Re: Comments on Proposed Accreditation Standards

Dear Judge Oliver and Mr. Currier,

We are writing in support of Equal Justice Works’ proposal to revise the Interpretation of Section 303-2 of the final Accreditation Standards to provide a 50 hour aspirational pro bono target for each law student, which can be accomplished through pro bono work, clinics, internships and externships that provide free legal services to people who can’t afford a lawyer.

Law Students for Pro Bono, an initiative of Equal Justice Works, is submitting herein the signatures of 601 law students and graduates from across the country in support of this revision. We believe that law school pro bono projects are an ideal opportunity for law students to help increase access to justice and assist persons of limited means, while gaining practical skills and hands-on experience and ensuring students develop a lifetime commitment to providing legal services to those in need.

We urge the ABA to adopt Equal Justice Works’ proposal for the following revisions proposed Standard 303(b) regarding law school pro bono. The proposed changes are in italic and underscored.

Suggested Revisions to Proposed Standard 303

Standard 303. CURRICULUM

(b) A law school shall provide substantial opportunities to students for:

(1) faculty supervised clinical courses or field placement(s); and

(2) student participation in pro bono legal services or law-related public service activities.

Interpretation 303-2

Rule 6.1 of the ABA Model Rules of Professional Conduct encourages lawyers to provide pro bono legal services primarily to persons of limited means or to organizations that serve such persons. In addition, lawyers are encouraged to provide pro bono law-related public service. In meeting the requirement of Standard 303(b)(2), law schools are encouraged to promote opportunities for law student pro bono service that incorporate the priorities established by the ABA in Model Rule 6.1. To solidify a professional ethic of promoting justice and to assure that

students acquire practical skills and experience, law schools are encouraged to promote law

student participation in at least 50 hours of pro bono legal services and to provide them with

adequate training and supervision. Law schools are encouraged to track the hours and services

that students perform, and to evaluate the impact of their pro bono services. Pro bono and public service opportunities need not be structured to accomplish any of the outcomes required by Standard 302. Standard 303(b)(2) does not preclude the inclusion of credit-granting activities within a law school’s overall program of law-related pro bono opportunities so long as law-related non-credit bearing initiatives, such as pro bono service, summer public interest

internships and externships, are also part of that program.
