Dear Mayor Arcillas ,Vice Mayor Gomez and members of the Sang. Panlungsod,

In ,behalf of the members of Santa Rosa Garden Villas 1 Subdivision Homeowner Association, we would like to earnestly seek and implore your most valuable concern and assistance in resolving our conflict with DOC Land regarding the passage of its big truck haulers in our subdivision heavily damaging the roads in our subdivision specifically along Sutter Avenue. This bad road condition is brought about by the passage of 200 plus heavy hauling trucks of DOC land that regularly- meaning all the time of the day- ply the routes of Olympia main road and Sutter Avenue. The heavy weightload of these hauling trucks caused our concrete roads to crack and deep holes were created bringing not only great danger to our motor riders and commuting public but also great inconvenience. Besides, the noise that these heavy trucks created particularly during midnight and wee hours in the morning caused unbearable anxiety to a lot of homeowners as they were always abruptly and untimely awakend from their deep sleep. Now, because of the bad road condition of our subdivision, homeowners are now worried of their safe t ravel since they cannot anymore rely on the road worthiness and safety because of the big holes in the road pavement created by these heavy vehicles coming inside our subdivision as supported by pictures herein attached.

Cognizant of this predicament and the necessity and urgency to act thereon.the Board of Directors of the homeowners association, invoking its authority to regulate under Section 49 of R.A 9904 otherwise known as ''The Magna carta for Homeowners and Homeowners Association" referring to its power to regulate access to, passage through the subdivision/village roads for purposes of preserving privacy, tranquility, Internal security, safety and traffic order, issued an advisory addressed to the public that the Sutter Avenue will be temporarily closed to heavy vehides effective February 14, 2015 due to "bad road condition". The decision to issue the said advisory was due to the fact that the subject roads are not anymore fit for use by heavy vehicles. Also, the continued use thereof would further damage the roads.

As a result of the issuance of the abovesaid advisory , a certain Debbie Cortez called us and arranged for a possible meeting with the homeowners officers. The meeting was set last February 14, 2015, which incidentally coincided with the effectivity date of the advisory. The meeting was attended by Ms. Cita carvajal, Engineer Charlie Reutotar and their security officers. In the said meeting, it was proposed that a tripartite agreement between HOA, Drydock Corporation and LGU of Santa Rosa City be crafted to serve as our blue print in Identifying institutional arrangements for the rehabilitation of our local road. However, they ignored the agreements mad!! last Saturday and continued passing through our subdivision. Engineer Reutotar and security officers, who were present during the previous meeting, even escorted heavy trucks and vehicles to pass through inside the subdivision completely ignoring the advisory and the agreements entered in the meeting. homeowners are already suggesting to do some drastic and determined measures but are just prevailed upon by the association officers. '

last February 17, 2015, we received a demand letter from Huecas Law Office asking us to refrain from preventing DDC Land from accessing Sutter Avenue on the argument that it has been already turned over to the local government unit of Santa Rosa City thus, making it the property of the local government of Santa Rosa which is intended for public use and it form part of the public domain meaning, it is now beyond the commerce of men.

In the light of the foregoing, and considering the seriousness of the matter and its far reaching-effects if remains unresolved, we, the officers of the homeowners association, with the imprimatur of its members, most respectfully appeal to the kind disposition of the Hon. Arlene B. Arclllas, Hon. Arne\ D.C. Gomez, and the Honorable members of the Sanggunian Panlungsod as well as Hon. Marcelo Tangonan-Punong Barangay of Barangay Labas to intercede and direct or convince DDC Land to use other more durable roads in the City as access to their development site. Or better still, for the City government to approriate funds for the rehabilitation of the badly damaged subject roads . The City may also consider to rehabilitate the subject roads jointly with DDC Land as the latter's gesture of its corporate social responsibility to the community it itself developed. May we as well take this opportunity to rquest the City government for the restoration of our street lights since we are already turned over to your LGU. We have attached our Board resolution no. 03-2014 requesting for reconsideration of our development concerns in our subdivision as well as the list of people who are not in favor of allowing entry of heavy trucks inside our subdivision.

We sincerely thank all of you for taking time to study this earnest appeal and for that matter, we are most willing to have a meeting with you together with our homeowner's officers on your most convenient time. We will be coordinating with your office for the schedule and your confirmation.
