BACKGROUND

Proposed use: Amusement redemption machine establishment

Site: Amusement redemption machine establishment

Surrounding land uses: North of the site are the Tuscany apartments and the Tuscany commercial strip (including Fred Loya Insurance, Swisher & Martin Realty and Marmoles & Canteras ), Polio Palenque, multi­family uses and single-family uses. On the east are single-family residences; O'Reilly Auto Parts; Family Dollar; condominiums and apartments. To the south are Whataburger; Roberto Martinez, MD; a vacant lot; We'll Wash Coin Laundry; mini-storage; Hollywood Garden and Nursery; single-family residences, and the McPherson Del Norte Center.

Comprehensive Plan: The Future Land Use Map recognizes this area as Light Commercial.

Transportation Plan: The Long Range Thoroughfare Plan identifies McPherson Road as a Major Arterial and Shiloh Drive as a Modified Major Arterial.

Letters sent to surrounding property owners: 45 In Favor: 0 Opposed: 0

STAFF COMMENTS The Laredo Land Development Code (Section 24.63: Permitted Uses) permits amusement redemption machine establishments in zones B-4, M-1, M-2 and MXD. This property is currently zoned B-1. Section 24.94.5(A)(3): Conditional Use Permit Application Submittal Criteria state that, "Applications for properties currently zoned B-1, B-lR, CBD, B-3 or B-4, may only seek conditional use status for those uses permitted by zones B-lR, CBD, B-3, B-4 or M-lofhigher intensity."

Staff supports the proposed Conditional Use Permit for the following reasons:

1. The proposed use is compatible with other uses along McPherson Road. 2. The property is near the intersection of McPherson Road and Shiloh Drive, two arterials. 3. The C.U.P. is an extension of an existing amusement redemption machine establishment.

Staff Comments continued:

Staff does not support the Conditional Use Permit at this location but recommends the following provisions be attached if approved:

1. The C.U.P. shall be issued to Aoil Gupta and is nontransferable. 2. The C.U.P. is restricted to operating hours from 11:00 a.m. through 2:00a.m. 3. The C.U.P. is restricted to the site plan, Exhibit "B", which is made part hereof for all purposes. 4. Signage is limited to that allowed in a B-3 District. 5. Owner shall provide parking places in compliance with Section 24.78 of the Laredo Land Development

Code. ADA-compliant parking space(s) shall be required. 6. Off-site parking is prohibited. 7. Owner shall provide and maintain trees and shrubs in compliance with Section 24.83 of the Laredo Land

Development Code. 8. Owner shall provide an opaque fence wall of not less than seven feet in height along property lines which

abut or adjoin residential property or residential zoning district, in compliance with Section 24.79 of the Laredo Land Development Code.

9. Lighting of property shall be screened to avoid adverse impact on adjacent residential uses. 10. Outdoor music and speakers shall be prohibited and there shall be no ground vibrations created or

sustained on this site which are perceptible without instruments at any point on any property adjoining this property.

11. The sale and consumption of alcohol on premises is prohibited. 12. Owner shall make provisions to keep litter to a minimum, and to keep it from blowing onto adjacent

streets and properties. 13. Owner shall comply with all Building, Fire and Life Safety Code Regulations as required. 14. Strobe lights, flashing lights, and any other outdoor lighting designed to attract attention are prohibited. 15. Barmers and window signs are prohibited. 14. The C.U.P. shall be issued for five years from date of issuance.

To the west are single-family residen­tial uses, vacant lots, Inter-plastic (vacant warehouse) and vacant warehouses. To the south are single­family residential uses and La Casita Palapa & Pool.

PLANNING & ZONING COMMUNICATION

IMPACT ANALYSIS

R-3 (Mixed Residential District): The purpose of the R-3 is to provide an area for higher density residential uses, the use of mobile homes on single lots, and those public and semipublic uses normal­ly considered an integral part of the neighborhood they serve.

Is this change contrary to the established land use pattern? No, the established land use pattern is primarily residential in nature.

Would this change create an isolated zoning district unrelated to surrounding districts? No, there are other R-3 districts to the north and south.

Will change adversely influence living conditions in the neighborhood? No, there are similar uses in the area.

Are there substantial reasons why the property can not be used in accordance with existing zon­ing? Yes. The current M-1 district does not permit manufactured homes.

IMPACT ANALYSIS

B-3 (Community Business District): The purpose of the B-3 District is to provide for those businesses and services serving a trade area larger than a neighborhood, but smaller than the entire city and located primarily along minor or principal arterial streets, as classified in the Transportation Plan of the City of Laredo. It is intended for this zoning classification to exist primarily abutting minor or principal arterial streets while preserving established residential neighborhoods along such streets.

Is this change contrary to the established land use pattern? Yes, the established land use pattern is primarily residential in nature.

Would this change create an isolated zoning district unrelated to surrounding districts? Yes, this section of Meadow Avenue is primarily zoned B-1.

Will change adversely influence living conditions in the neighborhood? The proposed B-3 district may introduce more intense uses to the area.

Are there substantial reasons why the property cannot be used in accord with existing zoning? No, the existing B-1 district allows for sufficient commercial uses.

A Special Use Permit is basically an overlay on top of the existing zoning designation and can be limited in many respects such as time, fencing, setbacks, landscaping, etc.

Staff does not support the request of the proposed SUP at this location for the following reasons:

I. The property does not have sufficient parking to accommodate the existing and proposed uses. 2. Forty four ( 44) parking spaces are required and only twenty five (25) parking spaces are provided

on the proposed site plan.

Should the Commission recommend approval of the proposed SUP, staff suggests the following conditions:

1. The Special Use Permit is issued to Joel Gueta, Jr. and Sandra Rocha Taylor, and is non-transferable. 2. The Special Use Permit is restricted to the site plan, Exhibit "A", which is made part hereof for all

purposes. 3. Hours of operation shall be from 7 a.m. to 12 a.m. from Monday through Saturday. 4. The establishment must make provisions to keep litter to a minimum, and to keep it from blowing

onto adjacent streets and properties. 5. Signage shall be consistent with the City's Sign Ordinance and T ABC rule or regulation. 6. Off-street parking shall be provided in accordance with the City of Laredo Land Development Code. 7. There shall be no ground vibrations created or sustained on the site which are perceptible without

instruments at any point on any property adjoining the subject property. 8. At all times the restaurant is open to the public for business, it shall continually maintain and serve

food from its full service menu. 9. The restaurant shall not exceed the "Occupant Load" as set forth in the Certificate of Occupancy with

Occupant Load. 10. The restaurant shall, during all hours of operation, maintain, free from obstruction or impediment to

full instant use in the case offrre or other emergency, all exit accesses, exits or exit discharges. 11. The restaurant shall undergo an annual Fire Inspection. 12. All permits, licenses, certifications and inspections required by the codes and ordinances of the City

of Laredo shall be kept up to date and current including but not limited to Food Manager License (annual), Food handler's Permit (annual), and Certificate of Occupancy with Occupant Load, Occupant Load being the approved capacity of a building or portion thereof.

13. Landscaping of property shall be provided in accordance with the City of Laredo Land Development Code.

14. Minimum 24 foot maneuverability required shall be provided for two-way traffic inside the property boundaries.

15. Owner shall comply with Building, Health, Life and Safety, and all applicable codes and regulations as required.

16. Owner shall provide parking spaces in compliance with Section 24.78 and 24.78.3 ofthe Laredo Land Development Code, for commercial parking, parking space dimensional requirements, loading space requirements and dimensions, paving, drainage, maintenance, lighting, location of parking spaces, disabled vehicles, joint use of parking spaces (on-site), wheel blocks, access and maneuvering space requirements, width of access driveway in business and industrial districts, as required by ordinance.

January 15, 2016

I am currently applying for a Beer and Wine License for a local restaurant located in

3301 San Bernardo Building A Suite B. The Business name is Don Vicente Restaurant. The

restaurant has been running for a few years and currently am planning on taking over it and

starting to have the option of offering Beer and Wine with their meals as an option. Restaurant

will be selling more food than alcohol and it is a sit down restaurant where customers can dine

in and relax and drink or eat as they like. The hours of business will be from 7am- 12am from

Monday thru Saturday and will be closed sundays. The primary use of this restaurant is for food

for family dine and the beer and wine is just for complimentary of those who consume. We will

have breakfast, lunch , and dinner food menu. My parking consist of 1 Handicap and 11 parking

slots totaling 12 total parking spaces. The staff includes 5 during morning and afternoon shift

and the night shift includes 4 employees for a total of 9 employees.

B-4 (Highway Commercial District): The purpose of the B-4 District (Highway Commercial District) is to provide for those businesses and services serving a regional area which are to be located primarily along principal (major) arterial streets or the freeway, as classified in the Transportation Plan of the City of Laredo. It is intended for this zoning classification to exist primarily along principal arterial streets or the freeway and to impose site development regulations to ensure adequate access of all uses within this classification.

Is this change contrary to the established land use pattern? Yes, the established land use pattern along this section of US Highway 83 and Doc Sigi Perez Loop is primarily vacant and undeveloped.

Would this change create an isolated zoning district unrelated to surroundiog districts? No, there is an M-1 District to the south along US Highway 83.

Citation: The previously existing E Bar was cited by Zoning Officer Villa on June 23, 2012 for operating a bar in a B-3 (Community Business District).

Surrounding land uses: West of the site are the Hillside Recreation Center, Bias Castaneda Park, and the Mission Viejo condominiums. To the north is McPherson Plaza, a strip mall containing Stitch and Print Embroidery, YuKids Play, Tortas Yukon, Cordona, Inc., vacant (former restaurant), Cakes By Design, Laredo School and Medical Uniforms, ProNails, Nieto-Speer Insurance, SGL- Saenz Global Logistics, Lan-Tech Computers, XFit Reloaded, vacant suites, and Flores, Sanchez and Chu, PLLC. To the east are single-family residences and Newman Elementary School. South of the site are Lucky Fish Amusement, Sonic, EZ Pawn, CDP Ventures Construction, Auto Zone, Diana Navarro, Attorney, Herff Jones, Susan Castillo Financial Services, D & E Alliance, and apartments.

Comprehensive Plan: The Comprehensive Plan identifies this area as Light Commercial.

Staff Comments (cont.) Staff does not support the request of the proposed SUP at this location for the following reasons:

1 . The proposed SUP does not provide for the minimum 53 required parking spaces. Only 27 parking spaces are available on site.

Should the Commission recommend approval of the proposed SUP, staff suggests the following conditions:

l. The Special Use Permit is issued to Diego Mounetou and Fava Square LLC, and is non-transferable. 2. The Special Use Permit is restricted to the site plan, Exhibit "A", which is made part hereof for all

purposes. 3. Hours of operation shall be from ll a.m. to 11 p.m. on weekdays and 11 a.m. to 1 a.m. on Saturdays. 4. The establishment must make provisions to keep litter to a minimum, and to keep it from blowing

onto adjacent streets and properties. 5. Signage shall be consistent with the City's Sign Ordinance and T ABC rule or regulation. 6. Off-street parking shall be provided in accordance with the City of Laredo Land Development Code. 7. There shall be no ground vibrations created or sustained on the site which are perceptible without

instruments at any point on any property adjoining the subject property. 8. At all times the restaurant is open to the public for business, it shall continually maintain and serve

food from its full service menu. 9. The restaurant shall not exceed the "Occupant Load" as set forth in the Certificate of Occupancy with

Occupant Load. 1 0. The restaurant shall, during all hours of operation, maintain, free from obstruction or impediment to

full instant use in the case of fire or other emergency, all exit accesses, exits or exit discharges. 11. The restaurant shall undergo an annual Fire Inspection. 12. All permits, licenses, certifications and inspections required by the codes and ordinances of the City

of Laredo shall be kept up to date and current including but not limited to Food Manager License (annual), Food handler's Permit (annual), and Certificate of Occupancy with Occupant Load, Occupant Load being the approved capacity of a building or portion thereof.

13. Landscaping of property shall be provided in accordance with the City of Laredo Land Development Code.

14. Lighting of property shall be screened to avoid adverse impact on adjacent residential neighborhoods. 15. Minimum 24 foot maneuverability required shall be provided for two-way traffic inside the property

boundaries. 16. Owner shall comply with Building, Health, Life and Safety, and all applicable codes and regulations

as required. 17. Owner must provide a total of 53 parking spaces, currently 26 short with proposed site plan.

To Whom It May Concern:

Diego Mounetou and Jorge Arturo de Gorordo will be opening a restaurant located at 5509 McPherson Rd, serving Mexican seafood with the city of Tampico's influence. Opening hours will be from Ham to 10pm on Tuesday and Wednesday Ham to lam on Thursdays, Fridays, and Saturdays and Ham to 6pm on Sundays serving lunch and dinner offering unique seafood dishes.

Our initial plan is to make minor remodeling to this establishment to allow the flow of the restaurant to be seamless. This remolding will consist of creating an outdoor patio to allow our smoking customers to enjoy their meals as well. We are planning on bringing a new restaurant concept giving a new venue to the city allowing it to grow with Laredo. Having a seafood restaurant with an outdoor atmosphere gives new impressions to the city.

We understand that your establishment must abide by the current SUP guidelines. We hope that this establishment will hire up to 30 employees to meet the demand of 170 patrons.

2. At-grade Uniroyal Dr. is also heavily congested, with truck traffic also coming from west of IH35 from two truck stops. UPRR has 24 daily train trips through the intersection, which reduces efficient operation and possibly diverts traffic to the aforementioned Carriers Dr.

3. The almost 2000-acre master plan geographically DOUBLES the area served by Carriers and Uniroyal. Additionally, the master plan shows that all new traffic generated by Port Grande will be serviced only through grade-separated Carriers.

4. With the existing traffic, Carriers Dr. is experiencing northbound IH truck queues that at times have backed up onto the NB IH35 off-ramp, creating a safety issue. Part of this issue can be attributed to internal circulation in the industrial park (4-way stop at S. Unitec Dr.).

Master Plan:

1. Change Master Plan name from Green -Escondido to Green Master Plan (Revised).

2. This master plan may only be approved if the parkland offered by the Developer is recommended for acceptance by the Director of the Parks Department and the Laredo Parks and Recreation Board.
