1 MART FY15-17 DBE Goals

Goal Submission for Fiscal Years 2015-2017 New Goals The Montachusett Regional Transit Authority’s (MART) overall goal for the time period FFY2015-2017 (October 1, 2014 through September 30, 2017) is 3.6% of the Federal financial assistance we will expend in DOT-assisted contracts, exclusive of FTA funds to be used for the purchase of transit vehicles. $4,860,064 is the dollar amount of DOT-assisted contracts that MART expects to award between FFY2015 and FFY2017. $1,350,000 is expected to be awarded in FFY2015, $2,665,064 in FFY16, and $820,000 in FFY17. This means that MART has set a goal of expending $176,807.52 with DBEs during the next three fiscal years. We estimate that, in meeting our overall goal of 4%, we will obtain 4% from race-neutral participation and 0% through race-conscious measures.

Proof of Publication MART published a notice announcing the DBE goals that it has established as a part of this program each year in the Fitchburg and Leominster Sentinel and Enterprise, the Worcester Telegram, the Boston Globe, and the Northeast Minority Business News. The notice informed the public that a DBE participation program including DBE goals and a description of how there were developed are available for inspection during normal business hours at the office of the Montachusett Regional Transit Authority for 30 days following the date of said notice, and informing the public that the Department of Transportation and MART will accept comments on the goals for 45 days from the date of notice. The 45 day period was from June 24, 2014 to August 7, 2014. MART did not receive any comments or disputes to our goal. Scanned copies of the legal ads are provided in Attachment A.

Minority/Women Contracting Groups MART reached out to the Twin Cities Community Development Corporation to establish a better relationship with Small Business and Minority Business groups in the region. An open discussion was conducted at the Twin Cities CDC Offices on Main Street in Fitchburg. The CDC invited members to attend, but only two made the meeting – a Minority Business Owner and an employee of the City of Fitchburg Housing Division who is responsible for 3E, MBE & WBE Outreach. Although the group was small, the conversation was productive. The major talking points were as follows:

1) How can we make the certification process easier? Does the SDO have a “Train the Trainer” program that would allow Twin Cities CDC to help the potential DBE’s get through the process? The business owner in attendance went through a 4 hour class 5 years ago given by SDO, then SOMWBA, and never finished the “daunting” paperwork.

2) Is there a central location where businesses can find bidding opportunities which would give them an idea of the potential volume and make it worthwhile to go through the DBE Certification process?

Also MART, as part of the larger group of Massachusetts RTA’s, had an opportunity to inform members of the WTS International, Boston Chapter of the contracting opportunities at their Business Partner Expo last October (2013). WTS Boston’s members were informed about the RTA’s outside of their established relationship with MBTA. This connection was facilitated by Lynn Ahlgren, an independent consultant. MART will bring these specific goals to this year’s conference directly on October 23, 2014.

MART is a member of the North Central Workforce Investment Board and the North Central Massachusetts Chamber of Commerce. MART will continue to use these connections to establish relationships with more minority and women contracting groups.

Goal Construction: Projects The following projects will be completed during the time period of Fiscal Years 2015-2017 and will be accomplished with DOT financial assistance. A short description of each project follows: Misc Facility Rehabilitation Projects – MART will use 5307 funds to accomplish various rehabilitation projects on MART’s facilities. These projects are small jobs ranging from $50,000-$250,000. This doesn’t afford for MART to split the project into prime and sub-contracting opportunities. However the size of the projects does lend naturally to smaller firms, DBE and SBE alike. The following is a summary of those projects by year of expected contracting:

FFY14-15 Projects: • Replace curbing and sidewalk on rail-side of Intermodal Center in downtown Fitchburg. • Repair roof leaking issue and damages cause by said leak in North Pod of Intermodal Center

at 100 Main Street. • Drainage/flood mitigation issue at the Gardner maintenance facility

FFY15-16 Projects: • Resealing of the garage decking at Fitchburg parking garage at 150 Main St • Asphalt repaving of outside parking lot on rail-side of Intermodal Center • Gas tank containment issue at Water Street maintenance facility in Fitchburg • Convert to dry fire suppression system in server rooms at Water Street and Main Street

FFY16-17 Projects: • Rehab stairwells (paint/sealing/light replacement) at Fitchburg parking garage • Enclose canopy catwalk from Fitchburg parking garage to rail platform • Replace/rehab garage doors at Fitchburg maintenance facility

Equipment Purchases: • Computers/Network Support – purchase miscellaneous network equipment such as large

UPS’s and replacement computers and servers will happen in each of the three years. • Support Equipment – purchase operational support equipment such as snowmelter and

related equipment such as a bobcat and dump truck in FFY2015. • Electric charging stations will be purchased for each of MART’s parking facilities in

FY2016. Large Project – MART has one large project for this goal setting period. MART has $3.2M in TEA-21 FHWA funds which were transferred over to FTA that are earmarked for an “Ayer Parking Garage.” This project will be to expand a current surface lot and increase parking from 75 cars to almost 200 cars. This project will include the acquisition of Real Estate around the existing lot (and all the sub-projects that Real Estate acquisition entails), and procurement of A&E services to design the expanded lot and ROW with pedestrian street crossing. The project will culminate with construction to be completed in 2016. Although the construction is just a surface lot, there may be subcontracting opportunities, such as paving or landscaping.

Information Sources MART used two sources to determine the availability of total firms and the number of DBE’s certified in our region.

1. MART is part of a UCP with the Commonwealth of Massachusetts and the Massachusetts Department of Transportation. The Commonwealth’s Supplier Diversity Office (SDO) certifies Disadvantages Businesses and keeps a directory of these businesses on their website which can be downloaded. This is a searchable directory in which DBE certified businesses can be sorted by NAICS code. MART’s DBE Office downloaded this directory, then categorized, sorted and checked for duplicate listings in similar categories. The narrowed directory is included as Attachment C. It was found that Eight Hundred Twenty-Three (822) DBE firms relate to MART in the following categories: Architectural and Engineering (174), Construction – General & Specialty Contractors (338), Construction Materials (43), Computer Services (62), Professional Services (152), Insurance (15), Office Equipment (13) and Other Materials (25).

2. To calculate all Firms within the same geographic region MART used two sources - 2010 Census Data and the 2012 NAICS database. At first it appeared that the Census data only listed grouped categories, which was fine for categories like Construction – but required further breakdown for manufacturing and professional services. However a link to a related census database site (censtats.census.gov) was discovered and followed. This site allows the user to drill down into each category for detailed statistics for each and every NAICS code. The overall statistics for each category for Massachusetts (chosen as MART’s local market) is shown in Attachment D.

Step One: Base Figure In order to determine a base figure for the DBE goal the following methodology was used: MART’s DBELO used an example spreadsheet provided by the RCRO to calculate a weighted DBE base figure for all projects forecasted for the upcoming goal submission period. Each of the projects, as described previously, was entered into a spreadsheet page using an estimate of funds for each NAICS code, relevant to that project, adding up to the project total. Each project sheet is then tied to a base figure calculation summary page for all the projects. This calculation takes the weight of each project times the total of all projects and multiplies it by the Relative Availability of DBE’s to all firms in the local market. This provides a weighted base figure. These calculations are shown in Attachment B. Table 1 (next page) provides a detailed summary of these projects using the following information:

Step Two: Adjustment MART has adjusted its overall DBE goal to 4.5%. MART determined this adjustment by examining the following evidentiary information:

1. Past Participation – Past goal attainment (detailed within the next section) seems much higher than MART’s 4.5% goal (more than double the 2% of the last goal submission period). 5.39% is the median of contract completions over the last 3 years. However the median of contract awards, which is used to judge goal attainment, is much higher at 11.59%. There were 4 years of history considered, but 2013 is removed from consideration due to an unusual circumstance. A subcontract was given by a prime without a change order and not in the year of original award. This subcontract is 32% of that year’s total prime contracting of which only 0.15% ($680) was dispersed to a prime contract. The average of the weighted base figure (3.64%) and the median of past performance is 7.615%. However, a goal adjusted to 7% or higher would be likely to not reach attainment without race conscious measures in FFY16 and FFY17 for the following reason. Nearly $1.5 million dollars was given to a DBE firm, during this past goal attainment period, which is providing customized software on MART’s VTCLI – MOVET project. This project will wrap at the beginning of FFY2015 (December 31, 2014). MART does not anticipate a contract or project of this magnitude or design in the foreseeable future. Therefore contracting opportunities of the past three years are not comparative to the contracting opportunities coming in the next three years. However the first report of the FFY2015 reporting period (6/1/15) will show an unusually high DBE contract award percentage since $400,091, which is part of the $1.5 million previously mentioned, was actually awarded on October 15, 2014 due to a slight delay in negotiations.

2. Disparity Studies – MART researched disparity studies done for the Commonwealth of Massachusetts and could only find one for our state. This study was done by NERA Economic Consulting for a joint effort by the Commonwealth’s Division of Capital Asset Management and the Massachusetts Housing Finance Agency in September 2010. Race, Sex, and Business Enterprise: Evidence from the Commonwealth of Massachusetts: Volume II shows evidence of racial disparity in the market area. The Massachusetts Department of Transportation has undertaken a diversity study that would be more applicable to an agency such as MART; but that study has not been completed at this time. Although not everything in the DCAM study is relevant to MART, the data on construction and design can be used, as well as the statistical disparities in the ability of DBE’s to get financing, bonding, and insurance to participate. The study encourages an upward adjustment to baseline estimates of DBE availability to account for the continuing effects of discrimination on minority and women-owned businesses. The disparity ratio sited in the study for Construction related businesses was 0.6361

3. Statistical Disparities – The study also showed evidence of statistical disparities in the Capital Market which covers areas of financing, bonding, and insurance. In the study national data is analyzed and compared to a survey conducted by NERA in the Massachusetts region, to examine whether discrimination exists in the small business credit market. The Executive Summary of

(NERA Economic Consulting, 2010). MART has only one major construction project in the upcoming goal submission period and it is less than 50% of the total projects budget. MART does have some minor construction related projects which will be much easier to get DBE’s to bid upon. Therefore we have adjusted our goal up from 3.6% DBE availability to 4.5%

that study was release to the public, whereas the complete report is marked “Proprietary and Confidential.” The following relevant bullet points are from the published Executive Summary: • Minority-owned firms were particularly likely to report that they did not apply for a loan over the

preceding three years because they feared the loan would be denied. • When minority-owned firms did apply for a loan, their loan requests were substantially more

likely to be denied than other groups, even after accounting for differences in factors like size and credit history.

• When minority-owned firms did receive a loan, they were charged higher interest rates on the loan than was true of comparable White-owned firms.

• Far more minority-owned firms report that credit market conditions are a serious concern than is the case for White-owned firms.

• A greater share of minority-owned firms believes that the availability of credit is the most important issue likely to confront the firm in the next 12 months.

“We conclude that there is statistically significant evidence of discrimination in Massachusetts in the small business credit market, particularly with respect to firms owned by Blacks. We find little or no significant evidence, however, that White females are discriminated against in this market.” 2

4. Additional data on employment, self-employment, education, training, and union apprenticeship programs were examined both within the NERA Economic Consulting study and data from the updated 2007 Survey of Business Owners (SBO) Census Data (the study contains 2002 SBO data). The evidence confirms the continuing disparity in all these areas against disadvantaged businesses, as well as discrimination in union apprenticeship programs.

Race-Neutral & Race Conscious Participation Detailed Past Goal Attainment MART has met or exceeded our goal of 2% for the past four years.

1. In 2011 there was 6.26% DBE participation in contract completions, which included ARRA funds. 11.59% was made in contract awards, all of which were given as Prime contracts.

2. In 2012 there was 4.02% DBE participation in contract completions. 8.64% was made in contract awards, all of which were given as Prime contracts.

3. In 2013 completed contracts produced 5.39% in expenditures. There were unbalanced DBE awards of 31.96% due to a large subcontract to a DBE made by a GC who was awarded the Prime contract in a previous year. This subcontract was not a result of a change order, just a decision by the GC to sub-out a portion of work not previously subcontracted. This primary contract is still pending completion. Only 0.15% of the 31.96% was given to a prime contract.

4. In 2014 there was 6.12% DBE participation in contract completions. 20.83% was made in contract awards, all of which were given as prime contracts.

The awards made over the past 3 years seem very large in comparison to the contract completions reported. This is due to two very big projects (over $10 million combined) pending completion. MART’s past attainments were all made by Race-Neutral measures (no contract goals were set). MART will strive to continue to meet the maximum feasible portion of its overall goal by using race-neutral means of facilitating DBE participation.
