetobepaidhispresentsalary.

    4.6.2 If reclassifiedto a positionwitha highersalarygrade,thefollowing. . .salaryrulesonpromotionshallapply:

    4.6.2.1 If thebasicsalaryoftheemployeein his formerpositionisbelow the hiringrate6f the reclassifiedposition,theemployeeshallbeallowedthe1ststeporthehiringrate;

    4.6.2.2 If thepresentsalaryfallsin-betWeensteps,theemployeeshallbeallowedthehigherstep;

    4.6.2.3 If thepresentsalaryis in excessof thema)(imumor 8thStep,theemployeeshallbeallowedtocontinuetoreceivehislherpresentsalarywith theexcessoverthe8thSteptreatedas"transitionallowance"whichshallbededucted. "-fromanyfuturesalaryadjustmentoftheemployee.
