Council Agenda Title/Description: Detention Corporal Promotions _____________________________________________________________________________ Executive Summary: Corporal Shuron C. Anderson is a am a Crescent High School graduate, and has served as detention officer for the City of Anderson Police Department since 2014. While working for the City of Anderson Police Department he has received certification as a Field Training Officer, as well as weapon, vehicle, and defense tactics training. Corporal Katrina Brown is a lifelong resident of Abbeville, South Carolina and a graduate of Abbeville High School. Corporal Brown began her law enforcement career as a detention officer at the Abbeville Sheriff’s Office in 2007, and currently serves as a detention officer at the City of Anderson Police Department. Corporal Brown has completed certifications in NCIC, FTO and First Line Supervision. She plans to enroll at University of Georgia online to earn a Bachelor’s Degree in Criminal Justice. Corporal DeAutra “Dee” Lee, Sr. is a graduate of Abbeville High School, and earned an Associate’s Degree in Criminal Justice from Piedmont Community College with a minor in Human Services. Corporal Lee began his law enforcement career with the Abbeville Sheriff’s Office as Detention Officer, and has served with the Anderson Police Department for 2 years. In his time at the City of Anderson he has completed certifications in FTO, CPR, AED, and First Line Supervision. Corporal Janice Sanders is a graduate of Westside High School Class in Anderson, South Carolina. Corporal Sanders began her law enforcement career in 1999 with the City of Anderson Police Department where she serves as a detention officer. Corporal Pamela H. Wharton is a graduate a McCormick High School, and received an Associate Degree in Criminal Justice from Piedmont Technical College. She began her law enforcement career as a detention officer in Abbeville in 2001. She has received training in Supervision, Sex Offender Registry, Fingerprinting, and is NCIC and Validation Certified. Regular Meeting January 8, 2018

The regular meeting of City Council was held this date in City Hall Council Chambers at 6:00 pm. In attendance were Mayor Terence Roberts, Mayor Pro Tem John Roberts, Council Members Thompson, Buck Roberts, Chapman, Laughridge, Stewart, Harbin and Newton. Also in attendance were Assistant City Manager, David McCuen; Finance Director, Margot Martin; City Attorney, Frankie McClain; Planning Director, Maurice McKenzie; Police Chief, Jim Stewart; Parks and Recreation Director, Bobby Beville; and Economic Development Manager, Mary Haley Thompson. The invocation was given by Councilman Harbin and respect to the flag was given by Mayor Pro Tem John Roberts.

APPROVAL OF MINUTES A motion by Council Member Thompson seconded by Councilman Laughridge carried unanimously (9-0) to approve the minutes of the December 11, 2017 meeting as presented.

REQUEST CONSIDERATION OF ORDINANCE 18-01 REGARDING THE SALE OF CITY OWNED PROPERTY LOCATED AT THE CORNER OF EAST MARKET AND SOUTH MAIN STREETS

City Manager, Linda McConnell said this is consideration of a proposal and to negotiate a contract for the sale of city owned property located downtown with boundaries of the property fronting South Main, East Market, and South McDuffie Streets. The property is currently serving as part of the East Church Street parking lot. Pursuant to the Procurement Code for the City of Anderson, the City of Anderson publicly advertised for requests for proposals (RFPs) to purchase parcels located in the East Church Street parking lot. Based upon the proposals received, the City Council has agreed to sell the property. The sale of the property will benefit the City of Anderson because it will enhance the activity base of the Central Business District in a way that meets a desired niche for downtown. In addition, the property will be returned to the tax books. The details of this will be addressed during Executive Session and possible vote afterwards.

REQUEST CONSIDERATION OF ORDINANCE 18-02 TO ANNEX AND ZONE TO RM-18, MULTI-FAMILY RESIDENTIAL, 520-526 SIMPSON ROAD

Councilman Chapman recused himself from discussion and vote and left the meeting before discussion of this item due to potential involvement with this project. City Manager, Linda McConnell said the applicant requests to annex and zone 2 parcels of land, each with a duplex building. These properties have been in the ownership of Calvary Home for Children for ten years, and they would like to annex them so they will be under the same jurisdiction as their campus. The majority of the Calvary Home for Children property is already inside the city limits. Planning Director, Maurice McKenzie said the portion of the Calvary Home for Children that is inside the City is already zoned RM-18, Multi-Family Residential, which allows such a campus. Therefore, designating the RM-18 classification on the subject parcels will allow them to be in conformance for campus-related uses. It also allows multi-family uses, so the duplexes can remain for residential occupancy. The Planning Commission unanimously recommended approval of the request at their January 2nd meeting. A motion by Councilman Harbin seconded by Council Member Thompson carried (8-0) with Councilman Chapman recused from vote to approve Ordinance 18-02 to annex and zone to RM-18, Multi-Family Residential, 520-526 Simpson Road on First Reading. REQUEST CONSIDERATION OF RESOLUTION 18-01, 18-02 AND 18-03 AUTHORIZING EXECUTION

OF A MUTUAL AID AGREEMENT BETWEEN CITY OF ANDERSON AND THE CITY OF CLEMSON; TOWN OF WILLIAMSTON; AND TOWN OF WEST PELZER

City Manager, Linda McConnell said this is a request for consideration of resolutions authorizing execution and delivery of an agreement between the City of Anderson and the City of Clemson; Town of Williamston; and Town of West Pelzer to provide for the transfer of law enforcement officers on a temporary basis to work in law enforcement in the other municipality. Police Chief, Jim Stewart said Section 23-20-10 of the Code of Laws of South Carolina (1976, as amended) provides that law enforcement officers may be transferred on a temporary basis to work in law enforcement in other municipalities or counties in this state under the conditions set forth in said section and pursuant to an agreement entered into by the entities stating the conditions and terms of the temporary employment of officers to be transferred.

Municipalities are authorized by the South Carolina Code of Laws to enter into Mutual Aid Agreements for the benefit of the citizens. Section 23-1-210 of the Code of Laws for South Carolina specifically authorizes an agreement for the transfer of law enforcement officers to work in law enforcement in any other municipality or county in the state. Prior to any transfer, the concerned municipalities are required to enter into a written agreement stating the terms of the temporary employment of all officers to be transferred. The City of Clemson; Town of Williamston; and Town of West Pelzer desires to enter into such agreement with the City of Anderson Police Department for the purpose of securing to each other the benefits of mutual aid in the event of natural disaster, disorder, or other emergency situations. *All three Mutual Aid Agreements read the same with the exception of the name of the city. The citizens of the City of Anderson and the City of Clemson; Town of Williamston; and Town of West Pelzer will benefit by having enhanced law enforcement response in the event of natural disasters, disorder, or other emergency situations. A motion by Councilman Laughridge seconded by Councilman Buck Roberts carried unanimously (9-0) to approve Resolutions 18-01, 18-02 and 18-03 authorizing execution of a mutual aid agreement between the City of Anderson and the City of Clemson; Town of Williamston; and Town of West Pelzer.

REQUEST CONSIDERATION OF RESOLUTION 18-04 AUTHORIZING THE CLOSURE OF FIRST AVENUE TO VEHICULAR TRAFFIC AND ALTERING THE USE

Parks and Recreation Director, Bobby Beville said St. Francis Park is located between First and Second Avenue off of West Mauldin Street. First Avenue needs some pavement/drainage improvements and has been closed to vehicular traffic for approximately two years. The park is on one side and a wooded undeveloped parcel borders the other side of First Avenue. The road is not needed for emergency vehicle access. Closing the street to vehicular traffic will provide a safer area for the new playground and create a place for adults/kids to walk and ride bikes. The closure provides an opportunity to develop an aesthetic closure of the street. A motion by Council Member Thompson seconded by Councilman Laughridge carried unanimously (9-0) to approve Resolution 18-04 authorizing the closure of First Avenue to vehicular traffic and altering the use.

REQUEST CONSIDERATION OF AN ENGINEERING CONTRACT WITH ALLIANCE CONSULTING ENGINEERS FOR THE HERITAGE CORRIDOR GRANT PROJECT “UNDER THE BRIDGE”

Economic Development Manager, Mary Haley Thompson said the City has continued its public investment in Downtown based upon the Vision Plan’s premise that public improvements serve as catalysts for private investment and reinvestment. The City’s Capital Improvement Projects (CIP) serves as a roadmap to guide public investment that supports economic growth. The “Under the Bridge” project has been on the City’s CIP list since FY14. The City was awarded a grant of $30,000 from the SC National Heritage Corridor for this project. On June 26, 2017, City Council approved the funding of this project with a budget estimate of $145,809 (City funding of $115,809 and $30,000 from SCNHC). The Murray Avenue Bridge/Under the Bridge Project is a stimulant to the ongoing vibrancy of downtown. The SCNHC grant provides a boost to another part of our economic ecosystem and strengthens the City’s position along the Heritage Corridor Discover Route. This puzzle piece that connects Main Street will showcase our City’s walkability, arts and culture, and serve as a continuing magnet for economic growth. It can create visual interest, a sense of place, and become an attraction amenity. Additionally, it can provide an opportunity to expand the east-west connections and development potential. The proposed contract is with Alliance Consulting Engineers, Inc. for professional services. The contract price of $11,600 includes the boundary and topographic survey, conceptual design, and construction cost opinion for the Under the Bridge Project. Total estimated budget funding was approved previously by City Council utilizing TIF and Hospitality funds and the grant funds received by the South Carolina National Heritage Corridor Grant. (City funding of $116,000 and $30,000 from SCNHC). The staff recommends approval of the contract with Alliance Consulting Engineers, Inc. in the amount of $11,600 for the identified scope of work for the Under the Bridge Project. A motion by Councilman Chapman seconded by Council Member Thompson carried unanimously (9-0) to approve an engineering contract with Alliance Consulting Engineers in the amount of $11,600 for the Under the Bridge Project.

A motion by Councilman Buck Roberts seconded by Mayor Pro Tem John Roberts carried (9-0) to move into Executive Session to discuss Section 30-4-70(a)(2) – Discussion of negotiations incident to proposed contractual arrangements and proposed sale of property owned by the City of Anderson located at the corner of East Market and South Main Street. A motion by Councilman Laughridge seconded by Councilman Buck Roberts carried unanimously (9-0) to move out of Executive Session. A motion by Councilman Stewart seconded by Councilman Laughridge carried unanimously (9-0) to approve Ordinance 18-01 on Second Reading authorizing the Mayor to execute a Memorandum of Understanding and a Contract for the sale of the property and upon closing to execute a Deed conveying the property to Long Short, LLC.

Title/Description: New Business Request: Consideration of resolutions to Anderson County, the Anderson County Transportation Committee, and the South Carolina Department of Transportation ________________________________________________________________________ Executive Summary: Background: On an annual basis, the City Council submits repaving priority resolutions to the Anderson County Council, the Anderson County Transportation Committee (ACTC), and the South Carolina Department of Transportation (SCDOT). The City has always anticipated that the resolutions provide direction for the specified agencies when they develop paving plans. Although funding is uncertain at the present time, the City was fortunate to see 27 streets repaved over the last two years.

The staff continued its process of grading every road on our state list and all local streets inside the City in order to establish a tiered priority system. Evaluations were based on SCDOT’s ranking system -- pavement condition (50%), average daily traffic (20%), economic/community impact (10%), and population affected (20%). Attached are the top streets listed in a tiered order of need, along with the resolutions.

Benefit: To provide Anderson County, the ACTC, and the SCDOT direction in terms of what is in the best interest of City residents who pay local and state taxes. WHEREAS, the City of Anderson is a municipality within Anderson County, and WHEREAS, the City of Anderson is dependent upon Anderson County, the South Carolina Department of Transportation, and the Anderson County Transportation Committee for the maintenance of streets and roadways within the corporate limits, and WHEREAS, City of Anderson taxpayers are also Anderson County taxpayers, and WHEREAS, Anderson County has the authority to allocate funds to repave streets or portions of streets, and WHEREAS, in an effort to be equitable, the City has evaluated the street improvement needs and based upon this evaluation, the following streets have been identified for repaving. RESOLUTION NO.___________ A RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF ANDERSON, SOUTH CAROLINA RECOMMENDING TO THE ANDERSON COUNTY TRANSPORTATION COMMITTEE (ACTC) THE REPAVING OF CERTAIN STREETS OR PORTIONS OF STREETS WITHIN THE CORPORATE LIMITS. WHEREAS, the City of Anderson is a municipality within Anderson County, and WHEREAS, the City of Anderson is dependent upon Anderson County, the South Carolina Department of Transportation, and the Anderson County Transportation Committee for the maintenance of streets and roadways within the corporate limits, and WHEREAS, City of Anderson taxpayers are also State of South Carolina taxpayers, and WHEREAS, the Anderson County Transportation Committee (ACTC) has the authority to allocate funds to repave streets or portions of streets, and WHEREAS, in an effort to be equitable, the City has evaluated the street improvement needs and based upon this evaluation, several streets have been identified for repaving. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF ANDERSON THAT:

Title/Description: New Business Request consideration to enter into an agreement with WM Building Envelope for roof repairs at the Recreation Center. ______________________________________________________________________________ Executive Summary: Background: There are some areas within the Recreation Center that leak consistently during rain events. Jeff Martin (WMBE) identified those areas and the problems allowing the water intrusion. The locations are high traffic/use areas such as the front lobby, cardio and weight workout areas. Jeff Martin/WMBE submitted a proposal which will fix some of the problem areas. The proposal was reviewed by the Rec Committee on January 11th includes providing a scope of work, obtain a qualified vendor and perform inspections for cost of $38,750. The scope of work will include the following:

• Replacing thru-wall flashing at the front atrium • Make repairs to the modified bitumen and metal roofs • Make repairs to the laps in the skylight ledge • Miscellaneous Repairs

The thru-wall replacement at the front atrium will be a permanent fix. Benefit: The repairs will stop some of the current leaks in high traffic areas allow continued use of the building for activities/programming. The work will not solve 100% of the water intrusion issues but will provide time to determine the future use and expansion of the facility. Funding: Hospitality Fund. The hospitality fun balance at the end of 12/31/17 was $2,022,013. Recommendation: The Recreation Committee and staff recommends entering into an agreement with WM Building Envelope to provide the scope of work, obtain a qualified vendor to perform the work and provide inspections of the work. The total cost will not exceed $38,750. It is also recommended to allocate $6,025 for wall/sheetrock repairs and painting. Dear Sir, After meeting with you and performing several inspections on the roof as well as viewing the past and current leaks, it is our understanding that the city would like to have repairs done to the facility in order to stop or reduce the intrusion of moisture. Below is our proposal for the repair scope. We can draft a scope for repairs and perform quality assurance inspections for the sum of $6,750.00 (Six thousand seven hundred fifty dollars). This would not include a complete set of specifications but would include a scope of work and detailed drawings on the main items to be repaired. The total price for the design, oversight, and project work would be a NTE figure of $38,750.00 (Thirty eight thousand seven hundred fifty dollars) NOTE: These proposed repairs will stop some of the current leaks but will not solve all of the water intrusion issues. The thru-wall replacement will be a permanent fix but other repairs may or may not last for more than one year. Upon review of this proposal, please call if you have any questions.
