MINUTES

CALL TO ORDER: The meeting was called to order at 6:30 p.m.

ROLL CALL: Members Norm Erickson, Bob Garcia, Nick Koval and James Pappalardo are present. Daniel Fisher not present.

Others present: Carmen Rosamonda, City Manager; Eric Frankton, IT Director; and Annette Hatch, City Clerk.

PUBLIC PARTICIPATION: Citizen comments are limited to two (2) minutes per speaker. Speakers will be called when the item is introduced for discussion. Additional comments may be accepted at the end of the meeting.

No one addressed the Commission.

APPROVAL OF MINUTES: Motion by Nick Koval to approve the January 29, 2020, minutes. Seconded by James Pappalardo. Motion passed unanimously.

Mr. Fisher entered the meeting at 6:34 p.m.

OLD BUSINESS: The City Manager reviewed the City Attorney’s rewording of the Commission’s recommended changes for Chapters 1 through 4.

It was the consensus of the Commission to accept the modifications as presented.

NEW BUSINESS

Charter Chapter 5

Section 5.0 - Elections. In subsection (a), the Commission recommended changing the qualifying period from 11 days to 5 days and adding the wording “. . . established by Volusia County Supervisor of Elections.”

Subsection (b): It was the consensus of the Commission to re-visit this subsection.

Subsection (c): The Commission had no recommended changes to this subsection.

Section 5.02 – Commencement of term: The Commission recommended changing the wording to state the term would “ . . . begin on the first meeting regular meeting in January following the election.”

Section 5.03 – Terms of office: After discussion, it was the consensus of the Commission to leave the term of office at four (4) years but re-visit this section after additional financial information is received.

Regarding the number of terms a Council Member can serve, the Commission recommended keeping the number of terms and the period of time between consecutive terms the same when seeking another Council seat. However, a Council Member may run for the Mayor’s seat without a 1-year waiting period.

The Commission also decided to revisit this section to further discuss adding language for resignation requirements for a Council Member wishing to run for a County, State or Federal office.

Section 5.04 – Qualified elections: The Commission had no recommended changes to this section.

Section 5.05 – Adoption of election procedures: The Commission had no recommended changes to this section.

Section 5.06 – Nonpartisan elections: The Commission had no recommended changes to this section.

Section 5.07 – Multiple candidates; nomination of candidates, petitions for placement on ballot: The Commission had no recommended changes to this section.

Section 5.08 – Recall: The Commission had no recommended changes to this section.

Charter Chapter 6

Section 6.01 – Appointment and qualifications: To the sentence regarding the City Manager appointment, the Commission recommended the sentence to read: “. . . for a definite or indefinite term. . .”

Section 6.02 – Removal: The Commission had no recommended changes to this section.

Section 6.03 – Powers and duties: The Commission had no recommended changes to this section.

Section 7.01 – Appointment; duties: The Commission had no recommended changes to this section.

Charter Chapter 8

Section 8.01 – Appointment; duties: The Commission had no recommended changes to this section.

Charter Chapter 9

Section 9.01 – Establishment of additional departments: The Commission had no recommended changes to this section.
