TIllS CAUSE came on to be heard on Defendant s Motion to Dismiss for failure to Provide

a Fast and Speedy Trial. Having considered the submissionsof he parties, their arguments and being

otherwise thoroughly advised in the premises, thelcourt is

taken and should be denied,

1. The defendant was indicted on June

, 2004 for the charge ofpossession ofcocaine.

He was Arraigned on September

2004. The Phblic Defender s office was appointed to represent

the defendant on this charge.

2. Herein, the Defendant, through his attorney, requested and received numerous

continuances

of

a trial

in

this matter. The Court

reflects that the Defendant requested and was

3. The Defendant is

the custody

the Mississippi Department

Corrections while

serving time on another charge. The Court, in February, 2006, issued a Writ of abeas Corpus
