PRELIMINARY ALLEGATIONS

1. Plaintiff Shawn Shirvan ("Plaintiff") is a natural person and a resident of Orange

:ounty, California. Plaintiff is an American citizen who was born in Tehran, Iran.

2. Defendant ASTECH Engineered Products, Inc. ("ASTECH") was at all times

:levant hereto a corporation organized and existing under the laws of the State of California

3. The unlawfij.1 employment practice(s) complained of herein occurred in Orang

County, California.

4. The amount in controversy is in excess of the minimum jurisdiction of this court.

FACTUAIJ BACKGROUND

5. Plaintiff is a naturalized American citizen born in Tehran, Iran. Plaintil

graduated from high school in Scottsdale, Arizona and has a bachelor's degree in Aerospac

Engineering from Arizona State University, a Master's degree in Aerospace Engineering fion

San Diego State University and a Masters in Busiiless Administration degree from Nationa

University. Prior to being employed by ASTECH, Plaintiff had seventeen years experience wit1

major companies in the aerospace industry.

6. Plaintiff began working for ASTECH on or about April 23, 1998 .as Manager o

Special Products.

7. During his employment with ASTECH, it became apparent to Plaintiff that certai~

of Plaintiff's co-workers at ASTECH, including, without limitation, Jody Callihan, Don Down;

md Lori Eisler, resented Plaintiff's Iranian origin and, to a lesser extent, Plaintiff's superio

zngineering and formal business education. These and other employees of ASTECH undertook ;

systematic campaign of harassment and other employment-related actions and statement

jesigned to humiliate and embarrass Plaintiff and otherwise to undermine Plaintiff':

?erfonnance of his job responsibilities.

8. Many times during the course of Plaintiffs eillployment with ASTECH

4STECH employees told Plaintiff that the United States should bomb or "nuke" Iran.

9. An email was circulated to all company employees erroneously informing al:

~ersonnel that any employee of Iranian ancestry was required by the United States government tc

eport for fingerprinting.

10. In the context of this environment, and indicative of the overall atmosphere tha

has pervaded the ASTECH culture, a white employee of ASTECH once asked Plaintiff hov

nstalled equipment. Meanwhile, Plaintiff was denied the opportunity to participate in origina

:quipment manufacturing and marketing projects, in which ASTECH products are manufacturec

u ~ d sold to manufacturers of planes and other aerospace products for original installation wher

he products are first manufactured. Plaintiff was denied promotions to a position that woulc

nclude responsibility for the original equipment market. The original equipment market is the

nost lucrative market for ASTECH, with most of the customers being very large Arnericar

:ompanies would not deal with ~ranians.

12. Plaintiff was excluded from participating in other major projects, including major

~rojects involving Chinese and other East Asian customers. Plaintiff was excluded from the

roject because the Chinese only wanted to deal with "Americans."

13. Plaintiff was at all times during the course of his employment with ASTECH h l l y

lualified for the promotions, jobs and projects from which he was excluded. Similarly situated

mployees, or employees substantially less qualified than Plaintiff, but who were not of Iranian

rigin, were included in and assigned to jobs and projects from which Plaintiff was excluded.

14. Plaintiff was overheard by his superior, Jody Callihan, speaking over the

:lephone in Persian. Mr. Callihan instructed Plaintiff to speak only English on the job, even

fter Plaintiff informed Mr. Callihan that the customer to whom he was speaking was in fact a

ersian speaker and preferred to converse in Persian. Not only was this English-only policy not

lstified by any business necessity, it also was selectively invoked against Plaintiff and had the

effect not just to inhibit Plaintiff in the performance of his job but to further harass and degradt

Plaintiff.

15. Over time, the individual ASTECH employees identified in paragraph 7 abovt

were promoted to director-level positions on the ASTECH "management team," anc

consequently had more opportunity to influence adversely the perception of Plaintiffs jot

performance within and throughout ASTECH and ASTECH's parent company, GKN Aerospace,

and to inailufacture and "document" Plaintiffs supposed mistakes and infractions against

company policy.

16. The members of the "management team" failed and refused to promote Plaintifi

to a supervisor-level position to be part of the management team. This failure, and Plaiiltiff s

absence from the management team was so obvious and conspicuous that Chris Loedel, Vice

President of GKN Aerospace, directed the other members to promote Plaintiff to Director and

Aftermarket Sales, so that Plaintiff would have the authority and responsibilities commensurate

ryith that position. However, other director-level employees resented this promotion, and, in

?ractice, Plaintiff was excluded from the normal management functions associated with director-

eve1 status, including such matters as participating in the interview and recruiting process, so I

.hat he could have little influence over company operations. Moreover, as a result, during the

Spring of 2007, supervisor-level employees of ASTECH - members of the "management teanl"

- increased the level of scrutiny of Plaintiff and orchestrated a "paper trail" documenting

neaningless or trivial infractions of company policy or expressed dissatisfaction with Plaintiffs

ob performance in terms too vague and subjective to be refuted or "corrected." The sole

lurpose of this campaign was to fabricate justification for Plaintiffs termination. I 17. Plaintiff was terminated from employment on Noveinber 14, 2007, allegedly due

o "Continued Unacceptable Performance and Behaviors." The stated reason for termination was

mere pretext for the true motive for Plaintiffs termination.

an abusive work environment. The conduct represented a concerted pattern of harassment of a

repeated, routine, or a generalized nature that would have interfered with a reasonable

eillployee's work performance and seriously affected the psychological well-being of a

reasonable enlployee. Plaintiff was actually offended by the harassing behavior and did consider

his work environment to be hostile and abusive.

25. ASTECH, or its agents and supervisors, knew or should have known of the

harassing conduct, some of which was engaged in by Plaintiffs supervisors themselves, and

failed to take immediate and appropriate corrective action.

26. ASTECH's discriminatory acts over the course of Plaintiffs employment were

closely related and part of a persistent, ongoing pattern of discrimination constituting a

continuing violation of Government Code 5 12940.

27. As a proxiinate result of ASTECHys actions, Plaintiff has suffered and continues

to suffer losses of past and future earnings, and other benefits of employment, all to Plaiiltiff s

damage in an amount according to proof at trial.

28. As a further proximate result of ASTECH's actions, Plaintiff has suffered and

continues to suffer severe and lasting emotional distress, humiliation, embarrassment and mental

34. Accordingly, ASTECH failed to take all reasonable steps necessary to preven

discrimination and harassment from occurring in violation of Government Code 5 12940(k).

35. As a proximate result of ASTECHys actions, Plaintiff has suffered and continue

to suffer losses of past and future earnings, and other benefits of employment, all to Plaintiff

damage in an amount according to proof at trial.

36. As a further proximate result of ASTECHys actions, Plaintiff has suffered an

THIRD CAUSE OF ACTION

(UNLAWFUL WORKPLACE LANGUAGE POLICY)

42. The English-only policy described in paragraph 14 above constituted an unlawful

business practice in violation of Government Code 9 12951 because there was no business

necessity for the language restriction as defined therein.

43. As a result of the unlawfU1 business practice of ASTECH, Plaintiff is entitled to

costs of suit, including reasonable attorney's fees, pursuant to Government Code 9 12965(b) in

an amount according to proof at trial.

FOUKL'H CAUSE OF ACTION

(WRONGFUL TERMINATION IN VIOLATION OF PUBLIC POLICY)

44. Plaintiff incorporates by reference the allegations at paragraph 1 through 43 as

45. Plaintiff was employed by ASTECH.

46. There is a fundarnental policy of the State of California expressed in Government

Code 5 12920, which states that it is "the public policy of this state that it is necessary to protect

and safeguard the right and opportunity of all persons to seek, obtain, and hold employment

without discrimination or abridgment on account of race, religious creed, color, national origin,

ancestry, physical disability, mental disability, medical condition, marital status, sex, or age."

47. There is a fundamental policy expressed in the Constitution of the State of'

FIFTlI CAUSE OF ACTION

constitute extreme and outrageous conduct far beyond that to be expected as part of a normi

extreme emotional distress or were known to be substantially cei-tain to result in extrem

emotional distress of Plaintiff.

57. ASTECH abused its position of authority by encouraging the conduct complaine

of by ignoring it and refusing to reprimand its abusive employees, all with the intention c

reckless disregard that Plaintiffs emotional distress was substantially certain to result from il

zxtreme and outrageous conduct.

58. In addition, ASTECH further compounded its extreme and outrageous conduct b

terminating Plaintiff, with the intent and knowledge that doing so would affect Plaintiff

?rofessional and financial status for which he had worked so hard over the course of nine years.

59. ASTECHys conduct actually and proximately caused Plaintiff to suffer emotions

iistress so severe, substantial and long lasting that no reasoilable person in a civilized societ

should be expected to bear it, including, but not limited to, humiliation, mental anguisl

iepression, anxiety, and other damages to be determined at trial according to proof.

60. As a direct, natural, and foreseeable consequence of ASTECH's conduct, Plaintii

las suffered and incurred, and continues to suffer and incur, substantial loss of earnings, ant

~ther employment-related benefits.

61. Plaintiff is informed and believes, and thereon alleges, that in doing the act

64. Plaintiff has suffered an injury in fact and lost money or property as a result o:

65. Business & Professions Code $ 17203 authorizes the court to enjoin any persor

66. ASTECH has a history of engaging in the unlawful practices described herein

.ncluding harassment and discrimination and unlawful workplace language policies in violatio~

~f Government Code $ 12940. Based on the discriminatory, harassing and unlawful actions o:

ADR Information

Introductlon.

Most civil disputes are resolved without filing a lawsuit, and most civil lawsuits are resolved without a trial. The courts and others offer a variety of Alternative Dispute Resolution (ADR) processes to help people resolve disputes without a trial. ADR is usually less formal, less expensive, and less time-consuming than a trial. ADR can also give people more opportunity to determine when and how their dispute will be resolved.

BENEFITS OF ADR.

Using ADR may have a variety of benefits, depending on the type of ADR process used and the circumstances of the particular case. Some potential benefits of ADR are summarized below.

Save Time. A dispute often can be settled or decided much sooner with ADR; often in a matter of months, even weeks, while bringing a lawsuit to trial can take a year or more.

Save Money. When cases are resolved earlier through ADR, the parties may save some of the money they would have spent on attorney fees, court costs, experts' fees, and other litigation expenses.

lncrease Control Over the Process and the Outcome. In ADR, parties typically play a greater role in shaping both the process and its outcome. In most ADR processes, parties have more opportunity to tell their side of the story than they do at trial. Some ADR processes, such as mediation, allow the parties to fashion creative resolutions that are not available in a trial. Other ADR processes, such as arbitration, allow the parties to choose an expert in a particular field to decide the dispute.

Presewe Relationships. ADR can be a less adversarial and hostile way to resolve a dispute. For example, an experienced mediator can help the parties effectively communicate their needs and point of view to the other side. This can be an important advantage where the parties have a relationship to preserve.

lncrease Satisfaction. In a trial, there is typically a winner and a loser. The loser is not likely to be happy, and even the winner may not be completely satisfied with the outcome. ADR can help the parties find win-win solutions and achieve their real goals. 'This, along with all of ADR's other potential advantages, may increase the parties' overall satisfaction with both the dispute resolution process and the outcome.

Improve Attorney-Client Relationships. Attorneys may also benefit from ADR by being seen as problem-solvers rather than combatants. Quick, cost-effective, and satisfying resolutions are likely to produce happier clients and thus generate repeat business from clients and referrals of their friends and associates.

DISADVANTAGES OF ADR.

ADR may not be suitable for every dispute.

Loss of protections. If ADR is binding, the parties normally give up most court protections, including a decision by a judge or jury under formal rules of evidence and procedure, and review for legal error by an appellate court.

Less discovery. There generally is less opportunity to find out about the other side's case with ADR than with litigation. ADR may not be effective if it takes place before the parties have sufficient information to resolve the dispute.

Additional costs. The neutral may charge a fee for his or her services. If a dispute is not resolved through ADR, the parties may have to put time and money into both ADR and a lawsuit.

Effect of delays if the dispute is not resolved. Lawsuits must be brought within specified periods of time, known as statues of limitation. Parties must be careful not to let a statute of limitations run out while a dispute is in an ADR process.

TYPES OF ADR IN CIVIL CASES.

The most commonly used ADR processes are arbitration, mediation, neutral evaluation and settlement conferences.

Arbitration. In arbitration, a neutral person called an "arbitrator" hears arguments and evidence from each side and then decides the outcome of the dispute. Arbitration is less formal than a trial, and the rules of evidence are often relaxed. Arbitration may be either "binding" or "nonbinding." Binding arbitration means that the parties waive their right to a trial and agree to accept the arbitrator's decision as final. Generally, there is no right to appeal an arbitrator's decision. Nonbinding arbitration means that the parties are free to request a trial if they do not accept the arbitrator's decision.

Cases for Which Arbitration May Be Appropriate. Arbitration is best for cases where the parties want another person to decide the outcome of their dispute for them but would like to avoid the formality, time, and expense of a trial. It may also be appropriate for complex matters where the parties want a decision-maker who has training or experience in the subject matter of the dispute.

Cases for Which Arbitration May &J Be Appropriate. If parties want to retain control over how their dispute is resolved, arbitration, particularly binding arbitration, is not appropriate. In binding arbitration, the parties generally cannot appeal the arbitrator's award, even if it is not supported by the evidence or the law. Even in nonbinding arbitration, if a party requests a trial and does not receive a more favorable result at trial than in arbitration, there may be penalties.

Mediation. In mediation, an impartial person called a "mediator" helps the parties try to reach a mutually acceptable resolution of the dispute. The mediator does not decide the dispute but helps the parties communicate so they can try to settle the dispute themselves. Mediation leaves control of the outcome with the parties.

Cases for Which Mediation May Be Appropriate. Mediation may be particularly useful when parties have a relationship they want to preserve. So when family members, neighbors, or business partners have a dispute, mediation may be the ADR process to use. Mediation is also effective when emotions are getting in the way of resolution. An effective mediator can hear the parties out and help them communicate with each other in an effective and nondestructive manner.

Cases for Which Mediation May j&t Be Appropriate. Mediation may not be effective if one of the parties is unwilling to cooperate or compromise. Mediation also may not be effective if one of the parties has a significant advantage in power over the other. Therefore, it may not be a good choice if the parties have a history of abuse or victimization.

Neutral Evaluation. In neutral evaluation, each party gets a chance to present the case to a neutral person called an "evaluator." The evaluator then gives an opinion on the strengths and weaknesses of each party's evidence and arguments and about how the dispute could be resolved. The evaluator is

often an expert in the subject matter of the dispute. Although the evaluator's opinion is not binding, the parties typically use it as a basis for trying to negotiate a resolution of the dispute.

Cases for Which Neutral Evaluation May Be Appropriate. Neutral evaluation may be most appropriate in cases in which there are technical issues that require special expertise to resolve or the only significant issue in the case is the amount of damages.

Cases for Which Neutral Evaluation May Not Be Appropriate. Neutral evaluation may not be appropriate when there are significant personal or emotional barriers to resolving the dispute.

Settlement Conferences. Settlement conferences may be either mandatory or voluntary. In both types of settlement conferences, the parties and their attorneys meet with a judge or a neutral person called a "settlement officer" to discuss possible settlement of their dispute. The judge or settlement officer does not make a decision in the case but assists the parties in evaluating the strengths and weaknesses of the case and in negotiating a settlement. Settlement conferences are appropriate in any case where settlement is an option. Mandatory settlement conferences are often held close to the date a case is set for trial.

ADDITIONAL INFORMATION.

In addition to mediation, arbitration, neutral evaluation, and settlement conferences, there are other types of ADR, including conciliation, fact finding, mini-trials, and summary jury trials. Sometimes parties will try a combination of ADR types. The important thing is to try to find the type or types of ADR that are most likely to resolve your dispute.
