The Norwegian Union of Marine Engineers (NUME)represented by Hege M Bengtsson

It is agreed and accepted between the above mentioned unions and the NSA to renewthe aforesaid collec'tive bargaining agreement.

The terms and conditions in this collective bargaining agreement will be applicable toFilipino ofiicers who are members of AMOSUP serving on board vessels which areregistered under NlS, and enlisted in NSA.

This agreement shall be binding to Filipino officers serving on board vessel where theseterms have been applied until notice of termination has been given or the agreed term ofservice has expired. \Mich of these altematives to be used and in case of the time ofnotice, shall be agreed upon in each instiance. For offcers hired on these terms, however,these shall apply until their time of service has expired.

The parties to this agreement are aiming to have a clear understanding of each othe/srighb and obligations in order to develop and maintain a smooth relationship between theNSA and the unions. In order to achieve this and in the interests of all concerned, thefollowing conveyances and conditions are drawn up and agreed upon between the NSAand the Unions.

Article 1AEngagement Mustering and Travelllng Expenses

The officer will sign an agreement for a fixed period that he shall be serving on board avessel, covered by this agreement. Prior to signing such agreement, the officer shall beinteMewed and medically examined for fitness.

During the examination, the seafarer shall disclose to the doctor any and all knownpre-existing illness or condition pursuant to #11 (Definition of terms) of the POEAStandard Terms and Conditions Goveming the Employment of Filipino Seafarerson Board Ocean-Going Ships (POEA SEC). Concealment of a pre-existing illnessor condition shall also be subjected to Section 20 (E) of the POEA SEC.

Engagement, mustering expenses and travelling expenses from Manila to the place ofembarkation shall be paid by the Company. The officer shall be reimbursed for medicalcertificate, passport and visa.

After completion of service in accordance with the contract of hiring, the Company shallpay for travelling expenses and lodging from the ship to Manila. The ofiicer will in additionbe entitled to a travelling allowance of one (1) day basic wage to a maximum of two (2)days basic wage.

lf the officer however, requests on his own personal reason an early termination of thecontract he shall give a written request to the Master. Should then inform him in thepresence of a witness, about the consequence of the early termination of his employmentcontract regarding his liability to shoulder the cost of his repatriation and the travelexpenses of his replacement.

The Company, however, shall consider special request of early termination of the contractof employment based on compassionate grounds such as in cases of the death orserious illness of spouse, children or parents in which case the repatriation costs will be tothe Company's account.

Travelling expenses on the Company's account, shall not include the offcers'baggage inexcess of the normal allowed vtteight by the air canier. Excess baggage shall be at theofficers' expense.

Article 1BCompany

The word "Company' in this agreement shall be defined as the Company which owns oroperates the vessel and is named in the employnent contracl as the employer.

Chanqe of Emolover

lf the ofiicer is employed by a Company which operates the vessel, the oftcer shallaccept that the ownes of the vessel take over as his employer for his remaining period ofservice (see article 4). Provided, however;

- that the previous employer or the new employer (the ourners of the vessel) settlesall accounts due to him under his original employment contract.

- that the new employer (the owners) declares in a written statement to take over allresponsibility from the previous employer. The statement shall be addressed toPOEA. AMOSUP and the officer.

The crewing agent used by the new employer (the owners) shall issue a similar writtenstatement that he takes over as representative for the employer and assumes allresponsibility towards the officer.

Chanoe of CrewAoencv

lf the Company should make a change of crewing agency in Manila, the officer shallcontinue in service with the Company provided his account is settled for the period servedwith the first agency and provided the second agency declares in a written statement tothe ofrcer, sthe POEA and AMOSUP that it takes on all responsibilities on behalf of theCompany towards the oficer from the first agency.

Arfcle 2Wage

The offcers' basic wage and rates of overtime are set out in the attached Wage Scale(Appendix A). The wages are stipulated in US dollars, and the offcers' account is kept inUS dollars. Wage accrues from the day the officer commences service on board. lf hehas to travel from the Philippines in order to take up service on board, basic wageaccrues from the day of departure from Manila to the day when the offcer sign-off fromthe ship.

Each month he is on board, the ofiicer is entitled to payment of the remaining 20olo of hisbasic wage afler legal deduclions have been made. The remaining 80% shall be paid tothe beneficiary that the ofricer has nominated through any authorized Philippine Bank andshall be available not later than the 10th of the immediate succeeding month. Overtimeremuneration shall be paid out on board, ref. to Article 7 below conceming fxed monthlywages.

The rate of exchange for conversion of us dollars into Philippine curency shall be thebuying rate of exchange indicated in the credit advice of the local authorized PhilippineBank. The allotnent to be paid out on board should be paid out in cash and may be paidout in the port state curency.

The officer will be entitled to a seniority allowance for:

1. Service in the same position on N|S-ships when employed by the same company.

2. Service in the same position on ships under other flags when employed by thesame company.

3. Seniority allowance shall be based on the cunent position of the officer.

Ardcle 3Board and Lodging

The offcer is entitled to free board and lodging during service on board. lf board andlodging is not provided on board, the Company shall deftay the cost of satisfactory boardand lodging ashore.

Article 4Duration of Seruice

The officer signs on for a period of NINE (9) months. However, the contract could at theCompan/s option be terminated by any time betrr'reen 8 and 10 months. A cadet mightbe engaged for a longer period but less than 12 months in order to comply with thePilipino prequalification scheme for maritime education. The cost of repatriation shall beon Company's account.

A shorter service period than I months may be agreed for substitutes, repair personneland similar employees. The cost of repatriation shall be on Company's account.

The first 3 months of service with the Company is considered a probationary periodduring which the company may terminate the contract by giving 14 days written notice.Termination of contracl by the Company in the probation period, will not entitle he offcerto termination pay (see Article 5 c) but to free repatriation.

Article 5Termination of Service in Exceptional Circumgtances

a) In the event of sale, laying-up, or lengthy stay in a repair yard, the Company mayterminate the service. The oftcer is then entitled to pay up to including the day ofsigning-off plus TWO (2) months' basic wages and repatriation to Manila on theCompany's account.

In case of ship loss the ofiicer is then entitled to pay up to including the day ofsigning-off plus two (2) months' basic wages and repatriation to Manila on theCompany's account.

b) The ofiicer is entitled to terminate the service contract immediately if the vessel isdeclared unseaworthy in accodance with Chapter 1 , Rule 19, of the Convention onthe Safety of Life at Sea (the 'SO|-AS' Convention). The vessel sl'plt also be. \/ w

deemed to be unseaworthy if it lacks one or more of the certifcates prescribed inChaptelt, Rules 12 and 13 of the "SO|-AS" Convention. The oficer is then enti{edto pay up to including the day of signing-ofi plus two (2) months' basic wages andrepatriation to Manila on the Company's account.

c) The Company may terminate the employment contrast on valid reason prior to theagreed period of duration, ref. Art. 4, provided the offcer is paid two (2) months'basic wages and repatriation expenses to Manila. The Company may alwalaterminate the contract of employment if the officer becomes ill or injured and has tosign off from the vessel.

d) An officer who has served the agreed contrac't period, ref. Article 4 (8 months ormore) will not be entided to termination pay of two (2) months' basic wages asmentioned in point) to c) above. lf the office/s remaining contract period of service isless than one (1) month (he has already served more than 7 months), he shall onlybe entitled to ONE (1) month's basic wage termination pay, see litra a) to c) above.

e) An ofiicer who has received termination pay in accordance with the aboveprovisions (litra a) to d), shall be considered to have received full and finalcompensation in any respect.

D An ofiicer who is offered to continue in service on another vessel within one month,ref. Article 17, is not entitled to termination pay in accordance with the rules in litra a)to d) above, but shall be entitled to basic wage until the date of joining the othershiP.

lf the offce/s contract of employment is terminated due to changing of managementfor the vessel, the offcer shall have no right to termination pay, if he accepts tocontinue in service on board with the new manager as employer.

S) The Company or its representative may within the contract period dismiss inaccordance with the Grievance Procedure any officer who neglecG to meet onboard at appropriate time, commits himself to disobedience, violent behaviour,abuse of narcotics and alcohol or other valid grounds (ref. the Norwegian ShipLabour Ac't Article 5-14). The repatriation costs will be for the ofiicers' accountprovided he has not completed his employment contract and he may be heldresponsible for expenses and damages caused by such breaches on rules andregulations.

Article 6Grievance Procedure and Voluntary Arbitration

As indicated in article 5 points c) and e) the company may terminate the employnentcontrac't with the officer for disciplinary leasons. The ofiicer may on his side, find itnecessary to make complaints about negligence of his employment contract.

be resolved through voluntary arbitration pursuant to the procedures set forth in AppendixD.

Article 7Working Hourc

The normal working hours is 8 hours per day, Monday to Friday and 4 hours on Saturday.The offcer will be paid monthly wages for service on board including fixed overtimecompensation. The fixed overtime will include all

overtime work necessary and related to the trade and the vessel concerned. The ofiicershall be given sufficient rest period.

It is underctood that overtime work will be performed at the direction of the Master or theMaste/s representative.

Compensation for UMS-watches is covered by the fixed overtime in the wage scale.

The fficer is entitled to 10 hours of rest during any period of 24 hours and 77 hours ofrest during any period of 7 days (168 hours). The rest hours can be divided into 2 periodswith one period of at least 6 hours and with no more than 14 hours between any rest-hourperiod. For watch-keepea the rest period can be reduced to 6 hours provided no suchreduction is maintained over a period of more than 48 hours, and provided a total restperiod of 70 hours per any period of 7 days.

Exemption from these rules are allowed in situations of distress, emergency, boat4rilland other oveniding operational conditions (see ILO convention 180, STCW 95 and EUdirective 63/1999)

The fixed overtime compensation is stipulated on a monthly basis, see wage scale, butwill be paid pro rata for pail of the month.

The provision in the Nonrvegian Ship Labour Act, afticle 9.4 about compensation for standby watches in port is covered by the basic wage.

The existence of potential danger shall be determined solely by the Master. Inconnection therewith the officer shall perform the necessary work without overtime pay forpurposes of maintaining the vessel's safety, that of the officers, passengeF and thecargoes on board, or saving lives, rendering assistance to other vessels in distress or inall other cases of emergency, or fire and boat drills.

2WATCH SYSTEM

On 2 watch system ships the maximum service period should be six months.

The 2 watch system provides for up to 84 hours of work per week.

fficers who are physically affected by the 2 watch system shall be paid a monthly 2watch keeping allowance of USD250. The fixed overtime compensation and the 2 watchkeeping allowance cover all and any overtime work.

The seafarer/officer is only entitled to the agreed holidays stated in this articleregardless of the actual holidays stated in the POEA contract.

Compensation for work on Public Holidays will be:

1/191 basic wage per hour for up to 8 hours work during Public Holidays which fall on anordinary weekday. AddiUonal work (beyond 8 hours) shall be considered covered by thefixed overtime.

Compensation for all work on Public Holidays which falls on a Saturdays and Sundays, isincluded in the fixed overtime compensation.

The officer shall be entitled to eleven (11) days vacation leave with pay based on thebasic wage for every month of employment.

Article 9Compensation for Perconal Effects

In case of accident, fire or other mishap afiecting the ship, the Company shallcompensate the officer for his damaged or lost personal effects either partial or total,depending on the extent of the damage or value of the lost effects to a maximum of USD3,000 for total damage or loss. The offcer will be entitled to an additional compensationfor necessary clothing in case of ship loss. The compensation may be reduced onaccount of the offces' own contributory negligence or fauft and circumstances otheruise.

The officer shall submit a signed statement speciffing the items lost prior to payment ofany compensation hereof.

The provisions of the Nonvegian Ship Labour Act, article 8-,,4 are replaced by this Article.

Article l0Sickness and Injury

During the period of employment and at the time of signing off, the officer shall submit toa medical examination when requested by the Company or its representative, at theCompany's expense.

While serving on board, a sick or injured officer is entitled to medical treatrnent at theCompany's expense. The Company is not responsible for conservative dental treatment.

lf the officer has to sign ofr due to sickness or injury or if he is sick or injured at thetermination of the service period, he has the same entitlement to a medical treatmentincluding hospitalization, for a maximum period of one hundred and thir$ (130) days fromdate of signing off. However, in case of an occupational injury or an occupational disease,the offcei hai the same entitlement to medical treatrnent including hospitalization, until

he is declared fit or the degree of permanent disability has been established by aphysician authorised by the Norwegian authorities.

In accordance with the POEA's rules and regulation the officer must submit to a post

employment medical examination within three (3) working days after his retum to thePhiiipdines to obtain these benefits. lf he should be unable by reason of physical

incapacity to do so, a written notice to the agenry within the same period is deemed as

compliance provided the notice about the incapacity is certified by the Master or an

authorized physician.

In the event of sickness or injury necessitating signing-off, the seafarer is entitled to travel

to Manila at the Company's exPense.

In the event of sickness or injury necessitating signing off, the officer is also entitled tosick pay (at the same rate as basic wage) for up to one hundred and thirty (130) days

after'silningoff, to be paid on a monthly basis, provided the sickness or the injury is

verified-by written statement from an authorized physician. (See POEA's rules and

regulationi). The sick pay will be in addition to the vacation leave compensation

mEntioned'in Art. 8 but not'in addition to the termination pay compensation mentioned in

Art. 5 points a) to c).

Expenses advanced by the officer from his owtl pocket for 1) medicines purchases

prdscribed by a Company designated physician, and 2) reasonable transportation

expenses to have treatment, shall be reimbursed on a monthly basis. The reimbursement

shall be subjec{ to submission of receipts or proof of expenses.

It is understood that an ofiicer who is signed-off by reason of sickness or iniury must

retum to the Philippines within the usuai period of travel from the date and place ofdisembarkation indiiated in homeward bound ticket. On anival in the Philippines, he shall

report to the Company's designated physician within three (3) trtrorking days fiom the time

of anival for posi emptoyment medical examination, otherwise, the employe/s liability

Article llGompensatlon for Death

In the event of death of an officer while serving on board or while travelling to or from thevessel on Company's business or due to marine peril, or due to illness acquired duringemployment, the Company will pay to his legal heirs a compensation in the amount ofusD 87,500.

It is agreed that paytnent of this amount shall be inclusive of the benefits payable underthe POEA Standard Employment Contract for Seafarers On-Board Ocean-Going Vessels.

It is further agreed that the compensation shall be payable to the offce/s legal heirs inaccordance with Philippine laws.

The names and addresses of the office/s legal heirs be declared at the time of hiring.

The Company shall pay an additional compensation to each of the offce/s children underthe age of 21 years of USD 17,000 maximum four (4) children with a maximum amountequivalent to USD68,000. lt is agreed that payment of this amount shall be inclusive ofthe benefits to children payable under the POEA Standard Employment Contract forSeafarers On-Board Ocean-Going Vessels.

The Company shall take out the necessary insurance to cover the benefits mentionedabove. Coverage ananged with a P & I Club recognized by the Nonregian authorities willmeet these requirements.

Article 12Disability Compensation

lf an offcer due to no fault of his own, sufiers an occupational injury as a result of anaccident or an occupational disease, while serving on board or while travelling to or fromthe vessel on Company's business or due to marine peril, and as a result his ability towork is permanenfly reduced, totally or partially, and never to be declared fit. TheCompany shall pay him a disability compensation which including the amounts stipulatedby the POEA's rules and regulations shall be the maximum USD 110.000 for ofiicers andUSD 90.000 for cadets.

lf the disability should cause the officer's death, the death compensation to hisbeneficiaries should be reduced with the amount paid out as a disability compensation.

The disability compensation shall be calculated on the basis of the POEA's schedule ofdisability or impediment for injuries at a percentage recommended by a doctor authorizedby the Nonregian authorities for the medical examination of seafarers.

The disabili$ shall be based solely on the disability grading provided under Seclion 32 ofthe POEA Standard Employment Contract, and shall not be measured or determined bythe number of days a seafarer is under treat'nent or the number of days in which sicknessallowance is paid.

Article 13APhilippine Social Security Syatem, Philhealth and Employees Compensafion

The Filipino seafarer will also be covered by the Philippine Social SecuritySystem, Philippine Health Insurance Corporation (Philhealth), the EmployeesCompensation Commission (ECC) and the Home Development Mutual Fund(Pag-lbig). The premiums should be paid partly by the seafarer and partly by theCompany as provided by the government regulations. The contributions fromthe seafarer should be deducted from his salary and remitted by the Company tothe Philippine SSS, Philhealth and Employees Compensation Commission andPag-lbig Offices.

lf the officer is not declared frt after the expiration of the one hundred and thifi (130) daysperiod, he may be entitled to benefits under the Philippine Employment CompensationProgram and the Philippine Social Security System.

The Company's Contributions to be paid to SSS, ECC, Philhealth and PagJbig isindicated in the wage scale.

Article'l38Survivorc Pension Fund Plan

The Company shall contribute to an insurance scheme to provide benefits toseafarers widows as and when the scheme has been developed by AMOSUP.The scheme shall be managed by a board of trustees. The cost of this benefit isrecognized under the heading 'Survivorship Pension Fund Scheme' shown in theattached wage scale.

Contribution to be made to a bank account advised by AMOSUP.

Article 14War and Piracy Bonus

War and piracy risk bonus will accrue and expire from the same dates as for similaragreements for officers between the NSA and NMOA/NUME.

The war and piracy risk bonus will be based on basic wage with the same Percentage as

agreed between NSA and NMOA/NUME.

Remark:Regarding Guff of Aden - entitlement and rates of compensation shall be in line with

POEA Goveming Board Resolution No. 12, Series ot 2012.

in accordance with article 11 (compensation for death) and article 12 (disability) in thisCBA.

Article 15Unemployment Benefits

After the agreed period of service on board, see Article 4, the ofiicer will be entitled tounemployment allowance when his leave period has expired, provided he has reportedback to the Company or ship manager for a renewal of contract of employment no lessthan ten (10) days, but not earlier than three (3) weeks before his leave period hasterminated. The officers will not be entitled to an unemployment allowance if theemployment contract with the Company has been terminated with a written notice oftermination from the Company or the officer has been dismissed, see Articles 5 and 6.

The unemployment allowance is US Dollar 60 per month for a maximum period of three(3) months (US dollar 2 per day). lf the office/s contract of employment is renewed insuch period of unemployment, his right to unemployment allowance will cease from thetime he is entitled to wages after the new contract.

Article 16Medical Treatment

The officer and his immediate dependents shall be entitled to medical treatment providedfor by the AMOSUP FAMILY MEDICAL AND DENTAL PLAN (FMDP).

The Company agrees to contribute to the existing AMOSUP Family Medical and DentalPlan (FMDP) for the officers and his dependents the sum of USD 25 a month per officerfor his service period. lt is understood that this contribution shall not affect the treatTentand sick pay benefits of the officer provided by Article 't0 of this agreement for the first130 days.

It is understood that the existing AMOSUP Family Medical and Dental Plan (FMDP) shallbe to the extent of the services and facilities available as included in Appendix "E" of thisagreement. The Seamen's Hospital shall not be obliged to cover treatment outside itsavailable services and facilities.

Article 17Transfer of Seamen

The Company may transfer an officer to any of its vessels provided that the transfer shallnot result to demotion in rank or diminution of pay and benefits and that there will be nointeruption of time for calculating leave benefits or increase in term of service.

Article 18Jurisdiction

The Unions and the NSA have observed that according to the NIS Act this agreementshould be subjected to Noruegian law and the jurisdiction of the courts in Noruay.

Cases conceming the office/s service on the ship may be broughtbefore a Norwegian court or before a court in the office/s country of

Article 19Regulation Concerning the Appllcation of Special Provisions in the Norwegian

International Register Act

The parties have agreed to make exceptions trom the Nonregian Ship Safety andSecurity Act conceming hours of work on board ships and the Noruegian Ship LabourAct, ref. the Norwegian Intemational Ship RegisterActArticle's 7 and 8.

The hours of work shall be as stipulated in Article 6 of this agreement.

The following provisions in the Nonrrregian Ship Labour Act article 3-1 (4), articles 3-3 toand including 3-8, article +2 3 section, article 46, first section letter a), article 5-1 secondsection, article $ 5-2 first seclion, 2. Point nr (2) og (3) article 5-3 second and thirdsection) letter a) to and including letter d), article 54, article $6 second and fourthsection, article 5-7, article 5-9, adicle 5-10, article 5-12, article 6-1 to and including 6-3,arfrcle 7-2, article 7-3, article 7-5 to and including 7-12, article 84 and chapter Xl areexcluded by the provisions mentioned above, and shall not be applicable to the contractsof engagement which are established with reference to this agreement

Article 20Contribution to Training, Upgrading and Education Project

ln order to improve the qualifications of the Filipino officers and to secure a sufficient andsatisfactory recruitment, the parties have agreed to establish an Education Project forFilipino officers serving on NIS vessels.

The Project shall be administered by NSA and the turther stiatutes for the Project shall begiven by NSA Council. The union parties shall be informed about the statutes, and all andany later amendments of these statutes.

NSA has appointed a Steering Committee among the Companies' representiatives in

Manila. AMOSUP and the Norwegian Maritime Unions have the right to be represented in

the Steering Committee with one representative each (totally 2 representatives).

The Company shall contribute USD 45 per seafarer/officer per month to the Projecl, tobe remitted every three (3) months to the Project's bank account, according to the NSACouncil's decision.

Article 21Provident Fund

The parties to this CBA have establish a Provident Fund to provide security to theofficers. lt is agreed that this plan will enhance the efficiency and loyatty and furtherencourage the off@rs' continued service on NIS vessels.

The Company shall contribute to the Provident Fund a monthly amount of USD 80 forMasters, Chief Engineers, Chief fficers, 2nd Engineer, 2nd fficer, 3rd Engineer, 3rdOfiicer and 4th Engineer while the officer is engaged onboard and an amount of USD 50per month for Jr. 3rd Officer/Jr.4th Engineer. Cadets shall not be included by thisProvident Fund provision.

The Provident Fund shall be ananged with an intemationally acknowledged insurancecompany chosen by NSA. The present manager of the Provident Fund is StorebrandLivsforsikring AS.

Statutes for the Provident Fund are established by NSAs board of directors.

Contribution to Provident Fund to be paid to Storebrand LMorsikring AS (manager for theProvident Fund).

Aslicle 22Joint Adminietration (NlS)

The Company shall each month contribute USD 38 per Filipino officer covered by thisCBA to the Joint Administration (NlS).

The Company shall submit actual crew list to the Joint Administration (NlS). The crewlist will be basis for the invoice of the above said contribution to the Joint Administration(Nrs)

The contribution shall be paid in advance every sixth months, normally 13t January and1{ July of each calendar year, together with actual crew list. Without such crew list, thecontribution will be estimated.

For part of month, the contribution will be proportional.

Ariicle 25Right to Recovery of Erpenses ftom Third Pardes

Where pursuant to the provisions in this agreement, payments are made by or on behalfof the Company, to or on behalf of the oficer in respect of an injury or a disabilitysustained in circumstances not related to employment and giving rise to legal liability by athird party to the offcer (whether in negligence or othenrvise), then the making of eachsuch payment shall entitle the Company to assume the right of the offcer to pursue foritself the said third party for recovery of expenses paid with all related interests thereon,on its own account, and whatever amount it may recover shall be treated asindemniftcation in favour of the Company for paying the liability to the offcer.

In case the office/s presence or co-operation is necessary to a successful recovery of thesaid claim, the Company shall fumish the conesponding expenses for transportationfares, hotel accommodation or board and lodging and allowance needed under thecircumstances.

The Company shall assume full responsibility for any pertinent legal action it decided totake and assures that the offcer shall not be exposed to any counter-claim.

Artcle 26Protocol Regarding Cargo Handling

The parties will continue to find a satisfactory solution to the question in co-operation withthe lTF.

Artcle 27Drug and Alcohol Test

The seafarer shall consent to submit to drug and alcohol testing prior to the signing ofcontract of employment and shall also agree to submit to random testing for drugs andalcohol at any time during the period of employment when so requested by the Masteror by other authority. The testing should be in accordance with guidelines fromNorwegian authorities.'

Article 28Duration of the Gollective Bargaining Agreement

This agreement shall be effective from 1st January 2016 until 31st December 2017 andfufiher if a request for termination is not given neither by the NSA nor by the AMOSUPand the NORWEGIAN OFFICERS UNIONS with 3 months written notice. A notice givenby the unions, the AMOSUP and the NORWEGIAN OFFICERS UNION, should beagrced upon and signed by both the AMOSUP and the NORWEGIAN OFFICERSUNIONS.

APPENDIX B

Agreementabout

Htgh Rlsk Bonus and Compensation in case of disability or deal/l' coused by Waror Pincy Altack

The parties agreed to establish an agreement regarding compensation in case ofdisability or death that befalls a seafarer when in service on a ship as a directconsequence of a war or piracy attack, See the chapter 15 of the NonregianMarine lnsurance Plan of 1996, version 2007.

The agreement shall cover disability or death as a direct consequence of a shiptransiting an area where the parties have agreed that there exist a risk for war orpiracy attack, and have established an agreement describing this area.

Artlcle I

The following conditions will apply regarding compensation in case of disabilig ordeath directly caused by war or piracy attack:

1. ln case of injury that makes the seafarer permanently unfit for furtherservice as a seafarer, he/she receives a compensation of USD 165 000.

2. lf the seafarer dies, the surviving dependants (spouse, children or parents inthis preferential order) will receive USD 165 000.

3. lf the seafarer is permanenUy unfit for further service as a seafarer (seepoint 1 above), and has children under the age of 21 years that aresupported by him/her, or her/she dies (point 2 above) leaves behind childrenunder the age of 21 years, each child will receive a compensation ofusD 40 000.

Arfcle 2

The above mentioned compensation amounts, will be given in addition to thecompensations and pensions from collective life insurance, insurancecontribution or other collective or individual pension- and insurance anangementsthat might exist and that cover death and injury caused by war or piracy attack.However, seafarec who are entitled to the compensation mentioned in article 1

above, are not entitled to the compensation provided for in case of death anddisability in NIS or Model agreements concluded between the NorwegianShipowners' Association, the AMOSUP and Norwegian Unions, see the NISagreement adicle 11 and 12 and the Model agreement article '12 and '13.

Article 3

This Agreement is subject to Norwegian laws and Norwegian courts of justice.

Artlcle 4

This Agreement is efiective from the 'l March 2010 and will replace all earliercollec{ive bargaining agreements and prctocols regarding uar and piracy attacksthat have been established between the Norwegian Shipourners'Association, theAMOSUP and Norwegian Unions for NIS and foreign flag ships for Philippinesoffcers and Philippines ratings. APPENDIX C

Grievance Procedure

NSA and AMOSUP have agreed to an amicable settlement of all disputes related to thiscoriective bargaining agreement including disputes between their members, the shippingcompanies and the ofiicers, see the introduction part, last paragraph pages 1 and 2.

As a result, the NSA and AMOSUP agree that the following procedures shall be followedfor disputes between the shipping companies and the seafarers:

'1. The company and the officers shall refrain from filing any complaint before the poEAor any court or office in the Philippines without having exhausted first this grievanceprocedure.

2. The company shall observe the following disciplinary actions when offended ordissatisfied with the officer's behaviour or performance:

1) Ening seafarer shall receive a written waming from head of department, seniorofftcer or the master. The waming issued should also ask the ofiicer to explain hisactions in writing within 24 hours and indicate the possible consequen@s for him ofhis actions. A notice of the waming should be entered into the ship's logbook.

2) when the ofiice/s steps shall be taken or if the case should rest. lf further stepsshould be taken, the procedure will be:

a) lf the master considers it necessary to terminate the contract of employment, theseafarer shall be duly informed. He will have the entiflements for termination payand repatriation as prescribed in Article 5 c and d.

b) lf the master considers it possible that the seafarer should be dismissed, a hearingshall be summoned before a committee consisting of the master as a chairmanand two other members appointed by the master. lf possible one of the othermembers shall be chosen amongst the officers or crew group that the ofiicer hasseafarer has belonged to. The hearing shall take place less than 14 days after theenors or similar has happened.

The master/chairman shall question the officer and any witness who might be ableto provide information in the case. The remaining members of the committee anothe ofiicer himself may ask questions to the witnesses, through themaster/chairman or direc'tly as the master/chairman decides. When the hearing is concluded, the master shall decide as soon as possible if theseafiarer should be dismissed (article 5e) be given notice of termination (article 5c)or if the case should rest without further steps for the time being.

lf the master decides to dismiss the ofiicer, the officer shall be informeoimmediately of the decision. The decision may be included in the protocol from thehearing and should be entered into the ship's logbook.

An offtcer who has been dismissed should be given the information in writing. Astandard form which may be used for such information is enclosed as appendix"2". He will have no entitlements to termination pay or repatriation, see article 5e.

lf the master decides to give the offcer notice of termination, the seafarer shall beduly informed and receive the entitlements indicated in article 5 c and d.

In special cases the committee may be appointed by the Company or theCompany's representative and the hearing will take place ashore if considerednecessary in order to best elucidate the fac,tual basis for dismissal.

lf the company has not established lts own complaint procedure, the following procedureshall be used:

\Mrth reference to the ILO Maritime Labour Convention (lLO MLC), regulation 5.1.5, thefollowing on board complaint procedure has been established for expeditious handling ofseahrer complaints alleging breaches of the requirements of the ILO MLC.

A Seafarer making use of this procedure shall not be victimized for filing a complaint andhe/she will also have the option to seek redress whatever legal means that the seafarermay consider appropriate.

This procedure seeks to resolve complaints at the lowest level possible.

The Seafarer has the right to be accompanied or represented during the complaintprocedure, and to safeguard against any kind of victimization for filing complaints.

The Seafarer will receive a copy of this complaint procedure. To submit a complaint, theSeafarer may contact:

A Seafarer who considers himself aggrieved shall make his complaint(s) in accordancewith the follo,rring procedures:

a) A written complaint shall be communicated to head of the Department of theSeafarer lodging the complaint or to the Seafare/s Superior Officer to resolve thematter within prescribed time limits appropriate to the seriousness of the issuesinvolved.

b) lf the head of the Department or the Superior fficer cannot resolve the complaintto the satisfastion of the Seaf;arer, the latter may refer it to the Master, who shouldhandle the matter personally.

c) A meeting may be held with the Seafarer and the Master, Superior Ofiicer oranother representative for the employer to discuss and settle the complaint.

d) All complaints and the decisions on them should be recorded and a copy providedto the Seafares concemed.

e) lf a complaint cannot be resolved on board, the matter should be refened ashoreto the Employer/Shipowner, who should be given an appropriate time limit forresolving the matter, where appropriate, in consultation with the Seafarerconcemed or any person the Seafarer may appoint as his/her representative.

f) A Seafarer who wishes to appeal a settlemenUnon-settlement of the complaint,should consult hiVher national union or the union that may be co-party to thecollective bargaining agreement applicable for his /her employnent. The union(s)shall, before advising an appeal to be filed, request the Employer's/Shipowner'sview or the opinion of the Employer Association that is party to the collectivebargaining agreement before an appeal is made to the relevant authorities or acouft of justice.

AMOSUP shall, before advising an appeal to be filed, request the company's view. TheCompany is entitled to the request that AMOSUP discuss the case with NSA before anappeal is made to the authorities or the court.

APPENDIX D

Vo I u nta ry A hitration P rccedu re

NSA and AMOSUP have agreed to be bound by the provisions of Articles 261 and262 of the Labor Code of the Philippines and recognizes that voluntary arbitratorVpanel of voluntary arbitratorc shall have original and exclusive jurisdiction andauthority to hear and decide, within thirty (30) days ftom date of submission of laspleading clarificatory hearing, all unresolved grievances refened by the GrievanceCommittee and/or those arising from the interpretation or implementation of thecollec{ive bargaining agreement or company personnel policies.

The Company and the Union shall select from among the list of VoluntaryArbitrators/ panel of Arbitrators below specified. Thereafter, they are required toaccomplish, execute and submit the Submission Agreement to the NationalConciliation and Mediation Board-Department of Labor & Employnent. Costs ofvoluntary arbitration shall be equally shared by the Company and the Union.

In case the seafarer is represented by counsel other that the Union, he shall bearthe cosUexpenses of voluntary arbitration and/or shall directly apply with theNational Conciliation & Mediation Board or subsidy.

The Voluntary Arbitrator or members of the panel of voluntary arbitrators consistingof three members, to be chosen by the parties, shall be selected from amongrespected members (retired) of the judiciary and lhe academe who are non-practicing lawyers and cunently unafiiliated with any law firm/s; the list of whichshall be provided by the NCMB- DOLE upon the signing of the SubmissionAgreement by the parties.

The Voluntary Arbitrator or members of the panel of voluntary arbitrators shall beentitled to receive an arbitration fee for each case handled, amounts of which shallbe standardized depending on the individual Arbitrators appreciation of thecomplexity of the factual matters to be determined and legal issues to be resolved,

The VA or PVA shall adopt the Revised Procedural Guidelines in the conduct ofVoluntary Arbitration Proceedings insofar as they are applicable and consistent withthe provisions of this chapter as to enable the parties to the dispute, disagreementor controversy to present fully but expeditiously their respective sides.

In case of PVA shall have been chosen by the parties, the concurrence of two (2)members shall be necessary to render a decision which shall be valid and bindingupon the parties.

The decision of the VA or PVA shall be guided by the existing agreement (cba), theapplicable laws, rules and regulations, relevant jurisprudence and evidence/spresented.

The decision of the VA or PVA shall be final and executory after ten (10) calendar

The decision of the VA or PVA is not subject to a Motion for Reconsideration.

ENFORCEMENT OF DECISION. In instances of non-compliance by either or bothparties, a motion to enforce/execute the award may be filed with the voluntaryarbitrator who may issue a writ of execution requiring either the sherifi or theNational Labor Relations Commission or the regular courts or any public officialwhom the parties may designate in the submission agreement, to execute the finaldecision.

In the absence of the voluntary arbitrator or in case of his incapacity, the motionshall be filed with the Labor Arbiter in the region having jurisdiction over theworkplace. The filing of motion for the issuance of Writ of Execution is withoutprejudice to any other action the aggrieved party may take against the non-complying party such as a petition for contempt or imposition of fines and penalties.

PRE-EXECUTION CONFERENCE. Within two (2) working days from the receipt ofthe Motion for the lssuance of a Writ of Execution, the Voluntary Arbitrator or incase of his incapacity, the Labor Arbiter before whom the Motion is filed shallschedule a pre-execution conference to thresh out matterc relevant to execution.

ISSUANCE OF A WRIT. Execution shall issue upon a decision that finally disposesof the actions or proceedings.

Enforcement of Writ. The Sheriff or other authorized officer shall be guided by theNLRC Manual on Execution and Judgment, the Procedural Guidelines in theExecution of Voluntrary Arbitrators Decision, the Memorandum of AgreementExecuted between NLRC and NCMB and the absence of applicable rules, theRevised Rules of Court. as amended.

DESIGNATION OF SPECIAL SHERIFF. Only the Secretary of Labor andEmployment may designate special sheriffs to ensure compliance with the decisionofthe VA or PVA.

EFFECT OF FILING OF PETITION FOR CERTIORARI ON EXECUTTON. The fitingof petition for certiorari with the Court of Appeals or the Supreme Court shall notstay the execution of the assailed decision unless a temporary restraining order ofinjunction is issued by the Court of Appeals or the Supreme Court pendingresolution of such petition.

Seameab Hospltal

The Seamen's Hospital is one of the country's accredited hospital that offers a tertiary level ofhealth care delivery. A great number of minor and major surgeries from the variousspecialties have been performed in this hospital.

Following are the services offered in their Department Order.

Depaftment of Suryery

1. General,surgery - involves surgery of the Esophagus & Diaphragm, Acute Abdomen,Peritoneal cavity, stomach and Duodenum, Liver Biliary Tract, pancreis, spleen, small andLarge Intestines, Anorectum.

2. Orthopedics - involves the management of infections of the bones and joints, the variousforms of arthritis, tumors and tumor like lesions of the bones, the various forms ofDislocations, Fractures and Fracture Dislocations which include the spine and minor iniurieslike sprain and strain.

3. Urology - covers the management of the infection and injuries involving the Genito-UrinaryTracl. The removal of stones found in the Genito-urinary Tract. Tumors of the Genitourinary Tlact and disorders of the scrotum, testis, spermatic cord, penis, prostate andseminal vessels and adrenals.

4. Thoraces Surgery - involves the surgical management of is orders in the lungs, the pleuralcavit the bronchus, the pulmonary Vascular system which may arise from infe&ion, tumor ortrauma.

5. Anesthesiology - the service provides local and general anesthesia depending upon theindications to the various specialties in the hospital. Facilities for the administration ofanesthesia are available in the operating room complex and the emergency room on call orscheduled basis.

Depaftment of Pediatrics

Dependents of seamen members who are pediatric c€rses are provided a twelve (12) bed airconditioned ward by the seamen's Hospital. The Pediatric stafi provides the necessarydiagnostic and therapeutic management of such cases.

Department of Obstetrics and Gynecology

This is one of the busiest department of the Seamen's Hospital. lt has an average delivery of50€0 per month. Aside from deliveries which includes caesarian section, pre- nital checli-upand management of obstetrical and gynecological disorders are provided.

'1. lntemal Medicine - this involved the management of the diseases of the vital organs of thebody not requiring surgical management. lt encompasses the whole human body system inits general aspect and this is handled by our general praclitioner. Whenever necessary thesecases are further refened to the sub-specialties i.e. cardiologist etc. for more specificmanagement.

2. Cardiologist - our cardiologist ofier ECG examination, interpretation and monitoring. Wehave also the cardiac tress test monitoring station to further evaluate prospectivecardio-vascular cases.

3. Dermatology - This services provides the evaluation and management of all skin disordersto include infection, Congenital anomalies, tumor, parasitic infection and also the hair andnail disorders.

Department of Rehabilitation Medicine

This department provides physical medicine and rehabilltation services to patients refenedby various specialists. Most of the cases refened are disabilities arising from medical,surgical and traumatic conditions. These conditions are handled by a physiatrist and physicaltherapist. They render thermo therapy, electro-therapy, gymnasium consisting of quadricepschair, parallel bars, practice stairs, shoulder wheel and traclion apparatus for cervical andpelvic traction. They also have whidpool bath for hydro-therapy and uftrasound machines.Shortwave Diathermy apparatus, Infrared lamps and parafin bath.

Depaftment of Eye, Ear, Nose and Throat

This service provides for the medical and surgical management of disorders of the eye, ear,nose and throat. Surgical management like cataract extraction with intra-ocular lensimplantration are among the various eye surgery done in this hospital. Most common eyecondition among seamen is pterygium which is surgically excised when it becomes initatedand affects the vision of the seaman. The diagnostic facilities available in this departrnent arethe refractometer and projection screen for visual acuity test, the direct and indirectopthalmoscope, the p73 slit lamp apparatus, the SchioE Tonometer, the. Perimeter, theaudio-booth and the Audiometer, and lshihara test plates for color vision.

Depaftment of Radiology

This service provides X-ray and Ultrasound examination. lt has two (2) fxed x-ray machines(500 MA and 650 MA) with one having a TV monitoring capability. lt also has a mobile X-rayMachine that can be transported to the wards and operating room. lt also has an ultrasoundapparatus that can determine defects in the liver, gall bladder, spleen, pancreas, kidney andthe biliary tree. lt can also determine the age of gestation of the fetus in the uterus andsometimes the sex when possible. lt can also detect other masses in the pelvic cavityincluding the abdominal aorta.

Depaftment of Patholqy

Provides examinations that includes hematology, serology, blood chemistry, clinicalmicroscopy, bacteriology, parasitilogy, and exfoliative cytology. Our laboratory is a dulyaccredited facility by the govemment.

Dental Department

The dental department provides like dental examinations, dental consultation and/orcheck-up, oral prophylacsis, anodyn treatment, temporary filling, zinc phosphate cementbond filling, silicate cement filling, silver amalgam filling, basic gum treatment, basic dentalextraction, pre and post operative treatment and systemic medication.

Other Seruices

Psychometric Screening Section

This provides proper screening of prospec{ive seamen in order to determine whether theyare psychologically and intellectually prepared to face the demands and hazards of a neurenvironment aboard ship. They undergo personal interview and also written and practicalexaminations which are prescribed by the Health and Marine Agencies of the Govemment.

Nursing Service

The Nursing Service provides the medical and surgical nursing care to patients confined inthe hospital. They are distributed to the wards, operating room complex, out patientdeparfnent, emergency room and nursery. Our nurses are trained p73 to provide the best ofattention and response to the comforting needs of the patients.

Transportation Service (Ambulance)

The Seamen's Hospital provides evacuation, transfer and pick-up of patients to and from thehospital. The two ambulances are provides with orygen and other insulation apparatus plusthe emergency and obstetrical bags.

Pharmacy

Out-Patient - 8:00 a.m. to 5:00 p.m.ln-Patient - 24 Hours

Dietary

Responsible for planning both general and special diets, devising menus, preparingand serving food to patients and personnel.

It is agreed and accepted between the above mentioned unions and the NSA to renewthe aforesaid collective bargaining agreement.

The terms and conditions in this collective bargaining agreement will be applicable toFilipino Seafarers who are members of AMOSUP serving on board vessels which areregistered under NlS, and enlisted in NSA.

This agreement shall be binding with regard to Filipino seafarers serving on boardvessels where these terms have been applied until notice of termination has been givenor the agreed term of service of the crew hired on these terms has expired. Which ofthese altematives to be used and in case of the time of notice, shall be agreed upon ineach instance. For seafarers hired on these terms, however, these shall apply until theirtime of service has expired.

The parties to this agreement are aiming to have a clear understanding of each othe/srights and obligations in order to develop and maintain a smooth relationship between theNSA and the unions. Article 1AEngagemenl ilustering and Travelllng Expenses

The seafarer will sign an agreement for a fixed period that he shall be serving on board avessel, covered by this agreement. Prior to signing such agreement, the seafrarer shallbe interviewed and medically examined for fitness.

During the examination, the seafarer shall disclose to the doctor any and all knownpre'existing illness or condition pursuant to #11 (Definition of terms) of the POEAStandard Terms and Conditions Goveming the Employment of Filipino Seafarerson Board Ocean-Going Ships (POEA SEC). Concealment of a pre-existing illnessor condition shall also be subjected to Section 20 (E) of the POEA SEC.

Engagement, mustering expenses and travelling expenses ftom Manila to the place ofembarkation shall be paid by the Company. The seafarer shall be reimbursed for medicalcertificate, passport and visa.

After completion of service in accordance with the contract of hiring, the Company shallpay for travelling expenses and lodging from the ship to Manila. The seafarer will inaddition be entitled to a travelling allowance of one ('t) day basic wage to a maximum oftwo (2) days basic wege.

lf the seafarer however, requests on his own personal reason an early termination of thecontract he shall give a written request to the Master. The Master should then inform himin the presence of a witness, about the consequences of the early termination of hisemployment ccntract regarding his liability to shoulder the cost of his repatriation and thetravel expenses of his replacement.

The Company, however, shall consider special request of eady termination of the contractof employrnent based on compassionate grounds such as in cases of the death orserious illness of spouse, children or parents in which case the repatriation costs will be tothe Company's account.

Travelling expenses on the Company's account shall not include the seafarers' baggagein excess of the normal allowed weight by the air canier. Excess baggage shall be at theseafarers' expense.

Article 18Company

The word "Company'' in this agreement shall be defined as the Company which owns oroperates the vessel and is named in the employment contract as the employer.

Chanoe of Emolover

lf the seafarer is employed by a Company which operates the vessel, the seafarer shallaccept that the owners of the vessel take over as his employer for his remaining period ofservice (see article 4). Provided, however;

't. That the previous employer or the new employer (the owners of the vessel) settles allaccounts due to him under his original employment contract.

2. That the new employer (the owners) declares in a written statement to take over allresponsibility from the previous employer. The statement shall be addressed toPOEA, AMOSUP and the seafarer.

The crewing agent used by the new employer (the ownerc) shall issue a similar writtenstiatement that he takes over as representative for the employer and assumes allresponsibility towards the seafarer.

Chanoe of Crew Aoent

lf the Company should make a change of crewing agency in Manila, the seafarer shallcontinue in service with the Company provided his account is settled for the period servedwith the first agency and provided the second agency declares in a written statement tothe seafarer, the POEA and AMOSUP that it trakes on all responsibilities on behalf of theCompany towards the seafarerftom the first agency.

Ardcle 2Wage

The seafarer's basic wage and rates of overtime are set out in the attached Wage Scale(Appendix ?)"). The wages are stipulated in US dollars, and the seafare/s account iskept in US dollars. Wage accrues from the day the seafarer commences service onboard. lf he has to travel from the Philippines in order to take up service on board, basicwage accrues from the day of departure from Manila to the day when the seafarer sign-ofrfrom the ship.

Each month he is on board, the seafarer is entitled to payment of the remaining 20o/o olhis basic wage after legal deductions have been made. The remaining 80o/o shall be paid

to the beneficiary that the seafarer has nominated through any authorized Philippine Bankand shall be available no later than the 10th of the immediately succeeding month.Overtime remuneration shall be paid out on board, ref. to Article 7 below conceming fixedmonthly wages.

The rate of exchange for conversion of US dollars into Philippine curency shall be thebuying rate of exchange indicated in the credit advice of the local authorized PhilippineBank. The allotment to be paid out on board should be paid out in cash and may be paid

out in the port state curency.

Article 3Board and Lodging

The seafarer is entitled to free board and lodging during service on board. lf board andlodging is not provided on board, the Company shall defray the cost of satisfactory board

and lodging ashore.

Artlcle 4Duration of S€rvice

The seafarer signs on for a period of NINE (9) months. However, the contract could atthe Company's option be terminated at any time between 8 and 10 months. A cadet mightbe engaged for a longer period but less than 12 months in order to compty with theP1pino prequalification scheme for maritime education. The cost of repatriation shall be

on Company's account.

A shorter service period than 8 months may be agreed for substitutes, repair personneland similar employees. The cost of repatriation shall be on Company's account.

The first 3 months of service with the Company is considered a probationary periodduring which the company may terminate the contract by giving 14 days written notice.Termination of contract by the Company in the probation period, will not entitle theseafarer to termination pay (see Article 5 c) but to free repatriation.

Article 5Termination of Service in Exceptional Circumstances

a) In the event of sale, laying-up, or lengthy stay in a repair yard, the Company mayterminate the service. The seafarer is then entitled to pay up to including the day ofsigning-off plus TWO (2) months' basic wages and repatriation to Manila on theCompany's account.

In case of shiploss the seafarer is then entitled to pay up to including the day ofsigningoff plus two (2) months' basic wages and repatriation to Manila on theCompany's account.

b) The seafarer is entltled to terminate the service contract immediately if the vessel isdeclared unseaworthy in accordancewith Chapter 1, Rule 19, of the Convention onthe Safety of Life at Sea (the "SOLAS" Convention). The vessel shall also be deemedto be unseaworthy if it lacks one or more of the certificates prescribed in Chapter 1,

Rules 12 and 13 of the "SOIAS" Convention. The seafarer is then entitled to pay up toincluding the day of signing-off, plus two (2) months' basic wages and repatriation toManila on the Company's account.

c) The Company may terminate the employment contract on valid reason prior to theagreed period of duration, ref. Art. 4, provided the seafarer is paid two (2) months'basic wages and repatriation expens€s to Manila. The Company may alwaysterminate the contract of employment if the seafarer becomes ill or injured and has tosign off from the vessel.

d) A seafarer who has served the agreed contract period, ref. Article 4 (8 months ormore) will not be entitled to termination pay of two (2) months' basic wages asmentioned in litra a) to c) above.

lf the seafare/s remaining contraql period of service is less than one (1) month (hehas already served more than seven months), he shall only be entitled to ONE (1)

month's basic wage termination pay, see litra a) to c) above.

e) A seafarer who has received termination pay in accordance with the above provisions(lilra 'a'to'd') shall be considered to have received full and final compensation in anyrespect.

0 A seafarer who is offered to continue in service on another vessel within one month,ref. Article '17, is not entitled to termination pay in accordance with the rules in litra a)to d) above, but shall be entitled to basic wage until the date of joining the other ship.

lf the seafare/s contract of employnent is terminated due to changing of managementfor the vessel, the seafarer shall have no right to termination pay, if he accepts tocontinue in service on board with the new manager as employer.

Ig) The Company or its representative may within the contract period dismiss in

acenrdance with the Grievance Procedure any offcer who neglecG to meet on boardat appropriate time, commits himself to disobedience, violent behaviour, abuse ofnarcotics and alcohol or other valid grounds (ref. the Norwegian Ship Labour ActArticle 5-14). The repatriation costs will be for the officers'account provided he hasnot completed his employment contract and he may be held responsible for expensesand damages caused by such breaches on rules and regulations.

Article 6Grievance Procedure and Voluntary Arbitration

As indicated in article 5 c and e the company may terminate the employment contractwith the seafarers for disciplinary reasons. The seafarer may on his side, find it necessaryto make complaints about negligence of his employment contract.

Grievance procedures to be observed in such circumstane€s are enclosed asAppendix C.

All disputes arising out of this collective bargaining agreement or employment contractsconnected to this collective bargaining agreement shall be settled in accordance with thegrievance procedure as set forth above. lf the dispute cannot be settled, the same shallbe resolved through voluntary arbitration pursuant to the procedures set forth inAppendix D.

Article 7Working Hours

The normal working hours is 8 hours per day, Monday to Friday and 4 hours on Saturday.For those who attend sea watch, their working hours shall be eight staggered hours perday, under the direction of the Master or his representative. The seafarer will be paidmonthly wages for service on board which include guaranteed overtime compensation.Hourly overtime for service rendered in excess of the guaranteed eighty five (85) hoursovertime shall be paid as indicated in the Wage Scale, Annex 2 of this agreement.

It is understood that overtime work will be performed at the direstion of the Master or theMaste/s representative.

The crewmembers are supposed to perform altemation service on the deck and in themachinery department whenever required. Compensation for such altemating service isincluded in the basic wages.

The Radio fficers/Chief Stewards and Electricians will be paid monthly wages forservice on board which include fixed overtime compensation. The fixed overtime willinclude all overtime work necessary and related to the trade and the vessel concemed.

The guaranteed and fixed overtime compensation is stipulated on a monthly basis, seewage scale, but will be paid pro rata for part of the month.

The provision in the Nonrvegian Ship Labour Act, article 9-4 about compensation for standby watches in port is covered by the basic wage.

The seafarer is entitled to 10 hours of rest during any period of 24 hours and 77 hours ofrest during any period of 7 days ('168 hours). The rest hours can be divided into 2 periodswith one period of at least 6 hours and with no more than 14 hogs between any rest-hour

Exemption ftom these rules are allowed in situation of distress, emergency, boatdrill andother overriding operational conditions (see ILO convention 180, STCW 95 and EUdirec{ive 63/1999)

The existence of potential danger shall be determined solely by the Master. Inconnection therewith the seafarer shall perform the necessary work without overtime payfor purposes of maintaining the vessel's safety, that of the seafarers, passengersi and thecargoes on board, or saving lives, rendering assistance to other vessels in distress or inall other cases of emergency, or fire and boat drills.

2WATCH SYSTEMOn 2 watch system ships the maximum service period should be six months.

The 2 watch system provides for up to 84 hours of work per week.

RATINGSThe monthly basic wage shall be based on 191 hours (computed at 44 ordinary hoursevery week) and monthly guaranteed overtime compensation equivalent of 143 hours.

Working houts in excess of 334 hours a month are to be compensated as overtimecompensation.

RADIO OFFICERS ELECTRO.TECHNICIANS. ELECTRICIANS AND CHIEFSTEWARDSSeafarers who are physically affected by the 2 watch system shall be paid a monthly 2watch keeping allowance of USD 250. The fixed overtime compensation and the 2 watchkeeping allowance cover all and any overtime work.

Artlcle 8Holidays

The parties adopt the following Public Holidays in Nonivay:

Radio OffcerV Chief Stewards and Electricians/Eleclro Technicians

- 11191 basic wage per hour for up to 8 hours work for work on Public Holidays whichfall on an ordinary week day. Additional work (beyond 8 hours) shall be consideredcovered by the fixed overtime.

- Compensation for all work on Public Holidays which falls on a Saturdays andSundays, are included in the fixed overtime compensation.

Ratinqs

- Working hours on Public Holidap and Sundays, shall be compensated by overtimecompensation. The guaranteed eighty fve (85) hours of overtime compensation permonth may be used to cover such entitlements.

The Radio Officers, Chief Stewards, Eleclricians, Electro Technicians and Ratingsshall be entitled to TEN (10) days vacation pay based on the basic wage for everymonth of employnent.

Article 9Compensation for Porsonal Effects

In case of accident, fre or other mishap affecting the ship, the Company shallcompensate the seafarer for his damaged or lost personal effects either partial or total,depending on the extent of the damage or value of the lost effecG to a maximum of USD3,000 for total damage or loss. The seafarer will be entitled to an additionalcompensation for necessary clothing in case of ship loss. The compensation may bereduced on account of the seafare/s own contributory negligence or circumstancesothenivise.

The seafarer submit a signed statement specifoing the items lost prior to payment of anycompensation hereof.

The provisions of the Nonregian Ship Labour Act article 8-4 are replaced by this Article.

Article l0Sickness and Injury

During the period of employment and at the time of signing off, the seafarer shall submitto a medical examination when reguested by the Company or its representative, at theCompany's expense.

\Mtile serving on board, a sick or injured seafarer is entitled to medical treatment at theCompany's expense. The Company is not responsible for conservative dental treatrnent.

lf the seafarer has to sign off due to sickness or injury or if he is sick or injured at theterminaUon of the service period, he has the same entitlement to a medical treatmentincluding hospitalization, for a maximum period of one hundred and thirty (130) days fromdate of signing off. Ho^€ver, in case of an occupational injury or an occupational disease,the seafarer is entlUed to medical treatment including hospitalization, until he is declaredfrt or the degree of permanent disability has been established by a Company designatedphysician authorised by the Nonrvegian authorities.

In accordance with the POEA's rules and regulation the seafarer must submit to a postemployment medical examination within three (3) working days after his return to thePhilippines to obtain these benefits. lf he should be unable by reason of physicalincapacity to do so, a written notice to the agency within the same period is deemed ascompliance provided the notice about the incapacity is certified by the Master or anauthorized physician.

In the event of sickness or injury necessitating signing-off, the seafarer is entitled to travelto Manila at the Company's expense.

In the event of sickness or injury necessitating signing off, the seafarer is also entitled tosick pay (at the same rate as basic wage) for up to one hundred and thirty (130) daysafier signing-ofi, to be paid on a monthly basis, provided the sickness or the injury isverifed by written statement from an Noruegian authorized physician. (See POEA's rulesand regulations). The sick pay will be in addition to the vacation leave compensationmentioned in Art. 8 but not in addition to the termination pay compensation mentioned inArt. 5 points a) to c).

Expenses advanced by the seafarer from his own pocket for 't) medicines purchasesprescribed by a Company designated physician, and 2) reasonable transportationexpenses to have treatment, shall be reimbursed on a monthly basis. Thereimbursement shall be subject to submission of receipts or proof of expenses.

It is understood that a seafarer who is signed-off by reason of sickness or injury mustretum to the Philippines within the usual period of travel from the date and place ofdisembarkation indicated in homeward bound ticket. On arrival in the Philippines, heshall report to the Company's designated physician within three (3) working days from thetime of anival for post employment medical examination, othenvise, the employe/sliability shall be deemed terminated. In case however, of failure to report due toseafiarers' physical incapacity, a written notice to the Company within three (3) workingdays from anival is deemed as compliance provided the notification about the incapacityis certifted by the Master or an authorized physician.

Article 1lCompensation for Death

In the event of death of a seafarer while serving on board or while traveling to or from thevessel on Company's business or due to marine peril, or due to illness acquired duringemployment, the Company will pay to his legal heirs a compensation in the amount ofusD 87.500.

It is agreed that payment of this amount shall be inclusive of the benefits payable underthe POEA Standard Employment Contract for Seafarers On-Board Ocean-Going Vessels.

It is further agreed that the compensation shall be payable to the seafare/s legal heirs inaccordance with Philippine laws.

The names and addresses of the seafare/s legal heirs shall be declared at the time ofhiring.

The Company shall pay an additional compensation to each of the seafarefs childrenunder the age of 21 years of USD 17,000, maximum of four (4) children with maximumamount equivalent to USD 68,000. lt is agreed that payment of fiis amount shall beinclusive of the benefib to children payable under the PpEA Standard Employment

Article 12Disability Compensation

lf a seafarer due to no fault of his own, suffers an occupational injury as a result of anaccident or an occupational disease while serving on board or while travelling to or fromthe vessel on Companfs business or due to marine peril, and as a result his ability towork is permanently reduced, partially or totally, and never to be declared ftt, theCompany shall pay him a disability compensation which including the amounts stipulatedby the POEA's rules and regulations shall be maximum:

lf the disability should cause the seafare/s death, the death compensation to hisbeneficiaries should be reduced with the amount paid out as a disability compensation.

The disability compensation shall be calculated on the basis of the POEA's schedule ofdisability or impediment for injuries at a percentage recommended by a doctor authorizedby the Norwegian authorities for the medical examination of seafarers.

The disability shall be based solely on the disability grading provided under Sec'tion 32 ofthe POEA Strandard Employment Contract, and shall not be measured or determined bythe number of days a seafarer is under treatment or the number of days in which sicknessallowance is paid.

The Company shall take out the necessary insurance to cover the benefits mentionedabove. Coverage ananged with a P&l Club recognized by the Norwegian authoritiesshall be deemed to meet these requiremenb.

Article t3APhilippine Social Security System, Philhealth and Employees Compensation

The Filipino seafarer will also be covered by the Philippine Social SecuritySystem, Philippine Health Insurance Corporation (Philhealth), the EmployeesCompensation Commission (ECC) and the Home Development Mutual Fund(Pag-lbig). The premiums should be paid partly by the seafarer and partly by theCompany as provided by the govemment regulations. The contributions from theseafarer should be deducted from his salary and remitted by the Company to thePhilippine SSS, Philhealth and Employees Compensation Commission andPag-lbig Offices.

lf the seafarer is not declared fit afterthe expiration of the one hundred and thirty (130)days period, he may be entitled to benefits under the Philippine EmploymentCompensation Program and the Philippine Social Security System.

The Company's Contributions to be paid to SSS, ECC, Philhealth and PagJbig isindicated in the wage scale

Article 138Sulivofs Pension Plan Fund

The Company shall contribute to an insurance scheme to provide benefits toseafarers widows as and when the scheme has been developed by AMOSUP.The scheme shall be managed by a board of trustees. The cost of this benefit isrecognized under the heading 'Survivorship Pension Fund Scheme' shown in theattached wage scale.

Contribution to be made to a bank account advised bv AMOSUP.

Article 14War and Piracy Bonus

War and piracy risk bonus will accrue and expire from the same dates as for similaragreements for seafarers between the NSA and NSU.

The war and piracy risk bonus will be based on basic wage with the same percentage asagreed between NSA and NSU.

Remark:

Regarding Gulf of Aden - entitlement and rates of compensation shall be in line withPOEA Goveming Board Resolution No. 12, Series ot 2012.

A special agreement concerning indemnity is attached as Appendix "B". Seafarers whoare entitled to compensation in accordance with the rules in Appendix B have noentitlement in accordance with article 1 1 (compensation for death) and afticle 12(disability) in this CBA."

Article 15Unemployment Benefits

After the agreed period of service on board, see Article 4, the seafiarer will be entitled tounemployment allowance when his leave period has expired, provided he has reportedback to the Company or ship manager for a renewal of contract of employment no lessthan ten (10) days, but not earlier than three (3) weeks before his leave period hasterminated.

The seafarer will not be entitled to an unemployment allowance if the employmentcontract with the Company has been terminated with a wriften notice of termination fromthe Company or the seafarer has been dismissed, see Article 5 and 6.

The unemployment allowance is USD 60 per month for a maximum period of three (3)months (US dollar 2 per day). lf the seafare/s contract of employnent is renewed in suchperiod of unemployment, his right to unemployment allowance will cease from the time heis entitled to wages after the new contrac't.

Article 16Medical Treatnent

The seafarer and his immediate dependents shall be entitled to medical treatrnentprovided for by the AMOSUP FAMILY MEDICAL AND DENTAL PI-AN (FMDP).

The Company agrees to contribute to the existing AMOSUP Family Medical and DentalPlan (FMDP) for the seafarer and his dependents the sum of USD 25 a month perseafarer for his service period, bop USD 20. lt is understood that this contribution shallnot afiecl the treatment and sick pay benefrt of the seafarer provided by Article 10 of thisagreement for the fi rst (130) days.

It is understood that the existing AMOSUP FAMILY MEDICAL AND DENTAL PLAN(FMDP) shall be to the extent of the services and facilities available as indicated inAppendixes E of this agreement. The Seamen's Hospital shall not be obliged to covertreatment outside its available services and facilities.

Article 17Transfer of Seafarer

The Company may transfer a seafarer to any of its vessels provided lhat the transfer shallnot result to demotion in rank or diminution of pay and benefts and that there will be nointerruption of time for calculating leave benefits or increase in term of service.

Ariicle 18Jurisdiction

The Unions and the NSA have observed that according to the NIS ACT this agreementshould be subjected to Nonrvegian law and the jurisdiction of the courts in Norway.

Cases conceming the seafare/s service on the ship may be brought against the companybefore a Nonivegian court or before a court in the seafare/s country of residence.

Article 19Regulation Concerning the Applicatlon of Special Provislons in The Norwegian

International Register Act

The parties have agreed to make exceptions from the Norwegian Ship Safety andSecurity Act conceming hours of work on board ships and the Norwegian Ship LabourAct, ref. the Norwegian Intemational Ship Register Act Article's 7 and 8.

The hours of work shall be as stipulated in Article 6 of this agreement.

excluded by the provisions mentioned above, and shall not be applicable to the contractsof engagement which are established with reference to this agreement

Article 20Contribution to Training, Upgrading and Education Project

In order to improve the qualifications of the Filipino seafarers and to secure a sufficientand satisfactory recruitment, the parties have agreed to establish an Education Project forFilipino seafarers serving on NIS vessels.

The Project shall be administered by NSA and the further statutes for the Project shall begiven by NSA Council. The union parties shall be informed about he statutes, and alland any later amendments of these statutes.

NSA has appointed a Steering Committee among the Companies' representatives inManila. AMOSUP and the Nonnregian Maritime Unions have the right to be represented inthe Steering Committee with one representative each (totally 2 representatives).

The Company shall contribute USD 45 per seafarer/officer per month to the Project, tobe remitted every three (3) months to the Project's bank account, according to the NSACouncil's decision.

Article 23Strlkes, Lockouts and Similar Reaction

The seafarers and companies who are covered by this agreement shall refrain ftomstrikes, lockouts and similar action at sea and in pofts with the exemption of ports inNonrvay.

Article 24Right to Recovery of Expenses from Third Parties

\A/here pursuant to the provisions in this agreement, payments are made by or on behalfof the Company, to or on behalf of the seafarer in respect of an injury or a disabilitysustained in circumstances not related to employment and giving rise to legal liability by athird party to the seaftrer (whether in negligence or otherwise), then the making of eachsuch payment shall entitle the Company to assume the right of the seafarer to pursue foritself the said third party for recovery of expenses paid with all related interests thereon,on its own ac@unt, and whatever amount it may recover shall be treated asindemnification in favour of the Company for paying the liability to the seafarer.

In case the seafarer's presence or cooperation is necessary to a successful recovery ofthe said claim, the company shall fumish the conesponding expenses for transportationfares, hotel accommodation or board and lodging and allowance needed under thecircumstan@s.

The Company shall assume full responsibility for any pertinent legal action it decided totake and assures that the seafarer shall not be exposed to any counter-claim.

Artlcle 25Protocol regarding Gargo Handling

The parties will continue to find a satisfactory solution to the question in cooperation withthe lTF.

Article 26Drug and Alcohol Test

The seafarer shall consent to submit to drug and alcohol testing prior to the signing ofcontract of employment and shall also agree to submit to random testing for drugs and

alcohol at any time during the period of employment when so requested by the Master orby other authority. The testing should be in accordance with guidelines from Nonivegianauthorities.

This agreement shall be effective from 1st January 2016 until 31st December 2017 andturther il a request for termination is not given neither by the NSA nor by the AMOSUPand the NSU with three (3) months written notice. APPENDIX B

AGREEMENTabout

High Risk Bonus and Compensation in case of disability or death coused by Waror Pincy Attack

The parties agreed to establish an agreement regarding compensation in case ofdisability or death that befalls a seafarer when in seryice on a ship as a directconsequence of a war or piracy attack, See the chapter '15 of the NoruegianMarine Insurance Plan of 1996, version 2007.

The agreement shall cover disability or death as a direct consequence of a shiptransiting an area where the parties have agreed that there exist a risk for war orpiracy attack, and have established an agreement describing this area.

Article 1

The following conditions will apply regarding compensation in case of disability ordeath directly caused by war or piracy attack:

1. In case of injury that makes the seafarer permanently unfrt for furtherservice as a seafarer, he/she receives a compensation of USD 165 000.

2. lf the seafurer dies, the surviving dependants (spouse, children or parents inthis preferential order) will receive USD 165 000.

3. lf the seafarer is permanently unfrt for further service as a seafarer (seepoint 1 above), and has children under the age of 21 years that aresupported by him/her, or he/she dies (point 2 above) leaves behind childrenunder the age of 21 years, each child will receive a compensation ofusD 40 000.

Article 2

The above mentioned compensation amounts, will be given in addition to thecompensations and pensions from collective life insurance, insurancecontribution or other collective or individual pension- and insurance anangementsthat might exist and that cover death and injury caused by war or piracy attack.Howevel seafarers who are entitled to the compensation mentioned in article 1

above, are not entitled to the compensation provided for in case of death anddisability in NIS or Model agreements concluded between the NonregianShipowners' Association, the AMOSUP and Norwegian Unions, see the NISagreement article 11 and 12 and the Model agreement article 12 and 13.

Article 3

This Agreement is subject to Nomegian laws and Noruvegian courts of justice.

Article 4

This Agreement is effective ftom the 1 March 2010 and will replace all earliercollective bargaining agreements and protocols regarding war andrpiracy attacks

Grievance Ptocedutc

ASO and AMOSUP have agreed to an amicable settlement of all disputes related tothis collective bargaining agreement including disputes between their members, theshipping companies and the seafarers, see the introduction part, last paragraph page1 and 2.

As a result, the ASO and AMOSUP agree that the following procedures shall befollovred for disputes between the shipping companies and the seafarers:

1. The Company and the seafarers shall refrain from filing any complaint before thePOEA or any court or ofiice in the Philippines without having exhausted first thisgrievance procedure.

2. The Company shall observe the following disciplinary actions when ofiended ordissatisfied with the seafare/s behaviour or performance:

1) Ening seafarer shall receive a written waming from head of department, seniorofiicer or the master. The waming issued should also ask the officer to explain hisac'tions in writing within 24 hours and indicate the possible consequences for himof his actions. A notice of the waming should be entered into the ship's logbook.

2) When the seafare/s written explanation is received, the master will decide iffurther steps shall be taken or if the case should rest. lf further steps should betaken, the procedure will be:

a) lf the master considers it necessary to terminate the contrac{ of employment,the seafarer shall be duly informed. He will have the entitlements fortermination pay and repatriation as prescribed in Adicle 5 c and d.

b) lf the master consider it possible that the seafarer should be dismissed, ahearing shall be summoned before a committee consisting of the master as achairman and two other members appointed by the master. lf possible one ofthe other members shall be chosen amongst the offcer or crew group that theseafarer has belonged to. The hearing shall take place less than 14 days afterthe enors or similar has happened.

The master/chairman shall question the seafarer and any witness who mightbe able to provide information in the case. The remaining members of thecommittee and the seafarer himself may ask questions to the witnesses,through the master/chairman or directly as the master/chairman decides. Thesubmitted statemenb from the seafarer and the witnesses shall be entered intoa special protocol. A copy of standard protocol which may be utilized isattached as appendix "1". The statement shall be read out to those who havesubmitted them. lf the master/chairman makes a decision in the matter, heshall state the grounds for such decision, and the decision shall be entered inthe protocol.

The members of the committee shall by their signature certiff the accuracy ofthe entered statemenb. The seafarer is entitled to a copy of the protocol. Anotice of the protocol and the headng should be entered into the ship'slogbook. /

c) When the hearing is concluded, the master shall decide as soon as possibleif the seafarer should be dismissed (article 5e) be given notice of termination(article 5c) or if the case should rest without further steps for the time being.

lf the master decides to dismiss the seafarer, the seafarer shall be informedimmediately of the decision. The decision may be included in the protocol fromthe hearing and should be entered into the ship's logbook.

A seafarer who has been dismissed should be given the information in writing.A standard form which may be used for such information is enclosed asappendix "2". He will have no entitlements to termination pay or repatriation,see article 5e.

lf the master decides to give the seafarer notice of termination, the seafarershall be duly informed and receive the entitlements indicaied in article 5 c and

d) In special cases the committee may be appointed by lhe Company or theCompany's representative and the hearing will take place ashore if considerednecessary in order to best elucidate the factual basis for dismissal.

lf the company ha3 not establlshed its own complaint procedure, the following procedureshall be used:

Wth reference to the ILO Maritime Labour Convention (lLO MLC), regulation 5.1.5, thefollowing on board complaint procedure has been established for expeditious handling ofseafarer complaints alleging breaches of the requirements of the ILO MLC.

A Seafurer making use of this procedure shall not be victimized for filing a complaint andhe/she will also have the option to seek redress whatever legal means that the seafarermay consider appropriate.

This procedure seeks to resolve complaints at the lowest level possible.

The Seafarer has the right to be accompanied or represented during the complaintprocedure, and to safeguard against any kind of victimization for filing complaints.

A seafarer who considers himself aggrieved shall make his complaint(s) in accordancewith the following procedures:

a) A written complaint shall be communicated to head of the Department of theSeafarer lodging the complaint or to the Seafare/s Superior Officer to resolve thematter within prescribed time limits appropriate to the seriousness of the issuesinvolved.

b) lf the head of the Department or the Superior Officer cannot resolve the complaintto the satisfaction of the seafarer, the latter may refer it to the Master, who shouldhandle the matter personally.

c) A meeting may be held with the seafarer and the Master, superior officer oranother representative for the employer to discuss and setfle the complaint.

d) All complaints and the decisions on them should be recorded and a copy providedto the Seafarers concemed

e) lf a complaint cannot be resolved on board, the matter should be refened ashoreto the Employer/shipowner, who should be given an appropriate time limit forresolving the matter, where appropriate, in consuttation with the seafarerconcemed or any person the Seafarer may appoint as his/her representative.

f) A seafarer who wishes to appeal a settlemenvnon-setflement of the complaint,should consult his/her national union or the union that may be co-party to thecollective bargaining agreement applicable for his /her employment. The union(s)shall, before advising an appeal to be filed, request the Employer,Vshipowner,sview or the opinion of the Employer Association that is party to the collectivebargaining agreement before an appeal is made to the relevant authorities or acourt ofjustice.

AMOSUP shall, before advising an appeal to be filed, request the company's view.The Company is entitled to the request that AMOSUp discuss the case with NSAbefore an appeal is made to the authorities or the court

APPENDIX D

Vo I u nta ry A rbitnti o n Prcc edu re

NSA and AMOSUP have agreed to be bound by the provisions of Micles 261and 262 of the Labor Code of the Philippines and recognizes that voluntaryarbitrators/ panel of voluntary arbitrators shall have original and exclusivejurisdiction and authority to hear and decide, within thirty (30) days ftom date ofsubmission of las pleading clarificatory hearing, all unresolved grievancesrefened by the Grievance Committee and/or those arising from the interpretationor implementation of the collective bargaining agreement or company personneloolicies.

The Company and the Union shall select ftom among the list of VoluntaryArbitrators/ panel of Arlcitrators below specified. Thereafter, they are required toaccomplish, execute and submit the Submission Agreement to the NationalConciliation and Mediation Board-Department of Labor & Employment. Costs ofvoluntary arbitration shall be equally shared by the Company and the Union.

In case the seafarer is represented by counsel other that the Union, he shallbear the cosUexpenses of voluntary arbitration and/or shall directly apply with theNational Conciliation & Mediation Board or subsidy.

The Voluntary Arbitrator or members of the panel of voluntary arbitratorsconsisting of three members, to be chosen by the parties, shall be selectecj fromamong respected members (retired) of the judiciary and the academe who arenon-praciicing lawyers and cunently unaffiliated with any law firm/s; the list ofwhich shall be provided by the NCMB- DOLE upon the signing of theSubmission Agreement by the parties.

The Voluntary Arbitrator or members of the panel of voluntary arbitrators shall beentitled to receive an arbitration fee for each case handled, amounts of whichshall be standardized depending on the individual Arbitrators appreciation of thecomplexity of the factual matters to be determined and legal issues to beresolved.

The VA or PVA shall adopt the Revised Procedural Guidelines in the conduct ofVoluntary Arbitration Proceedings insofar as they are applicable and consistentwith the provisions of this chapter as to enable the parties to the dispute,disagreement or controversy to present fully but expeditiously their respectivesides.

In case of PVA shall have been chosen by the parties, the concunence of two(2) members shall be necessary to render a decision which shall be valid andbinding upon the parties.

The decision of the VA or PVA shall be guided by the existing agreement (cba),the applicable laws, rules and regulations, relevant jurisprudence and evidence/spresented. y

The decision of the VA or PVA is not subject to a Motion for Reconsideration.

8. ENFORCEMENT OF DECISION. In instances of non-compliance by either orboth parties, a motion to enforce/execute the award may be filed with thevoluntary arbitrator who may issue a writ of execution requiring either the sheriffor the National Labor Relations Commission or the regular courts or any publicofficial whom the parties may designate in the submission agreement, to executethe final decision.

In the absence of the voluntary arbitrator or in case of his incapacity, the motionshall be filed with the Labor Arbiter in the region having jurisdiction over theworkplace. The filing of motion for the issuance of Writ of Execution is withoutprejudice to any other action the aggrieved party may take against the non-complying party such as a petition for contempt or imposilion of fines andoenaJties.

9. PRE-EXECUTION CONFERENCE. Within two (2) working days from thereceipt of the Motion for the lssuance of a Writ of Execution, the VoluntaryArbitrator or in case of his incapacity, the Labor Arbiter before whom the Motionis filed shall schedule a pre-execution conference to thresh out mafters relevantto execution.

10. ISSUANCE OF A WRIT. Execution shall issue upon a decision that finallydisposes ofthe actions or proceedings.

11. Enforcement of Writ. The Sheriff or other authorized officer shall be guided bythe NLRC Manual on Execution and Judgment, the Procedural Guidelines in theExecution of Voluntary Arbitrators Decision, the Memorandum of AgreementExecuted between NLRC and NCMB and the absence of applicable rules, theRevised Rules of Court. as amended.

12. DESIGNATION OF SPECIAL SHERIFF. Only the Secretary of Labor andEmployment may designate special sheriffs to ensure compliance with thedecision of the VA or PVA.

13. EFFECT OF FILING OF PETITION FOR CERTIORARI ON EXECUTION. Thefiling of petition for certiorari with the Court of Appeals or the Supreme Courtshall not stay the execution of the assailed decision unless a temporaryrestraining order of injunction is issued by the Court of Appeals or the SupremeCourt pending resolution of such petition.

The Seamen's Hospiial is one of the country's accredited hospital that offers a tertiarylevel of health care delivery. A great number of minor and major surgeries from thevarious specialties have been performed in this hospital.

Following are the services offered in their Department Order.

Deoartment of Surqerv

1. General Surgery - involves surgery of the Esophagus & Diaphragm, AcuteAbdomen, Peritoneal Cavity,

Stomach and Duodenum, Liver Biliary Tract, Pancreas, Spleen, Small and LargeIntestines, Anorectum.

2. Orthopedics - involves the management of infections of the bones and joints, thevarious forms of arthritis, tumors and turnor like lesions of the bones, the variousforms of Dislocations, Fractures and Fracture Dislocations which include the spineand minor injuries like sprain and strain.

3. Urology - covers the management of the infection and injuries involving theGenito-Urinary Tract. The removal of stones found in the Genito-Urinary Tract.Tumors of the Genito- Urinary Tract and disorders of the scrotum, testis, spermaticcord, penis, prostate and seminal vessels and adrenals.

4. Thoraces Surgery - involves the surgical management of is orders in the lungs, thepleural cavitthe bronchus, the pulmonary Vascular system which may arise frominfection, tumor or trauma.

5. Anesthesiology - the service provides local and general anesthesia dependingupon the indications to the various specialties in the hospital. Facilities for theadministration of anesthesia are available in the operating room complex and theemergency room on call or scheduled basis.

Department of Pediatrics

Dependents of seamen members who are pediatric cases are provided a twelve(12)bed air-conditioned ward by the Seamen's Hospital. The Pediatric staff provides thenecessary diagnostic and therapeutic management of such cases.

Department of Obstetrics and Gvnecoloov

Deoartment of Medicine

i. jnternal Meciicine - this involved the management of the diseases of the vitai organsurf r'he body not requiring surgical management. lt encompasses the whole humanbody system in its general aspect and this is handled by our general practitioner.\Menever necessary these cases are further refened to the sub-specialties i.e.cardiologist etc. for more specific management.

2. Cardiologist - our cardiologist offer ECG examination, interpretation and monitoring.We have also the cardiac tress test monitoring station to further evaluate prospectivecardio-vascular cases.

3. Dermatology - This services provides the evaluation and management of all skindisorders to include infection, congenital anomalies, tumor, parasitic infection and alsothe hair and nail disorders.

Department of Rehabilitation Medicine

This department provides physical medicine and rehabilitation services to patientsrefened by various specialists. Most of the cases refened are disabilities arising frommedical, surgical and traumatic conditions. These conditions are handled by aphysiatrist and physical therapist. They render thermo therapy, electre.therapy,gymnasium consisting of quadriceps chair, parallel bars, practice stairs, shoulderwheel and traction apparatus for cervical and pelvic traction. They also have whirlpoolbath for hydro-therapy and ultrasound machines. Shortwave Diathermy apparatus,Infrared lamps and parafin bath.

DeoartmentofEve. Ear, Nose and Throat

This service provides for the medical and surgical management of disorders of theeye, ear, nose and throat. Surgical management like cataract extraction withintra-ocular lens implantation are among the various eye surgery done in this hospital.Most common eye condition among seamen is pterygium which is surgically excisedwhen it becomes irritated and affects the vision of the seaman. The diagnosticfacilities available in this department are the refractometer and pojection screen forvisual acuity test, the direct and indirect opthalmoscope, the p73 slit lamp apparatus,the SchioE Tonometer, the Perimeter, the audio-booth and the Audiometer, andlshihara test plates for color vision.

Department of Radioloov

This service provides X-ray and Ultrasound examination. lt has two (2) fixed x+aymachines (500 MA and 650 MA) with one having a TV monitoring capability. lt alsohas a mobile X-ray Machine that can be transported to the wards and operating room.It also has an ultrasound apparatus that can determine defects in the liver, gall

bladder, spleen, pancreas, kidney and the biliary tree. lt can also determine the ageof gestation of the fetus in the uterus and sometimes the sex when possibie. it can

also detect other masses in the pelvic cavity including the abdominal aorta.

Provides examinations that include hematology, serology, blood chemistry, clinicalmicroscopy, bacteriology, parasitology, and exfoliative cytology. Our laboratory is aduly accredited facility by the government.

Dental Department

The dental department provides like dental examinations, dental consultation and/orcheck-up, oral prophylacsis, anodyn treatrnent, temporary filling, zinc phosphatecement bond filling, silicate cement filling, silver amalgam filling, basic gum treatment,basic dental extraction, pre and post operative treatnent and systemic medication.

Psyc h o metric Scrce ning Secfion

This provides proper screening of prospective seamen in order to determine whetherthey are psychologically and intellectually prepared to face the demands and hazardsof a new environment aboard ship. They undergo personal interview and also writtenand practical examinations which are prescribed by the Health and Marine Agenciesof the Govemment.

Nursing Seruice

The Nursing Service provides the medical and surgical nursing care to patientsconfined in the hospital. They are distributed to the wards, operating room complex,out patient department, emergency room and nursery. Our nurses are trained p73 toprovide the best of attention and response to the comforting needs of the patients.

Tnnspoftation Servlce (Amb ulance)

The Seamen's Hospital provides evacuation, transfer and pick-up of patients to andfrom the hospital. The two ambulances are provides with orygen and other insulationapparatus plus the emergency and obstetrical bags.
