• Fulfill Clery Act education requirements for a Campus Security Authority

JEANNE CLERY MURDER

• Raped and murdered in college dorm in 1986 by another student

• Federal Clery Act signed in 1990

UMMS MUST COMPLY WITH CLERY ACT

• All colleges and universities receiving federal funds must comply

• Department of Education monitors compliance

UMMS MUST APPOINT CAMPUS SECURITY AUTHORITIES (CSAS)

From the Dept. of Education:

• An official who has significant responsibilities for student and campus activities

• Official: Any person who has the authority and duty to take action or respond to particular issues on behalf of the institution

• A person to whom students and employees should report criminal offenses

THERE ARE 8 CLERY ACT CRIMES

• Criminal homicides

• Sexual offenses, forcible and non-forcible (incest, statutory rape)

• Aggravated assault

• Burglary

• Motor vehicle theft

• Arson

• Hate Crimes

• Violations of liquor, drugs and weapons laws

CSAS HAVE REPORTING REQUIREMENTS

• A CSA’s function is to report to the UMW Dept. of Public Safety (campus police) those allegations of Clery Act crimes that the CSA concludes were made in good faith

• BUT CSAs are not responsible for determining authoritatively whether a crime took place. When in doubt, report.

• BUT CSAs should not try to apprehend an alleged crime perpetrator (That’s for law enforcement)

CSAS SHOULD IMMEDIATELY REPORT

• All crimes to the UMW Dept. of Public Safety (campus police)

• A crime report may be the basis for determining if there is a serious or continuing threat to campus community safety, which would require an alert (i.e. timely warning)

CSAS ARE NOT RESPONSIBLE

• To convince a victim to contact law enforcement if the victim chooses not to do so

• BUT, if a victim doesn’t want the report to go any further than the CSA, the CSA should explain that he or she is required to submit the report to the UMW Dept. of Public Safety (campus police) for statistical purposes, but it can be submitted without identifying the victim

OFFER ASSISTANCE TO VICTIMS

• Title IX Coordinator (DEOO) can assist the victim in many ways

• Counseling and psychological services are available

• Campus police can also offer assistance

NOT CSAS

• Pastoral counselor: A person who is associated with a religious order or denomination, is recognized by that religious order or denomination as someone who provides confidential counseling, and is functioning as a pastoral counselor

• Professional counselor: A person whose official responsibilities include providing mental health counseling to the UMW community and is functioning within the scope of his/her license or certification.

TITLE IX PROHIBITS SEXUAL HARASSMENT OF STUDENTS

• Includes sexual violence

• Department of Education establishes requirements and monitors compliance

• UMW reviewing policies addressing the investigative policy and procedures
