Before this transfer of property ~ take place, the watt :rwa.rd boU>.1dary mµst be established. The wa.tertront area has been subjected to artificial influ­ence for nia.ny yea.rs. It has been ~eed that sun-eys of the Mean High Tide Line of 1856 and tpe Mean Low Tiae Jii.ne .qf 1856 correctly represent the two segments of the :permanent boundacy. (The Mt~ Low Tide Line of 1856 is the watarward boundary of Tideland Survey No. 1 previously conveyed by the State.)

Ama:p of the$~ boundaries has been prepared by the State Lands Division and is acce:ptable t~ tb.e United States and to the City of Benicia.

A Bou,nda.ry Agreement (copy of which i$ -attached as ~ibit •'A") is also acceptable to. both the United S·tates. and the City of Benici~. The office of the Attorney General previously approved boundary agreements in this form, and Staff Counsel detenni.ned this agreement to be iegally sufficient .•
