REZONING APPLICANT'S LETTER OF INTENT

The Applicant and Owner, Century . Communities, requests a Change in

Conditions of the existing R-60, case number RZR2017-00025 for the purpose of

making the 16 homes of this subdivision in Gwinnett match up to their product. Century

Communities did not do the original rezoning and the condition restricting the width of

the garage to 50% of the front fa9ade is not possible with their product line on the

property.

Condition needing changes:

1.E. The condition restricts the homes to the width of the garage wall not

exceeding 50% of the front fa9ade of the dwelling. Century is asking that this condition

be changed to: All dwellings shall have at least a double-car garage. The width of

the garage wall shall not exceed 55% of the width of the front fa~ade of the

dwelling.

All of the other existing conditions are acceptable and this condition will now

match the requirements of the Hall County portion of this subdivision.

STANDARDS GOVERNING EXERCISE OF THE ZONING POWER

PURSUANT TO SECTION 1702 OF THE 1985 ZONING RESOLUTION, THE BOARD OF COMMISSIONERS FINDS THAT THE FOLLOWING STANDARDS ARE RELEVANT IN BALANCING THE INTEREST IN PROMOTING THE PUBLIC HEAL TH, SAFETY, MORALITY, OR GENERAL WELFARE AGAINST THE RIGHT TO THE UNRESTRICTED USE OF PROPERTY AND SHALL GOVERN THE EXERCISE OF THE ZONING POWER.

Based upon the above reasons, the applicant feels that this is a reasonable request and that action contradictory to the zoning request will constitute a taking of property in violation of the Just Compensation Clause of the Fifth Amendment and the Due Process Clause of the Fourteenth Amendment to the Constitution of the United States, and Article 1, Section 1, Paragraph 1, and Article 1, Section 3, Paragraph 1 of the Constitution of Georgia, denying the owner viable use of its land.
