REGULAR COUNCIL MEETING CITY OF UDALL Monday, July 14, 2014 The Udall City Council met for the Regular Council Meeting on Monday, July 14, 2014, at 6:30 p.m., at the city building. Mayor Brown called the meeting to order. Roll call was then taken with the following council members present: Janette Adams, Michael Grahem, Regina Hanson, and Randall Smith. Quorum established. Attending were Brian Spano, Rose Mary Saunders, Rozella Sherman, Erik King, Eric Allen and Lulita Hopkins. MODIFICATION OF AGENDA

MOTION: by Adams, second by Smith, to add Rose Mary Saunders to Old Business Item 1b Environmental Review. All voted aye, motion carried.

GENERAL DISCUSSION: 1. There will be a Listening Meeting with the Cowley County Housing Survey held on Wednesday, July 16, at 9:00 a.m. at the

City Council Room. The public is invited to ask questions about the housing survey. 2. Congressmen Mike Pompeo will be available to the public on July 22 at 3:30 – 4:40 p.m. at the City Council Room. BUSINESS FROM THE FLOOR: No items CONSENT AGENDA: MOTION: by Smith, second by Hansen, to approve the Consent Agenda including the minutes for the June 9 Regular Meeting, June 25 Special Council Meeting, Clerk’s and Treasurer’s reports for July 2014, Expenditure Report in the amount of $144,627.14, Payroll Account Report Totals $14,784.37 All voted aye, motion carried. OLD BUSINESS: 1. Phase II Water Project – Brian Spano of Wilson & Co. presented an update on the Phase II water project. The design stage

will be completed by December 2014. We are required by the terms of the Community Development Block Grant to have a contractor on board and awarded by March 2015. The specifications of the project will be advertised for bid in January or February 2015. The bids will be opened and evaluated prior to the March council meeting. The actual construction will be completed by the end of 2015, leaving several months of cushion prior to the March 2016 deadline. Brian explained design changes requested to the Doyle Addition which required a separate survey. There are also two points on the lines to the wells where the existing line can be salvaged. Also, in reviewing the plans there are two areas where the sewer lines and water lines are closer than allowed. This will be remedied by liners placed inside the sewer lines so they cannot leak. The supplemental agreement totals costs of $5,150.00 Rose Mary Saunders reported that the Environmental Review had been delayed due to a slow response from the Bureau of Indian Affairs. The review is complete at this time and the Release of Funds publication will be in the Winfield Courier this Wednesday to open the seven day comment period. The review information will be available at the City Clerk’s office for individuals to request, if interested. There are no impacts on wildlife or other existing conditions. MOTION: by Adams, second by Grahem, to approve the Supplement Agreement as presented by Brian Spano and totaling $5,150.00. All voted aye, motion carried.

2. Zoning Administrator – Three candidates were interviewed for the position of Zoning Administrator. Two had a strong background and knowledge of zoning in rural areas. The Udall Planning Commission presented a letter to the council signed by all members recommending Erik King for the position. MOTION: by Hansen, second by Grahem, to appoint Erik King as Zoning Administrator and requesting monthly activity reports. The annual salary will be $6,000.00 from the Planning Commission budget. All voted aye, motion carried.

3. AT&T Contract negotiation – Our attorney’s suggestions and paragraph additions to the contract have been reviewed by all council members. It was discussed whether to have Ben Winters negotiate with Black Dot and Veatch or continue discussions. At this point, Mayor Brown will contact BlackDot’s representative with the City’s terms for negotiation.

NEW BUSINESS 1. North Point Park – buoy system for property definition. There was discussion regarding the rights of those visiting the public

park and homeowners at North Point. A recent incident later involved contacting the Kansas Department of Wildlife and Parks. KDWP advised the City that opening a portion of a waterway to public use and then limiting activities on the public property requires clear definition of public versus private property. There is an ordinance in place prohibiting the use of boats, swimming, wading or any water activity other than fishing, with proper licensing, at the public park. The Clerk was instructed to find out from the insurance company if a buoy system is required.

STAFF REPORTS: Allen – Requested permission to secure bids for a tower maintenance contract. This was approved by consensus. Randy Hoffman contact Eric regarding the East street storm siren. The pole has begun to lean quite a bit and could potentially damage the siren. Emergency Management has agreed they will share the cost of re-installing the pole to the proper position. This could be up to $750 with our cost being half that. MOTION: by Smith, second by Hansen, to have the siren pole straightened with our cost not being more than $500. All voted aye, motion carried.

Eric reminded the council that there is a Bad Boy mower that is not being used at this time. The City has two Grasshopper mowers and an additional mower for the park. It was agreed by consensus to sell the mower by placing it in front of the shop and on GovDeals. KDHE inspection of the water system was held last Friday, July 11. All items were satisfactory with a few minor details to be addressed. King – The Dodge Durango needs shocks and re-alignment. He has checked with Duke’s in Winfield and they can do this for $250-$300. MOTION: by Smith, second by Adams, to have 4 shocks installed and alignment work not to exceed $300 or lowest bid. All voted aye, motion carried. Erik reported on the department’s most recent Click-it-or-Ticket campaign. KDOT will be awarding the department $3,000 in equipment. Out of cities with a population of 2,500 or less, Udall was #1 in the state during the most recent campaign and comparable to many cities with populations of 10,000 or more. The department will also be awarded a AAA plaque and another $1,000 in overtime reimbursement for future campaigns. Erik also reported on nuisance violations. He will be in contact with various homeowners regarding mowing and clean-up. Fall Festival was discussed and it was requested for a report to be made on what police coverage will be provided if there is alcohol available, what streets will be requesting barricades, etc. Mayor Brown will be contacting Jason Tharp for this information. COUNCIL MEMBER REPORTS: Brown – Presented Udall Open Golf Tournament information which is scheduled for the same day as Fall Festival, September 20

th. The cost this year to sponsor a team of four is $260.00

MOTION: by Adams, second by Smith, to sponsor a team for the Udall Open at $260.00. All voted aye, motion carried. Mayor Brown reported resolving the property situation with the Udall Senior Citizens and the Historical Society. G.K. Thompson kept the investigation going until a deed was discovered at the Register of Deeds office recording the property back to the City of Udall which then leased it to the Udall Historical Society. A special meeting will be held on Wednesday, July 23, to review the budget and approve numbers for publication. Adams – Suggested a Fishing Tournament for Saturday, September 12. Letters will be sent to vendors requesting donations. Grahem – Asked Erik King if the camera equipment in both vehicles is operational. Erik’s does not work, Bill’s camera does work. Erik was directed to obtain bids for repairs to the system. MOTION: by Hansen, second by Grahem, to adjourn the meeting. All voted aye, motion carried. Lulita Hopkins, City Clerk

SPECIAL COUNCIL MEETING CITY OF UDALL Wednesday, July 23, 2014

The Udall City Council met for a Special Council Meeting on Wednesday, July 23, 2014, at 6:30 p.m., at the city building. Mayor Brown called the meeting to order. Roll call was then taken with the following council members present: Michael Grahem, Chris Lette, and Randall Smith. Quorum established. Attending Lulita Hopkins. NEW BUSINESS: 1. The Dodge Durango air conditioner needs repaired.

Three estimates were reviewed. MOTION: by Smith, second by Grahem, to approve the $593.09 estimate from Action Jackson Automotive. All voted aye, motion carried.

2. Mayor Brown has been in contract negotiations with a company representing AT&T. Terms have included a guaranteed 10 year term with a 30 year contract decreasing initial payments. The terms also include incremental increases in each of the last 5 year periods for the final 20 years of the contract. MOTION: by Lette, second by Smith, to table the issue. Two voted aye, one voted nay. Motion carried.

3. The 2015 budget information was reviewed at length. The prepared budget summary and notice of hearing was reviewed. More details will need to be provided for the budget hearing. MOTION: by Smith, second by Lette, to publish the budget summary and notice of hearing scheduling the August 11 budget hearing at 6:30 p.m with more details provided for the budget hearing. All voted aye, motion carried. MOTION: by Smith, second by Grahem, to adjourn the meeting. All voted aye, motion carried.
