1.INTRODUCTIONThis report represents the Stormwater ManagementProgram (SWMP) Plan prepared by the City of Newcastle(City) in accordance with the National Pollutant DischargeElimination System (NPDES) Phase II Western WashingtonMunicipal Stormwater Permit (Phase II permit). The PhaseII permit is a requirement of the federal CleanWater Act(CWA), and in some states, the federal EnvironmentalProtection Agency (EPA) delegates permit authority tostateenvironmentalagencies.InWashington,theNPDESpermit authority is theWashington StateDepartment ofEcology(Ecology).

ThePhase IIpermit requirest he Cityto d e ve l op a SWMPPlan that includes numerous actions andactivities with the overall goals of protecting the water quality and of reducing the discharge ofpollutants from its m u n i c i p a l s e p a r a t e storm sewer system (MS4), to the maximum extentpracticable (MEP).The actions and activities are described in a number of program components underSection S5 of the Phase II permit. The Phase II permit directs the City to prepare a SWMP documentthat includes a description for each of the programcomponents.

This section provides: background information on the Phase II permit; a mission statement from theCity regarding its stormwatermanagement activities;and f inally, this section outlines the structure fortheremainderoftheSWMPPlan.

1.1 NPDESPhaseIIPermitBackgroundThe followingprovidesabriefbackground to, andoverviewof, thePhase IIpermitprocesses thathaveoccurredtodate:

• ThefederalCleanWaterAct (CWA)wasmodified in1987to includestormwater intheNPDES permit program. That is, a municipality such as the City, will need an NPDESpermit to discharge stormwater from its municipal storm sewer system, or MS4, towaters ofthestate.

• In the state ofWashington, the EPA Ecologytheauthoritytoissue suchpermits.

• In 1999, EPA issued final Phase II rules to include all municipalities in census-definedurbanareaswiththecurrentpopulationgreaterthan1,000.

• The City is determined to be an operator of a regulated small MS4, in an Ecology-designatedurbanizedarea,and is therefore requiredto submit for approval andreceive coverageunderaPhaseIIpermit.EcologydevelopedthePhaseIIpermit,whichallowstheCitytodischarge stormwaterfromitsMS4intosurfacewatersofWashingtonState,providedtheCityimplements aSWMPto:

• Reduce the discharge of pollutants from its MS4 to the maximum extentpracticable (MEP)

• MeetstateAKART(AllKnown,Available,andReasonableTechnologies)standards

• Protectwaterquality

This Phase II permit authorizes discharges of non-stormwater flows to surface waters and togroundwatersofthestatefromtheCity’sMS4onlyunderthefollowingconditions:

• ThedischargeisauthorizedbyaseparateNPDESorStateWasteDischargepermit.

• Thedischargeisfromemergencyfire-fightingactivities.

• The discharge is from another illicit or non-stormwater discharge that ismanaged bythe CityasprovidedinSpecialConditionSectionsS5.C.3.bandS6.C.3.bofthepermit.

ThePhase II permit requires theCity todevelopa SWMPthat includes the followingcomponents fromSectionS5.Cofthepermit:

• PublicEducationandOutreach

• PublicInvolvementandParticipation

• IllicitDischargeDetectionandElimination

• ControllingRunofffromNewDevelopment,Redevelopment,andConstructionSites

• PollutionPreventionandOperationandMaintenanceforMunicipalOperations

• MonitoringandAssessment

TheSWMPdocument isalsointendedto includeanyadditional informationonmeetingapplicableTotalMaximum Discharge Limits (TMDLs) pursuant to Section S7 of the Phase II permit. Since no TMDLsapplytotheCity’sreceivingwatersatthistime,thisreportdoesnotaddressTMDLissues.

The City is required to report annually on progress in permit implementation for the prior year, andsubmitaSWMPPlan thatdescribes theprogramactivities for thecomingyear. The implementationofvariouspermit conditions isphased throughout the five-yearpermit term,August1,2013 through July31,2018.

1.2CityofNewcastleMissionStatement

The City is dedicated to developing, implementing, and enhancing an adaptive stormwatermanagement program that is committed to protecting water quality and the environment, andreducingpollutantsinourstormwatersystems. TheSWMPPlanprovidesanoutlineofactionsandactivitiesthattheCityutilizestoaccomplishthesegoals.TheCityiscommittedtocontinuingto build successful stormwater programs, reviewing programs and making adaptations asnecessary, and continuing to coordinate and collaborate with other jurisdictions, agencies,organizations,businessandpropertyowners,residents,andotherstakeholderstoachieveourgoalsofprotectingwaterquality,theenvironment,andreducingpollutants.

The SWMP Plan is updated annually, and is considered a working document that will be modified asnecessary to reflect adaptationsthatcontributetoasuccessfulprogram.TheCitywillmakeeveryeffortto be transparent with suchmodifications through its public education and involvement programs aswell as through the annualSWMPPlansubmittalprocess.

2.PROGRAMMANAGEMENTANDADMINISTRATIONThis section outlines the oversight and administrativeactivities necessary to support the development andimplementation of theCity’sSWMP.

2.1CoordinationThe City currently coordinates with King County andother Phase I and II jurisdictions on issues related tomaintenance, development, transportation, drainage,andspillresponseasneeded. TheCityparticipates inthe following coordination opportunities: RegionalOperations and Maintenance Program (ROADMAP),Phase II Permit Coordinators Forum, StormwaterOutreach for Regional Municipalities (STORM), WRIA8 Salmon Recovery Council, S to rmwater Ac t ion Mon i to r ing ( SAM) , and Stormwater OutreachGroup-KingCounty(SOG).

2.2TrackingPrograms2.2.1DrainageComplaints,Concerns,andInquiries

The City used a Request for Action (RFA) database until last year to track drainage complaints andillicit discharges; the RFA systemwas eliminated in 2016. The City currently receives notifications viaYourGov.com fordrainage complaints,waterquality concerns, and flooding concerns. YourGov.com istiedtotheCity’snewassetmanagementsystem,Cartegraph.TheCityalsoacceptsinquiriesviaemailorphones calls to the SurfaceWater ProgramManager or other City staff. The SurfaceWater ProgramManager tracks drainage complaints and concerns on YourGov.comaswell as in a spreadsheet. Each

complaintisassignedaWorkOrdernumber,andCitystafftrytorespondtoinquiriesorconcernswithinonebusinessday.

2.2.2IllicitDischargeReportingTheCityhasaSpillReportinghotline,forbothbusinesshoursaswellaseveningsandweekends.Whenanillicitdischargecallisreceived,Citystaffrespondimmediatelytocontainandeitherinitiateorenforcecleanup efforts. Illicit discharges are tracked in an IDDE spreadsheet that includes spill response,containment,andcleanupeffortsdeployed.Dependingonthelocationofthespillorillicitdischarge,thespillor illicitdischarge isaddedtoCartegraph(theCity’sassetmanagementsystem),TRAKiT(theCity’spermittingdataset),NPDESPro(theCity’sdatabaseforprivatelymaintainedstormwatersystems).WaterqualityviolationsareissuedthroughaNoticeandOrder,andaretrackedinouraccountingdatabase.

2.2.3O&MandInspectionProgramsAllpublicandprivatestormwater facilitiesanddrainage infrastructureattributesaremapped in ArcGISand tracked in a geodatabase to ensure adequate and timely inspection,maintenance and repair.Thisdatacanbeviewedathttp://arcg.is/1WoBOmp.

Publicly maintained stormwater systems are inspected per NPDES requirements and inspections aretrackedinWorkOrders(withsubsequenttasks)inCartegraph.

Privatelymaintainedsystemsareinspected,dependingonPhaseIIpermitrequirements,eitherannuallyoreveryotheryear.TheCityrecentlypurchasedNPDESPro,whichwilltrackinspections,maintenance,correspondence,sourcecontrolefforts,andenforcementactionswiththecloud-baseddatabase.

Constructionstormwater/TESCinspectionstrackedinTRAKiT,theCity’spermitmanagementdatabase,andtheassetsareaddedtotheArcGISgeodatabaseandmaps.Whenaprojectiscomplete,theassetsareeitheraddedtoCartegraphorNPDESPro.

2.2.4EducationOutreach&PublicParticipationProgramsTheCitytracksitseducationandoutreachprograms,training,andparticipationopportunitiesinanexcelspreadsheet. Partneringprograms, suchasKingConservationDistrict (KCD) tracks theiroutreachandeducationeffortsandprovidestheCitywithareportattheendoftheyear.

2.3TrainingProgramsThe City is committed to participate in the Regional RoadMaintenance Endangered Species Act (ESA)TrainingProgramandtheCertifiedErosionandSedimentControlLeadTrainingProgram (CESCL).

TheCitycurrentlyprovidesadditional trainingsannuallyandonanas-neededbasisontopics like IDDE,SWPPPtraining,permitting,planreview,operationandmaintenance,andinspections.TheCitytracksitstrainingprogramsandupdatesinspreadsheets.

3. PUBLICEDUCATIONANDOUTREACHThissectionsummarizesthePhaseIIpermitrequirementsforthepubliceducationandoutreach,describescurrentactivitiestheCityhasunderwayforpubliceducationandoutreach.

AsperthePhase IIpermit,“Each Permittee shall create stewardship opportunities and/or partner withexisting organizations to encourage residents to participate in activities such as stream teams, stormdrainmarking,volunteermonitoring,riparianplantingsandeducationactivities,”(Ecology,2012).

“Each Permittee shall measure the understanding and adoption of the targeted behaviors for at leastone target audience in at least one subject area. No later than February2, 2016,Permittees shall usethe resultingmeasurements to direct education and outreach resourcesmost effectively, as well as toevaluate changes in adoption of the targeted behaviors. Permittees may meet this requirementindividuallyorasa memberofaregionalgroup,”(Ecology,2012).

3.1Education&OutreachActivitiesThe City currently has an active public Education and Outreach (E&O) Program that uses a variety ofapproachestoinformthecommunityaboutstormwater-relatedpollutionpreventionactivities.

3.1.1WatershedEducationinOurSchoolsIn2016,theCitypartneredwithKingConservationDistrict(KCD)toprovidea newhands-on learningprogramtoeducateschool-agedchildren in Newcastle.TheprogramwillbeofferedagainthisyeartobothHazelwoodElementaryandNewcastleElementarySchool.Thelearningobjectivesincludetheimportanceofclean water, waterpollution and where it comes from, andmethods of reducingpollutionfromhumanactivities.Participantsinthe program willsigna pledgestatinghowthey’regoing toprevent waterpollutionintheirdailylives.

3.1.2PetWasteIn 2016, Newcastle stepped up efforts on proper pet waste management. The City, in partnershipwithRegionalAnimalServicesofKingCounty(RASKC),providedadditional outreachmaterials, includingpet waste bags to each dog owner who pledges to pick up pet waste. This outreach will be donewhen pets are registered within the City and encourages behavior changewhenwalking their dogs inareas that don’t have stationary pet waste dispensers. The City will continue this in 2017, as well ascontinuetosupplythestationarypetwastedispenserswithpetwastebags.

3.1.2LIDOutreachTheCityamendedcodesandadoptedordinancesinDecember2016aspartoftheLIDintegrationprocess.This year, theCity isupdatingourPublicWorks standards to includeLID featuresanddesign,aswell ascreatingnewoutreachmaterials fordevelopers, contractors, andpropertyowners. ThesematerialswillexplaintheimportanceandusageofLIDprinciplesandBMPs.TheCityalsoadoptedthe2016KingCountySurfaceWaterDesignManual(2016KCSWDM)aspartoftheLIDcodeintegrationprocess.Inadditiontoadopting the 2016 KCSWDM, the City created a 2016 Addendum, which describes City-specificrequirements.

3.1.3IDDEOutreachTheCitywillworkwithbusinessownersthisyeartoprovideoutreachaspartofthePrivatelyMaintainedStormwater System Inspection Program. Educational efforts will include: overview of the stormwatersystemanditsfunctioning,overviewofpotentialpollutants,andsite-specificBMPs.Thisyear,theCitywillbeupdatingitsIDDEeducationalbrochures.

3.1.4AdditionalEducationandOutreachActivities• RestorationeventsduringEarthWeekandscheduledthroughouttheyear.

• Treeplanning andmaintenanceworkshop.Freetreetoparticipantstoincrease Newcastle’streecanopy.

4. PUBLICINVOLVEMENTANDPARTICIPATIONThis section summarizes the Phase II permit requirements for public involvement and participation,describes current activities theCity hasunderway forpublic involvementand participation.

Section S5.C.2 of the Phase II permit requires the City to include ongoing opportunities for publicinvolvement through advisory councils, watershed committees, participation in developing ratestructures,stewardshipprograms,environmentalactivities,orothersimilaractivities.

TheCity is also required tomake its SWMPdocument, annual report, andall other submittals requiredunderthePhaseIIpermitavailabletothepublic.

The latest SWMP document and annual report are posted on the City’s website. The Cityencourages public comment in the development and implementation of the City’s SWMP Plan.Commentscanbeaddressedto:

4.1CommunityInvolvement4.1.1CommunityFeedback

The City encourages public comment in the development and implementation of the City’s SWMP.The process to obtain feedback continues at public meetings concerning Phase II permit requirementsand through email, in writing, or by phone. The latest program document and annual report arepostedontheCity’swebsite.

In2016,theCitybegantheprocesstoupdateitsSurfaceWaterComprehensivePlan,a5-6yearplanthatdescribestheCity’swatershedsandnaturalwaterways,andstormwaterinfrastructure,stormwaterCapitalImprovementProjects(CIP),andanoverviewoftheSWMprogram.Asurveyaskedforresidents,propertyowners, and business owners’ input for our updated Surface Water Comprehensive Plan. The newComprehensivePlanshouldbecompleted later thisyear,andthe findingsandrecommendationswillbepresentedatapublicmeeting.

4.1.2CommunityResourcesTheCityusestheCity Clerk’sofficeforpublicnotificationofpublicmeetingspertainingtoPhaseIIpermitrequirements involving further development of the City’s SWMP. The City uses the City website,calendar, social media, and occasionally flyers for notification of local stewardship and environmentalactivities/events/programs. The City re-designed its website this year, and the website is much moreinteractive. The webmaster adds posts and updates from the Surface Water Program Manager thatdescribe updates to current water quality monitoring, stormwater projects, and upcoming publicparticipationopportunities.

The City has retained the following venues in an effort to keep its residents informed ondevelopmentandimplementationoftheCity’sSWMPcomponents:

• SurfaceWaterManagement(SWM)programwebpageontheCity’swebsite.TheCity’snew,user-friendlywebsiteandsocialmediaallowsustopostvideosandother mediato increaseawareness.

4.2CommunityStewardshipParticipationTheCityisplanningtoprovideseveralrestorationprojectsthroughouttheyear,aswellasotheroutreachand participation opportunities. The City plans to continue the storm drain marker program, and isplanningoncreatingotherstewardshipopportunities.

5. ILLICITDISCHARGEDETECTIONANDELIMINATIONThissectionsummarizesthePhaseIIpermitrequirementsforIllicitDischargeDetection and Elimination (IDDE), describes current activities the City hasunderway.TheCityisrequiredbySectionS5.C.3ofthepermittoimplementanongoing program to detect and remove illicit connections, discharges, andimproper disposal, including any spills not under the purview of anotherrespondingauthority, into theMS4 owned or operated by the City.

5.1 IDDEProgramActivities

The City will maintain ongoing IDDE programs and update municipal stormwater system mapping, aswell as investigate and remove illicit discharges and connections to the City stormwater system. Thegoals and requirements of the City’s IDDEprogramareasfollows:

• TheCitycurrentlyrequiresstaff intheCity’sPublicWorksDepartmenttoparticipate intheRegional Road Maintenance Endangered Species Act Training (ESA Track 3) Program andthe Certified Erosion and Sediment Control Lead (CESCL) Training Program. Other trainingopportunities are identified and provided on an as-needed basis for illicit discharges andillicitconnections.

• Utilizing Ecology’s 2013 Illicit Connection and Illicit Discharge Field Screening and SourceTracing Guidance Manual (IDDE Manual) as a procedural guide, the City hasimplementedacombinationofCatchBasin/ManholeinspectionsandOutfall inspectionsasthe IDDE Field Screening Methodology. 6. CONTROLLINGRUNOFFFROMNEWDEVELOPMENT,REDEVELOPMENT,ANDCONSTRUCTIONSITES

This section summarizes the Phase II permit requirements for runofffrom new development, redevelopment, and construction sites;describes current activities the City has underway; plannedactivities neededwithin the permit cycle; and presents activities theCity plans to undertake to bring its current program in compliancewith the Phase II permit requirements andscheduledeffortsthroughtheendofthepermitcycle.

6.1 PermitRequirementsThePhaseIIpermitrequiresthattheCity:

a. Implement an ordinance or other enforceable mechanism that addresses runoff from newdevelopment,redevelopment,andconstructionsiteprojects.

b. The program shall include a permitting process with site plan review, inspection andenforcementcapability tomeet the standards listed in (i) through (iv)below, forbothprivateand publicprojects,usingqualifiedpersonnel(asdefinedinDefinitionsandAcronyms).

i. Reviewofallstormwatersiteplansforproposeddevelopmentactivities.

ii. Inspect, prior to clearing and construction, all permitted development sitesthat have a high potential for sediment transport as determined throughplanreview.

iii. Inspect all permitted development sites during construction to verify properinstallation and maintenance of required erosion and sediment controls.Enforce asnecessarybasedontheinspection.

iv. Inspect all permitted development sites upon completion of constructionand prior to final approval or occupancy to ensure proper installation ofpermanent stormwater facilities. Verify that amaintenance plan is completedand responsibility for maintenance is assigned for stormwater treatmentand flow controlBMPs/facilities.Enforceasnecessarybasedontheinspection.

v. Compliancewiththeinspectionrequirementsin(ii),(iii)and(iv)above,shallbedetermined by the presence and records of an established inspectionprogram designedto inspectall sites.Complianceduringthispermit termshallbe determinedbyachievingatleast80%ofscheduledinspections.

vi. An enforcement strategy shall be implemented to respond to issues of non-compliance.

c. The program shall include provisions to verify adequate long-term operation andmaintenance (O&M) of stormwater treatment and flow control BMPs/facilities that arepermittedand constructed.

d. The program shall make available as applicable copies of the "Notice of Intent forConstruction Activity" and copies of the "Notice of Intent for Industrial Activity" torepresentativesofproposednewdevelopmentandredevelopment.Permitteesshallcontinueto enforce local ordinances controlling runoff from sites that are also covered bystormwater permitsissuedbyEcology.

e. Each Permittee shall ensure that all staff whose primary job duties are implementingthe program to control stormwater runoff from new development, redevelopment, andconstruction sites, including permitting, plan review, construction site inspections, andenforcement, are trained to conduct these activities. Follow-up training shall be providedas needed to address changes in procedures, techniques or staffing. Permittees shalldocument andmaintainrecordsofthetrainingprovidedandthestafftrained.

f. Lowimpactdevelopmentcode-relatedrequirements.

g. Watershed-scalestormwaterplanning.

6.2 ExistingPrograms

AsperPhaseIIpermitSectionS5.C.4,theCitywillcontinuetomaintainexistingdevelopmentreviewandinspection programs as well as stormwater standards for controlling runoff from new development,redevelopment, and other construction sites in 2017. The City currently has an active program toreduce pollutants in stormwater runoff from new development, redevelopment, and construction siteactivities.Theexistingprogram currently applies to both public and private projects, including roads.The current compliance activitiesassociatedwiththeabovepermitrequirementsinclude:

• The current program has existing municipal codes and engineering designstandards thatareenforcedthroughthecurrentpermit,planreview,andinspectionprocessesto reducepollutantsfromstormwaterrunoff.

• The City has adopted the 2016 KCSWDM that gained equivalency from Ecology,aswell as the 2016 City Addendum for surface and stormwater design review fordevelopmentandredevelopmentprojects.

• TheCityrecordsandmaintainsinspectionsandenforcementactionsbystaff.

• There is a system of escalating enforcement procedures necessary to sustainthe existing codes and standards throughout the construction/developmentprocess in Chapters13.10and4.05oftheNMC.

• All sites are inspected by the City prior to the start of construction, duringconstruction,andpostconstruction.

6.3 LIDIntegration

In addition tomaintaining existingprograms, theCity updatedCity codes, standards, policies andplansnecessary to ensure LID techniques won’t be limited by current policies. This work was completedDecember2016,andisineffectthisyear.TheCityisdevelopingLIDoutreachmaterialsfordevelopersandcontractorstoutilizeasareference.TheCityisalsointheprocessofupdatingthestormwaterCityPublicWorksStandardstoincludeLIDfacilities.

7. OPERATIONS&MAINTENANCEPROGRAMThis section summarizes the Phase II permit requirementsfor Operations & Maintenance (O&M) and pollutionprevention; describes current activities the City hasimplementedtomeetthePhaseIIpermit requirements.

7.1 InspectionProgramThe City conducts annual inspection of all municipally owned or operated permanent stormwatertreatmentandflowcontrolfacilities.Catchbasinsareinspectedandmaintained,ifnecessary,onceeverytwo years. Inspection of all catch basins will be completed by August 1st, 2017. Publicly owned ormaintained catch basins will be inspected every two years thereafter. The City implemented its assetmanagementsystem,Cartegraph,in2016andtheCityutilizesCartegraphforinspectionsdataandphotos.

7.2 MaintenanceProgramIf necessary, inspections are followed by maintenance to ensurecontinuedfunctionality. TheCityInspectorassignsmaintenanceorrepairtasksinCartegraphimmediatelyfollowinganinspection.Themaintenancescheduleis:

• Within 1 year for typical facilitymaintenance, exceptcatchbasins

• Within6monthsforcatchbasins

• Within 2 years formaintenance that requires capitalconstructionofless than$25,000.

7.3 Post-stormInspectionProgramTheCity conducts spot checks of potentially damaged permanent treatment and flow control facilities,after major (greater than 24-hour-10-year recurrence interval rainfall) storm events. If spot checksreveal widespread damage/maintenance needs, inspect all stormwater treatment and flow controlfacilitiesthatmaybeaffected.Atleast95percentofallsiteswhereinspectionisrequired,eithercyclicallyorstorm-event related,areinspected.

7.4 PrivatelyMaintainedStormwaterSystemInspectionProgramThis year, the City purchased a database to manage the Privately Maintained Stormwater InspectionProgram. The City inspects privately maintained stormwater systems as part of Phase II permitrequirements, as well as to reduce flooding, protect water quality, and to protect the City’s MS4.Inspections are conducted either annually or every other year, depending on the Phase II permitrequirements as they pertain to each privatelymaintained stormwater system. The City also provideseducation to property and/or business owners during the inspection process. The education includes:stormwatersystemknowledge,watershedknowledge,pollutionprevention,andBMPs.

7.5 O&MPollutionPreventionThe City is continuing practices to reduce stormwater impacts associated with runoff from streets,parking lots, roads, or highways owned or maintained by the City and road maintenance activitiesconductedbytheCity.Thefollowingactivitiesshallbeaddressed:

• Pipecleaning

• Cleaningofculvertsthatconveystormwaterinditchsystems

• Ditchmaintenance

• Streetsweeping

• Roadrepairandresurfacing,includingpavementgrinding

• Snowandicecontrol

• Utilityinstallation

• Pavementstripingmaintenance

• Maintainingroadsideareas,includingvegetationmanagement

• Dustcontrol.

• Application of fertilizer, pesticides, and herbicides, as well as the development of nutrientmanagement and integrated pestmanagement plans

• Sedimentanderosioncontrol

• Landscapemaintenanceandvegetationdisposal

• Trashmanagement

• Buildingexteriorcleaningandmaintenance.

7.6 Training&RegionalCoordinationThe City provides ongoing training for employees of the City whose construction, operation ormaintenance job functions may affect stormwater quality. The City provides training for staff onoperation and maintenance activities such as ESA Track 3 (Regional Road Maintenance ESA training),andMunicipalStormwaterPollutionPrevention.

Citymaintenancecrewsareresponsibleforspillsresponse.AlthoughCity crewsareprimarilyresponsibleforspillswithintheright-of-way,theyare oftenthefirstgrouptorespondtospillsreportingregardlessofwhere they are located. Spill kits are provided in city maintenance vehicles to address minor spills.Assistance is sought out in the event that spill kits couldnotcontainquantitiesthatexceeditscapacity.

• Notify DOE of its choice to independently conduct Status and Trends Monitoring andEffectiveness Studies, or participate by paying annually into the Regional StormwaterMonitoring Program (RSMP) thatwillbeconductedbyDOE.

• Pay into the RSMP to implement the Source Identification Information Repository (SIDR)elementof theRSMP.

Structural Source Control BMPs are physical, structural, ormechanical devices, or facilities that are intended toprevent pollutants fromentering stormwater.Operational BMPs are non-structural practices that prevent or reduce pollutants from enteringstormwater.

Stormwater means runoff during and following precipitation and snowmelt events, including surfacerunoff,drainageorinterflow.

Stormwater Associated with Industrial and Construction Activity means the discharge from anyconveyance which is used for collecting and conveying stormwater, which is directly related tomanufacturing, processing or raw materials storage areas at an industrial plant, or associated withclearing,gradingand/orexcavation,andisrequiredtohaveanNPDESpermit inaccordancewith40CFR122.26.

TotalMaximumDaily Loadmeans awater cleanup plan. A TMDL is a calculation of the maximumamountofapollutant that awaterbodycan receiveand stillmeetwaterquality standards,andanallocationof thatamount to thepollutant’s sources.ATMDL is the sumof theallowable loadsofasinglepollutantfromallcontributingpointandnonpointsources.

Thecalculationmust includeamarginof safety toensure that thewaterbody canbeused for thepurposesthestatehasdesignated.Thecalculationmustalsoaccountforseasonable variationinwaterquality.Waterqualitystandardsaresetbystates,territories,andtribes.

They identify the uses for each water body, for example, drinking water supply, contact recreation(swimming), and aquatic life support (fishing), and the scientific criteria to support that use. The CleanWaterAct,section303,establishesthewaterqualitystandardsandTMDLprograms.

Tributary conveyance means pipes, ditches, catch basins, and inlets owned or operated by thePermitteeanddesignedorusedforcollectingandconveyingstormwater.

Urbanized Area is a federally-designated land area comprising one or more places and theadjacent densely settled surrounding area that together have a residential population of atleast50,000andanoverallpopulationdensityofatleast1,000people persquaremile. UrbanizedAreasaredesignatedbytheU.S.CensusBureaubasedonthe mostrecentdecennial census.

Vehicle Maintenance or Storage Facility means an area where any vehicles are regularly washedormaintained,orstored.
