The Anti Counterfeiting Trade Agreement

(ACTA) was a multinational treaty for the

purpose of establishing international

standards for intellectual property rightsenforcement. The agreement aimed to

establish an international legal framework

for targeting counterfeit goods, generic

medicines and copyright infringement onthe internet.

BENEFITSOF ACTA

Enhancing international IPR (IntellectualProperty Rights) enforcement by partnering withcountries that recognize the critical importance ofsuch enforcement.

Strengthening the international fight againstpirate and counterfeiters who steal frombusinesses and workers, discourage innovationand creativity, threaten health and safety,provide an easy source of revenue for organized

crime, and cause loss of tax revenue. Building on the successes of the Strategy

Targeting Organized Piracy (STOP) initiative, agovernment-wide effort started in October 2004to confront piracy and counterfeiting.

A trademark is a word, name, symbol or devicewhich is used in trade with goods to indicatethe source of the goods and to distinguish themfrom the goods of others.

There may be liability for creating a username that confuses other users about yourrelationship to a Trademark owner, or dilutesa trademark owners brand.

There may also be liability for use of

anothers mark in Google Adwords,Keywords, Metatag usage.

DOES COPYRIGHT, TRADEMARK,

ACTA, ETCMAKESENSE?

My conclusion is that the point of Copyright,

Trademark, ACTA, etc just to make a profit. Here

we see the double standard that is at play within

the current system. Where the system is supposed

to be about anyone can succeed, as ifits a free-for-all, level-playing-field, where you can do what you

can to make profits, but then there are rules that

protect the profit making opportunities of some,

while preventing others.
