Mid Term Test B.B.A. LL.B. Semester II Law of Contract I Both questions are compulsory. Each question carries 7 ½ Marks. 1. Ram lends Rs. 10,000 to a Soham (a minor) on the basis of a representation that he was of full age. Soham spent Rs. 5000 out of the total money on purchasing a bicycle and rest of the money rests with him. On Soham’s failure to pay back the borrowed amount, Ram files a suit for recovery of Rs. 10,000. The defendant contends that the nature of contract was absolutely void because of his minority. Discuss whether: (a) Soham can be stopped from pleading his minority. (b) Ram can seek the refund of money under the provisions of the Indian Contract Act, 1872. 2. Three sisters A, B, C, gave an advertisement to sell their car. D, accepting the offer made in the advertisement agreed to purchase the car, paid Rs, 10, 000 as advance to A and decided to take the delivery of the car after a week. In the meantime B, ignorant of the acceptance by D sells the car to her best friend E and gives him the car’s key in the absence of A and C. D files a suit for breach of contract. Decide: a) Whether D can seek any relief? b) Whether the claim of D is going to have any impact on the rights of E?
