The Environmental Restoration and Redevelopment Program (ERRP) of the Maryland Department ofthe Environment (MDE) is responsible for managing the investigation and cleanup of uncontrolledhazardous substance releases at sites throughout the state of Maryland. ERRP efforts protect publichealth and the environment by abating uncontrolled discharges of hazardous substances and ensuringthat measures are taken to protect public health and the environment.

PROGRAM ORGANIZATION

The ERRP is comprised of three Divisions that oversee and conduct investigations and cleanups athazardous substance release sites. The State Superfund Division oversees cleanups of historicallycontaminated hazardous substances at sites that are not on the United States Environmental ProtectionAgency's (EPA) NationalPriorities List (NPL). Oversight ofenvironmentalremediation at sitesthroughout Maryland isprovided with primaryemphasis on the StateMaster List, a list of sitesknown or reported to becontaminated byhazardous substances.Currently, this part of theProgram oversees cleanup at over 35 sites including 6 “Pilot Deferral” NPL caliber sites.

The Division also conducts assessments of property on brownfields and other sites using EPA funds.Brownfields are abandoned or under-utilized industrial or commercial properties where real orperceived environmental contamination hinders redevelopment. Complementary to the BrownfieldAssessments, the Division prepares Site Surveys, Preliminary Assessments and Site Investigationreports for EPA Region III under a Superfund Pre-Remedial Cooperative Agreement.

The Federal Facilities/NPL Superfund Division oversees the investigation and remediation of sitesthat are listed on the NPL and sites where the Department of Defense (DOD) is a responsible party tothe contamination at sites. The Federal Facilities Section oversees DOD lead hazardous substancerelease site cleanups. The Section ensures that state requirements are considered and public health andthe environment are protected at sites where the Department of Defense is responsible forcontamination. The Federal Facilities Section currently oversees environmental activity at 21 sites inMaryland including Aberdeen Proving Ground, Fort Detrick and the Naval Air Station at Patuxent

River. Five of these federal sites are listed on the NPL.

The Federal Facilities Section placesemphasis on Base Realignment andClosure sites and other military facilitiesscheduled to close to facilitate reuse ofthese properties. Through partneringefforts with these facilities and theEPA, the Section is able to expediteassessment, evaluation and, wherenecessary, remediation ofenvironmental conditions at these sites.

The NPL Superfund Section overseesthe remedial activities at NPL sites notowned by the federal government. Atthese sites, a responsible party to thecontamination at a site conducts boththe investigation and remediation under

the oversight of the EPA and the MDE. If no viable responsible party is available to address thecontamination at a site, then the EPA, with the support of the MDE, conducts the requiredenvironmental studies. The NPL Section currently is overseeing work at eight NPL sites.

The Voluntary Cleanup/BrownfieldsDivision encourages the voluntary cleanup andredevelopment of contaminated propertiesthrough a streamlined regulatory process. Theprogram enables eligible purchasers of propertyto substantially limit liability for pastcontamination prior to purchase of theproperty. The Voluntary Cleanup Program(VCP) works closely with the BrownfieldsRevitalization Incentive Program, administeredby the Maryland Department of Business andEconomic Development, to provide financialincentives in the form of tax credits, grants andloans for redevelopment of eligible brownfieldproperties.

The following highlights the major activities conducted from each of the ERRP Divisions.

State Superfund Division

In 1999, the State Superfund Division requested federal Superfundfunding to assess 132 State Master List sites that are suspected tobe contaminated with hazardous substances or materials. Thefunding request was the first step in a 3-step process to allow theMDE to determine those sites that required remediation and todetermine if the current property owner would perform thenecessary work. In step 1 of the 3-step process, the Divisionconducted site surveys on the 132 State Master List sites (see Appendix 1). In the second step of the3-step process, the State Superfund Division received in FY 2000 $241,451 in State general funds toconduct site assessments/ remedial investigations at seven sites that had been screened from step 1. The final step, to begin in FY 2001, will use $750,000 from the State Capitol Budget "PAYGO" funds

To date, the State SuperfundDivision using EPA funding hasconducted 58 assessments ofbrownfield properties totaling over967 acres of properties located inurban, as well as more rural areas,across Maryland.

to begin State funded remediation at a contaminated step-2 site where the person(s) identified asresponsible for the release of hazardous substances either refused or was unable to perform thenecessary remediation work.

Brownfields Assessments

The State Superfund Division for the past 5 years has been an active participant in the EPA-fundedBrownfields Site Assessment Initiative. Under this initiative, Federal funds are used to conduct siteassessments on publicly owned brownfields sites. To be eligible for the program, sites must be vacant orunder-utilized, where remediation is feasible and where redevelopment will create jobs and improve thelocal tax base. To date, the Division has conducted 58 assessments of brownfield properties totaling

Baldwin House PropertyHagerstown, Maryland

The Baldwin House property in Hagerstown,Washington County, Maryland is an excellentexample of how pivotal a brownfieldsassessment can be in facilitating reuse ofproperty. This one-acre property, formerlyused as a hotel and department store facility, isowned by the City of Hagerstown. Theproperty has not been used for the past 17years. The City of Hagerstown has targetedeconomic development efforts toward thisproperty because of the site’s location,infrastructure and flat topography. Using EPAfunding, the State was able to assess the interiorand exterior area of the property at the requestof the University of Maryland. This additionalenvironmental assessment information is beingused to enter the site in the State’s VCP wherea plan will soon be prepared to address any environmental issues. Prospective purchasers andlessees have been interested in the site but environmental issues have proved to be a barrier. Thisassessment will facilitate the reuse of the property as an extension of the University of Maryland.

over 967 acres of properties located in urban, as well as more rural areas, across Maryland. Eachbrownfield assessment increases the potential for reuse of that property by providing prospective buyerswith the environmental information necessary to quantify the extent of environmental costs that will berequired to meet public health and environmental protection standards, if any. In some cases, theassessments have determined that there are no further requirements necessary for properties whichincreases the likelihood that those properties will be redeveloped.

The Maryland Voluntary Cleanup Program

When Governor Glendening signed emergency legislation in February 1997 creating a VCP withinMDE, a Brownfields Revitalization Incentive Program within the Department of Business and EconomicDevelopment, and expanded protection for lenders on contaminated properties, he said, "Thebrownfields law would help save undeveloped land around the State while helping bring jobs back intoolder areas in furtherance of Smart Growth." At the present time, 44 sites have been accepted into theVCP, cleanup is underway at five of the approved sites, and 11other sites are pending (applicationsbeing reviewed or awaiting additional information to complete the application packages). In addition,27 sites have been completed: 23 sites have received No Further Requirements Determinations andfour sites have received Certificates of Completion. The 55 sites for which applications have beenreceived represent 1,355.86 acres of property in Baltimore City and Allegany, Anne Arundel,Baltimore, Carroll, Cecil, Dorchester, Howard, Montgomery, Prince George’s, Washington andWicomico counties.

The VCP reforms the process used to clean up eligible properties that are, or perceived to be,contaminated by hazardous substance release. In addition to providing a streamlined cleanup process,the VCP law provides liability protection for certain prospective owners of eligible properties in theProgram to encourage the transfer of properties. These changes provide more "certainty" regardingenvironmental requirements to both responsible persons and future owners of a property therebyallowing parties to more accurately predict costs and time lines associated with a cleanup and increasingthe likelihood of cleanup and redevelopment.

The Brownfields Revitalization Incentive Program provides property tax credits for the redevelopmentof brownfields in participating jurisdictions. This program also provides loans and grants to inculpablepersons toward the remediation of property contaminated by hazardous substance release or oil,thereby "jump starting" the redevelopment process where cleanup will have significant environment,economic development and urban revitalization benefits.

Additional enhancements to the Brownfields Revitalization Incentive Program were recently passed bythe Maryland General Assembly during the 2000 legislative session. Effective October 2000, theDepartment of Business and Economic Development will be able to offer either low rate loans or grantsto both prospective owners or responsible persons for the conduct of a Phase I and II environmentalaudit at eligible Brownfield sites.

To increase the likelihood of cleanup and redevelopment under the VCP, a Memorandum ofUnderstanding was signed in 1997 by MDE and EPA Region III. The agreement addresses federalliability of a participant in Maryland’s VCP by providing that EPA will consider sites (in Maryland’sprogram) of no interest. Eligible properties in Maryland’s VCP will fall under this agreement once a nofurther requirements determination or certificate of completion has been issued for the property byMDE.

MDE’s ERRP is currently developing regulations to further streamline and standardize the applicationand response action plan approval process and fully implement the requirements of the VCP law. In theshort term, uniform numeric cleanup standards are being developed to standardize the process ofinvestigation, while program regulations will be developed over a longer time frame.

MDE continues to promote the VCP through the many forums, workshops and symposiums sponsoredby the private sector and local governments and individual meetings with potential applicants. Pleasesee Appendix 2 for the VCP Information Document.

properties by significantly limiting thepurchaser's liability for existing environmentalcontamination.A response action plan for the CSX FormerBolt and Forge property was developed andimplemented by CSX to address the soil andgroundwater contamination. Remediation ofthe property began in 1998 in accordancewith the response action plan approved by theDepartment. Although the plan addresses allareas of soil and groundwater contaminationon the 33-acre site, the first phase of the planfocused on a 11.5-acre portion of theproperty. Remediation activities, includingexcavation of contaminated soils and cappingof certain portions of the 11.5-acre site havebeen completed and construction of ashopping center, with a major food marketchain as the anchor store, is now in operationat the site.

CSX Former Bolt and Forge PropertyCumberland, Maryland

Focus On A Voluntary Cleanup Program Site

The CSX property remained vacant for over a decade.

A successful example of a Voluntary CleanupProject is the CSX Bolt and Forge propertylocated in downtown Cumberland. This 33-acre site had been used for steel boltfabrication and metal forging operationsbetween 1920 and the early 1970s. Allstructures were razed in the mid-1980s andthe site remained vacant for over a decadeprior to acceptance into the VoluntaryCleanup Program. The developer of aportion of the property, having no current orprior ownership or interest in the property,was accepted as an inculpable personparticipant in the Program. The inculpableperson status encourages new investment in

NPL Sites

During State FY 2000, the NPL Superfund Section provided regulatory and technical oversight at 8 privatesector NPL sites. It is anticipated that the construction phase of the remedial action at several of these siteswill be completed during State FY 2001. Construction work at the Woodlawn Landfill in Cecil County,Bush Valley Landfill in Harford County, and the Southern Maryland Wood Treating site in St. Mary’sCounty should be completed during State FY 2001. During FY 2001, the Section will focus much of theirefforts on the remaining active NPL sites which are the Kane and Lombard site, the Maryland Sand, Graveland Stone site, the Spectron site, the Ordnance Products site, and the Central Chemical site. The Sectionreceives financial support, through a series of cooperative agreements, from the EPA to provide supportagency regulatory oversight at private sector and fund lead NPL sites.

Federal Facilities

During State FY 2000, the Federal Facilities Section provided support, regulatory and technical oversightat 7 DOD NPL sites, 5 DOD Defense Base Closure sites, and approximately 9 other DOD sitesthroughout Maryland. Work at a total of 28 DOD facilities is planned during FY 2001. The Sectionreceives financial support, through a cooperative agreement from the DOD, to provide regulatory oversightand to generally support environmental work, which is funded by the Defense Environmental RestorationAccount.

Since 1995, the Section has been actively involved in “formal partnering with a number of DOD facilitiesin Maryland. The Section has had a very positive experience with the partnering process. The progress ofenvironmental work at a number of Army and Navy facilities has been significantly accelerated as the resultof the “partnering” process. In addition to the success at Ft. George G. Meade’s Tipton Army AirfieldBase Closure site, the Section’s partnering efforts at the Naval Air Station facility at Patuxent River hassignificantly contributed to the Navy’s efforts to accommodate Base Realignment activities and to

Opening ceremonies for Tipton Airfield, located at Fort Meade inAnne Arundel County, were held on November 1, 1999 toofficially mark the removal and delisting of the 366 acre site fromthe national list of most hazardous waste sites known as theNational Priorities List (NPL) or “Superfund” sites. Fort Meadewas designated as a Superfund Site and listed on the NPL in July1998.U.S. Sens. Paul S. Sarbanes and Barbara Mikulski, Rep. WayneT. Gilchrest, U.S. Environmental Protection Agency (EPA)Assistant Administrator Tim Fields, Anne Arundel CountyExecutive Janet Owens, and Maryland Department of the

Environment (MDE) Deputy Secretary Arthur Ray were amongthe nearly 150 who participated in the ceremonies.The Tipton Airfield will now become a public airport managedand operated by Anne Arundel County. The Army is now in thefinal stages of formally transferring the former Fort Meademilitary airfield to the county. The delisting of the Tipton Airfield parcel took only 15 monthsto complete and is now recognized nationally as the months to complete and is now recognized nationally as

the fastest NPL delisting of a superfund site to date. To establish this landmark record for environmentalcleanup, close cooperation and partnering between MDE, EPA and the Department of the Army wasnecessary. The result of these efforts was the expedited restoration and cleanup of the airfield site in a safeand efficient manner.

On Feb. 14 the U.S. Navy broke ties with the NavalTraining Center-Bainbridge (NTCB). That day aceremony was held at NTCB to celebrate the transferof the 1,185 acres of property from the Navy to theBainbridge Development Corporation.

Since the closure of naval operations there in 1976,the installation began to deteriorate. In 1986,Congress authorized the Secretary of the Navy todispose of the NTCB by sale to the private sector ortransfer to other government agencies. Congressspecified that before any transfer of the property, theNavy was required to “restore such property to acondition that meets all applicable federal and stateenvironmental protection regulations.”

To achieve this mission, the Navy launched environmental cleanup operations atthe NTCB. In this effort, the Navy worked closely with federal and stateofficials to meet all applicable environmental cleanup requirements. Throughthose years, MDE played a vital role in assuring that all necessary environmentalinvestigations and remedial actions were completed.

• Demolition of 429 buildings and proper disposal of 400,000 cubic yards ofdemolition debris and asbestos;

• Remediation of 40,000 cubic yards of petroleum and pesticide contaminated soil atthe former Fire Training Area and removal of 267 underground storage tanks;

• Remediation and capping of the Old Base Landfill and an on-site rubble landfill;• Cleanup and off-site disposal of 149,000 tons of asbestos (transite) and lead

contaminated soils, 650 tons of PCB contaminated soils, and 900 tons of heavymetals and PAH contaminated soils and debris.

By the end of 1999, the Navy had completed all required environmental cleanup actions. At its conclusion, theNavy spent in excess of $50 million dollars (well over 50 times the purchase price of the Tome portion of theproperty in 1942) to achieve final environmental cleanup of NTCB.
