    CHAPTER 6

    GOVERNMENT SERVANTS (EFFICIENCY AND DISCIPLINE) RULES, 1973

    1. FIXATION OF PAYOn promotion/appointment and move over to next higher scales, the pay of

    !a# 8accused8 means a 3overnment servant against $hom action

    is ta%en under these rules9

    !b# 8authority8 means the ):rime Minister; or an officer or authority

    designated by him to exercise the po$ers of the authority under theserules9

    !c# 8authorised officer8 means an. officer authorised by theauthority to perform functions of an authorised officerunder these rules or, if no officer is so authorised, theauthority9

    !d# 8misconduct8 means conduct preor unbecoming of an

    officer and, a gentleman and includes any act on thepart of a. 3overnment servant to bring or attempt tobring.political or other . Outside influence directly orindirectly to bear on the 3overnment or any3overnment officer in respect of any matter relating tothe appointment, promotion, transfer, punishment,retirement or other conditions of service of a

    3overnment servant9 and

    e. 8penalty8 means a penalty $hich may be imposed underthese rules.

    Committee is appointed, the authorised Officer shall&together $ith statement of the allegations explaining thecharge and of any other relevant circumstances $hichare proposed to be ta%en into consideration.

      g. 6e"uire the accused $ithin a reasonable time, $hichshall not be less than seven days or more than fourteendays from the day the charge has been communicated tohim, to put in a $ritten defence and to state at the samelime $hether he desires to be heard in person.

    h. 7he ?n"uiry Officer or the ?n"uiry Committee, as the casemay be, shall en"uire into the charge and may examinesuch oral or documentary evidence in support of thecharge or in defence of the accused as may beconsidered' necessary and the accused shall be entitledto cross&examine the $itnesses against him.

    !)# 7he promotions to higher grades $ere %ept $ithin the maximum"uota prescribed in the 6ecruitment 6ules for 5epartmentalromotion. ?n the event of the prescribed 5epartmental romotion"uota being exceeded in any particular case or cases, the seniorityof the person or persons promoted in excess of the "uota shall notcount from the date from $hich the promotion or promotions $ereactually made, but from the date or dates from $hich they $ould

    =. HOUSE PURCHASE ADVANCE

    a. Advance for the purchase of a constructed house may also be granted toa permanent employee. 7he advance should not exceed -= months

    running basic pay of a 3overnment *ervant.

    b. After dra$l of advance the 3overnment *ervant $ill have to purchase theconstructed house and get it mortgaged in the name of the residentof a%istan. 7he mortgage deed $ill be submitted $ithin = months of thedra$l of advance or before the close of financial year $hichever is earlier. ?ncase of failure the employees $ill have to refund the entireamount of advance in lump sum into the 3overnment 7reasury. Alternatively, the amount $ill be recovered from the pay of the 3overnment*ervant by stoppage of his pay till final li"uidation of the amount.

    not permanent.

    1>. INTEREST FREE LOANS

     As a special dispensation from normal rules mentioned in the3eneral Dinancial 6ules !3.D.6.#, 3overnment has decided that nointerest may be charged on the 0ouse uilding and Conveyanceadvances dra$n by a 3overnment *ervant $hose deposit in the providentfund carry no interest, sub

    rovident Dund accumulation prior to the dra$l of the advancefrom the 3overnment.

    b. 7he interest to be remitted under these orders shall not exceedthe amount of interest foregone by the 3overnment *ervant

    concerned on his rovident Dund account upto the date on$hich the interest on 3overnment loans $ould become due for payment.

    c. if at any time in future the 3overnment *ervant $ho has availedhimself of this concession choose to ta%e interest on hisprovident fund deposits, he $ill be re"uired to pay in full the3overnment the amount of interest accrued on the advancesdra$n by him from the 3overnment

    d. 7he above decision $ill also be applicable in the case of 3overnment *ervants $ho have already dra$n advances from

    the 3overnment, but the recovery of interest charges accruedthereon has not been made from them.
