Excelsior Correspondent SRINAGAR, Nov 9: Jammu and Kashmir Bank Limited has told the High Court that it doesn't come under the Right to Information Act and can't nominate the Public Information Officer. The bank has filed its response before the High Court in response to a petition filed by Advocate Firdous Ahmad Parray seeking direc- tion upon the Jammu and Kashmir Bank to designate the Public Information Officer and furnish informa- tion under the provision of the Act. The Bank in its reply has said that the J&K Bank is not at all financed by the State Government as such the Bank is not obliged under the act to nominate the 'Public Information Officer'. The bank further says that it is not public authority under the provisions of the Act. The issue regarding, is J&K Bank is a 'public author- ity 'or not is already pending before the Supreme Court. The Court sought response from the State Government in a PIL seeking provision of Right to Information Act be enforced on every department to disclose the information within prescribed period. The Division Bench of Justice Mohammad Yaqoob Mir and Justice Ali Mohammad Magrey directed the Government through Chief Secretary to file the response to the PIL by or before November 23. The PIL states that under the Section 4 of the RTI Act it is obligatory for every depart- ment to disclose information voluntarily within a period of 120 days. "The information shall be furnished by every Government department, semi Government organization, public sector banks with more than 50 percent Government Share, board or a corporation should proactively or volun- tarily give the information", reads the petition. It is further stated that the information must be digitized and put on the website of the department with name, desig- nation, powers, duties, responsibilities and salaries of all the officers working in that particular organization should be put on website. It is further said that all the infor- mation should be available with the Public Information Officer and there will be no need to submit a written application or pay application fee if the Section 4 of the act is implemented in letter and spirit but this section has not been implemented. The petitioner also seeks a direction upon the Registrar General of the High Court for taking steps to make the daily orders and judgments avail- able on the official website of the High Court so that orders are easily accessible to people and those associated with the judiciary. In a meeting with the Chief Secretary, B R Sharma here, Prof Mattoo discussed various issues pertaining to the overall progress and plan of action being followed to ensure complete synergy at all levels so that commitments of the Government towards the affected people under various Relief & Rehabilitation categories is realized expeditiously. Principal Secretary to the Chief Minister, B B Vyas, Principal Secretary, Relief & Rehabilitation, Sundeep K Nayak, Commissioner Secretary, R&B, Rohit Kansal, Managing Director, JKPCC, Daleep Thusoo were also present in the meeting. Adil Lateef SRINAGAR, Nov 9: Terming the Rs 80,000 crore package announced by Prime Minister Narendra Modi as jugglery of figures, the Kashmir Chamber of Commerce and Industry (KCCI) today said the flood-hit traders and residents have been ignored and left disappointed. “The Rs 80,000 crore pack- age announced by Prime Minister is jugglery of figures. We have already rejected it… We wanted immediate relief similar to what was given to Uttarakhand after floods. The Government of India had immediately come to rescue and had distributed relief,” KCCI president, Mushtaq Ahmad Wani, told reporters here. The KCCI president said the flood victims in Valley have been given nothing despite waiting for more than a year. “Inspite of immediate relief, they (Government of India) has allocated funds for the State Government for the period of five years,” he said, adding: “We would like that the Centre considers release of Rs 44, 000 crore as immediate relief which was submitted to it by State Government.” He said an estimated Rs 1 lakh crore damage was assessed by the Chamber and other trade organizations due to floods while the United Nations Annual Disaster Statistical review has put the losses at Rs 1, 04, 000 crore, surpassing the earlier assess- ments. He said the Centre has kept different heads in Rs 7854 crore allocated to State Government for the relief, flood management and disas- ters. They have kept it for flood management, dredging of Tawi and Jhelum rivers. We had sought micro details from them regarding how much they are going to spend on Jhelum and Tawi and how much they have kept for relief and rehabilita- tion. But they have not given us micro details of those Rs 7854 crores,” Wani said. The KCCI president said the Chamber apprehends that the flood victims would not be provided anything from these Rs 7854 crore. “We believe this much amount would be spent on dredging and other things while flood hit people would be given nothing,” he said. The KCCI hinted towards launching strike and said it would consult other trade organization to explore the options for future. “We will take on board other trade organizations to explore the options what to do as there is nothing in package. It is like rubbing salt on the wounds of affected people,” said Faiz Bakhsi, the senior KCCI mem- ber. Excelsior Correspondent NEW DELHI, Nov 9: Reiterating that the Narendra Modi Government is committed to address problems faced by people living along the border areas, Union Minister of State (Independent Charge) Northeast, MoS PMO, DoPT, Atomic Energy and Space, Dr Jitendra Singh said here today that this, nevertheless, requires a consistent approach because the problems faced by these people are diverse and peculiar. Dr. Jitendra Singh was speaking to the representatives of FANS (Forum for Awareness of National Security) organization who pre- sented him a memento as a token of thanks to the Modi Government for having announced Rs.80,000 crore package for J&K. Pertinent to mention that the FANS has been, for quite some time, pur- suing the issues related to bor- der States at different levels. The J&K package announced by Prime Minister on Saturday includes funds for border area people as well as provision for the recruitment of youth in forces and also for the payment of emoluments to the SPOs. In general, Dr. Jitendra Singh observed that India’s bor- ders are very extensive stretch- ing from J&K across the Himalayas and in the North- East. Similarly, the problems faced along these borders are also extensive and varying in nature, he said. As for J&K, Dr. Jitendra Singh said, his own Lok Sabha constituency of Kathua- Udhampur-Doda has a long stretch of border and one com- mon complaint there is that the farmers on the International Border and Line of Control( LoC) do not receive adequate compensation in lieu of land procured for them by security forces and this issue has been taken up by him with the Ministry of Defence. Similarly, he said, there was a demand to raise the compen- sation provided to the deceased and the injured people by bor- der firing, which he personally took up with Union Home Minister Rajnath Singh and was assured that this amount is soon going to be raised to Rs.5 lakhs. The task of constructing perma- nent bunkers along the border for the people to take shelter in the event of sudden cross firing or shelling has already been ini- tiated and this has been con- firmed to him by senior author- ities of both the BSF as well as Army, he added. On account of frequent cross border firing, Dr. Jitendra Singh said, there was a common com- plaint that whenever people liv- ing in these areas are temporar- ily shifted to neighbouring areas, they are not certain about where exactly to take shelter but, of late, a large chunk of land in the vicinity of Hiranagar has been identified providing 5 marlas to each family for this purpose and a similar exercise would also be undertaken along the other borders. Dr. Jitendra Singh disclosed that another issue is that of pro- viding reservation in jobs and in higher education which is a provision available to children of people living along the LoC but not available to those living along the International Border. Referring to grants available under Border Area Development Programme (BADP), he said that various special welfare schemes are being initiated. At the same time, he said, from his own resources, he has initiated a process of constructing toilets along the border areas in his constituency and nearly 100 such toilets are already com- plete. In addition, under the new social security schemes introduced by the Modi Government, it has been made mandatory to provide insur- ance cover to all the families living in the border areas, he added. Referring to North-East, which happens to be under his ministerial charge, Dr. Jitendra Singh referred to programmes like ‘Organic Farming Mission’ introduced by the present Government for upliftment of the living conditions of people along North-Eastern borders. The aspirants asked that if the posts were meant for SKIMS Bemina, why inter- views should be held in Jammu. They alleged that it is for the first time in 16 years that interview has been shift- ed to Jammu at the behest of Director SKIMS whose close relative is an applicant. The SKIMS in an adver- tisement (SKIMS MC-02 of 2015 dated 16-05-2015) said that interviews for Advertisement Notice No 03 of 2013 dated 14-10-2013 and Notice 01 SKIMS MC of 2014 dated 25-02-2014 will be held in Jammu. The aspirants allege that the interviews have been can- celled four times for the last several years as the Director's relative was not eligible. They said despite defi- ciencies pointed out by Medical Council of India in Faculties of Preclinical departments like Biochemistry, Physiology and Pediatrics the posts were never filled up. Director SKIMS Dr Showkat Ahmad Zargar dis- missed these allegations made by the aspirants. He said that the decision to hold interviews in Jammu has been made by the Chief Secretary. On allegations that deci- sion has been taken to favour his close relative, the Director said that any eligible candidate has the right to apply for the job. Excelsior Correspondent SAMBA, Nov 9: The State unit of the Bahujan Samaj Party (BSP) led by its President Tarsem Khullar, State coordina- tors R.K Bhagat and Jagdish Verma and Ex MLA Som Nath organised a mammoth rally today in District Samba. The rally started from the Guru Ravi Dass Temple Samba and after passing through National Highway culminated with handing over of a memo- randum to Deputy Commissioner, Samba for its further transmission to the Governor. The rally was held in support of reservations in Jammu and Kashmir. While speaking on the occa- sion, Tarsem Khullar informed that the BSP has demanded immediate calling of Special Session of the State Legislature for extending 77th, 81st and 85th Amendment Acts of Constitution to Jammu and Kashmir so that the situation in the matters of promotion in employment arising as a result of court orders could be negated for all times to come. He disclosed that the Brahminical forces within and outside the Government are part of a greater conspiracy to deprive the underprivileged sec- tions of their genuine rights. He appealed the Judiciary to resist such tactics and not fall a prey to such conspiracy. He further stated that the reservations for Scheduled Castes, Scheduled Tribes and Backward sections was not a charity but a matter of according representation to the people who were traditionally deprived of education, means of livelihood and safety by the Brahminical system and their religion. It was because of untiring efforts of Baba Sahib Ambedkar that these sections were given their human rights. Digging into the history, he informed that the provisions of according repre- sentation in employment, educa- tion and other institutions of governance was included in the Constitution of India in the aftermath of Poona Pact of 1932 wherein the depressed classes lost their right of ‘Separate Electorate with double voting power’ and were; instead, given reservations. He also stated that attack on reservation was depiction of Caste prejudices still prevalent in the society and RSS was vig- orously trying to foment such prejudices and communal hatred. He further stated that the statement of Mohan Bhagwat, RSS chief for reviewing the reservation policy was just the tip of the iceberg. Party t akes out rally in Samba Reservations not a charity: BSP Govt committed to address border people’s problems: Dr Jitendra 3 bodies recovered Excelsior Correspondent SRINAGAR, Nov 9: Police today said it recovered three bodies including of a Beacon employee at three separate places in city here. A police spokesman said a body was recovered near Tengpora in Batamaloo area. "The deceased was later identi- fied as Abdul Rashid Sodagar, a resident of Nundresh Colony A in Bemina," he said, adding that after completion of legal- medico formalities, the body of the deceased was handed over to his legal heirs for last rites. The spokesman said another body was recovered from Yatra Niwas in Lal Chowk here. "The deceased was later identified as Mahesh Chand, a Beacon employee from Uttarakhand," he said. The police spokesman said the third body was recovered beneath the fly-over at Hyderpora here. He said the body was of a female and seems she was mentally unsound and non-state subject. The police have not identified the deceased so far. The bodies of Mahesh Chand and unidentified female are in Mortuary at Pantha Chowk here, he said. "Police have registered cases and initi- ate proceedings under Section 174 CrPC to ascertain the cause of these deaths," the police spokesman added. Sharma today reviewed the facilities being extended to the employees in the estates colonies in winter capital Jammu in a meeting. Chief Secretary received brief on the overall status in the estates colonies with respect to the availability of water, electricity, garbage con- tainers, parking lots besides security arrangements. To allay the concerns regarding water supply in some of the main estates colonies, Chief Secretary asked Chief Engineer, PHE to explore the feasibility of meet- ing water require- ments by agumenta- tion through bore wells on pilot basis. “Water, electricity, sanitation and proper security arrangements should be ensured in all estates colonies”, Mr Sharma stressed. Pulwama residents demand reconstruction of 2 bridges Excelsior Correspondent SRINAGAR, Nov 9: Resi- dents of Pulwama district of South Kashmir today sought the reconstruction of two vital bridges in the district that were washed away due to September 2014 floods. The two bridges at Rohmoo and Gudora were washed away in last year’s floods and since then no reconstruction took place. While as Rohmoo bridge connects Pulwama with Pakharpora area of Budgam district, the Godora Bridge is located on Srinagar-Pulwama bypass. The local residents of these areas told Excelsior that the concerned authorities con- structed diversions in absence of the bridges but they were washed away several times as a result of flash floods. They said that diversions are in place but are not fit for vehicles and the light motor vehicles suffer chamber dam- age while crossing them. It must be mentioned here that Rohmoo diversion was washed away more than four times due to flash floods trig- gered by heavy rains in Romshi stream this year. The locals said that the authorities should start reconstruction so that they don’t face inconven- ience repeatedly. Assistant Executive Engineer (AEE) Roads and Buildings, Zahoor Ahmad, told Excelsior that the work on Gudora Bridge would be start- ed soon. “The funds for the work have been allotted and we will start the work on it soon,” he said. However, he said, the work on Rohmoo Bridge cannot be started as of now due to non-availability of funds. “There are no funds and till then we cannot start work,” he added. As for J&K, Dr. JitendraSingh said, his own Lok Sabhaconstituency of Kathua-Udhampur-Doda has a longstretch of border and one com-mon complaint there is that thefarmers on the InternationalBorder and Line of Control(LoC) do not receive adequatecompensation in lieu of landprocured for them by securityforces and this issue has beentaken up by him with theMinistry of Defence.

On account of frequent crossborder firing, Dr. Jitendra Singhsaid, there was a common com-plaint that whenever people liv-ing in these areas are temporar-ily shifted to neighbouringareas, they are not certain aboutwhere exactly to take shelterbut, of late, a large chunk ofland in the vicinity of Hiranagarhas been identified providing 5marlas to each family for thispurpose and a similar exercisewould also be undertaken alongthe other borders.

Dr. Jitendra Singh disclosedthat another issue is that of pro-viding reservation in jobs andin higher education which is aprovision available to childrenof people living along the LoCbut not available to those livingalong the International Border.Referring to grants availableunder Border AreaDevelopment Programme(BADP), he said that variousspecial welfare schemes arebeing initiated. At the sametime, he said, from his ownresources, he has initiated aprocess of constructing toiletsalong the border areas in hisconstituency and nearly 100such toilets are already com-plete. In addition, under thenew social security schemesintroduced by the ModiGovernment, it has been mademandatory to provide insur-ance cover to all the familiesliving in the border areas, headded.

Referring to North-East,which happens to be under hisministerial charge, Dr. JitendraSingh referred to programmeslike ‘Organic Farming Mission’introduced by the presentGovernment for upliftment ofthe living conditions of peoplealong North-Eastern borders.

SRINAGAR, Nov 9: Thedoctors who have applied forposts of lecturers in SKIMSMedical College Bemina intoday said that the DirectorSKIMS has managed to getthe interviews shifted toJammu to help his relative.

The aspirants asked that ifthe posts were meant forSKIMS Bemina, why inter-views should be held inJammu. They alleged that it isfor the first time in 16 yearsthat interview has been shift-ed to Jammu at the behest ofDirector SKIMS whose closerelative is an applicant.

The SKIMS in an adver-tisement (SKIMS MC-02 of2015 dated 16-05-2015) saidthat interviews forAdvertisement Notice No 03of 2013 dated 14-10-2013 andNotice 01 SKIMS MC of2014 dated 25-02-2014 willbe held in Jammu.

The aspirants allege thatthe interviews have been can-celled four times for the lastseveral years as the Director'srelative was not eligible.

They said despite defi-ciencies pointed out byMedical Council of India inFaculties of Preclinicaldepartments likeBiochemistry, Physiology andPediatrics the posts werenever filled up.

Director SKIMS DrShowkat Ahmad Zargar dis-missed these allegationsmade by the aspirants. Hesaid that the decision to holdinterviews in Jammu has beenmade by the Chief Secretary.

On allegations that deci-sion has been taken to favourhis close relative, theDirector said that any eligiblecandidate has the right toapply for the job.

SAMBA, Nov 9: The Stateunit of the Bahujan Samaj Party(BSP) led by its PresidentTarsem Khullar, State coordina-tors R.K Bhagat and JagdishVerma and Ex MLA Som Nathorganised a mammoth rallytoday in District Samba.

The rally started from theGuru Ravi Dass Temple Sambaand after passing throughNational Highway culminatedwith handing over of a memo-randum to DeputyCommissioner, Samba for itsfurther transmission to theGovernor. The rally was held insupport of reservations inJammu and Kashmir.

While speaking on the occa-sion, Tarsem Khullar informedthat the BSP has demandedimmediate calling of SpecialSession of the State Legislaturefor extending 77th, 81st and85th Amendment Acts ofConstitution to Jammu andKashmir so that the situation inthe matters of promotion inemployment arising as a resultof court orders could be negatedfor all times to come.

He disclosed that theBrahminical forces within andoutside the Government are partof a greater conspiracy todeprive the underprivileged sec-tions of their genuine rights. He

appealed the Judiciary to resistsuch tactics and not fall a prey tosuch conspiracy. He furtherstated that the reservations forScheduled Castes, ScheduledTribes and Backward sectionswas not a charity but a matter ofaccording representation to thepeople who were traditionallydeprived of education, means oflivelihood and safety by theBrahminical system and theirreligion.

It was because of untiringefforts of Baba Sahib Ambedkarthat these sections were giventheir human rights. Digging intothe history, he informed that theprovisions of according repre-sentation in employment, educa-tion and other institutions ofgovernance was included in theConstitution of India in theaftermath of Poona Pact of 1932wherein the depressed classeslost their right of ‘SeparateElectorate with double votingpower’ and were; instead, givenreservations.

He also stated that attack onreservation was depiction ofCaste prejudices still prevalentin the society and RSS was vig-orously trying to foment suchprejudices and communalhatred. SRINAGAR, Nov 9: Policetoday said it recovered threebodies including of a Beaconemployee at three separateplaces in city here.

A police spokesman said abody was recovered nearTengpora in Batamaloo area."The deceased was later identi-fied as Abdul Rashid Sodagar, aresident of Nundresh Colony Ain Bemina," he said, adding thatafter completion of legal-medico formalities, the body ofthe deceased was handed over tohis legal heirs for last rites.

The spokesman said anotherbody was recovered from YatraNiwas in Lal Chowk here. "Thedeceased was later identified asMahesh Chand, a Beaconemployee from Uttarakhand,"he said.

The police spokesman saidthe third body was recoveredbeneath the fly-over atHyderpora here. He said thebody was of a female and seemsshe was mentally unsound andnon-state subject. The policehave not identified the deceasedso far.

The bodies of MaheshChand and unidentified femaleare in Mortuary at PanthaChowk here, he said. "Policehave registered cases and initi-ate proceedings under Section174 CrPC to ascertain the causeof these deaths," the policespokesman added.

Pulwama residents demandreconstruction of 2 bridgesExcelsior Correspondent

SRINAGAR, Nov 9: Resi-dents of Pulwama district ofSouth Kashmir today soughtthe reconstruction of two vitalbridges in the district that werewashed away due to September2014 floods.

The two bridges at Rohmooand Gudora were washed awayin last year’s floods and sincethen no reconstruction tookplace. While as Rohmoobridge connects Pulwama withPakharpora area of Budgamdistrict, the Godora Bridge islocated on Srinagar-Pulwamabypass.

The local residents of theseareas told Excelsior that theconcerned authorities con-structed diversions in absenceof the bridges but they werewashed away several times asa result of flash floods.

They said that diversionsare in place but are not fit for

vehicles and the light motorvehicles suffer chamber dam-age while crossing them.

It must be mentioned herethat Rohmoo diversion waswashed away more than fourtimes due to flash floods trig-gered by heavy rains inRomshi stream this year. Thelocals said that the authoritiesshould start reconstruction sothat they don’t face inconven-ience repeatedly.

Assistant ExecutiveEngineer (AEE) Roads andBuildings, Zahoor Ahmad, toldExcelsior that the work onGudora Bridge would be start-ed soon. “The funds for thework have been allotted andwe will start the work on itsoon,” he said. However, hesaid, the work on RohmooBridge cannot be started as ofnow due to non-availability offunds. “There are no fundsand till then we cannot startwork,” he added.
