JUNE 1, 2020 A meeting of the City Council of the City of Blue Springs, Missouri, was held on Monday, June 1, 2020, 6:00 p.m. with Mayor Carson Ross presiding. A State of Emergency for Jackson County, Missouri was declared on March 12, 2020 and subsequent amendments by Jackson County Executive Order requiring residents to stay at home and limiting public gatherings to reduce the spread of the COVID-19 virus. As provided in Sections 610.020(1) and 610.020(4) RSMo., the City Council participated in this meeting via video-conference and telephone to ensure safe social distancing measures were taken. Councilmember Culpepper introduced Bill No. 4755 approving amendments to the Unified Development Code related to fence construction and materials (UDCT-03-20-7250). City Clerk Sheryl Morgan made the first reading of Bill No. 4755 by title; copies of the proposed Bill having previously been made available to the public. Councilmember Fowler moved to approve Bill No. 4755 upon its first reading and proceed with the second reading. Motion seconded by Councilmember Ericson and carried with the following votes:

City Clerk Sheryl Morgan entered two exhibits into the record. Exhibit No. 2 is an email, letter and fact sheet from Cindy Miller, President of Blue Springs Downtown Alive! sent to the businesses in the Downtown District.

IN SUPPORT OF Melodie Chrisman of Community Services League expressed her gratitude for the CDBG funds allocated and discussed how additional funds from the CDBG-CV grant could use used to benefit individuals and families in Blue Springs. Cindy Miller, President of Blue Springs Downtown Alive! stated she felt putting people back to work would lessen the need for assistance from the Community Services League and requested additional funds from the CDBG-CV grant.

RESOLUTION 46-2020 - SUBSTANTIAL AMENDMENTS TO THE COMMUNITY DEVELOPMENT BLOCK GRANT PLAN

Councilmember Fowler moved to adopt Resolution No. 46-2020 approving substantial amendments to the CDBG 2017-2021 Consolidated Plan, 2017-2021 Citizen Participation Plan, and the 2019-2020 Annual Action Plan to accommodate and allocate $158,235 in CDBG-CV funds received through the CARES Act. Motion seconded by Councilmember Kaylor

MOTION TO AMEND RESOLUTION NO. 46-2020

Councilmember Ericson moved to amend Resolution No. 46-2020 to amend the proposed substantial amendments to the 2019-20 Annual Action Plan by increasing the allocation for the small business loan program from $100,000 to $135,000, and reducing the allocation for Community Services League from $58,235 to $23,235. Motion seconded by Councilmember Culpepper and carried with a 5-2 vote as follows:

MAYORAL ANNOUNCEMENTS

Mayor Ross reminded the public of the Municipal Election on Tuesday, June 2, 2020. Thoughts to ponder: “The message of what has happened to the wrongful killing of George Floyd is being hijacked and lost with the destruction of peaceful protests that is legal and needed by a bunch of opportunistic criminals and thugs. Looting, burning of businesses and police cars while attacking police officers are unacceptable. There are reports that many of them don’t even live in the cities they are destroying. How disgraceful. Our attention should be on George Floyd and those before him seeking justice and a change of attitude in America. God created all of us in his image and after his likeness. Many of you are as saddened as I am and disgusted in what we are witnessing by those who have an agenda other than seeking justice for George Floyd. I employ them to stop the looting, buring and destroying property that don’t belong to them all the while we are still fighting the invisible and silent killer, Coronavirus and COVID-19 pandemic. May God bless us all and may God bless America.” (Mayor Carson Ross)

VISITORS Preston Smith addressed Council requesting the playgrounds be reopened for use. Council and staff discussed the restrictions and desire to open the playgrounds and splashpad.

EXECUTIVE ORDER

20-03

WHEREAS, on March 13, 2020, a state of emergency was declared, pursuant to Sections 44. 100 and 44.110, RSMo, in an effort to ensure the protection of the safety and welfare of the citizens of Missouri from the Coronavirus and COVID-19;

WHEREAS, the emergency conditions and state of emergency continue to exist;

WHEREAS, the emergency conditions and state of emergency interfere with the electoral process in that a General Municipal Election is scheduled for April 7, 2020 in every election authority in the state (the counties, the City of Kansas City and the City of St. Louis);

WHEREAS, the Centers for Disease Control and Prevention recommends cancellation or suspension of gatherings and limiting close contacts via social distancing to limit the spread of the Corona virus;

WHEREAS, Section 44.100, RSMo, provides that during a state of emergency, the Governor is authorized to "waive or suspend the operation of any statutory requirement or administrative rule prescribing procedures for conducting state business, where strict compliance with such requirements and rules would prevent, hinder, or delay necessary action by the department of health and senior services to respond to a declared emergency or increased health threat to the population"; and

WHEREAS Section 44.100, RSMo, provides that during a state of emergency, the Governor is authorized to "perform and exercise such other functions, powers and duties as may be necessary to promote and secure the safety and protection of the civilian population";

NOW, THEREFORE, I, MICHAEL L. PARSON, GOVERNOR OF THE STATE OF MISSOURI, by virtue of the authority vested in me by the Constitution and the Laws of the State of Missouri, including Section 44.100 and 44.110, RSMo, do hereby order, effective immediately:

I. The General Municipal Election scheduled for April 7, 2020, is hereby postponed to June 2, 2020, in all of the State.

II. The following dates apply to the June 2, 2020, General Municipal Election:

A. Each election authority shall cause to be published a notice of the June 2, 2020, election as required

in Section 115.127 .2, RS Mo, and shall include a reference to this Executive Order;

B. The closing date for registration pursuant to Section 115.135.1 RS Mo, shall remain March 11, 2020;

C. The minimum age requirement for voting as set forth in Mo. Const. Art. Vlll, section 2, shall

continue to be ascertained as of April 7, 2020;

D. The deadline for filing a declaration of intent to be a write-in candidate pursuant to Section

115.453(4) shall remain at 5:00 p.m. on March 27, 2020.

E. The deadline to apply for an absentee ballot under Section 115.279, RSMo, shall be May 20, 2020;

F. The ballots already printed and bearing a date of April 7, 2020, shall be used for the election on

June 2, 2020;

G. A public test of the voting equipment under Section 115.233, RSMo, shall be completed no later

than June 1, 2020;

H. In-person absentee voting shall continue until 5 :00 p.m. on June 1, 2020;

I. The deadline by which absentee ballots must be received by the election authority under Section

115.293.1, RSMo, shall be 7:00 p.m. on June 2, 2020; and

J. For covered voters as defined in Section 115.902(1), RSMo:

a. The deadline for a covered voter to request a ballot from an election authority shall be 5 :00

p.m. on May 29, 2020 (§ 115.912, RSMo);

b. The deadline for an election authority to begin making baliots· available to covered ·voters

shall be April 18, 2020 (§ 115.914, RSMo); and

c. The deadline by which absentee ballots from covered voters must be received by an

election authority shall before noon on June 5, 2020 (§ 115.920, RSMo).

K. The election results shall be certified by an election authority no sooner than noon on June 5, 2020

(§ 115.508) and no later than June 16, 2020 (§ 115.507, RSMo).

lll. In addition to the legally required notice in II.A, above, each election authority, within its

capabilities, shall endeavor to provide notice to the public by: (I) posting information on its

website; (2) issuing press releases; (3) making public appearances; (4) directly contacting

stakeholders, such as the candidates for election and the jurisdictions which have placed issues

and candidates on the General Municipal Election ballot; and (5) using social media platforms

to notify voters.

IV. The candidates for offices for which no election is scheduled for April 7, 2020, due to the

exemption in Section 115 .124, RS Mo, shall assume the responsibilities of their offices at the

same time and in the same manner as if the election had been held on April 7, 2020.

V. As provided in Article VII, Section 12 of the Missouri Constitution, "Except as provided in this

constitution, and subject to the right of resignation, all officers shall continue to hold office for

the term thereof, and until their successors are duly elected or appointed and qualified."

VI. Nothing within this order shall be construed to effect any other election in the State of Missouri

other than the General Municipal Election scheduled for April 7, 2020.

BACKGROUND/JUSTIFICATION In accordance with Section 235.020 of the Code of Ordinances, City of Blue Springs, Missouri, the population of the City of Blue Springs shall be determined annually and submitted to the City Council on or before January 1st of each year. On or before July 1 of each year, the U.S. Census Bureau releases population estimates for all municipalities in the United States from the previous year. The latest population estimate for Blue Springs is 55,829, reflecting a 703 person increase in population from July 1, 2018 to July 1, 2019. This is a 1.28% increase over the previous year’s population of 55,104 and both the largest percentage and numerical increase over the past 10 years. Population estimates are used to determine the number of certain liquor licenses, fireworks permits, payday loan establishments, tobacconists, and body art service land uses.

A RESOLUTION APPROVING CHANGE ORDER NO. 1 TO A CONTRACT WITH

RADMACHER BROTHERS EXCAVATING CO., INC. FOR RECONSTRUCTION OF THE NE 20TH STREET ENTRANCE AT NE JEFFERSON STREET

WHEREAS, OSHA requirements under Section 292.675, RSMo 2009, require: a. Any contractor for any public body for purposes of construction of public works and any subcontractor (any person entering into a subcontract with a contractor for construction of public works which employs "on-site employees" for purposes of completion of the contract) to such contractor shall provide a ten-hour Occupational Safety and Health Administration (OSHA) construction safety program for their on-site employees which includes a course in construction safety and health approved by OSHA or a similar program approved by the department which is at least as stringent as an approved OSHA program, unless such employees have previously completed the required program. All employees who have not previously completed the program are required to complete the program within sixty days of beginning work on such construction project. b. Any employee found on a work site subject to this section without documentation of the successful completion of the required course shall be afforded twenty days to produce such documentation before being subject to removal from the project. c. The contractor to whom the contract is awarded and any subcontractor under such contractor shall require all on-site employees to complete the above referenced ten-hour training program or such employees must hold documentation of prior completion of the program. Said contractor and subcontractor(s) shall comply with Section 292.675, RSMo 2009, in all respects as required in relation to work done pursuant to this contract. d. The contractor shall forfeit as a penalty to the public body on whose behalf the contract is made or awarded, two thousand five hundred dollars plus one hundred dollars for each employee employed by the contractor or subcontractor, for each calendar day, or portion thereof, such employee is employed without the required training. The penalty shall not begin to accrue until the time period referenced in subparagraphs a and b above have elapsed. e. The public body awarding the contract shall withhold and retain therefrom all sums and amounts due and owing as a result of any violations of this section when making payments to the contractor under the contract. The contractor may withhold from any subcontractor sufficient sums to cover any penalties the public body has withheld from the contractor resulting from the subcontractor's failure to comply with the terms of this section. If the payment has been made to the subcontractor without withholding, the contractor may recover the amount of the penalty resulting from the fault of the subcontractor in an action maintained in the circuit court in the county in which the public works project is located from the subcontractor. f. “On-site employees” are defined as laborers, workmen, drivers, equipment operators, and craftsmen employed by contractors and subcontractors to be directly engaged in construction at the site of the public works. "Directly engaged in construction" shall mean work performed in the actual erection of the structure or completion of the improvement constituting the public works. In addition, employees working at a nearby or adjacent facility used by the

contractor or subcontractor for construction of the public works shall be deemed "on-site employees." Persons engaged solely in the transportation of materials, fuel, or equipment to the site of the public works shall not be deemed to be "directly engaged in construction;” and WHEREAS, not less than the prevailing hourly rate of wages for work of a similar character in this locality, as established and amended at any time by the Department of Labor and Industrial Relations of the State of Missouri, shall be paid to all workers performing work under this Agreement; and WHEREAS, the Department has a contract with Radmacher Brothers Excavating Co., Inc. for 2019 Roanoke Drive Project and now recommends that the City approve Change Order No. 1 in the amount of $219,120. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BLUE SPRINGS, MISSOURI, as follows: Section 1. The City Administrator has the authority and is hereby authorized to approve Change

Order No. 1 with Radmacher Brothers Excavating Co., Inc., 2201 N. 7 Highway, Suite B, Pleasant Hill, MO 64080 for the reconstruction of the entrance to NE 20th Street at NE Jefferson Street as part of the 2019 Roanoke Drive Project (CIP ST-08). A copy of Change Order No. 1 is attached as Exhibit "A” and incorporated herein.

Section 2. City staff is directed to perform all tasks necessary to implement said contract.

Resolution No. 49-2020 A RESOLUTION APPROVING A NINTH AMENDMENT TO THE JULY 14, 2015 CONTRACT

NUMBER 2015-096.1A WITH SUPERIOR ELECTRICAL CONSTRUCTION, INC. FOR ON CALL ELECTRICAL SERVICES

WHEREAS, OSHA requirements under Section 292.675, RSMo 2009, require: a. Any contractor for any public body for purposes of construction of public works and any subcontractor (any person entering into a subcontract with a contractor for construction of public works which employs "on-site employees" for purposes of completion of the contract) to such contractor shall provide a ten-hour Occupational Safety and Health Administration (OSHA) construction safety program for their on-site employees which includes a course in construction safety and health approved by OSHA or a similar program approved by the department which is at least as stringent as an approved OSHA program, unless such employees have previously completed the required program. All employees who have not previously completed the program are required to complete the program within sixty days of beginning work on such construction project. b. Any employee found on a work site subject to this section without documentation of the successful completion of the required course shall be afforded twenty days to produce such documentation before being subject to removal from the project. c. The contractor to whom the contract is awarded and any subcontractor under such contractor shall require all on-site employees to complete the above referenced ten-hour training program or such employees must hold documentation of prior completion of the program. Said contractor and subcontractor(s) shall comply with Section 292.675, RSMo 2009, in all respects as required in relation to work done pursuant to this contract. d. The contractor shall forfeit as a penalty to the public body on whose behalf the contract is made or awarded, two thousand five hundred dollars plus one hundred dollars for each employee employed by the contractor or subcontractor, for each calendar day, or portion thereof, such employee is employed without the required training. The penalty shall not begin to accrue until the time period referenced in subparagraphs a and b above have elapsed. e. The public body awarding the contract shall withhold and retain therefrom all sums and amounts due and owing as a result of any violations of this section when making payments to the contractor under the contract. The contractor may withhold from any subcontractor sufficient sums to cover any penalties the public body has withheld from the contractor resulting from the subcontractor's failure to comply with the terms of this section. If the payment has been made to the subcontractor without withholding, the contractor may recover the amount of the penalty resulting from the fault of the subcontractor in an action maintained in the circuit court in the county in which the public works project is located from the subcontractor. f. “On-site employees” are defined as laborers, workmen, drivers, equipment operators, and craftsmen employed by contractors and subcontractors to be directly engaged in construction at the site of the public works. "Directly engaged in construction" shall mean work performed in the actual erection of the structure or completion of the improvement constituting the public works. In addition, employees working at a nearby or adjacent facility used by the contractor or subcontractor for construction of the public works shall be deemed "on-site

employees." Persons engaged solely in the transportation of materials, fuel, or equipment to the site of the public works shall not be deemed to be "directly engaged in construction;” and WHEREAS, not less than the prevailing hourly rate of wages for work of a similar character in this locality, as established and amended at any time by the Department of Labor and Industrial Relations of the State of Missouri, shall be paid to all workers performing work under this Contract; and

WHEREAS, this 9th amendment to the Contractor Contract Number 2015-096.1A for on call electrical services dated July 14, 2015 will increase the amount payable under the Contract with Superior Electrical Construction, Inc., for the July 14, 2019 through July 13, 2020 term by $5,000.00 for a total of $50,000.00. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BLUE SPRINGS, MISSOURI, as follows: Section 1. The City Administrator has the authority and is hereby authorized to execute the Ninth

Amendment to the Contract with Superior Electrical Construction, Inc., 12780 E 40 Highway, Independence, MO 64055, by increasing the amount to be paid by $5,000.00 for the July 14, 2019 through July 13, 2020 term for a total of $50,000.00. A copy of the Ninth Amendment is attached as Exhibit "A” and incorporated herein.

The approval of Liquor License renewals for the 2020-2021 license year. According to City of Blue Springs City Code, Chapter 600, Section 600.120 (B), all changes to the Managing Agent or type of license shall be approved by City Council.

BACKGROUND/JUSTIFICATION

Currently, 27 of the 92 Liquor License renewals for the 2020-2021 license year have been submitted to the Business Service Department. Three licenses have been submitted with changes to the Managing Agent. Resolution No 41-2020, allows for an additional 30 days for renewals and changes to all liquor licenses that expire on June 30, 2020, therefore additional liquor licenses may appear on July 20, 2020 agenda if submitted.

Adopt a Resolution accepting the proposal for and authorizing the payment for the City’s annual property, liability, and workers’ compensation insurance for the insurance plan year that begins July 1, 2020.

BACKGROUND/JUSTIFICATION

The City has been working with CBIZ, Inc. for all city insurance options; health, dental, vision, life, property, casualty, liability and worker’s compensation. Over the last several months, the council has passed several resolutions taking action to implement new insurance for the 2020-21 plan year. Public Risk insurance pool as of June 30, 2020 04/06/20 36-2020 Approved binding property and liability rates with Travelers

for property insurance for the 2020-21. 04/20/20 40-2020 Approved implementing the City’s annual insurance

programs for health, dental, vision, life, and other employee benefit programs.

This resolution accepts the proposal, including rates, and authorizes payment for property, liability and workers compensation insurance. The total premium for these lines of insurance for the 2020-21 plan year total $1,590,083. This results in a savings of $597,711 or 27% over the premiums that were approved for the 2019-20 plan year (Resolution 34-2019.)

TERRORISM NOTICE

On January 12, 2015, the President signed into law the Terrorism Risk Insurance Program Reauthorization Act of 2015. This Act amends the Terrorism Risk Insurance Act of 2002 (TRIA) to extend the Terrorism Insurance Program through December 31, 2020, with modifications. Modifications include:

a. A change in the federal share of payments beginning on January 1, 2016, for acts of terrorism, to be reduced annually to 80% of insured losses.

b. Premium Financing You may choose to use a premium finance company in connection with the insurance coverages we place for you or the services we provide to you. Premium finance options are not always available. Where permitted by law, we may receive a fee for the administrative services we provide those companies. These services include processing the premium finance applications and marketing and sales support they do not have. Vacancy Restrictions Most property insurance policies restrict coverage on buildings that have been vacant beyond a specified period of time (usually 30 or 60 days). For example, a standard commercial property policy does not cover losses arising from vandalism, sprinkler leakage (unless the system has been protected from freezing), building glass breakage, theft, or attempted theft if the building where the loss occurs has been vacant for more than 60 consecutive days before the loss. Recovery for other insured losses is reduced by 15 percent under the same circumstances. It is also important to be aware of the policy's definition of "vacancy." Under a standard commercial property policy, if the insured is a building owner or general lessee, a building is considered vacant unless at least 31 percent of its total square footage is used by the building owner, a lessee, or a sub lessee to conduct their customary operations. If the insured is a tenant, the vacancy provision applies only to the space leased to the insured, and this space is considered vacant when it does not have enough contents for the insured to carry on normal business operations. WHEREAS, as a result of increasing costs for insurance coverage, the City researched other options and costs in the marketplace through a contract with CBIZ Inc.; and

WHEREAS, the City of Blue Springs will be utilizing Travelers Property Casualty Co. of

America for property and liability insurance and Missouri Employers Mutual Insurance Co. for workers’ compensation insurance beginning July 1, 2020; and

WHEREAS, staff recommends payment of $178,457 for property insurance, $521,617 for

liability insurance, and $890,009 for workers’ compensation for the plan year July 1, 2020 through June 30, 2021 for a total of $1,590,083.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BLUE SPRINGS, MISSOURI, as follows: Section 1. The City Administrator is hereby authorized to accept the insurance proposal and

Upon conclusion of the public hearing, a Bill Amending Section 403, Development Review Procedures, of the Unified Development Code, of the Code of Ordinances of the City of Blue Springs to add a new development review application for a General Development Plan will be ready for introduction and readings.

BACKGROUND/JUSTIFICATION

The current UDC regulations do not require a plan or conceptual drawing to be submitted in conjunction with a rezoning application, unless it is for a Planned Development which requires a PD Concept Plan to be submitted for City Council review. Additionally, if a property is already zoned appropriately for the proposed use, potentially, only a Preliminary Plat application is required, which is reviewed and approved by the Planning Commission. Recently, the City Council has expressed a desire to have more review plans as part of a zoning application, as well as the desire to review Preliminary Plat applications. Under Missouri State Statutes, a Plat is deemed to be a “ministerial” matter, in which if the plat application meets all of the UDC regulations, then it must be approved. As such, this new General Development Plan application will be required anytime there is a rezoning, unless a Planned Development is involved, or prior to/in conjunction with a Preliminary Plat application. The General Development Plan will provide City Council the opportunity to review development plans prior to the platting process, and thus, will afford City Council more discretion in their decision-making authority when it comes to new developments throughout the City. The Development Advisory Commission (DAC) met to review the proposed UDC Text Amendment on Thursday, May 28, 2020, and recommended approval of the proposed amendments, by a vote of 3- Aye, 1-No, and 1-Abstain. The Planning Commission held a public hearing on June 8, 2020 to review the proposed amendment and voted unanimously to approve the UDC Text Amendment language as written.

PREVIOUS ACTIONS/APPROVALS:

• The City of Blue Springs adopted a Unified Development Code (UDC) in 1996 by passage of Ordinance No. 2738 on November 18, 1996.

• An amended Unified Development Code was adopted on August 3, 2015, by passage of Ordinance No. 4558.

• The Unified Development Code has been further amended since 2015 for maintenance purposes, as well as to respond to changing development patterns and keep up to date with current trends.

PROPOSED UDC LANGUAGE The proposed changes to the UDC are identified below:

Chapter 403. Development Review Procedures

Section 403.045. General Development Plan

A. Overview/Applicability. The purpose of the General Development Plan process is to ensure compliance with zoning and other development regulations and the achievement of quality development through the review of a General Development Plan that will represent the general development on the site. The General Development Plan will be approved by City Council to establish the framework for development on a property. General Development Plan is a generalized development plan for the entire area proposed to be included within a proposed development. The purpose of a General Development Plan is to allow preliminary review of a proposed development before substantial technical work has been undertaken. B. When a General Development Plan is required. Unless a PD Concept Plan is included as part of a Planned Development, a General Development Plan is required for commercial and residential development applications prior to or concurrent with the approval of zoning or rezoning and prior to the application for a preliminary plat for more than 4 residential lots. C. General Development Plan shall provide.

1. Community Character Plan. A plan outlining the general location, design characteristics, and functions of all proposed streets, stormwater management, open spaces, civic spaces, and circulation networks — whether public, common or private — that will create the public realm for the plan. 2. Land Use And Development Plan. A plan indicating the specific land uses and their density/intensity, block and lot patterns, building types and scale, materials and design characteristics, and other building and site design elements. This plan shall have a particular emphasis on how these elements relate to the community character plan and where transitions between these elements occur at a parcel or block scale both within the development and in coordination with abutting property. The land use and development plan shall specifically identify where development standards may differ from those otherwise applicable through the base zoning districts and general development requirements of this Code.

3. Existing Conditions. Analysis identifying the general layout of any existing structures, streets or infrastructure and the location of natural features such as watercourses, steep grades, significant stands of trees, specimen trees or other features available on the most refined scale of the Natural Resources Inventory identified in Appendix A3 of the Comprehensive Plan. 4. Phasing Or Implementation. A strategy indicating the estimated timing of development and any other administrative details of implementing the plan through future final plans. 5. Illustrative Plan. The General Development Plan shall include an illustrative plan that includes renderings, elevations or plans of buildings, streetscapes, and public spaces or other urban design and architectural details demonstrating how the plan will be executed according to the applicable development standards.

D. General Development Plan Review Criteria. A General Development Plan shall be reviewed according to the following criteria:

1. The proposed General Development Plan is consistent with the Comprehensive Plan and all requirements of the UDC; 2. The proposed General Development Plan is consistent with the current zoning on the property or conditioned on the approval of an existing application for a zoning map amendment. 3. The General Development Plan is in compliance with all applicable use, development and design standards set forth in this Code, unless Alternative Design Standards have been approved for the development. 4. Adequate facilities and services exist or are planned by the project to serve the development at the time of construction. 5. The General Development Plan is sensitive to the existing land uses and is compatible with the existing adjacent land use designations. Compatibility with the surrounding area is demonstrated by proposed improvements, including screening and buffering that has been provided to minimize impacts to adjacent uses. 6. The amendment will provide for orderly physical growth of the city, and foster safe, convenient and walkable neighborhoods and shopping districts.

E. Effect Of General Development Plan Approval. Approval of a General Development Plan shall constitute acceptance of the overall planning concepts and development parameters. In reviewing and approving a General Development Plan, the Planning Commission may recommend or the City Council may require conditions that must be met before an applicant submits a for a Site Plan and Design Review. An approved General Development Plan shall lapse and be of no further force and effect if a Site Plan Design Review or Preliminary Plat application has not been applied for within two (2) years of the date of approval of the General Development Plan

STAFF ANALYSIS

Text amendments ensure that the generally applicable laws in the Development Code reflect the broad public interest and long-range planning goals of the community, as reflected in the Comprehensive Plan. The City may determine that it is necessary from time to time to revise and update the Development Code to implement the Comprehensive Plan.

Section 403.020 of the UDC states a Text Amendment shall be reviewed according to the following criteria: Review Criteria. All review bodies shall use the following criteria for review, recommendations and decisions on text amendments: 1. Whether the change is in accordance with the Comprehensive Plan, Design and Construction Manual, or any official plans or programs developed under the guidance of the Comprehensive Plan;

Staff Response: The proposed UDC Amendments provide regulations in accordance with the Comprehensive Plan components to provide for adequate development and zoning regulations to guide future growth of the City.

2. Whether such change is consistent with the purposes of this Development Code, and the intent or objectives of any Chapter or Subsection containing the change;

Staff Response: The change is consistent with the purpose of the Development Code to provide for appropriate regulations for the development, building and use of property in the City and to promote the public safety, health and general welfare of residents and visitors to the City.

3. The areas that are most likely to be directly affected by the amendment and in what way they will be affected;

Staff Response: The proposed amendments would require a new application type, a General Development Plan, to be reviewed by the Planning Commission and the City Council concurrent with a rezoning application or prior to approval of a Preliminary Plat application. Currently, developers and applicants do not need to provide a plan as part of a standard rezoning application and if zoning is already established on a property and the proposed use is a permitted use, the Preliminary Plat application is only reviewed by the Planning Commission. This new General Development plat will add a step in the development review process and give City Council more discretion with approving development plans throughout the City.

4. Whether the proposed amendment is made necessary because of changed or changing social values, new planning concepts or other social or economic conditions in the areas and zoning districts affected; and

Staff Response: The proposed amendment to add a new discretionary approval for City Council in conjunction with a rezoning and/ or a Preliminary Plat is being done due to the City Council’s changing values and the desire to have more input on development approvals throughout the City.

BACKGROUND/JUSTIFICATION

The applicant is requesting approval of a Final Plat for “Calamar,” a 1-lot subdivision on 7.77 +/- acres located at 2000 NE Coronado Drive. The subject property is located immediately east of the Adams Pointe Golf Club and will accommodate a 134-unit multi-family development. BACKGROUND INFORMATION/SUMMARY: The applicant is requesting Final Plat approval for Calamar, Lot 1. The Final Plat is located on the south side of NE Coronado Drive immediately north and west of the Adams Pointe Golf Club. This is the first and only anticipated final plat for Calamar Senior Living and includes 1 lot covering 7.77 +/- acres. The proposed Final Plat is in substantial compliance with the approved Preliminary Plat.

PREVIOUS ACTIONS/APPROVALS:

On September 20, 1982, the Board of Alderman approved an annexation request (A-5-1982) for the subject property. The annexation was effective September 20, 1982.

On March 24, 1997, the Planning Commission recommended approval of the Adams Dairy Parkway Overlay District rezoning (R-2-1997), which would rezone the subject property from “LI” (Light Industrial) to “SO/ADP-O” (Service Office/Adams Dairy Parkway-Overlay). The City Council approved the rezoning on April 21, 1997.

On September 11, 2017, the Planning Commission recommended approval to rezone (RZ-08-17-5971) of the subject property from “SO/ADP-O” (Service Office/Adams Dairy Parkway-Overlay) to “MF-18/ADP-O” (High Density Multi-Family/Adams Dairy Parkway-Overlay). The City Council approved the rezoning on September 18, 2017 (Ordinance No. 4686).

On October 9, 2017, the Planning Commission recommended approval of a PD Concept Plan (PDC-09-17-6024) for Calamar Senior Living. The City Council approved the PD Concept Plan on October 16, 2017 (Ordinance No. 4692).

On October 9, 2017, the Planning Commission approved a “For Sale Only” Preliminary Plat (PP-09-17-6022) for Coronado Holdings.

On October 9, 2017, the Planning Commission recommended approval of a “For Sale Only” Final Plat (PF-09-17-6023) for Coronado Holdings. The City Council approved the Final Plat on October 16, 2017 (Ordinance No. 4693). The Final Plat was recorded at Jackson County on March 9, 2018.

On July 9, 2018, the Planning Commission approved a Preliminary Plat (PP-12-17-6167) for Calamar 1st Plat, Lot 1.

On December 12, 2019, the Appearance Review Committee (ARC-11-19-7133) reviewed a PD Final Plan / Site Plan Design Review (PDFS-11-19-7132) for the subject property and recommended approval. The Planning Commission approved the PD Final Plan / Site Plan Design Review on December 30, 2019.

FINAL PLAT REVIEW

Land Use: The proposed plat covers 7.77 +/- acres and includes 1 lot for a 134-unit mid-rise apartment building (Calamar Senior Living). The PD Concept Plan approved an increase of the maximum lot size from 2.00 acres to 7.80 acres. The minimum lot width of 150-ft. has been met with a frontage width of 382-ft. All other setbacks have been met with the previously approved PD Final Plan / Site Plan Design Review and will be required to be met with the building permit plans.

Vehicular & Pedestrian Network:

There are no additional street improvements needed along NE Coronado Drive. There is an existing 4-ft. sidewalk along NE Coronado Drive which will need to be removed and replaced with 5’ ADA compliant sidewalk. The sidewalk improvements must be completed prior to the issuance of a Certificate of Occupancy for the building.

Streetscape, Open Space & Amenities:

Street trees and open space amenities must be installed and maintained per the approved landscape plan with the PD Final Plan / Site Plan Design Review. Since the subject property is a one-lot subdivision there is not a need for the dedication of a tract for the preservation and maintenance of open space. The site met the minimum open space through the PD Final Plan / Site Plan Design Review with 23.46% of the site, exceeding the minimum 15% requirement.

Public Utilities:

All lots have access to public utilities through a proposed and/or existing utility easements.

Stormwater Management:

Stormwater detention will be provided through an onsite detention basin. The stormwater detention improvements must be completed prior to the issuance of a Certificate of Occupancy for the building.

Easements: All easements have been provided as required by Public Works.

Floor Area Classification:

There is not a minimum livable floor area classification requirement for multi-family units or buildings.

ACTION BY PLANNING COMMISSION:

The Planning Commission is being asked to provide a recommendation on the Final Plat. Final plats are reviewed to determine if they conform to the requirements of the City’s development codes; and if there are appropriate assurances that the proposed improvements will be completed if the developer fails to perform. The Commission may recommend approval, modified approval or, if the plans do not meet the requirements of the City, recommend denial. Approval of the Final Plat by the City constitutes an acceptance of the easements shown on the plat. Endorsement of the Final Plat by the City confers on the owner the right to record the plat, and to use the plat as an instrument to transfer lot ownership. AN ORDINANCE APPROVING THE FINAL PLAT FOR CALAMAR, A REPLAT OF LOT 1, CORONADO HOLDINGS 1ST PLAT

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF BLUE SPRINGS, MISSOURI, as

follows: Section 1. The final plat Calamar, within the City of Blue Springs, Missouri, hereinbefore

presented to the City Council and having been found to be in compliance with the Unified Development Code (UDC), its amendments, and other ordinances of the City of Blue Springs, is hereby approved subject to the following conditions and those set out in the Planning Commission Staff Report for Case File Number PF-05-20-7302 submitted to the Planning Commission at its May 26, 2020 meeting:

Conditions:

1. Approval by the City Council based on the representations of any drawings presented as part of this application does not waive any requirements or development standard contained in the UDC unless modified by the PD Concept Plan.

2. Prior to building permit issuance, the Final Plat must be recorded with Jackson County and returned to the City.

3. Prior to the issuance of a Certificate of Occupancy for the building, all ADA sidewalk and stormwater detention improvements are required to be completed.

Section 2. Scrivener’s Errors. Typographical errors and other matters of a similar nature that do

not affect the intent of this ordinance, as determined by the City Clerk and City Attorney, may be corrected with the endorsement of the City Administrator without the need to come before the City Council.

AN ORDINANCE ACCEPTING THE CONVEYANCE OF AN OFF-SITE PERMANENT SANITARY SEWER EASEMENT FROM CORONADO HOLDINGS, LLC. FOR CALAMAR

SENIOR LIVING WHEREAS, the City of Blue Springs is committed to ensuring the sanitary sewer system works as designed; and WHEREAS, Coronado Holdings, LLC has agreed to provide a sanity sewer easement on the property adjacent to the Calamar Senior Living site, allowing the extension of the system across the property to the south to the site; and WHEREAS, the easement is required to allow access and improvements for as long as the sewer line is in the proposed location; and WHEREAS, the Public Works Department recommends the acceptance of the permanent sanitary sewer easement from Coronado Holdings, LLC.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF BLUE SPRINGS, MISSOURI, as follows: Section 1. The Mayor has the authority and is hereby authorized to accept the permanent

sanitary sewer easement from Coronado Holdings, LLC for the Calamar Senior Living project on NE Coronado Drive. A copy of the proposed easement is attached as Exhibit “A” and is incorporated herein.

Section 2. Scrivener’s Errors. Typographical errors and other matters of a similar nature that do

not affect the intent of this ordinance, as determined by the City Clerk and City Attorney, may be corrected with the endorsement of the City Administrator without the need to come before the City Council.
