116. Grid Iron Ale House & Grille (Liquor License Violation) – Friday, October 28, 2016

“On 10/28/16 at approximately 0209 hours, I Officer Pinheiro and Officer Andrews were dispatched to

Grid Iron Ale House, located at 1599 Post Road for the report of a possible liquor law violation.

Prior to arriving, I spoke to Captain Calise regarding a male who identified himself as the bar manager,

later identified as Arthur Tattrie (DOB: 02/08/72) requesting a closing time extension at approximately

0145 hours. Tattrie sounded intoxicated and stated he was requesting an overnight extension in order to

have painting completed in the business. Captain denied the request due to lack of notice by the

manager. Shortly after, I then spoke to dispatch who informed me that Tattrie called dispatch back

requesting a 20 minute extension to “put bar back together”. The request was again denied and the male

was upset and seemed confused.

Upon arrival, officers spoke to Tattrie who appeared intoxicated and officers could detect the smell of an

alcoholic beverage on his breath. Tattrie continued to repeat his conversation that he had with the

Captain and dispatch via telephone. He continued to be confused by the denial of the extension despite

the explanation given by officers. Officers observed there to be several males in the bar who appeared to

be doing construction work. There was also one employee/bouncer at the bar after hours. Officers

explained Tattrie’s extension was denied and having individuals at the establishment after hours is a

violation. Tattrie apologized for the inconvenience and instructed workers and staff to leave the

establishment.

At approximately 0235 hours, I responded back to Grid Iron and observed the restaurant to be in

complete darkness and the parking lot empty.

This report is for documentation purposes and will be forwarded to the Licensing Division, as well as the

Board of Public Safety.”

Due to the aforementioned facts the management of Grid Iron Ale House & Grille is in violation of the

following rules and regulations issued by the Board of Public Safety for the orderly operation of liquor

establishments:

9. CLEARANCE OF PREMISE AND ASSOCIATED AREAS:

A. All patrons shall leave the licensed premise within one-half hour after the required closing time, and

all employees and patrons shall leave the parking and outside areas within one hour after the

required closing time.

D. No one, other than employees, police and enforcement personnel, shall be admitted to the premises

after the required closing time.

ACTION:

117. Discussion of event held at Rocky Point Blueberry Farm on Saturday, October 29, 2016.

“On 10/29/16 at approximately 1805 hours, I, Officer Pacheco, was dispatched to the area of West Shore

Road at Warwick Neck Avenue for a check condition. Dispatch advised that the reporting party stated that

Warwick Neck Avenue was not moving due to the pumpkin walk. The reporting party advised that it was

very dangerous and that traffic was backed up all the way to West Shore Road.

Upon arrival, I responded from the area of Samuel Gorton Avenue. At which time, I observed southbound

traffic on Warwick Neck Avenue to be grid locked. Upon looking to the north, I observed the traffic to

continue around the bend in the area of 150 Warwick Neck Avenue. I then pulled out into traffic in the

southbound lane and waited; however, traffic was not moving. Due to the distance still to go before reaching

Rocky Point Avenue, I activated my emergency overhead lights and sirens to continue southbound to check

the traffic condition.

While traveling south on Warwick Neck Avenue, I observed vehicles to be parked on both sides of the road in

the area of the Warwick Neck School south towards the curve in the road past Rocky Point Avenue. I

observed numerous vehicles to be making u-turns in the middle of the road. The traffic eastbound on Rocky

Point Avenue was grid locked as well. Upon continuing on to Rocky Point Avenue with my lights and sirens

approaching the area of the blueberry farm, I observed vehicles to be parked on both sides of the road. I

observed numerous pedestrians in the road. The eastbound and westbound traffic on Rocky Point Avenue

was grid locked as the line to get into the Pumpkin Spectacular at the blueberry farm at 130 Rocky Point

Avenue was in the roadway. The vehicles parked on both sides of the road had lined the roadway as well as

pedestrian traffic leaving the spectacular made it impossible for eastbound and westbound traffic to flow. I

was unable to proceed any further in cruiser and had to pull into a parking lot off of Rocky Point Avenue and

walk down.

During which time, I was flagged down by numerous subjects who stated that their vehicles had been blocked

in down at the parking lot of the Rocky Point trail park. At this time, I contacted Channel 2 Dispatch to

inquire if there were any detail officers on scene and they advised that there were no detail officers. I then

requested a sergeant and additional officer where Sergeant Valliere and Officer Brodeur responded. Due to

the grid lock pattern, Officer Brodeur was advised to block traffic and the intersection of Rocky Point Avenue

and Warwick Neck Avenue prohibiting any more vehicles from turning eastbound on Rocky Point Avenue.

Officer Waldman also arrived to assist and responded to the scene via Palmer Avenue. He advised that traffic

was extensive and backed up all past Rocky Point.

I then responded back and shut the road off in the area of Palmer Avenue and Britton Street prohibiting any

more traffic to proceed towards Rocky Point. Sergeant Valliere advised me that an additional officer needed

to respond to the intersection of West Shore Road and Warwick Neck Avenue to prevent any more vehicles

from coming down Warwick Neck Avenue. Officer McGuire advised that eastbound traffic on West Shore

Road from Warwick Neck Avenue was backed up all the way to Hans Palace. He stated that traffic on

Warwick Avenue southbound towards Duggans Corner was backed up to the traffic lot at the Big Lots plaza.

While assisting with clearing vehicles and opening the roadway of Rocky Point Avenue in the area of the

blueberry farm, I was flagged down by a female who stated that her car had been blocked in the Rocky Point

lot for the park. While attempting to walk down to assist, I observed a male subject, later identified as

Anthony Demezza (DOB 09/22/63) to be stumbling in the middle of the roadway in front of vehicles.

Demezza then walked into me. I observed him to be stumbling and he appeared to be heavily intoxicated.

Due to the traffic constraints and the overwhelming number of people, officers were unable to clear and

requested that Warwick Rescue respond to transport Demezza for detox.

Warwick Fire personnel arrived on scene and stated that they were unaware of the event as were officers and

it made it extremely difficult for their trucks to get to the scene even after closing the roadway and freeing up

traffic on Rocky Point Avenue. Warwick Rescue had to make a u-turn in the road as traffic eastbound on

Rocky Point Avenue.

I then made contact with the owners of the blueberry farm, identified as Joseph Gouveia (DOB 03/06/56) and

Rhonda Shumaker (DOB 06/08/63). They did not seem to think there was an issue. I advised Shumaker of

the extensive traffic. At which time, she stated that there was not a problem and that the fire truck as able to

get in and out without a problem. I advised her that there was approximately five Warwick Police Officers

assigned to patrol who were currently assisting the extensive traffic volume due to the extremely unsafe

conditions, to which she was not receptive.

I spoke with Shumaker’s husband, Joseph Gouveia. He inquired about a detail. Shumaker state that they had

detail officers last year but she did not feel that they did anything so they did not call this year. Gouveia

stated that he had called the Warwick Police Department and requested no parking signs as he had years prior.

Gouveia stated that he did not have the point of contacts name but they stated they would be out to place the

signs. Gouveia stated that no one ever showed up and as a result he had taken the emergency no parking signs

posted from the previous year 2015 with the dates of 10/29/15 and 10/30/15 which he placed along the

telephone poles on the north side of Rocky Point Avenue in the area of the blueberry farm.

Officers has to remain on scene due to the excessive number of people still waiting to get inside of the

Pumpkin Spectacular with the line to purchase tickets almost to the parking lot of the Rocky Point Park.

Shumaker stated that they would stop selling ticked around 2030 hours and would begin directing people

away from the line no accepting any new additions to the line at approximately 2000 hours.

After the last tickets were sold at approximately 2030 hours, no additional people were let into the

spectacular. However, due to the large number of people still inside of the event and people in line for the

food truck outside that Officer Waldman, Officer Brodeur, and I, Officer Pacheco, remained on scene. We

remained on scene due to the heavy pedestrian traffic leaving the poorly lit area. Officers remained on scene

past 2100 hours.

Gouveia and Shumaker stated that there was another scheduled event for the next date Saturday 10/30/16;

however, Sergeant Valliere advised that without proper detail officers and arrangements that the event could

not take place. Shumaker stated that they would call the Officer in Charge in the morning and arrange for

detail officers. Shumaker was advised that without detail officers that event would have to be shut down due

to the unsafe situation on today’s date. Gouveia stated that years prior they had opened the state owned

portion of the Rocky Point Park for parking; however, he was advised this year there was construction being

done and they were not able to utilize the parking lot.
