The current Phase Two reconstruction work by DRP National includes seismic strengthening of the structure, new electric and plumbing systems, restoration of the platforms and signage as well as rehabilitation of damaged siding, eaves, windows and doors to bring the building up to current code. During the Phase Two construction of the project, various potential contract changes for design modifications have been identified and require additional CMA. Approval of additional CMA will allow staff to process contract modifications for work performed by the Contractor and who submitted Requests for Change that have now been found to have merit by Metro staff. ISSUE

Rehabilitation of Lankershim Depot Phase 2-Approve Increase in CMA

DISCUSSION

Metro is rehabilitating the historic Lankershim Depot as approved by the Board under Project Number 800118 Lankershim Depot Transit Center Rehabilitation Project.

During the current Phase Two construction effort, a number of differing site conditions were discovered that required re-design, replacement, or renovation of the structural and architectural components of the building once these areas were exposed. The most significant impacts involve structurally deficient members, including framing and support members due to the age of the building. The impacts ranged from extensive lumber replacement at the platform area -this area had existing concrete cover, to new concrete foundations, rotted out joists and sill plates, the need to strengthen perimeter brick walls, providing a connection between the existing columns and foundations, and reframing inadequate shear walls. There is currently insufficient CMA to cover the identified Contract Modifications. Staff requests approval of an additional $150,000 of CMA for the Rehabilitation of Lankershim Depot Phase Two Project 800118 to complete this project. A detailed matrix of Contract Modifications/Change Orders is shown in Attachment B.

DETERMINATION OF SAFETY IMPACT

This Board action will not have an impact on established safety standards for Metro's Construction Projects.

FINANCIAL IMPACT

The funds for this action are included in the FY14 Budget in Cost Center 8510, Construction Contract under Project 800118. The approved LOP Budget of $3,600,000 is sufficient to complete the project. Since this is a multi-year project, the Project Manager and the Executive Director, Transit Project Delivery is responsible for budgeting in future years.

Impact to Budget

The funding for this action will come from Prop. C 10% funding and from the City of Los Angeles. No other source of funds was considered since this action is within the Life-of­Project Budget. The funds are not eligible for bus or rail operating expenses, but are eligible for specific capital expenses.

ALTERNATIVES CONSIDERED

The Board may decline to approve the recommended actions. This is not recommended as it will prevent the issuance of Modifications for work performed by the Contractor who submitted Requests for Change that have now been found to have merit by Metro staff.

A. Procurement Background

On July 11, 2013, Contract No. C0984R was awarded to DRP National Inc., the lowest responsive and responsible bidder, in the amount of $1,320,340, for the shell and core rehabilitation of the Historic Lankershim Depot, including hazardous soils removal. The project site is located at 11275 Chandler Boulevard, in North Hollywood, Ca.

Attachment B shows that thirteen (13) modifications and one (1) change order have been issued to date to add and/or delete work and nine (9) modifications are currently in negotiation.

B. Cost/Price Analysis

The recommended price of any future changes will be determined to be fair and reasonable based upon an independent cost estimate, cost analysis, technical evaluation, fact finding, and negotiations.

C. Small Business Participation

The Diversity and Economic Opportunity Department (DEOD) established a 10% Small Business Enterprise (SBE) goal for this procurement. DRP National, Inc. made a 0% SBE commitment. DRP indicated that their efforts to secure Metro certified SBE contractors yielded no responses due to the historic nature of this project. At the time of award, achieving the goal was neither a condition of award nor an issue of responsiveness.
