[5.] RESPONSES TO FACTUAL AND LEGAL ALLEGATIONS MADE IN RESPONDENT’S RESPONSE TO COMPLAINT

This Complaint is based on the following factual and legal grounds: ICANN Rule 3(b)(ix). The analysis in this section may require more space than provided, but the entire Complaint shall not exceed fifteen (15) pages. NAF Supp. Rule 4(a).

[a.] Deacom, Inc. continues to assert its rights to the DEACOM trademark, which it

has used in commerce since its incorporation in 1996, 1 year prior to the Respondent’s registration of deacom.com (see documentary evidence B. per the Table of Contents) and 6 years prior to DEACOM INC’s filing as a domestic profit corporation, the business status of which was revoked on 10/16/2006. ICANN Rule 3(b)(ix)(1); ICANN Policy ¶ 4(a)(i).

[b.] Deacom, Inc. maintains its position that the Respondent has no legitimate interest

in respect of the domain name for the following reasons:

1. The domain is not being used in connection with a bona fide offering of goods or services as evidenced by the “404” error message that was cited in previous documentary evidence.

2. In addition, the Respondent has not explicitly used the domain for any Deacom-related business purposes throughout the past year. From 2007 to 2008, deacom.com served as merely a “transference site” for Jangl, Inc. (see documentary evidence C.) that automatically sent domain visitors to jangl.com, the domain of Jangl, Inc. Jangl, Inc. was co-founded by the Respondent in 2005.

3. For the period of 04/22/2008-02/09/2009, the Respondent continued to list the following contact information for its WHOIS record as Domain

Discreet ATTN: deacom.com Avenida do Infante 50 Funchal, Madeira 9004-521 PT (see documentary evidence A.), and did not identify the Respondent as being commonly known by the disputed domain name. Any changes to this WHOIS record were made after the Respondent became aware of the Notification of Complaint on 02/12/2009.

4. The deacom.com website itself continues to not identify the Respondent as having any association with the disputed domain name, as evidenced by the “404” error message cited in previous documentary evidence. ICANN Rule 3(b)(ix)(2); ICANN Policy ¶ 4(a)(ii).

[The Panel may consider any relevant aspects included in, but not limited to

ICANN Policy ¶ 4(c): [c.] The Respondent continues to not make fair use of the domain name, as the

disputed domain name fails to resolve to a website, and Internet users who attempt to access the domain name receive a “404” error message, as previously supported by documentary evidence. ICANN Rule 3(b)(ix)(3); ICANN Policy ¶ 4(a)(iii).

1. As previously stated, the period of 04/22/2008-02/09/2009 shows that the

Respondent listed only the following contact information for its WHOIS record: Domain Discreet ATTN: deacom.com Avenida do Infante 50 Funchal, Madeira 9004-521 PT (see documentary evidence A.), and did not identify the Respondent as being commonly known by the disputed domain name. Any changes to this WHOIS record were made after the Respondent became aware of the Notification of Complaint on 02/12/2009.

2. Deacom, Inc. continues to assert its rights to the DEACOM trademark, which it has used in commerce since its incorporation in 1996, 1 year prior to the Respondent’s registration of deacom.com (see documentary evidence B.) and 6 years prior to DEACOM INC’s filing as a domestic profit corporation, the business status of which was revoked on 10/16/2006.

3. Contrary to the statement in 3[c][1] of the Response, the Respondent has a history of conduct related to registering a domain name for non-legitimate use. The disputed domain was used for non-Deacom business purposes throughout the past year. From 2007 to 2008, deacom.com served as merely a “transference site” for Jangl, Inc. (see documentary evidence C.) that automatically sent domain visitors to jangl.com, the domain of Jangl, Inc. Jangl, Inc. was co-founded by the Respondent in 2005.

[6.] REMEDY SOUGHT The Complainant requests that the Panel issue a decision that the domain-name registration be [transferred] ICANN Rule 3(b)(x); ICANN Policy ¶ 4(i). [7.] OTHER LEGAL PROCEEDINGS

[To the best knowledge of the complainant, there are no other legal proceedings that have been commenced or terminated in connection with or relating to deacom.com, that which is the subject of this complaint.] ICANN Rule 3(b)(xi). [8.] COMPLAINT TRANSMISSION The Complainant asserts that a copy of this Complaint, together with the cover sheet as prescribed by NAF’s Supplemental Rules, has been sent or transmitted to the Respondent (domain-name holder), in accordance with ICANN Rule 2(b) and to the Registrar(s) of the domain name(s), in accordance with NAF Supp. Rule 4(e). ICANN Rule 3(b)(xii); NAF Supp. Rule 4(c). [9.] MUTUAL JURISDICTION The Complainant will submit, with respect to any challenges to a decision in the administrative proceeding canceling or transferring the domain name, to [the Commonwealth of New York, as the location of the Registrar where the domain name is registered.] ICANN Rule 3(b)(xiii). [10.] CERTIFICATION Complainant agrees that its claims and remedies concerning the registration of the domain name, the dispute, or the dispute’s resolution shall be solely against the domain-name holder and waives all such claims and remedies against (a) the National Arbitration Forum and panelists, except in the case of deliberate wrongdoing, (b) the registrar, (c) the registry administrator, and (d) the Internet Corporation for Assigned Names and Numbers, as well as their directors, officers, employees, and agents.
