COMMITTEE OF THE WHOLE DAY 1 – MEETING MINUTES

Goderich, Ontario September 9, 2015

The Committee of the Whole Day 1 met in the Court House Council Chambers in Goderich on the 9th day of September 2015. 1. Call to Order: All members of Council were present. Chair Versteeg called the meeting to order at 9:05 a.m. 2. Approval of the Agenda: MOTION: Moved By: Councillor Ginn and Seconded By: Councillor Watt THAT: The Committee of the Whole Day 1 Agenda for September 9, 2015 be accepted and all reports included in the Agenda be received as presented. CARRIED 3. Declaration of Pecuniary Interest and the General Nature Thereof: None. 4. Delegations/Petitions/Presentations: None.

5. Councillor’s Issues: Councillor Frayne requested a staff report on options for re-programming the traffic lights in Exeter to alleviate the traffic congestion on County Road 83. Councillor MacLellan stated his concerns regarding this issue and the ambulance base that is located near this intersection. Councillor Vincent applauded the efforts of CHIP (Coalition for Huron Injury Prevention) regarding the “Share the Road” initiatives. Councillor Jewitt questioned if the County had a policy for dealing with external reports. This topic will be included at the internal service delivery review September 2015. CAO Orchard informed members that Virtual Conference sessions from ICMA (International City/County Management Association) will be made available to Councillors and staff on September 29 and 30. Details are available from CAO Orchard. 6. Consent Agenda – Items 6.1 through 6.9:

6.1 Delegated Consents under the Planning Act: (prepared by Senga Smith) The authority to grant undisputed consents is delegated to the Manager of Planning under By-law No. 54-2014. The report lists the applications which received provisional consent approval since the last report. County Council is notified for information and appeal purposes only. ACTION: THAT:

The recommendation of Senga Smith, Land Division Secretary, that no objections be lodged to the Delegated Consents submitted with the Report of August 20, 2015, be approved. 6.2 Zoning By-laws: (prepared by Sandra Weber) Zoning By-laws and amendments are circulated to the County from local municipalities. These by-laws are reviewed for conformity with the County Official Plan and with the local Official Plan. The by-laws are listed in the report. ACTION: THAT: The recommendation of Sandra Weber, Manager of Planning, that no objections be lodged to the Zoning By-laws, be approved. 6.3 Forest Conservation: (prepared by Dave Pullen) The Notices of Intent under the Forest Conservation By-law are listed in the report. ACTION: Receive for information. 6.4 Source Protection Municipal Implementation Fund, Extension of Agreement

Between the Ministry of the Environment and Climate Change and the County of Huron: (prepared by Sandra Weber)

The County of Huron received funding from the Ministry of the Environment and Climate Change to implement the recommendations of the local Source Water Protection Plan. The Ministry has extended the time period to use the funds from the original deadline of December 2015 to March 31, 2017. The extension requires an amendment to the funding agreement with the Province. ACTION: THAT: The recommendation of Sandra Weber, Manager of Planning, that a By-law be passed authorizing the Warden and Clerk to sign the Source Protection Municipal Implementation Fund amended agreement with the Province of Ontario to extend the funding until March 31, 2017, be approved. 6.5 Amended Contribution Agreement with Citizenship and Immigration Canada (CIC)

for the Local Immigration Partnership Program: (prepared by Rebecca Rathwell) ACTION: THAT: A By-law be prepared authorizing the County Clerk and the Warden to execute the amended contract with Citizenship and Immigration Canada. 6.6 Articles in Rural Voice Magazine: (prepared by Dave Pullen)

Excellent stories of stewardship initiatives in Huron County were published recently in the Rural Voice magazine. The Huron Clean Water Project and the County’s partnership with the Huron Soil and Crop Improvement Association were highlighted. The Rural Voice is widely circulated throughout mid-western Ontario and across the province through farm organizations. ACTION: Receive for information.

a) B30/15 – John Van Der Sluis (Owner/Applicant), South Part of Lot 24 and Part of the North Part of Lot 24, Concession 2, Wawanosh Ward, Ashfield-Colborne-Wawanosh: (presented by Sandra Weber)

The purpose and effect of this application is for a surplus farm residence severance. The application does not meet the Minimum Distance Separation requirements of Section 3.5.9.6 of the Ashfield-Colborne-Wawanosh (ACW) Official Plan and does not conform with the Provincial Policy Statement, or Section 51 (24) of the Planning Act. The Planning and Development Department recommends that the application be deferred pending a housekeeping amendment to the ACW Official Plan to remove the requirement for Minimum Distance Separation (MDS) for surplus residence severances. ACW Council has recommended that the application be approved. MOTION: Moved By: Councillor Van Diepenbeek and Seconded By: Councillor Watt THAT: Consent Application B30/15, requesting separation and conveyance of a parcel of land described as South Part of Lot 24 and Part of the North Part of Lot 24, Concession 2, Wawanosh Ward, Township of Ashfield-Colborne-Wawanosh, be approved with the recommended conditions.

b) B34/15 – Byron Boyes (Owner/Applicant), Part of Lot 13, Concession 5, Wawanosh Ward, Ashfield-Colborne-Wawanosh: (presented by Sandra Weber)

The purpose and effect of this application is for a surplus farm residence severance. The application meets the requirements of the Ashfield-Colborne-Wawanosh (ACW) Official Plan, Huron County Official Plan, Provincial Policy Statement, and Section 51 (24) of the Planning Act. The application has been referred to the Committee for a decision because of one letter of objection from a neighbouring property owner. The Planning and Development Department recommends that the application be approved. ACW Council has recommended that the application be approved. MOTION: Moved By: Councillor Vincent and Seconded By: Warden Gowing THAT: The recommendation of Monica Walker-Bolton, Planner, that Consent Application B34/15, requesting separation and conveyance of a parcel of land described as Part of Lot 13, Concession 5, Wawanosh Ward, Township of Ashfield-Colborne-Wawanosh, be approved with conditions, be approved.

8.2 Stewardship Update: (presented by Rachel White)

The Huron Stewardship Council (HSC) receives staff support and in-kind resources through the Planning and Development Department. Councillor Frayne is Council’s representative on the HSC. Recent projects include beneficial management practices, species at risk recovery, youth education, and habitat restoration. The County’s support of these projects attracts substantial provincial funding for stewardship projects. The Coordinator also works on natural heritage planning and other County projects. 10.1 Implementation of PS 3260 – Liability for Contaminated Sites : (presented by

MOTION: Moved By: Councillor Ginn and Seconded By: Warden Gowing THAT: The Council of the County of Huron approve the Contaminated Sites Policy presented in the report dated August 27, 2015 by Treasurer Michael Blumhagen, entitled “Implementation of PS 3260 – Liability for Contaminated Sites”.

Guy Albert)

This report was requested at the June 17, 2015 Committee of the Whole Day 2 meeting. A report on the balance in the performance bond account will be prepared by the Treasury department.

MOTION: Moved By: Councillor Steffler and Seconded By: Councillor Fergusson THAT: The Council of the County of Huron accept the report of Public Health Manager Jean-Guy Albert, dated September 9, 2015, entitled “Reimbursement of Plumbing Application Performance Bond”, as presented for information; AND FURTHER THAT: The existing Plumbing Application be amended to include that:

The performance bond will be refunded to the property owner when the final inspection has been completed and the work found to be in compliance with existing legislation or, will be refunded in accordance with written direction of the owner.

10.5 Ontario Community Infrastructure Fund application: (presented by Scott Currie) MOTION: Moved By: Councillor Watt and Seconded By: Councillor Van Diepenbeek THAT: The recommendation of Communications/Grants Coordinator Scott Currie, that the Council of the County of Huron endorse the Dashwood/Shipka Storm Sewer project for submission to the Ontario Community Infrastructure Fund (OCIF) for consideration, be approved.

11.1 Union Gas re: TransCanada Pipeline’s East Project. MOTION: Moved By: Councillor Morrison and Seconded By: Councillor Watt THAT: The Council of the County of Huron accepts correspondence not specifically dealt with, for information.

AND FURTHER THAT: CAO Brenda Orchard, Clerk Susan Cronin and County Engineer and Director of Operations, Steven Lund remain in attendance.
