Article I: Article I:

I am an American, fighting in the forcesWhich guard my country and our way of life. I am prepared to give my life in their defense.

Explanation.The code applies to all service members at all times,whether in active combat, in captivity, or in peacetimeas a result of hostage situations and Terroristactivities. Members of the Armed Forces have a dutyto support U.S. interests and oppose U.S. Enemiesregardless of the circumstances.

Article II: Article II:

I will never surrender of my own free will. If incommand, I will never surrender the members of mycommand while they still have the means to resist.

Explanation.Members of the Armed Forces may never surrender voluntarily. Asoldier’s duty is to avoid capture and return to friendly forces even When isolated, and no longer able to inflict casualties on the enemy or otherwise defend themselves. The means to evade isConsidered exhausted when escape is impossible. The means toresist is considered exhausted when Further fighting would lead tothe soldier’s death with no significant loss to the enemy.

Article III: Article III:

If I am captured, I will continue to resist by all meansavailable. I will make every effort to escape and aid

others to escape. I will accept neither parole norspecial favors from the enemy.

Explanation.Members of the Armed Forces must understand that a Captivesituation is to be considered an extension of the battlefield and theenemy has used a variety of tactics to exploit prisoners of war indisregard of the Geneva Convention of 1949 Relative to the Treatmentof Prisoners of War. These efforts have included physical and mentalharassment, general mistreatment and torture, medical neglect, andpolitical indoctrination. The duty of a member of the Armed Forces tocontinue resistance to enemy exploitation by all means available Isnot lessened by the misfortune of capture.

Article IV: Article IV:

If I become a prisoner of war, I will keep faith with myfellow prisoners. I will give no information or take part inany action which might be harmful to my comrades. If I

am senior, I will take command. If not, I will obey thelawful orders of those appointed over me and will back

them up in every way.

Explanation.Officers and noncommissioned officers will continue to carry out theirresponsibilities and to exercise their authority in captivity. Informingon fellow prisoners of war (PWs) is forbidden. PWs must especiallyavoid helping the enemy to identify fellow PWs who have informationthat is of value to the enemy. These PWs may be made to suffercoercive interrogation because of their knowledge.

Article V: Article V:

When questioned, should I become a prisoner of war, I am required to give name, rank, service number, anddate of birth. I will evade answering further questions

to the utmost of my ability. I will make no oral or writtenstatements disloyal to my country and its allies or

harmful to their cause.

Explanation.When questioned a PW is required by the Geneva Conventions and the Code of Conduct, E.O. 10631 and is permitted by the UCMJ to give name, rank,service number and date of birth. Under the Geneva Conventions the enemy has no right to try to force a PW to provide any additional information.

However,it is unrealistic to expect a PW to remain confined for years reciting only name, rank, service number and date of birth. There are many PW camp situations inwhich certain types of conversation with the enemy are permitted. For example,a PW is allowed, but not required by the Code of Conduct, the UCMJ or theGeneva Conventions to fill out a Geneva Conventions “capture card,” to writeletters home, and to communicate with captors on matters of health and welfare.

Article VI: Article VI:

I will never forget that I am an American, fighting forfreedom, responsible for my actions, and dedicated to

the principles which made my country free. I will trust inmy God and in the United States of America.

Explanation.A member of the Armed Forces remains responsible for personalactions at all times. Article VI is designed to assist members of theArmed Forces to fulfill their responsibilities and survive captivity withhonor. The Code of Conduct, E.O. 10631, does not conflict with theUCMJ, and the latter continues to apply to each military memberduring captivity or other hostile detention. Soldiers, whetherdetainees or captives, can be assured the U.S. Government will makeevery effort to obtain their earliest release. Faith in one’s country andits way of life, faith in fellow detainees or captives, and faith in one’sself are critical to surviving with honor and resisting exploitation.
