    Cr Swann MOVED that the minutes of the proceedings of the Council meeting held on 5 July 2016 and the Special Council meeting held on 12 July 2016 be received and confirmed as an accurate record of those proceedings.

    represent the south members and tell us the positives for the City of Onkaparinga. What do you think?

    I note that the BMX announcement quotes “$2 million to the City of Marion for a new BMX facility” so perhaps we need clarity on that also.

    Tour Down Under 2017

    Once again the City of Onkaparinga was successful in its application to host Stage 5 of the Tour Down Under in 2017. Parts of the city will also be included in other stages of the race.

    Natural Resources Management (NRM) Levy collection

    As you are aware State legislation requires local government to collect the NRM levy on the States Government’s behalf and transfer it to the State. This is just one example of Local Government being required to collect state taxes.

    I wrote to the Hon Ian Hunter, Minister for Sustainability, Environment and Conservation about the sharp increases in levies for 2016-17, particularly now that the department gauges $25,000/FTE from the levy to pay staff across the department.

    I questioned consideration of the levy quantum, local government collection and the apparent reduction in NRM work programs.

    My correspondence and the Minister’s reply are at attachment 1.

    SAPOL Organisational Reform Program

    You will recall that Council made a submission to proposed changes for the above reform. In response, I have received a letter from Noel Bamford, Assistant Commissioner of Police with more details of an expanded Neighbourhood Policing Team project. This works proactively with council and is good news. Please read the letter at attachment 2.

    Kangaroo Island Council

    I received a letter from Mayor Peter Clements of the Kangaroo Island Council in relation to the exploration of oil and gas along the Great Australian Bight. Please find the letter at attachment 3.

    Mayor’s Prayer Breakfast

    Just a reminder I will be hosting the sixth Mayor’s Prayer Breakfast together with the Ministers Fellowship of Onkaparinga and Full Gospel Business Australia on Friday, 9 September 2016.     Freedom of Entry

    Council voted at its 3 May 2016 meeting to grant Freedom of Entry to the 619 Squadron, Australian Air Force Cadets. This ceremony was conducted on 31 July 2016. It was an amazing day with the 619 (Australian Airforce Cadets) and 605 (City of Onkaparinga) Squadrons, TS Noarlunga (Australian Navy Cadets) and 40 Army Cadet Unit marching together; a first.

    Southern Mayor’s meeting

    Quarterly I catch up with Mayors from the Cities of Marion, Mitcham, Holdfast Bay and the Adelaide Hills Council. Topics are wide ranging and this was no different. We covered off areas of boundary reform, rate capping, budget reviews, tourism, representation reviews, membership of the Local Government Association, employment and many others. It is a valuable relationship builder for the southern group.

    Foodbank

    The Chief Executive Officer and I met with Greg Pattinson, Chief Executive Officer of Foodbank SA Inc. The meeting was an opportunity to hear what Foodbank is doing in our area and the desire they have to do more. Last year they provided 2 million kilograms of food to 500 welfare agencies and 300 schools.

    Over the last eight months they have held two ‘pop-up’ Foodbanks at Noarlunga Centre and Aldinga with approximately 500 people attending.

    They are assessing the need for a Foodbank outlet in the South. I am sure we would welcome the decision to have one in the South. I am in the process of organising a visit to the Edwardstown outlet so if any elected member is keen to attend, please let me know.

    Steven Marshall, Leader of the Opposition

    The Chief Executive Officer and I met with the Steven Marshall, Leader of the Opposition to update him on the World Heritage Bid and other matters within the Liberals 2036 Plan. Naturally rate capping was a topic of discussion as was our work around Noarlunga Centre.

    Port Adelaide Football Club Empower Youth Program

    At the invitation of Julie Clifton (Hastings Street Centre) staff and I met to discuss the above program. Thea Morgan from the Southern Hub, Department for Education also attended the meeting.

    We discussed how the Empower Youth Program could be introduced to the work Julie does with Flexible Learning Option (FLO) students through Connected Self from Willunga High School and Seaford Secondary College.

    Although many programs exist in the South, the attraction of this program is the buy in by the Department for Education where the students receive 10 SACE points towards completion. Once students complete the SACE they are linked with businesses interested in apprentices, interns etc and which could possibly lead to full time work or study.

    Local Government Association Board and Metropolitan Local Government Group meetings

    Key outcomes :

    Approach State Government to review election signage.

    Public lighting project manager employed, part funded by MLGG to conclude

    the public lighting issues.

    Workshop at September MLGG around the future of this body.

    Local Government Audit Committee introduced to Board, Terms of Reference agreed.

    An attempt to have political affiliations declared before elections (Notice of Motion – Mitcham) was defeated.

    Review of various Local Government Association schemes is ongoing.

    Nomination of the new President and Board will be called by 1 September 2016 to be in place by 13 December 2016.

    7.1 Proposal to close and sell a portion of unmade public road adjacent to 1 Mentone Parade O’Sullivan Beach (Dr Branden Emmerson)

    Dr Branden Emmerson gave a deputation and answered questions from elected members in relation to the proposal to close and sell a portion of unmade public road adjacent to 1 Mentone Parade O’Sullivan Beach.

    Cr Brown entered the meeting at 7.09pm.

    Cr Olsen entered the meeting at 7.11pm.

    Mayor Rosenberg brought forward Item 9.1 Update proposal to close and sell portion of unmade public road adjacent to 1 Mentone Parade O’Sullivan Beach at this point.

    9.1 Update report proposal to close and sell portion of unmade public road adjacent to 1 Mentone Parade O'Sullivan Beach

    MOVED Cr Nankivell.

    For the subject land legally described as portion of Allotment 296 in Deposited Plan 3397, portion of Certificate of Title Volume 6018 Folio 103, being a public right of way, Council resolves:

    1. Pursuant to sections 14 and 15 of the Roads (Opening and Closing) Act 1991, having considered the objection in attachment 2 to the agenda report received during the public consultation process, proceeds with the closure of the subject land bordered red on attachment 1 to the agenda report being an unmade portion of road intersecting with John Terrace, O’Sullivan Beach.

    2. To make a Road Process Order pursuant to section 15 of the Roads (Opening and Closing) Act 1991 for the closure of the portion of the subject land bordered red on attachment 1 to the agenda report and sells to the applicants at 1 Mentone Parade O’Sullivan Beach, subject to:

    a. The purchaser’s amalgamating the acquired land with their adjoining property comprised in Allotment 70 in Filed Plan 152646, Certificate of Title Volume 5579 Folio 261, and

    b. The purchaser’s paying market value for the land as determined by an independent property valuer and meeting all costs associated with the closure, sale, transfer and amalgamation of the land with their existing title, and

    c. The registration of the easements listed in recommendations 3, 4 and 5 on the purchaser’s Certificate of Title.

    3. Pursuant to sections 18(1) and 18(2)(b) of the Roads (Opening and Closing) Act 1991, to make an order for the granting of an easement in favour of SA Power Networks (formerly ETSA) for electricity supply purposes over portion of the subject land from the southern boundary as requested on their application in attachment 3 to the agenda report.

    4. Pursuant to sections 18(1) and 18(2)(b) of the Roads (Opening and Closing) Act 1991, to make an order for the granting of an easement in favour of SA Water for sewerage purposes over the whole of the subject land to be closed as requested on their application in attachment 4 to the agenda report.

    5. Pursuant to sections 18(1) and 18(2)(c) of the Roads (Opening and Closing) Act 1991, to make an order for the granting of an easement in favour of Council for drainage purposes over the whole of the subject land to be closed.

    6. That on closure of the subject road, the land will be excluded from the classification of community land.

    7. That the Chief Executive Officer is delegated approval to sign the relevant documentation required for finalisation of the road closure, easements, sale, transfer and amalgamation of the subject land to the applicants.

    8. That the net proceeds will be assigned to the Commercial Reserve fund to assist with strategic projects.

    9. Pursuant to section 20 of the Roads (Opening and Closing) Act 1991, the Road Process Order and associated documents and fees are provided to the Adelaide office of the Surveyor-General for confirmation by the Minister.
