Creative Commons.

A more flexible way to copyright creative works.

When we talk about creative commons, we mean a non-profit organization with headquarters

in San Francisco (United States) that works in service to others to allow you to share and

download creative works legally as for example, websites, music, documents, photos and

literature. The non-profit organization has created the Creative Commons Public Licenses

(CCPL) to make the copyright of these more flexible.

The translation and adaptation to our legal system has been prepared by Working Group of the

University of Turin.

Creative Commons Public Licenses (CCPL) are copyright licenses which are based on the

principle of "some rights reserved". They make it easy for the owner of copyright, to clearly

indicate that the reproduction, dissemination and circulation of his/her work is explicitly

permitted.

CCPL is only an instrument through which the rights holder gives permission to certain

licensees. Such permits are flexible and can be tied to certain conditions, depending on the

license chosen by the author.

Creative Commons Italy has developed a website1

Licenses

, helps to find material licensed with CC

licenses (with the help of Google and Yahoo!) And, second, it leads the authors to choose the

license that best suits their needs and aspirations.

The Italian law on copyright gives the creator of a work a number of rights. The six Public

License Creative Commons is a standardized tool to have, under certain conditions, some of

these rights.

Each Creative Commons license reveals itself in three different forms.

The actual license is called the Legal Code: a text contains rather dense legal concepts which

are long and potentially understandable to those who have training in law. The license will be

considered by the court if a legal dispute emerges on the use of the work dismissed.

However, Creative Commons has also thought to summarize the essential concepts of license

synthetic versions (called Commons Deed) easy to understand even for general consumers

and marked by effective visuals.

In addition, each license is convertible into a few lines of computer language (called Digital

Code) which act as metadata, or digital information that enable search engines to identify and

correctly recognize the work that contains them.

Creative Commons licenses are structured ideally in two parts: the first part where you

indicate what the author wants to grant freedom on his/her works and a second section

clarifies under what conditions you can use the work.

Part One: The freedom for the user

All licenses allow the copying and the distribution of the work:

•  You are free to copy, distribute, publish, display publicly, perform, and perform the

work

Some licenses also allow the modification of the work:•  You are free to change this

Part Two - The conditions for the use of the work

CC licenses are divided into four basic clauses that the author can choose and combine

according to his/her needs.

The six combinations of Creative Commons licenses3

Attribution

cc by

This license lets others distribute, remix, tweak and build upon your work, even

commercially, as long as they credit you for the original creation. This is the most

accommodating of the licenses offered, in terms of what others can do with your works

licensed under Attribution.

Attribution Non-Commercial

cc by-nc

This license lets others remix, tweak, and build upon your work non-commercially,

and although their new works must also acknowledge you and be non-commercial,

they don’t have to license their derivative works on the same terms.

cc by-nc-sa

This license lets others remix, tweak, and build upon your work non-commercially, as long as

they credit you and license their new creations under the identical terms. Others can download

and redistribute your work just like the by-nc-nd license, but they can also translate, make

remixes, and produce new stories based on your work. All new work based on yours will

carry the same license, so any derivatives will also be non-commercial in nature.

cc by-nc-nd  This license is the most restrictive of our six main licenses, allowing redistribution. This

license is often called the “free advertising” license because it allows others to download your

works and share them with others as long as they mention you and link back to you, but they

can’t change them in any way or use them commercially. View License Deed | View Legal Code

Jamendo

Creative Commons licenses were taken by millions of individuals (bloggers, educators, young

musicians, etc.) but also by institutions such as MIT in Boston and the Brazilian Ministry of

Culture, by publishers as prestigious as Feltrinelli, La Stampa, Internationale, Fayard andAlternative Press, and creators like Pearl Jam, David Byrne, Gilberto Gil and Beppe Grillo.

One of the many examples of using the creative commons licenses that we are considering is

 jamendo.com/it.

Jamendo is the leading platform for free and legally downloadable music published with

Creative Commons licenses or the Free Art License. The site is available in six languages and

offers the largest music catalog free network: 200,000 songs from more than 18,000 artists

from around the world. Jamendo is backed by a company based in Luxembourg. Its

innovative business model allows users to download music for free, and artists to be paid

through the distribution of advertising revenues and other commercial income.

Jamendo is a way for many artists to promote their work. The artists allow everyone to

download and share their music. It's free, legal and unlimited.

Jamendo PRO

At the end of 2008, the platform launched an interface for licensing commercial music. This

interface allows add a soundtrack to give sound to both multimedia projects (documentaries,

podcasts), and public spaces (stores, restaurants). Television channels such as France 2or Arte

frequently use a soundtrack PRO Jamendo for their productions.

Classical music project PRO is supplied by the Italian classical music OnClassical.

Thanksgiving graduated

To counteract the graduated response statutory HADOPI (French law providing for the

gradual disconnection from the network of users who download copyrighted files), Jamendo

launched March 12, 2009 “Thanksgiving graduated”:

•  For a track downloaded via Jamendo, the user will receive an email of thanks

•  If you continue to download via Jamendo, you will receive by mail a letter of thanks

but also a "kit of an accomplice" (stickers, promotional material ...)

•  Finally, a month subscription will be refunded if the provider fails to convince a public

space to become an area of free culture with Jamendo PRO.

The initiative was adopted by the press and users as a humorous and creative way to denounce

the repressive aspect of the law.
