Seizure of Dangerous Drugs, Controlled Precursorsand Essential Chemicals and Non-Drug Evidence

It is alarming to note that the illicit drug operations in the country is in billion of pesos. A very huge amount intended to destroy the moral fiber of the country.

This billion pesos worth of menace is evident in the value of seized drugs, controlled precursors and essential chemicals (CPECs) and non-drug evidence.

For 2012, Php2.53 billion worth of dangerous drugs and CPECs, and non-drug evidence were seized through various intensified anti-drug operations nationwide.

Financial Investigation Efforts

The PDEA aims to fortify its fight against money laundering, thus a Memorandum of Agreement with the Anti-Money Laundering Council (AMLC) was created and was signed in 2003. To further strengthen its anti-money laundering efforts, the Agency created the Anti-Money Laundering Desk.

In 2012, PDEA’s Anti-Money Laundering Desk (AMLD) referred 30 cases, involving 151 personalities, to the AMLC for financial investigation.

Further, assets amounting to Php17.7 million have pending Asset Preservation Order in Court.

Chemical and Precursor Diversion Prevention and Control

Some dangerous drugs and chemicals have legitimate uses; however, unscrupulous drug personalities take advantage of this and divert legally acquired dangerous drugs for illicit use. Chemical diversion is one strategy employed by drug syndicates to acquire controlled precursors and essential chemicals (CPECs) used in the local manufacture of dangerous drugs, specifically shabu. To prevent this, PDEA closely monitors and controls the medical institutions, chemical and pharmaceutical industries and ensures that controlled substances are made available for legitimate medical, scientific, research and industrial use.

As the operational enforcement body for dangerous drugs and precursor control, PDEA implements a systematic process of issuing permits and licenses to qualified and authorized handlers of dangerous drugs and CPECs.

The client registration for the year increased due to the Agency’s strict, judicious and consistent implementation of regulations, the upgrading of its information infrastructure and the enhanced capabilities, including total customer care, and regulatory information dissemination efforts to various stakeholders. In 2012, 12,981 licenses and permits were issued by PDEA.

Cases filed

Successful anti-drug operations do not only end in the arrest of drug personalities; successful prosecution, which starts with the filing of cases, also contributes to these operations. Operating units, after anti-drug operations, carefully and properly prepare all evidence gathered to ensure that drug personalities arrested end up in jail.

To strengthen drug cases filed in courts nationwide, the Agency continuously monitors their status through Project Court Watch. This project is unique to PDEA. This includes the deployment of case monitors nationwide to keep track of the status and progress of drug cases filed in courts.

From 2002 to 2012, a total of 80,580 drug cases were filed nationwide. Out of this number, only 14,087 cases ,or 17.48%, were resolved, while the remaining 66,493 cases, or 82.52%, are pending in courts.

The resolved cases are broken down as follows: l 17.48% conviction l 26.71% dismissal l 43.64% acquittal

Lack of evidence or probable cause, illegality of arrest, search and seizure and failure to comply with RA 9165 were the major reasons for dismissal and acquittal of cases.

For 2012, an aggregate of 12,534 drug cases were filed in the different courts in the country.

Destruction of Dangerous Drugs, Controlled Precursorsand Essential Chemicals and Laboratory Equipment

As mandated by RA 9165, PDEA is responsible for the custody and destruction of drug and non-drug evidence confiscated from anti-drug operations. Through close coordination with the courts, PDEA secures court orders for the immediate destruction of dangerous drugs, CPECs and laboratory equipment which are no longer needed as evidence.

For the year, the Agency has facilitated 23 burning and destruction activities nationwide that destroyed 527.650 kilos of solid dangerous drugs with an estimated value of Php784,596,797.05.

Private Eye Rewards

Operation: Private Eye is PDEA’s reward and incentive scheme to encourage the participation of the citizenry to provide information that would lead to seizure/recovery of illegal drugs, dismantling of clandestine laboratories and/or arrest of drug personalities.

For this year, a total of P8,501,906.05 was granted to 23 Operation “Private Eye” informants.

Process on how to apply for private eye

To anyone not a member of DDB, PDEA, PNP, AFP, NBI, PCG, BOC or any government agency exercising enforcement function who can provide any information that shall result in confiscation or destruction of dangerous drugs, precursors and essential chemicals; clandestine laboratories for illegal drugs and marijuana plantations, commensurate reward/s will be given confidentially to him/her/them, as indicated in the Reward Schedule of Operation “Private Eye”.

[Note: Even members/cohorts (“insiders”) of drug syndicates can participate and could receive the reward money; plus the added benefit of avoiding or minimizing criminal liability by readily qualifying as a state witness and even provided with protection under the Department of Justice Witness Protection and Benefit Program.]

Created on February 8, 2010, the Task Force Drug Courier (TFDC) is mandated to deter Filipinos from being used and victimized as drug couriers by drug syndicates. Composed of 13 agencies, the TFDC is chaired by PDEA and co-chaired by the Department of Foreign Affairs with the following agencies as members:

Since its creation, the TFDC has successfully achieved significant accomplishments thatresulted in the arrest of 84 African Drug Syndicate members and the seizure of 104.310 kg of dangerous drugs.

In 2011, the Philippine Information Agency (PIA) and PDEA endorsed the TFDC to the 2012 Anvil Awards, an award-giving body sponsored by the Public Relations Society of the Philippines, which annually recognizes outstanding public relations projects and programs.

On February 2012, the Task Force Drug Courier won the prestigious Anvil Award for Merit for its commendable work done on the anti-drug courier advocacy campaign. The PDEA continuously conducts anti-drug lectures nationwide, which include a module on the drug courier problem.
