Executive Summary

Modern Building Certifier’s have reviewed the architectural design documentation against the requirements of the National Construction Code Series (Volume 1) – Building Code of Australia (BCA) 2016.

The purpose of the assessment is to provide surety to the Consent Authority, that the buildings ‘design is capable of complying with the BCA and that subsequent compliance with the provisions of Parts C, D E, F & J of the BCA will not give rise to further modifications to the building that may necessitate additional design changes.

Our assessment of the concept design documentation was based on the following:

National Construction Code Series (Volume 1) Building Code of Australia 2016 (BCA)

Architectural Design Drawings – refer to Appendix A. Access to Premises – Buildings Standards 2010 (Access Code) Environmental Planning and Assessment Act 1979 (EP&A) Environmental Planning and Assessment Regulation 2000 (EP&AR)

The objectives of this statement are to:

Undertake an assessment of the proposed architectural design documentation against the Performance Requirements of National Construction Code Series 2016 (Volume 1) - Building Code of Australia (BCA).

Accompany the submission of the Development Application to Strathfield Council to enable the Consent Authority to be satisfied that the building design is capable of complying with the BCA and that subsequent compliance with Parts C, D, E, F & J of the BCA will not give rise to further design changes to the building.

Identify any BCA compliance issue that require resolution at the Construction Certificate stage. These matters are to be considered pursuant to Cls 53 .4 of the EP&A Regulation 2000.

Enable the certifying authority to satisfy its statutory obligations under Clause 143(1) (3) of the Environmental Planning and Assessment Regulation, 2000.

Enable the certifying authority to satisfy its statutory obligations under Clause 145 of the Environmental Planning and Assessment Regulation, 2000.

Enable the certifying authority to satisfy its statutory obligations under Clause 17 & 18 of the Building Professionals Regulation 2007.

1. Introduction

The subject site is currently a single storey brick dwelling with a tiled roof, with frontages to Torrington Road to the north and Woodward Avenue to the south.

The proposed development will include alterations and additions to convert the existing residential dwelling to a childcare centre.

Carparking will be available on site for employees and parent parking.

1.1 Current Legislation

The applicable legislation governing the design of buildings is the Environmental Planning and Assessment Act 1979. This Act requires that all new building works must be designed to comply with the BCA.

The version of the BCA applicable to the development, is version that in place at the time of the application to the Certifying authority for the Construction Certificate. For the purposes of this report, the proposed building works have been assessed against NCC – BCA 2016.

1.2 Consent Authority May Require The Building To Be Upgraded

The local authority when assessing the development application may require that the existing building be brought into partial on full compliance with the current provisions at the BCA. The trigger for upgrade includes:

Where the building works, together with any other works completed or authorised within the previous 3 years, represents more than half the total volume of the building; or

Council are not satisfied the measures contained in the building are not adequate for the safety of present using the building or prevention of special to adjacent buildings.

The proposed building works have been assessed under Clause 143 of the Environmental Planning and Assessment Regulation 2000, in relation to the following: (a) the fire protection and structural capacity of the building will be appropriate to

its new use, and (b) the building will comply with such of the Category 1 fire safety provisions as are

applicable to the new use.

1.3 Disability (Access to Premises — Buildings) Standards 2010

The Disability (Access to Premises — Buildings) Standards 2010 commenced on 1 May 2011. These take effect subject to subsection 31 (4) of the Disability Discrimination Act 1992. The objects of these Standards are:

1. To ensure that dignified, equitable, cost-effective and reasonably achievable access to buildings, and facilities and services within buildings, is provided for people with a disability; and

2. To give certainty to building certifiers, building developers and building managers that, if access to buildings is provided in accordance with these Standards, the provision of that access, to the extent covered by these Standards, will not be unlawful under the Act.

This Standards is to be applied to a new buildings (including Class 3, 5, 6, 7, 8, 9 or 10), a new part of a building (an extension to the building or a modified part of the building) and an affected part. An affected part is defined as:

a) The principal pedestrian entrance of an existing building that contains a new part; and

b) Any part of an existing building, that contains a new part, that is necessary to provide a continuous accessible path of travel from the entrance to the new part.

Where the project involves the internal works within part of an existing building by the building owner; The Access to Premises Legislation (2010) defines these new works as the new part of the building and requires that the affected parts of a building are also made accessible and compliant to the requirements of AS1428.1 2009 and the Access to Premises Legislation (2010) technical provisions. Affected parts are defined as the principal pedestrian entrance and a continuous path of travel between the primary entrance and the new part. (PS 2010 pg. 5-6). In this case this also includes the condition of the existing lift to travel between levels.

Where the project involves internal alterations within an existing building in which the client is a lessee; The Access to Premises Standard (2010) defines new works as the new part of a building and requires that affected parts of the building are also accessible. Affected parts are defined as the principal pedestrian entrance and a continuous path of travel from the entrance to the new part. There is an exemption to this requirement whereby if the lessees (not building owner) submit an application for approval for building works they are exempt from this requirement. As such there is no requirement under the Access to Premises Standard (2010) to provide alteration to the lift/ building entry.

Building work to which the Premises Standards apply

The Premises Standards apply to: a new building a new part of an existing building The affected part of an existing building.

Affected part means: the principal pedestrian entrance of an existing building that contains a new

part and Any part of an existing building that contains a new part, that is necessary to

provide a continuous accessible path of travel from the entrance to the new part.

The affected part of a building must comply with the new access requirements where alterations and/or additions are proposed to an existing building, and the proposed work is subject to a complying development certificate or a construction certificate

How the affected part applies

The affected part of the building: Must be “upgraded” to comply with the Premises Standards subject to any

exceptions or concessions Only applies to any part of an existing building once work requiring building

approval is to be undertaken.

3. Structural Provisions

Any new structural works are to comply with the applicable requirements of AS/NZS 1170.1.

Glazing is to comply with AS1288, and AS2047.

Prior to the issue of the Construction Certificate structural certification is required to be provided.

4. Fire Resistance

The buildings should be constructed generally in accordance with Table 5 of Specification C1.1 of the Building Code of Australia 2016. The building is required to be Type C Construction.

A building of Type C construction is required to achieve the following fire resistance level (FRL’s) based upon the setback from the side boundaries:

External Walls FRL’sLess than 1.5m 90/90/901.5m to less than 3.0m 60/60/603m or more -/-/-

The existing building is setback 1575mm from the western boundary. The external walls of the building is required to achieve an FRL of not less than 60/60/60. Based upon the external walls being brickwork, it is our opinion compliance will be achieved with the requirements of the BCA.

4.1 Protection of Openings

The prescriptive provisions of the BCA stipulate that openings within building elements required to have an FRL shall be protected as follows:

Any external opening within 3m of the side boundary must be protected in accordance with C3.4 of the BCA, as specified below:

a) External wall-wetting drenchers used with windows that are automatic closing or permanently fixed in the closed position; or

b) -/60/- fire windows that are automatic closing or permanently fixed in the closed position; or

c) -/60/- automatic closing fire shutters

The architectural drawings at construction certificate stage will need to be suitable detailed to indicate the method of protection of openings along the western external wall. The permanent fixing of the windows as specified in (a) and (b) will require rooms to be served by mechanical ventilation system in accordance with AS 1668.2 and AS/ZNS 3666.1.

4.2 Fire Hazard Properties

The fire hazard properties of fixed surface linings and mechanical ductwork will also need to be addressed within the detailed documentation phase pursuant to specification C1.10 Building Code of Australia.

5. Egress

The egress provisions from the proposed building are provided by:

External perimeter doorways

A class 9b building used as an early childhood centre must be served by 2 required exit that discharge outside the building. The building is served by 2 required exit doors. Each of these doorways must swing in the direction of egress from the building.

Other detailing issues that will need to be addressed include:

Door Hardware Exit door operation Handrail and balustrade construction Details of the egress provisions to the Road.

5.1 Exit Travel Distances

The locations of the proposed exits would appear to indicate that the deemed to satisfy requirements in terms of travel distances, distances between alternative exits and egress widths would be satisfied for insert relevant parts of the building parts of the buildings.

The travel distances to exits should not exceed:

Class 5-9 20m to a single exit or point of choice and where two exits are provided, a maximum

of 40m to one of those exits; andexits shall be located to not be more than 60m apart and not closer than 9m

The location of required exits indicate travel distances will comply with the prescriptive provisions of the BCA.

5.2 Dimensions of Exits

Minimum dimensions of 1000mm and 2000mm height to be provided within exits, with the paths of travel should provide a minimum width of 1000mm (note that all maintenance access, cat walks, etc. may comply with AS1657 in which case a 600mm clear width is required).

The exit width provided is 1.7m.

The total aggregate exit width within the building caters for the expect occupants to be accommodated within the building.

The following doors being designed to swing in the direction of egress:

Foyer entry doors (adjacent to laundry).

Doorways are permitted to contain a clear opening width of 750mm with a height of 1980mm as part of egress requirements. Access for persons with disabilities however requires a clear doorway opening width of 850mm (i.e. minimum 870 mm doors).

5.4 Balustrading and Handrail

Balustrading to a height of 1000mm with a maximum opening of 125mm in any direction should be provided adjacent to balconies, landings, corridors etc. where located adjacent to a change in level exceeding 1000mm.

Handrails should generally be provided at a minimum height of 865mm alongside of all ramps and stairs.

The main public stairs and ramps should be designed in accordance with the requirements of AS1428.1-2009 for persons with disabilities. This requires a handrail on each side of the stair and ramp and for the handrail to extend approximately 550mm – 600mm past the last tread / end of ramp.

5.5 Access for Persons with a Disability

Access for people with disabilities shall be provided to and within the building in accordance with the requirements of Clause D3.2, D3.3 and D3.4 of the BCA 2016. Parts of the building required to be accessible shall comply with the requirements of AS1428.1-2009.

The design would generally comply with the prescriptive provisions of the BCA with additional ongoing review being undertaken as to door widths, circulation, etc.

Where the main public entrance is via a ramp, tactile indicators shall be provided in accordance with AS 1428.4 at the top and bottom. Parking shall be provided for people with disabilities in accordance with in accordance with Clause D3.5 of the BCA. Facilities services and features of the building accessible to people with disabilities shall be identified by signage complying with Clause D3.6 of the BCA.

General

Access to be provided to and within the building pursuant to AS1428.1-2009 as follows:

Via the principle public entry and at least 50% of all other entrances From designated car parking spaces for the use of occupants with a disability. All areas used by the public.

Note that entrances that are not accessible are to be located within 50m of an entrance that is accessible.

If an inbuilt amplification system is to be installed a hearing augmentation-listening system shall be installed throughout the building in accordance with the requirements of Clause D3.7 of the BCA.

Accessible Carparking

At least 1 carparking space must be provided for people with a disability in accordance with AS/NZS 2890.6.

A review of the architectural design drawings indicate the shared area will have a width less than 2.4m. It is noted there is a reduced width of 69mm. It is considered this is a minor encroachment and will not impact upon the functional use of the accessible carparking space.

It is recommended that an Access Consultant prepare an alternative solution at the construction certificate stage to satisfy the performance criteria of the BCA.

6. Fire Services & Equipment

The following fire services will need to be provided throughout the building:

Portable Fire Extinguishers in accordance with Clause E1.6 of the BCA and AS 2444-2001,

Emergency lighting, exit signage and directional exit signage is required throughout the building in accordance with Part E of the BCA and AS/NZS 2293.1-2005

6.1 Fire Hydrants

A system of Fire Hydrants is not required to be provided to BCA Clause E1.3 and AS 2419.1-2005 as the building has a floor area less than 500 square metres.

6.2 Fire Hose Reels

A Fire Hose Reel System is not required to BCA Clause E1.4 and AS2441 as the building has a floor area less than 500 square metres.

7. Ventilation and Smoke Hazard Management

Smoke hazard management shall be provided throughout the building by means of the following systems:

Automatic Shutdown of Mechanical Systems in accordance with the requirements of AS/NZS 1668.1-1998;

Throughout the development the provision of natural or mechanical ventilation is required to all habitable rooms in accordance with F4.5 Building Code of Australia and AS 1668 and AS/NZS 3666.1.

8. Sanitary Facilities

The sanitary & other facilities within the development would generally consist of: -

Children: 5 pans, 5 basins for each sex and one unisex assisted pan & basin. Unisex Accessible for staff & public Staff Unisex facility.

Facilities for use by children must be –

Junior pans; and Washbasins with a rim height not exceeding 600mm; and Accessible from both indoor and outdoor play areas

A single unisex staff facility is capable of catering for a maximum of 10 staff members.

Please note the Unisex facilities provided for people with disabilities may be counted once for each sex. These facilities are to be provided in accordance with AS1428.1-2009.

The staff unisex facility is required to be an ambulant facility compliance with AS 1428.1-2009.

A Class 9b early childhood centre must be provided with— (i) a kitchen or food preparation area with a kitchen sink, separate hand washing

facilities, space for a refrigerator and space for cooking facilities, with— (A) the facilities protected by a door or gate with child proof latches to prevent

unsupervised access to the facilities by children younger than 5 years old; and

(B) the ability to facilitate supervision of children from the facilities if the early childhood centre accommodates children younger than 2 years old; and

(ii) one bath, shower or shower-bath; and (iii) if the centre accommodates children younger than 3 years old—

(A) a laundry facility comprising a washtub and space in the same room for a washing machine; and

(B) a bench type baby bath, which is within 1 m of the nappy change bench; and (C) a nappy changing bench which—

(aa) is within 1 m of separate adult hand washing facilities and bench type baby bath; and

(bb) must be not less than 0.9 m2 in area and at a height of not less than 850 mm, but not more than 900 mm above the finished floor level; and

(cc) must have a space not less than 800 mm high, 500 mm wide and 800 mm deep for the storage of steps; and

(dd) is positioned to permit a staff member changing a nappy to have visibility of the play area at all times.”

The construction certificate drawing will need to be suitable detailed to demonstrate compliance with the abovementioned provisions of the BCA.

9. Energy Efficiency

The proposed refurbishment of the building to class 9b childcare centre shall comply with Part J of the BCA. To achieve compliance, there are two options available:

1. The building can comply with the deemed-to-satisfy provisions of the BCA, relating to the following areas:

Building Fabric Glazing Building Sealing Air Conditioning & Ventilation Systems Artificial Lighting & Power Hot Water Supply

2. The building can be verified against a reference building as per Verification Method JV3. This requires that the proposed building and its services be shown to have an annual energy consumption of equal or less than the reference building which has been modelled as per the requirements of Part J of the BCA.

Certification from an appropriately qualified engineer should be provided for either option with a report / computations outlining how compliance is achieved.

Access for maintenance is to be provided to the building in accordance with the requirements of BCA Part J8.

The proposed site will be located in a climate zone 5.

10.3 Floors

Floors are to achieve an R rating of 2.0.

10.4 Glazing

This section relates to the conductance and solar heat gain of the windows, taking into consideration of the type of window frame, orientation and whether there are overhangs / shadings.

A glazing calculator will be required to be undertaken and results provided for assessment.

10.5 Building Sealing

A Seal to restrict air infiltration must be fitted to each edge of the external doors and openable windows. The seals may be foam or compressible strip, fibrous seal or the like. The main entry doors must have either an airlock, or self-closing doors, or a revolving door.

Miscellaneous exhaust fans must be fitted with a sealing device such as a self-closing damper.

An evaporative cooler must be fitted with a self-closing damper.

10.6 Air Conditioning

Be capable of being inactivated in each Sole Occupancy Unit. Where motorised dampers, be close when system is inactivated
