West Sussex County Council (Haywards Heath: Queens Road and Adjoining Roads) (20 MPH Speed Limit) And

(Prohibition of Heavy Commercial Vehicles) Order 2018

And

Haywards Heath: Queens Road Traffic Calming Measures 2018

NOTICE is hereby given that West Sussex County Council proposes to make a permanent Traffic Regulation Order under the provisions of the Road Traffic Regulation Act 1984, the effect of which will be to: a) Introduce a 20 mph speed limit throughout the whole lengths of Bridge Road, Church Avenue, Gordon Road and Queens Road in Haywards Heath; and b) Prohibit Heavy Commercial Vehicles (those exceeding 7.5 tons) from the whole lengths of Church Avenue and Gordon Road. The Order also prohibits these vehicles from Queens Road between its junction with Mill Green Road and the western kerbline of its junction with Bridge Road. NOTICE is also hereby given that West Sussex County Council, under the provisions of the Highways Act 1980 (Traffic calming) Regulations intends to install raised traffic calming features on Queens Road in Haywards Heath as follows: A feature comprising of a group of 3 raised ‘speed cushions’ would be installed on Queens Road, 41m east of its junction with Mill Green Road. A similar feature would be installed 56m east of the eastern junction of Gordon Road. Features comprising of a group of 2 raised ‘speed cushions’, combined with a kerbside build-out would be constructed a) 48m east of the western junction of Gordon road, b) immediately east of its junction with Church Avenue, and c) 46m west of the eastern junction of Gordon Road. Each individual speed cushion will be constructed from black macadam and will be 65mm high with approach ramps to a gradient of 1 in 10. The length of each feature will be 3 metres and the width 1.65 metres, with slight variance of width at each location depending on road width. Full details of the proposals in this notice can be viewed on our website at www.westsussex.gov.uk/tro. The website includes a response form for any comments or objections. The documents may also be inspected at County Hall Chichester, during normal office hours, and at Haywards Heath Library, 34 Boltro Road, Haywards Heath during normal library opening hours. Any comments or objections about the proposal must be received before 20 September 2018. STATEMENT OF REASONS FOR PROPOSING TO MAKE THE ORDER

West Sussex County Council proposes to make a permanent Traffic Regulation Order that will: a) Introduce a 20 mph speed limit throughout the whole lengths of Bridge Road, Church Avenue, Gordon Road and Queens Road in Haywards Heath; and b) Prohibit Heavy Commercial Vehicles (those exceeding 7.5 tons) from the whole lengths of Church Avenue and Gordon Road. The Order also prohibits these vehicles from Queens Road between its junction with Mill Green Road and the western kerbline of its junction with Bridge Road. Queens Road in Haywards Heath is a residential road but has an industrial area at its eastern end, accessed from Bridge Road. Concerns have been raised about traffic speeds in Queens Road and also about the residential end of the road frequently being used by heavy goods vehicles accessing the Bridge Road industrial area. To address these concerns it is proposed to introduce a 20 mph speed limit throughout Queens Road and the adjoining roads, and to install traffic calming features on Queens Road to facilitate compliance with the new speed limit. It is also proposed to prohibit heavy commercial vehicles from the residential parts of Queens Road, and the adjoining roads leading to it, leaving safe access to the industrial area off Bridge Road for HGVs via the eastern end of Queens Road. These measures are therefore proposed to avoid danger for traffic using the roads and to improve the amenity of the area through which the affected roads run. The attached drawings, numbered CMS8018 Speed Limits, CMS8018 Weight Restriction show the new traffic restrictions proposed by the Order. WEST SUSSEX COUNTY COUNCIL (HAYWARDS HEATH: QUEENS ROAD AND ADJOINING ROADS)

(20 MPH SPEED LIMIT) AND (PROHIBITION OF HEAVY COMMERCIAL VEHICLES)

ORDER 2018 West Sussex County Council in exercise of their powers under Section 84 (1) a of the Road Traffic Regulation Act 1984 ("the Act"), and after consultation with the chief officer of police in accordance with Part III and Part IV of Schedule 9 to the Act hereby make the following Order:- Commencement and Citation 1. This Order shall come into operation on the ***** day of ******* and may be

cited as "West Sussex County Council (Haywards Heath: Queens Road and Adjoining Roads) (20 MPH Speed Limit) And (Prohibition of Heavy Commercial Vehicles) Order 2018"

Interpretation 2. In this Order:-

“heavy commercial vehicle” means any goods vehicle which has an operating weight exceeding 7.5 tonnes as defined in Section 138 of the Act;

“public service vehicle” has the same meaning as in section 1 of the Public Passenger Vehicles Act as amended.

Speed Limit Provisions 3. No person shall cause or permit any vehicle to proceed at a speed exceeding 20

miles per hour in any length of road specified in the First Schedule to this Order. 4. Nothing in Paragraph 3 shall apply to a vehicle being used by naval, military or air

force purposes while being driven by a person for the timebeing subject to the orders of a member of the armed forces of the Crown on an occasion when –

(a) the person driving the vehicle is a member of the special forces as defined by the Road Traffic Exemptions (Special Forces) (Variation and Amendment) Regulations 2011; and

(b) the vehicle is being driven-

(i) in response, or for practice in responding, to a national security emergency by a

person who has been trained in driving vehicles at high speeds; or (ii) for the purpose of training a person in driving vehicles at high speeds.

Prohibition of Heavy Commercial Vehicles 5. Save as provided in Article 6, no person shall cause or permit any heavy commercial

vehicle to proceed in any length of road specified in the Second Schedule to this Order.

6. Nothing in Article 5 sall apply to:

(a) a Public Service Vehicle being used in the provision of a local service or carrying passengers for hire or reward or;

(b) a Public Service Vehicle being used in the provision of a school bus service or;

(c) a Public Service Vehicle being used in the provision of a works bus serivce; or

(d) a vehicle being driven in order to load or unload to or from premises adjacent to the lengths of road specified in the Second Schedule; or

(e) a vehicle being used for the purpose of agriculture in connection with land

adjacent to the roads specified in the Second Schedule or for the conveyance or haulage of timber felled upon that land; or

(f) a vehicle used in connection with any building operation or demolition in or on

land adjacent to the roads in the Second Schedule, or for the removal of any obstruction to traffic in those roads or the laying erection, alteration or repair in or near to those roads of any sewer or of any main, pipe or apparatus for the provision of gas, water, electricity or telecommunications; or

(g) a vehicle being used by the Fire Brigade, Police or Ambulance Services in the

event of an emergency. (h) a vehicle being garaged, serviced or repaired at any premises situated on or

adjacent to the lengths of roads specified in the Second Schedule; or (i) a vehicle being used by a local authority in pursuance of statutory powers or

duties; or (j) a vehicle being used for the conveyance of goods for sale from the vehicle; or (k) a vehicle proceeding as directed by a police constable in uniform.
