Twenty‐two students from the 6th and previous editions of theMaster in Animal Law and

Society(Onsite)defendedtheirthesesattheUniversitatAutònomaofBarcelonaonSeptember

18,19and20,2017.

Created and directedby Professor TeresaGiménez‐Candela, theMaster inAnimal Law and

Societyistailoredforgraduatesandprofessionalswhoaimtoacquirecompetencesenabling

themtoworkindifferentareasinvolvinganimals.Sinceissuesaremanifoldinthisfield,the

Masteroffersacross‐curricularplanofstudythatcoversawiderangeoftopicsrelatedtolaw,

scienceandethics.Inthisemerginglegaldiscipline,aninterdisciplinaryapproachisnecessary

todealwithanykindof issuepertaining toanimals.The investigations carriedoutand the

discussionsarisenduringthethesisdefencesconfirmedthecomplexityofthisdiscipline,and

itschallengesforthosewhoareconcernedwiththefateofanimalsintoday’sglobalizedsociety.

ruleUNE313001onanimalhealthandwelfare,aswellasitsimplementationbyanimalcentres

andshelters.Todothis,shecomparedthisstandardrulewiththecurrentCatalanlegislations

andmetsomeanimalprotectionorganisations.Theexperienceof theLigadeProtecciónde

AnimalesyPlantasdeBarcelonahasbeenrelevanttocarryoutthisresearch.

VaniaTugliodefendedherthesisentitled“EltraficodeanimalessalvajesenAméricadelSury

España”.Ms.Tuglio investigatedthe traffickingofwildanimals inSouthAmericaandSpain,

focused on the endangered species, and highlighted the lack of strict punishment for those

responsible.Shesuggestedsomespecificmeasures,whichshouldallowthejurisdictionstofight

againstthiscrimemoreeffectively.

MarcCanodefendedhisthesisentitled“LaregulaciónjurídicaenEspañadelosperrosguía,

especialreferenciaalosperrosdeasistencia”.Mr.Canoinvestigatedthelegalframeworkon

dogs assisting people with disabilities in Spain. This work starts with a reference to the

European regulations on the rights of persons whose mobility is reduced because of

impairments.Then,itanalysestheSpanishlegislationconsistingofnationalandregionalrules,

withparticularfocusonownershipandthesanitaryissues.Mr.Canoalsohighlightstheneed

foraharmonizationoftheselegislations.

JavierBaquerodefendedhisthesisentitled“Laselecciónderazascaninasysusconsecuencias:

Aspectoslegales”.Thisstudyaddressesthemainlegalissuesrelatedtothebreedingofpedigree

dogforcommercialpurpose.AsthecasesofEnglishandFrenchBulldogsshow,thisbusiness

affectshealthandwelfareoftheinvolveddogs.Thegoalistofigureoutifthisactivitycanbe

consideredanimal abuse.Toanswer this question,Mr.Baquero investigated the legal rules

existinginthisparticularmatter,particularlyinColombiaandSpain,andhealsoreferredto

someexperiencesintheUnitedStatedofAmerica.Finally,heproposedsomeideasthatcould

betakenintoaccountbylegislatureinordertoreducethesufferingofdogs.

asistidas por perros en el Consorci Sanitari de Terrassa. Marco jurídico y ético para su

implementaciónenpacientespediátricosdecortaestancia”.Thisresearchaimstofigureouta

legal framework to regulate theassistanceofdogs in therapies forpediatricpatientsat the

HospitalofTerrassa.Todothis,theliteratureonthistopichasbeenanalysed,aswellasthe

experiencesofprofessionalsworkinginthisfield.Thegoalistoensurethatthesatisfactionof

bothhumansandanimalshasbeenconsidered.

KatiePrendergastdefendedherthesisentitled“TheLegalRegimeofIvoryunderInternational

Law”. This investigation highlights the issues pertaining to the illegal trade of ivory,which

threats the populations of elephants particularly in Africa. This trafficking has also

consequencesontheenvironment,aswellasontheinternationalsecurityanddevelopment.

Thenewtechnologiescouldcontributetoreducethisillegalactivity.

PetyaBorislavovadefendedherthesisentitled“Losanimalesenlasreligiones,conparticular

referenciaalCristianismo,elJudaísmo,elIslam,lareligiónenelImperioRomanoyenGrecia

Antigua, el Hinduismo, el Budismo y el Confucianismo”. This work analyses the impact of

religious traditions on the attitudes of humans towards animals. It also highlights their

contradictions,aswellastheevolutioninfavourofabettertreatmentofanimals,whichare

moreconsideredthanbefore.

welfareofcompanionanimalsduringthetransportationinairplanes.Thousandofanimalsare

injured,lostordieeveryyear,becauseoftheweakrulesandthelackofenforcementofthem.

Theaircarriersoftenavoidanyliabilityandcontinuetooffercarelessaccommodations.

wildlifetrade”.Thisworkinvestigatesthefightingagainstthe illegal tradeofwildlife,which

alsoaffectsendangeredspecies,suchasAfricanelephants.Inthisregard,manyorganizations

playanimportantrole,becauseoftheirexpertiseandcooperation.

OliverWookeydefendedhisthesisentitled“ATheoryfortheDevelopmentofIndividualand

SocialMoralitybasedonaChangeintheTreatmentofNonhumanAnimals”.Thisworkfigures

out a change in the treatment of animals that could also enhance the individual and social

morality.Thistheoryparticularlyreferstoacoupleofsituationsinwhichhumansoftenjustify

thesufferingofanimals:theslaughteringofanimals,aswellastheanimalabuse.Theroleof

lawisfundamentaltohelpthischange.

GabrielaChalkiadefendedherthesisentitled“Ahistorical,socio‐politicalandlegalstudyofthe

HuntingAct2004”.ThisinvestigationfocusesoftheeffectsoftheBritishHuntingAct2004and

bringsrecommendationsforitspossibleamendment.Inthisregards,thehistoryofhuntingis

analysedovertheyears,aswellasthecontentandthelimitsofthisAct.

HelenaIsabelDiasCorreiadefendedherthesisentitled“Institutionaliseduseoffarmanimals

inadevelopingcountry”.Thisworkfiguresoutaconceptofsustainabledevelopmentbasedon

therespectforthelivesofanimals,whichcanalsoenhancetheconditionsofhumans,aswell

as the protection of the environment. The farming system in developing counties should

considerthisissue.Todefenditspropositions,thisworkcomparesAngolaandPortugal.

Verónica de Jesús defended her thesis entitled “Estudio y análisis sobre la legislación de

protecciónybienestaranimalenPuertoRico;sudesarrolloyevolución”.Thisworkanalyses

theoriginanddevelopmentofthePuertoRicoAnimalProtectionWelfarelegislation,focussing

onitseffectivenessparticularlyincasesofmistreatmentandabandonmentofanimals.Italso

studies theCourtdecisionson thismatter,other legalrulespertaining toanimalhealthand

safety,andbringsideasthatcouldbeimplementedtoenforcethelegislation.

GretaInglisdefendedherthesisentitled“Isalifetimeofconfinementoreuthanasiaallwecan

offer the straydogsof Italy andSpain?A comparativeanalysisof cultural, legal andethical

perspectives.”Thisresearchpertainstothemanagementofstraydogs,whichconstitutesan

issueintermsofanimalwelfare,humanhealthandpolicies.ThereisnoEUregulationonthis

matter.InSpain,eachautonomouscommunityregulatesthemanagementofstraydogs.InItaly,

theregionsmanagethestraydogsaccordingtoaFrameworkLaw,whichcouldsuggestideas

forothercountries.Thisresearchsuggestssomestrategiesforthefuture,suchasresourcesfor

spayandneutercampaigns,educationalprogrammes,cooperationbetweenadministrationand

animalprotectionorganization.

DiamelaCovarrubiasdefendedherthesisentitled“RodeoChileno:undilemanacional”.This

investigationfocusesonChileanRodeo,whichisatraditionalsportinthiscountryinvolving

horsesandcalves.Thefansofthisrodeoconsiderthatitrepresentsahistoricvalue,and,onthe

other side, it is also a source of revenue for many people. Indeed, the animal protection

organizationsdemandtoputanendtothissport,sinceitcouldbeconsideredananimalabuse.

Therefore, studies of thewelfare of these animals should be carried out to implement the

Chileanlegislationthatisnotclearinthisregard.

Venezuelaaños2010‐17”.Thisworkanalyses theriseof theactivism in favourofanimals in

Venezuela,andparticularlyforabandonedcatsanddogs.ThisinvestigationfocusesonCanine

SupportNetwork,anorganizationthatallowsunderstandingtheevolutionintheactivismand

thefollowinglegalchanges.Thisworkalsohighlightstheimportanceofthesocialnetworksin

theseactions.

Spain”.Thisresearchaimstodemonstrate that thecasesofanimalsexualabusedetectedby

veterinariansinthesecountiesarefrequent,Inparticular,thezoophilicactivitiesthroughthe

Internetarenotreallyconsidered.Therefore,thereisaneedforachangebothinPortuguese

andSpanishlegislationsinordertoensureeffectiveprotectionagainsttheseabuses.

JorgeAlvesdefendedhisthesisentitled“MutilationsofFarmAnimals:EUlegislationregarding4

mainmutilations”.Thisinvestigationconsidersfourrelevantmutilations:beaktrimming(laying

hens), castration (male pigs), tail docking (pigs), dehorning and disbudding (cattle). In this

regard,theEUandnationallegislationsontheseprocedureshavebeenanalysedtounderstand

whatcanbemadetoimprovethewelfareoftheseanimals,andtoreducethesemutilations.

AnaëleGenetdefendedherthesisentitled“Losmataderos.EnFranciayenEspaña”.Thisresearch

analysesthecomplexworldofslaughterhouses,theirperceptioninpublicopinion,thelegislation

anditsenforcementinEU,FranceandSpain.Concerningthepublicawareness,theinvestigations

carriedoutbytheFrenchAssociationL214havestimulatedsocietaldebatesandinterventions

ofpublicauthoritiestocontroltheconditionsofsomeslaughterhouses.However,thesuffering

ofanimalsduringthetimeofdeathisanissuethatstillremainopeninoursociety.


AnaëleGenetdefendingherthesis

ClaudiaAmardefendedher thesisentitled“Experimentaciónanimalpara finescosméticosen

Europa”. This investigation analyses the legal framework on animal testing for cosmetic

purposesatEuropeanUnionlevelanditsevolution.Inthisregard,thisworkparticularlyfocuses

on the Regulation (EC) No 1223/2009 of the European Parliament and of the Council of 30

November2009oncosmeticproducts,onthestepstophaseouttheanimaltesting,aswellason

thereportsoftheanimalprotectionorganizations.


ClaudiaAmardefendingherthesis

Marine Lercier defended her thesis entitled “Improving trot racehorses’ welfare and legal

protectioninFrance”.Thisresearchaimstoproviderecommendationstochangethelegalstatus

ofanimalsusedforworkingactivitiesingeneral,andofracehorsesinparticular.Inthisregard,

thecurrentprotectionlegislationisanalysed,aswellasthelegaltheoriesonanimals.Ms.Lercier

proposesargumentstograntanimalspersonhoodandsocialrights,inparticulartocontributeto

societywiththeirwork.


MarineLercierdefendingherthesis

Raffaela Cersosimo defended her thesis entitled “Teaching Animal Law in Europe: The

developmentofaspecificdiscipline”.Thisresearchesfocusesonthreereasonsthatjustifythe

teachingofAnimalLawasadistinctacademicdiscipline:theincreasingofsocietalconcernfor

thefateofanimals;theamountandcomplexityofthelegislationsrelatedtoanimals;theneedfor

educational and training programmes to teach and learn these legislations from a new

perspective:theconsiderationoftheinterestsofanimals.
