    PART I

    1. a) What are the exceptions to the employers liability to

    compensate a workman from a personal injury caused

    to him by an accident arising out & in course of

    employment?

    b) Mr. X a workman, in willful disobedience of an order

    expressly given to him by his employer, meets a serious

    accident resulting a major injury. Is the employer liable

    to pay compensation? Will your answer be the same in

    case the workman dies as a result of the same accident?

    Discuss the legal contention in the light of Workmen s

    Compens at ions Act, 1923.

    Construction sites be maintained? Discuss the various

    civilized society. Enumerate the various types of pumps

    & pipe joints used in construction.

    7. Discuss in brief the util ity of Power & the mode of itssupply in construction sites. Submersible Pumps have

    a distrinct advantage over other pumps Discuss in the

    light of other forms of pumps used in practice.

    as workman as per Workmens Compensat ions Act ,

    1923.

    i) a person employed as a clerk in a colliery.

    ii) a worker engaged in repair of a National Highway by the

    Public Works Department of the Government.

    2. a) Discuss the scope & definition of the term Industryin

    the Industr ia l Disputes A ct, 1947

    b) State giving reasons whether the following are industries

    under Industr ia l Dispu tes Act, 1947 :

    i) A Municipal Corporation.

    ii) A group of hospitals run by a State Government for giving

    Medical relief to citizens & imparting Medical Education.

    iii) Mary lebone Cr i cke t C lub (MCC) or any other club

    incorporated as a company under the Companies Act

    of the respective country.

    iv) An Ayurvedic College of Pharmacy manufacturing

    medicines for sale & for the benefit of students of the

    college besides other activities.

    3. a) 16 employees jointly absent themselves for 7 days

    without due notice with reasonable cause from your

    construction site. As a si te- in-chargecan their wages be

    deducted as per Payment of Wages A ct, 1936?

    b) Mr. X an employee of a grocer shop was NOT paid his

    wage for three months. Can he claim his wages under

    the Payment of Wages A ct, 1936?

    c) What is the maximum wage-period prescribed under the

    Payment of Wages A ct, 1936?
