He said the group has been looking into staffing and administration, work loads. salaries, placement records. budgetary items, etc. with an eye toward determining whether or not State funds are spent effectively.

Hopefully. the subcommittee will ronrludc its work by mid-summer, according to Mr. Schweder.

A meeting of the House Labor Relations Committee was held o n Tuesday, May 27, 1975, at 330 p.m. in the Minority Caucus Room. The Chairman called the meet- ing to order and a roll-call was taken. The Chairman noted that a quorum was present and the Committee was authorized lo conduct business.

The next hill brought up for discussion by the Chair- man was House Bill No. 893. There were three men present representing the Pennsylvania Electric Associa- tion, who were given time to make their presentations, and the lirst man to give presentation was Mr. Walter Creitz, President of the Pennsylvania Electric Associn- tion. Mr. Creitz read a prepared statement, a copy of which is attached hereto and marked Exhibit "A".

The next speaker was Mr. J. B. Anderson, Supt. of T & E Methods, Richmond, Virginia. Mr. Anderson pre- sented an illustration on the blackboard by which he explained how the linemen are protected while working on high voltage lines, using the rubber glove method. Mr. Anderson stated that employees, using the gloving method, have gloves rated at 40KV, which is 40,000 volts, on his hands. The employee would he standing . .

The answer was that the gloves were tested every 30 days; lines every 6 months; sleeves every 90 days; and the aria1 lift every 90 days. Rep. Davies asked how many man hours does your company log with the rubber glove method. However, Mr. Anderson could not quote figures. Mr. Anderson said there was a 25% saving of time in the use of gloving method over the hot-stick method. Mr. Coyne asked if the rubber glove method was used in Pennsylvania, and Mr. Van Name of Phila- delphia Electric Company responded and said on an experimental basis. Mr. Buck Comroy, line crew leader asired Mr. Andersun about justifying tying-in hy hand. and Mr. Anderson stated that you could get a neater job by hand as compared to use of the "hot-stick" method. Mr. Conroy was of the opinion that you needed leverage and the use of the "hot-stick" provided lever- age and would be better than a glove method. Mr. Anderson was then asked i f simiiar legislation was passed in the state of Virginia, what would the cost of operation be. Mr. Anderson said that it would be a severe hlow- very expensive.

The next man to testify was Mr. Van Name who is Supt. of Transmission for the Philadelphia Electric Cam- pany, who drew a diagram on the blackboard explain- ing the bare-hand method. Rep. Vroon asked if Mr. VanName knew of any linemen who could not get in- surance because of the hazards of his job and Mr. Van- Name stated that all employees of Philadelphia Electric Company are under a group plan if they so desire. Mr. VanName stated that fatigue is caused by use of "hot- sticks". He stated that if bare-hand work were pro- hibited, the electric costs would rise. Mr. VanNanle said that there were no reported accidents in the U.S. or Canada due to bare-hand work.

The Chairman, Rep. Valicenti, then asked Mr. Van- Name if they cleaned their insulators. The answer was yes and they are cleaned by high pressure water and the lines are not taken out of service.

Rep. Davies asked Mr. VanName how many man- hours, under this method of bare-hand were without accidents. Mr. VanName sard he did not have the figures.

At this time, Rep. Gillespie stated that this bill would give the people uwrking a margin of safety and made a motion to report the bill out of committee as com- mitted. The motion was seconded by Rep. Blackwell. Rep. Hamilton asked that the motion be withdrawn to allow 1VIr. Jerry Dwyer from the Dept. of Labor and Industry to give his views on House Bill No. 893. The motion and second were withdrawn by Rep. Gillespie

ment, because Rep. Caputo said the amendment would leave the Bill as it is now written and the objective of the Bill, as committed, would be lost. However, Rep. Caputo said that he would have no objection to includ- ing Chiropractors in the wording of the hill. Motion was made by Rep. Hepford to accept his amendment. The motion was seconded by Rep. Vroon. A roll-call vote was taken on Rep. Hepford's amendment and the results were 11 nays, and 6 yeas. The amendment was defeated. Rep. Caputo made a motion to report the hill out of committee as committed and was seconded by Rep. Blackwell. A roll-call vote was taken. The result uras 13 yeas and 5 nays. House Bill No. 1044 was re- ported out of committee as committed.

House Bill No. 458 was called up for consideration. This bill would provide for a cost of living increase. A motion was made by Rep. Valicenti, Chairman, to report House Bill No. 458 out of committee. The motion was seconded by Rep. Vroon. A roll-call vote was taken. The result was 11 yeas and 6 nays. Rep Gillespie called up House Bill No. 993 for con- sideration. Mr. Tom Miller, Secretary-Treasurer fur the Pennsylvania Construction and Trades Council was present and made a statement in favor of the bill. Rep. Vroon voiced an objection to this hill. llep. Vroon said that in many instances small contractors can do a good job where the market does not call for prevailing wage rates and stated that the Legislature should not introduce any legislation fixing prices. Rep. Caputo moved and Rep. Garzia seconded to have the Bill reported out as committed. A roll-call vote was taken. The result was 12 yeas, and 3 nays. a letter written to OSHA questioning if Pennsylvania is pre-empted where there is Federal standards. His understanding is that the Electric Companies do not have standards and use the General Duty Clause in OSHA, Mr. Dwyer feels that there are not enough safety factors employed by the companies.

I am President of Metropolitan Edison Company, but I am appearing here today in my role as the President of the Pennsylvania Electric Association which is the trade Association of the 16 investor-owned electric utilities which provide 98 percent of the Commonwealth's electric energy, I want to thank this Committee for affording me the op- portunity to make this statement on House Bill 893 which would in our view impose serious, improper and unwarranted restrictions of work practices with respect to electric transmission and distribution facilities.

House Bill 893, if enacted, would be a very serious obstruction to the development of improved work methods in the industry, and would deter the industry's ability to provide the most reliable service at the lowest reasonable cost to the consumer.

I am not going to go into details of the bill because there are two gentlemen, both experts in their fields, who will speak to you on that. Also, you have received a letter from PEA'S counsel indicating that this legisla- tion is unconstitutional.

In viewiug the proposed legislation, I have the im- pression that its backers, concerned about safety, feel that the utility industry wants to use work methods that arc untried and unproven. Nothing could be further from the truth. The safety record of the industry proves it. Let's look at the record.

In 1946 the number of lost time accidents per million manhours worked for all industry was 14.16. For the electric utility industry it was 14.81-slightly higher but not significantly so. Twenty-seven years later, in 1973, the ail-industry figure had decreased to a level or 10.55 lost time accidents per million manhours worked ---~a decrease of about 25 percent.

During that timc period, the electric utility industry, through emphasis on training, accident prevention, and the development of improved work methods had reduced the frequency of lost time accidents to a level of only 6.93-a decrease of some 53 percent.

The point is the utility industry, during the postwar periud of its greatest and most rapid growth, had im- proved its accident prevention record by more than twice thc all industry figure.

Actually, the record of the Pennsylvania investor-own- ed clectric utility induslry is even better than that of the national industry. In 1973 the nine largest companies had only 3.75 lost timc accidents per million manhours worked. We are proud of this record. We intend to keep lo\vering the accident rate. What we do and must object to is legislation that, without doing anything to improve safety, merely drives up the cost of electricity to con- sumers.

Under no circumstances wculd we entertain the thought of in~plementing new work methods until they have been thorouehlv develooed and uroven. In other

Unfortunately, since 1969, in a period of nationwide and worldwide inflation, electric utilities have had to seek rate increases. The average price of residential electric service has increased by 9.5 percent from the 1969 low of 2.09 cents per kilowatt-hour to 2.29 cents in 1972.

During that same period, however, the Consumer Price Indcx has increased by 14.1 percent-from 109.8 to 325.3, but the average price of residential electric service today is stiil less than what it was in 1946, the base year which I previously mentioned as marking the beginning of the electric utility industry's impressive improvement in ac- cident prevention.

I cite these statistics to make two points. First, to show that while utilities have had to increase

their rates since 1969, the increases have been less than the general rise in prices for other goods and services.

Second, to emphasize that because such things as en- vironmental improvements and increased fuel costs are driving up utility operating costs, it becomes all the more important for us to be able to develop and utilize the most efficient methods to provide our service at the lowest reasonable cost to our customers. And I assure you that we are-we are intent on investigating all pos- sible improvements in work methods.

In summary, the electric utility industry has clearly and continuously demonstrated (a) its concern for the safety and well being of its employees and (b) its ability to provide improved service at lower costs. Both efforts will continue in the future.

The proposed legislation, however, will serve neither objective. It will not assure any additional safety for employees, and it will most certainly impair the industry's nbility to apply improved technology and work methods for thc benefit of utility customers. The hill benefits no one. It will he a burden to cunsumers. It should not be enacted.

1913 is the first year for which data on the Consumer Price Index is available. Using 1967 as the base of 100, the Index in 1913 was 29.7. Ry 1969 it had increased mmjre than 3% timcq--to a level of 100.8.

Now, during that same period--1913 to 1969-the average price of residential clcctric service had decreased by four timcs-from 8.70 to 2.09 cents per kilowatt-hour.

I think thesc comparisons clearly show that the electric utility industry can give better service at lower costs. Obviously, this can only be donc by developing and putting into use improved machines, equipment and work methods made available by ever advancing tech- nology and the application of sound rngineering judg- ment.
