The Council for the Professions Complementary to Medicine appointed the sub-committees

shown hereunder in accordance with Part V Article 26 (3) and (4) of the Health Care

• The Registrar informed all Council members that the health care professionals, who

were previously granted temporary registration, had called again at the Council’s Office

in order to apply for permanent registration after having submitted the relevant

authenticated copy of the Degree/PG Diploma received during their graduation

ceremony.

• The Council agreed that the newly graduated health care professionals (listed hereunder

under new registrations) are to be registered in the respective Registers with effect from

30th January 2020.

Interviews held by the Council’s sub-committees

The Medical Laboratory Science sub-committee conducted two interviews during 2020. The

interviews were held to clarify certain details regarding the applicants’ professional qualities

in Medical Laboratory Science.

➢ The interview held on the 27th August was regarding an applicant who is a non-EU

Citizen. Following the said interview, the applicant was refused registration in the

Medical Laboratory Science Register since s/he did not show that s/he did not possess

the necessary basic knowledge in relation to the profession.

➢ The other interview was held on the 27th August regarding an applicant who is an EU

Citizen. The applicant was granted registration in the Medical Laboratory Science

Register.

Appeal Cases

1. Two applicants, who failed to provide all the professional requirements connection with

their request for registration in the Register of Medical Laboratory Science kept by the

CPCM and who had filed an appeal in May 2013 was still pending.

In December 2020, The Health Care Professions Appeals Committee held an appeal

hearing whereby both the Council and the appellants informed that there is no further

evidence to be submitted. In this regard, during the next hearing, the Healthcare

Professions Appeals Committee will conclude and decide upon this appeal.

2. Three applicants, who failed to provide all the professional requirements connection

with their request for registration in the Register of physiotherapists kept by the CPCM

and who had filed an appeal 2020.

During an appeal hearing held in December 2020, the Council was given 20 days from

the date of submission of evidence by the appellants to provide a written reply to the

Healthcare Professions appeals Committee.

These appeals will continue to be reviewed in 2021.

Court case

During the year in review the CPCM legal counsel continued to attend the court sittings held

in connection with the writ of summon filed in April 2012 by the Malta Dental Technologists

Association against the Superintendent of Public Health and the Council for the Professions

Complementary to Medicine regarding official recognition by the Health Authorities of the

Clinical Dental Technologists and the proposed changes in the programme of the Dental

Technology Course being organised by the University of Malta. The case was still ongoing by

the end of 2020.

Complaints

Allegations of illegal practice by individuals not registered with the Council During the year

in review, the CPCM received information from Healthcare Professionals, Professional

Associations and/or the public regarding individuals who were not registered with the CPCM

and who were allegedly performing the duties of Healthcare Professionals regulated by the

Council and/or advertising such practices. These were varied and included the professions of

Physiotherapy, Audiology, Nutrition and Dietetics.

The Council forwarded the information to the competent Authorities so as to investigate and

take the necessary steps to verify/stop the abuses. The Council regularly notified the individual

concerned or his/her employer/advertising agency that according to the Health Care

Professions Act no one could practice any Healthcare Profession regulated by the CPCM if not

duly registered with this Council. The Council is concerned about allegedly illegal practices

and feels that it is imperative that the health and wellbeing of the public is safeguarded.

benchmarking document. During 2020, all the sub-committees completed their benchmarking

The Council urged all the sub-committee to review and amend the respective Code of

Professional and Ethical Standards. During 2020, all the sub-committees completed the

The Council urged all the sub-committee to formulate and/or review/amend the respective

Codec of Practice. During 2020, all the sub-committees completed the updated documents

Health Care Professions Act (Amendment of Third Schedule) Regulations,

2014

The Council has agreed that the following documents will no longer be requested for

registration:

• Birth Certificate;

• Letter(s) of reference;

• Curriculum Vitae; and

• Residence or Working Permit.

Changes to Requirements for Registration

With regards to the requirements for registration, the Council has agreed that requirements will

change as per the below:

1. Application form.

2. The following documents (English version or Certified Translations):

(a) Identification Document;

(b) Recent Police conduct certificate;

(c) Professional Qualification;

(d) Documentation showing the applicant’s Professional Portfolio and/or the applicant’s

Portfolio of Academic Studies and Practical Training associated with the Profession and in

relation with the professional syllabus performed by the applicant’s Institution;

(e) A Certificate of good standing with the Council the applicant is registered with or, in

Member States where the profession is not regulated, and thus no such certificate can be

issued, a declaration on oath or by a solemn declaration stating that the applicant is not

registered with a Council in another Member State since the profession is not regulated in

such Member State (this should be made by the applicant before a competent judicial or

administrative authority or, where appropriate, a notary or qualified professional body of

the Member State from which the person comes; such authority or notary shall issue a

certificate attesting the authenticity of the declaration on oath or solemn declaration made

by the professional);

(f) English or Maltese Language Proficiency;

(g) If the Professional document or attestations of academic and/or professional competence

provided do not show the name of the Institution, the number of ECTS credits and the

European Qualification Framework (EQF) level, or if the document provided has not yet

been recognised by the Malta Qualifications Recognition Information Centre (MQRIC),

the applicant is invited to provide a letter issued from MQRIC, indicating the level of the

qualification in accordance to the European Qualifications Framework.

Changes to Language Proficiency Requirements

With regards to language proficiency, the Council has agreed that requirements will change as

per the below:

All professionals seeking registration are requested to present either one of the following:

1. A Maltese language certificate; OR

(i) An Ordinary Level MATSEC certificate (MQF level 3); OR

(ii) An Advanced/Intermediate Level MATSEC certificate (MQF level 4); OR

https://myexams.gov.mt/matsec-examinations/

(iii) A Medical Maltese Proficiency Certificate.

2. The applicant can provide evidence that his/her professional qualification(s) (on the

basis of which he/she is applying for registration) was/were acquired through the

medium of English or Maltese and that practice placements in that/those

qualification(s) were undertaken and supervised through the medium of English or

Maltese; OR

3. The applicant can provide evidence that s/he has lived in and practised his/her

profession through the medium of English or Maltese in a country that has English or

Maltese recognised as the official language of that country for a period of not less

than 2 years in the past five-year period; OR

4. Any other proof of English or Maltese language Proficiency.

Additionally, should the applicant choose to opt for other forms of proving language

proficiency, the applicant can opt for either one of the following Secure English Language

Conclusion

The Council is performing in a professional, proficient and effective way and is doing its

utmost to be an accountable Professional Regulatory Authority to meet to the challenges that

the Council encounters.

The Council needs to be adequately and sufficiently prepared to face the years to come. The

increase in the number of regulated professions, besides other issues, makes it imperative for

the Council to adapt itself according to todays’ needs.

With the proper tools and professional goodwill, the Council will persist in achieving and

maintaining a regulatory system which is sensitive to local contexts and which meets the

demands that a modern society needs.
