See, e.g., F.T.C. v. H.J. Heinz Co., 246 F.3d 708, 712-13 (D.C. Cir. 2001)(noting that the district court conducted a hearing which included testimony fromwitnesses). The hearing on the motion will be limited to three days, to commence at9:00 a.m. on 2/1/2012, with a maximum of four witnesses for plaintiff and fourwitnesses collectively for defendants. Plaintiff and the defendants collectively will beallowed equal time to be allocated as they see fit between presentation of evidence andcross-examination of opposing witnesses. In lieu of opening statements, the partiesshall submit pre-hearing memoranda containing each parties' position on the motionand a summary of what they expect the evidence to show. The memoranda are limitedto 15 pages and are due 1/27/2012. In lieu of closing arguments, post-hearing briefscontaining proposed factual findings and conclusions of law are due 2/14/2012.Responses due 2/21/2012.
