DRAFT MINUTES ROLL CALL PRESENT: Board members Aaron Cocking, Rob Olson, and John Vetsch Board member Walter Hudson arrived at 6:53 p.m. and Board Chair Jillian Hendrickson arrived at 6:57 p.m. ABSENT: None OTHERS PRESENT: City Administrator-PWD Adam Nafstad, City Clerk Kimberly Olson, Albertville Appraiser Brice Nelson, Wright County Assessor Tony Rasmussen Vetsch called the meeting to order at 6:47 p.m.

PID 101110006090, 6853 LaSalle Circle NE Nelson reported the homeowner felt the valuation was too high at $384,300 and so he chose four comparable properties in the same neighborhood to compare the home to. Cocking inquired if the process is non-subjective. Nelson explained how the formula works in using comparable sales to get a new estimated market value and stated that he does not form an opinion on the features of a home and relies on data instead. The new value using the formula came to $382,366. Nelson reported the homeowner is not in agreement. Motioned by Olson, seconded by Cocking, to reduce the valuation for 6853 LaSalle Circle NE to $382,366. Ayes: Hendrickson, Cocking, Olson, and Vetsch. Nays: None. Absent: Hudson. MOTION DECLARED CARRIED. PID 101500364301, 101500364302, 101500364311, 6065 Large Avenue NE Rasmussen reported there have been numerous appeals for the commercial property in the past and they have made reductions to the valuation. He stated the billboard parcel was valued at $56,100 and other properties along I-94 have values right around $56,100. He added they do not value the billboard, just the land that it sits on. The creamery parcel is valued at $61,000. He stated the asking price for the purchase of the property is listed at $200,000. If the asking price were lowered, Rasmussen stated he might reconsider, but the owner has it listed for the $200,000. Nafstad inquired about easement and right away on the other parcel and Rasmussen replied there is already a deduct on it.

Vetsch questioned if the price is right for the creamery building and if the building can even be occupied. Nafstad clarified that if the use does not change; it could be occupied and also would not have to be sprinkled. Cocking felt the owner must believe the building has value based on the asking price. Motioned by Cocking, seconded by Olson, to make no change in valuation for PID’s 101500364301, 101500364302, 101500364311, 6065 Large Ave. Ayes: Hendrickson, Cocking, Hudson, Olson, and Vetsch. 8. DEPARTMENT BUSINESS

A. City Council

1). Committee Updates Joint Powers Water Board Hendrickson reported the Board is moving forward with a new website, but needs to make some decisions regarding the domain name. Specifically, whether to change it or pay a fee to purchase the domain name from original purchaser. Hendrickson stated the Board has concerns if they don’t purchase the domain name, they may be without a website before the new one is active. Council suggested changing the domain name as the fee was too high. Parks Committee Vetsch reported that the committee wanted to be sure the property owners around Oakside Park are notified of the completion of the trail around the park. Nafstad stated he would be in contact with the homeowners and if there is opposition, he will bring the issue back to Council. FYCC Nafstad reported that Nicole Rice, FYCC Coordinator, has submitted her resignation. He stated that the interview process will be put on the fast track to find a replacement. Olson reported the FYCC bylaws need to be updated. Transportation Cocking reported he traveled to Washington D.C. and met with Minnesota’s elected officials regarding transportation. Congressman Emmer was willing to send a letter to the Federal Transportation Commissioner and he is also working on grant funding for ramps. Council discussed transportation legislation at the state level; no bills have been passed by either the House or Senate to date.

B. City Clerk 1). New Liquor License for Coborn’s Liquor

Clerk Olson reported that Coborn’s will be relocating their liquor store to 5600 LaCentre Avenue NE, Suite 114. She explained that the City Code requires a new license every time there is a change in location or ownership of a liquor license. Cocking inquired if this will be the permanent location

for the liquor store and Clerk Olson replied it would be. It was her understanding the former site will be used to expand parts of the grocery store. Hendrickson inquired about the fee since they just paid for their renewal. Clerk Olson stated that the applicant had submitted the fee for new license, but she would refund that and apply their renewal fee to the license as they don’t want to double charge them. Motioned by Vetsch, seconded by Hudson, to approve the Off -Sale Intoxicating Liquor License for Coborn’s Liquor for the premises located at 5600 LaCentre Avenue NE, Suite 114 contingent upon compliance with all building and fire codes. Ayes: Hendrickson, Cocking, Hudson, Olson, and Vetsch. Nays: None. Absent: None. MOTION DECLARED CARRIED.

C. Planning/Zoning

1). Communication Towers Discussion Brixius provided the Council with communication tower requirements from surrounding cities. He stated towers cannot be outright banned. He reviewed the comparison requirements and noted that the ordinances were similar to Albertville. He reported the Verizon development application was withdrawn until August/September. He stated Verizon had requested the tower to provide service to an overloaded area which is located in the northeast and central parts of the City. He indicated the applicant had requested more time to explore co-location. Brixius stated the real issue is co-location requirements and overall location of communication towers in the City. Brixius stated the Council may want to consider co-location if there is availability within a mile of a proposed location as well as researching certain setbacks and screening options. The Planning Commission also inquired about camouflage options. Brixius stated that demands are increasing for service and this type of request will not be decreasing. Olson noted that some cities require any new towers to accommodate location of one other service. Brixius suggested that new towers have a cap at 100 feet with exception for towers that do allow co-location.

1). City Administrator’s Update Nafstad reported a development group was scheduled to close on Towne Lakes 6th Addition last week and they plan to begin building homes this summer. Nafstad also stated the group plans to make a plat application for 7th Addition soon so they can begin construction late summer.

Centra Homes is looking to develop single family detached townhomes for Karston Cove 4th Addition. Nafstad stated Wright Hennepin Electric is also updating their streetlights with LED lights, but are doing so as they burn out. Olson commented on the difference in color between the two types of lights and also inquired if the City will see savings from the switch out that Xcel Energy is doing in their section of the City. Nafstad replied they will see a difference of a couple thousand dollars. Nafstad invited the Council to the First Responder event hosted by the I-94 West Chamber of Commerce on May 23. Bullen stated they will need to RSVP for any members going. Nafstad reported he met with the local baseball stakeholders on the lighting project and they discussed options for bullpens and batting cages. Olson asked Nafstad if Wright County could look into the timing of the stoplights on the County roads in the city. Hudson too felt the lights have issues during the off peak times. . 9. SALE INTOXICATING LIQUOR LICENSE RECOMMENDATION: It is respectfully requested that the Mayor and City Council consider the following: MOTION TO: Approve a Temporary On-Sale Intoxicating Liquor License for the Foxtailers Snowmobile Club on Saturday, June 10, 2017 during the 2017 Albertville Friendly City Days festival held in Central Park. BACKGROUND: The Foxtailers Snowmobile Club has submitted an application for a Temporary On-Sale Intoxicating Liquor License for June 10, 2017 for Albertville Friendly City Days. During the festival, there are two beer gardens sponsored by the Albertville Lions Club and Knights of Columbus. The Foxtailers Snowmobile Club is seeking the liquor license to serve on Saturday only. KEY ISSUES:

• The Foxtailers have submitted the correct application materials and insurance for the temporary liquor license.

• At the April 17, 2017 City Council meeting, the Council gave approval for the groups to apply to serve strong beer at the beer gardens rather than 3.2% beer.

FINANCIAL CONSIDERATIONS: There is minimal financial revenue collected from the applicant for the liquor license. LEGAL CONSIDERATIONS: The Mayor and City Council have the authority to review and approve or deny any liquor license. PERMIT RECOMMENDATION: It is respectfully requested that the Mayor and Council consider the following: MOTION TO: Approve the Church of St. Albert Lawful Gambling Exempt Permit Application for the annual Parish Festival that will be held on September 17, 2017 at the St. Albert Parish Center. BACKGROUND: The Church of St. Albert has submitted a Lawful Gambling Permit for their Parish Festival in the fall. The Church of St. Albert is a non-profit, religious organization that holds fund-raising events throughout the year. Their application for lawful gambling will allow them to conduct bingo, raffles, paddlewheels, pull tabs, and tip boards at the Festival. The Parish Festival will be held on September 17, 2017 at the St. Albert Parish Center, located at 11458 57th Street NE. KEY ISSUES:

• The Church of St. Albert is a qualifying non-profit organization. • The Parish Festival is an annual fund-raising event for the church. • The Minnesota Gambling Control Board ultimately issues this type of license, but

requires City approval prior to issuing the license. FINANCIAL CONSIDERATIONS: There is no financial revenue collected from the applicant for the gambling permit. LEGAL CONSIDERATIONS: It is the City’s policy to review and approve or deny gambling permit applications for gambling activity within the City. SUBJECT: PUBLIC WORKS DEPARTMENT – TENNIS COURT REGULATIONS RECOMMENDATION: It is respectfully requested that the Mayor and City Council consider the following motion: MOTION TO: Motion to adopt Ordinance 2017-02 establishing regulations for tennis courts in all city parks. BACKGROUND: The City has three parks that include tennis courts. Recently a group has expressed interest in reserving courts for summer camps, which has not been our practice. Generally the city’s park facilities are first come, first serve with the exception of fields and the Central Park shelter, which can be reserved. It is staff’s recommendation to keep the courts first come – first serve with a 1-hour playing time limit if others are waiting. The STMA School District does have courts that can be reserved for a fee. KEY ISSUES:

• Albertville’s courts are designed as neighborhood courts, close to homes, with limited parking and restrooms. Reservations are generally necessary for organized leagues and group lessons, which are facilities are not designed for and may not be designed by neighboring homes.

• Court rule sings are posted at the parks letting users know the regulations. • The ordinance will cover regulations for all tennis courts in the City. • The attached ordinance will allow enforcement of tennis regulations should they be

needed. POLICY/PRACTICES CONSIDERATIONS: The Mayor and City Council have the authority to regulate activities on city property. FINANCIAL CONSIDERATIONS: The only financial cost is to publish the ordinance in order for it to become effective. AN ORDINANCE AMENDING TITLE 8, CHAPTER 3, TO ADD TENNIS COURT REGULATIONS FOR ALL PARKS

The City Council of the City of Albertville, Minnesota hereby ordains: Section 1. Title 8, Chapter 3, Section 8-3-2 (Regulations for All Parks) is hereby amended to add the following language as follows:

8-3-2: S. TENNIS COURTS: The following regulations pertain to all groups

and/or individuals utilizing the tennis courts: A. Use of courts is at the user’s risk. B. Courts are first come first serve; however, play must be limited

to one hour if others are waiting. C. No food, drinks, or glass containers on courts. D. No pets. E. No bicycles, roller blades or skate boards. F. No sitting or hanging on nets. G. No climbing on fence

This ordinance shall be in full force and effective immediately following its passage and publication.

CROP LEASE AGREEMENT

This Lease is made effective between the City of Albertville (Landlord) and Brian Beaudry, tenant.

1. Approximately 17 acres north of sewer ponds.

2. This Lease is made the crop years 2017 and 2018, but either party can cancel by January 31, of current crop year.

3. As compensation, Lessee will have a tax statement put in his name for said property at Wright Count Assessor’s Office and pay property taxes each year because of agricultural use.

4. Lessee will follow generally accepted good agricultural practices that will preserve the long-term viability of the farm land.

5. Lessee will indemnify, defend, and hold harmless the Lessor from any liability that arises because of the Lessee’s agricultural activities, unless due to the Lessor’s negligence.

City Administrator’s Update May 11, 2017

GENERAL ADMINISTRATION

Arena Board: The 2016 audit was presented to the Board on May 8. We have prepared an updated JPA/ownership/operations agreement, which is currently being reviewed by staff from each entity.

Second Sheet of Ice: The School District is working to finalize the conceptual design of the new facility. City staff has met with the architect to discuss the city application and review process and is anticipating a mid-summer application.

Towne Lakes 6th and 7th: HSB Ventures, LLC (Onsite Solutions and partners) has closed on Towne Lakes 6th. They plan to start building the townhomes immediately and hope to have plat approvals for Towne Lakes 7th this summer, so they can begin construction this fall.

FYCC: The FYCC Coordinator position was advertised and they received eight applications. Interviews will be held on May 15 and it is anticipated the new Coordinator will begin in early June.

Karston Cove 4th Addition: Centra Homes is working on a single-family detached townhome concept and will potentially be making a development application this summer.

AFCD Social: An invite will be sent out soon to neighboring communities, officials, and staff for the annual social hour at Friendly City Days on Friday, June 9 at 5:00 p.m.

Sunday Liquor Sales: Off-sale liquor sales on Sundays were approved by the legislature and will be effective July 2, 2017. Sales can be made from 11:00 a.m. to 6:00 p.m. If Council would like to adopt those hours, the City Code will need to be modified slightly. Staff is looking for Council feedback if staff should move forward with an ordinance amendment, seek off-sale license holder feedback, and/or research how other cities are proceeding.

Crop Lease Agreement: The Beaudry family would like to farm (row crops) the approximate 17 acres north of the wastewater ponds. Once tilled for crop production, the property will be placed on the tax rolls. The Beaudry's are willing to pay the taxes and have prepared the attached agreement. The Beaudry’s have been haying this field for many years and this year they would like to plant a row crop.

ENGINEERING/PUBLIC WORKS

Main Avenue Railroad Crossing: We learned last week that the Railroad would be replacing the crossing the weeks of May 15 and May 21. In preparation of the Railroad’s work, the Main Avenue NE closure was posted on May 5 and closed on May 10. Our goal is to have the project complete by June 5.

Montgomery Property: The Excelsior Group plans to submit a formal development application to St. Michael in early June.

Otsego Truck Stop: The traffic analysis is not yet complete; however, SRF has identified several impacts to the system that will require further review. I expect to see the completed study soon.

2017 Street and Trail Improvements Project: Contracts have been prepared and are currently being circulated for signatures.

Mall of Entertainment-AUAR: I am currently preparing a memo regarding capacity and impacts to the City’s sewer and water infrastructure that will be included in the AUAR.

CSAH 37 and I-94 Signal and Striping Revisions: Wright County has identified this as a 2017 County project.

WWTF: The renewal of the MPCA permit and MPCA that required mercury minimization plan has been submitted. I will be scheduling a workshop to provide an update and discuss discharge requirement options.

2017 CSAH 19 and 57th Street NE Signal Improvements: Project plans and specifications are being prepared and will be presented to Council soon.

Ballfield Lighting: The lights are working and Public Works is restoring the disturbed areas. We will be ordering and installing the batting cages, distance markers, and bullpens soon.

CenturyLink Fiber Projects: CenturyLink will be resuming work soon.

Central Park Depot Project: A sanitary sewer stub was installed this week as part of the railroad crossing improvements.

Upcoming Events:

• May 19 – Explore Your Parks Night, 6:00 p.m. – 8:00 p.m. at Oakside, Linwood, Winter, Villas, Westwind and Four Seasons Parks.

• May 23 - I-94 West Chamber’s Annual First Responder Awards and Luncheon, 11:30 a.m. – 1:30 p.m. at the Medina Ballroom. Please let me now if you are interested in attending as we will need to RSVP for the event.

• June 14 to 16 – 2017 Annual League of MN Cities Conference in Rochester. Please let me know if you would like to attend.
