RECOMMENDATION
A. That DA 433/246/17 for a Merit form of development is not seriously at variance withthe provisions of the Clare & Gilbert Valleys Development Plan (consolidated 10November 2016).
B. That Development Plan Consent be granted to the development in DA 433/246/17 forthe construction of a domestic outbuilding pursuant to Section 33 (1)(a) of theDevelopment Act 1993, subject to the following conditions –
1. All proposal shall be developed in accordance with the details and plans lodged withthe application, except where varied by the conditions herein.
Reason: To ensure the proposal is established in accordance with the submitted andapproved plans.

2. The external finishes to the building or structure herein approved shall be inaccordance with the materials as specified in the application now approved.Reason: To maintain and enhance the visual amenity of the locality in which thesubject land is situated
3. Where cut and/or fill in excess of 300mm is required as a result of the proposeddevelopment, retaining walls or other suitable soil retention devices shall beemployed.Reason: To ensure that excavations and filled land is stable and will not result in anyadverse impact on adjoining properties.
4. Roof drainage water from the structure shall be disposed to rainwater tanks, streetwater table or stormwater sump on installation of roof cladding being installed so asto avoid nuisance to neighbours or destabilisation to building foundations or to thesubject land itself.Reason: To ensure storm water is disposed of in a controlled and safe manner.
5. The siting of the new building shall maintain at least a 2.5 metre clearance from theexisting septic system. If any part of the proposed development is located within the2.5 metre distance of the septic system, a Foundation Soil and Footing AssessmentReport prepared by a suitably qualified Engineer which satisfies Council that theproposed development will not have any impact un the septic system must beprovided.Reason: To ensure the development does to compromise the integrity of the wastemanagement system.
6. The use of the structure herein approved shall be restricted vehicle and domesticstorage and related purposes only with no commercial trade, business activities orhuman habitation being carried out or allowed to take place at any time.Reason: To ensure the approved use of the development is maintained and notcompromised.
7. That effective measures be implemented during the on-going use of the land inaccordance with this consent to:
prevent silt run-off from the land to adjoining properties, roads and drains; control dust arising from the construction and other activities, so as not to, in
the opinion of Council, be a nuisance to residents or occupiers on adjacent ornearby land;
ensure that soil or mud is not transferred onto the adjacent roadways byvehicles leaving the site;
ensure that all litter and building waste is contained on the subject site in asuitable bin or enclosure; or
ensure that no sound is emitted from any device, plant or equipment or fromany source or activity to become an unreasonable nuisance, in the opinion ofCouncil, to the occupiers of adjacent land.
Reason: To minimise potential adverse off site environmental impacts.
Advisory Notes
Any person proposing to undertake building work within the Clare and GilbertValleys Council is reminded of their obligation to take all reasonable measures toprotect Council infrastructure. Any incidental damage to the infrastructure –

Key factors Comments
Description of the development An application has been made for the construction of a replacement domestic outbuilding in association with an existing dwelling on land that is situated within the Residential Zone.
The subject land is located along Main North Road and will be accessed via King Street, Clare. The subject land has an area of approximately 1465sq/m.
The proposed outbuilding will have an internal floor area of 108sq/m with a 14.4sq/m verandah along the front creating a total floor area of 122.4sq/m. The maximum wall height will be 3.8m with a ridge height of 4m. The frontage of the shed which faces Main North Road will have a lower wall height of 3.2m with the verandah being 2.5m. The site is elevated from Main North Road however the shed will be cut into the land to some extent.
The proposed outbuilding will be utilised as a triple car garage with one of the parks to be utilised for parking the applicant’s caravan.
The proposed outbuilding contains three garage doors on the rear side facing King Street with a verandah, window and another garage door facing Main North Road. The garage door enables access to the extensive front garden from the proposed building.

The subject land is located near the northern entrance of the Clare Township along Main North Road. The subject land identified as allotment 30 in DP 46740 is located within the Residential Zone. The subject site is surrounded by other residential properties.
The locality comprises of similar sized and smaller allotments, the majority have been developed and contain single storey detached dwellings and various outbuildings.
To the immediate north east is a large paddock located in Primary Production Zone land. This agrarian site includes the Inchiquin Homestead which includes stone walls and stables which are State

The proposed site is located on a hill side which ascends to the west and descends down towards the Hutt River to the east. The Hutt River is located approximately 150m from the site.
The proposed site is located along Main North Road which is a major road within the Council area which links directly to metropolitan Adelaide and to the north of the State. The road is heavily used by local and non-local users alike.
The proposed site is surrounded by established trees which provide screening from the surrounding residential streets to the north and west. There is one established street tree along Main North Road in front of the proposed building.

The proposed outbuilding is to be sited to the rear of the site, setback approximately 25m from Main North Road and adjacent the existing character dwelling on site. The proposed outbuilding will be setback 3m from the closest side boundary and 6m from the rear boundary.
The proposed outbuilding will be located on the site of an existing, small shed.
The outbuilding will face towards Main North Road however its purpose as a 3 park garage will be accessed via King Street.
The proposed outbuilding will be cut into the ground to some extent but be raised by 0.5m at the front therefore the front verandah will be approximately 3m above ground level.
The proposed outbuilding will be sited a minimum 6m from the King Street site boundary and 3m from the Sabine Street site boundary. The closest residential dwelling is located approximately 25m from the proposed outbuilding along King Street.
Development Plan provisions and planning assessment
The subject land is located within the Residential Zone whose principal aim is to provide for a pleasant living environment for residential activity with associated buildings, such as outbuildings, and small-scale non residential uses that serve the local community.
A domestic outbuilding in association with a dwelling is an envisaged form of development within the Zone however there are some parameters in which sheds should be designed in order to reduce their impact on the amenity of the Zone which this proposed development does not meet. These parameters are located in PDC 10 of the Residential Zone.
The proposed development varies from the Development Plan in the following way:
Maximum Floor Area – 72 sq/m. Proposed development’s floor area is internally 108 sq/m and 122.4 sq/m includingthe verandah.
Maximum Building Height (from natural ground level) – 3.6m. Proposed development’s maximum building height is4m however this will be benched to some extent to create a wall height of approximately 3.8m at the rear of thebuilding.

Although the proposed development represents a significant variation in the maximum floor area allowed in the Development Plan, the applicant has made a number of design changes to improve its appearance and to enable it to blend in with the existing landscape and reduce its bulk and impact on the landscape.
The applicant has attempted to ensure it is consistent with the Objectives and Principles of Development Control of ‘Siting and Visibility’ of the Development Plan’s General Section. The two objectives being:
1. Protection of scenically attractive areas, particularly natural and rural landscapes.2. Protection and conservation of the scenic landscape of the Clare and Gilbert Valleys as visible from the main
roads and other scenic routes and recreational trails including the Heysen, Riesling, Mawson, Kidman andRattler Trails.
The proposed building is located on Main North Road, one of the key entry roads into the Clare Township from the north therefore design considerations are paramount when considering development applications. The applicant has attempted to reduce the proposed building’s impact on the landscape consistent with ‘Siting and Visibility’ PDCs 1, 4, 5 and 8 in the following ways:
Lowered the building height as much as possible in order to accommodate his caravan. The building’s heightcan not be reduced any further otherwise it would no longer be able to accommodate the caravan.
Created a skillion roof with the pitch height at the rear of the proposed building therefore reducing the visualimpact from Main North Road.
Maintained natural cream colour for the walls and the grey colours for the roof, consistent with the existingcharacter home. The proposed building will be constructed of Colorbond materials.
Provided a front verandah with a window to the proposed building to be consistent with the existing characterhome and reduce its appearance as a shed.
Of particular note are the established trees that are located along King and Sabine Streets and the high level of existing vegetation and well established vegetation located within the site that filters views of the proposed building significantly. The established street trees along Sabine Street largely block views from visitors coming from the north along Main North Road. A number of the trees that exist within the site are also relatively young and will grow over time further softening the appearance of the shed.
The proposed building has also been cut into the landscape to further reduce the height of the building however the proposed building will be 3m high from the front of the verandah due to the need to cut and fill due to the sloping nature of the site. The site can not be cut any further due to there being an existing septic tank in close proximity to the proposed building.
The proposed building is also setback 25m from the Main North Road frontage and therefore is consistent with the 10m setback requirement identified in Table CGV/1 – Building Setbacks from Road Boundaries. However, the site is sloping in nature and therefore would give the proposed building a heightened appearance from the street frontage.
Conclusion
Council’s Development Plan recognises that outbuildings in association with a dwelling are an envisaged use within the Residential Zone however these should be designed within the Zone’s parameters. The proposed building exceeds three of these parameters in PDC 10 including maximum floor area, maximum building height and maximum wall height. The proposed building is almost twice the size of the maximum floor area (72 sq/m) being 122.4 sq/m including the verandah.
Whilst the proposed development does not meet these parameters, the applicant has gone to great lengths to reduce its visual impact on the landscape and to complement the existing character home in terms of colour and the installation of a verandah. In addition, the applicant has cut in the proposed building as much as is practicable and designed a skillion roof which places the pitch at the rear of the building where it will have the least impact. The proposed building also utilizes existing landscaping that will continue to grow over time further filtering views of the proposed development.
I am of the opinion that the applicant has the desire to continue to improve the site as his main place of residence, particularly the character home and its extensive landscaping which has been run-down over time, further enhancing the appearance of this character site and improving the amenity of its locality.

Accordingly, it is considered that the proposed building, owing to the efforts of the applicant to reduce its visual impact and given the context of its locality, represents an acceptable form of development to warrant Development Plan Consent being granted.
